• July 9, 2001 -Site inspections matle regaNing sign problem in Ohurton Grove.
Violations verified. Photographs were taken (Attachment #2).
• July 25, 2001 -Notices of Zoning Violation aentto property owners (Attachment #3).
Notices received by ell property ownem (LUw InvesimeMS, Ina., Silfmore
Homes, LLC, Drees Company, and Seazer Nomas Corp.) with the exwption of
Churton Grove LLC. Postal noh on both of the Churton Grove, LLC envelopes
reatl "Moved-La8 No Address". Notice reganYing Lot ~9 (Churton Grove,
LLC) to be resent antl not conaltlered as part of [his case.
October 24,2001-Second site inspection peRoimetl. Photographs taken. Signs
• stlll located on properties with the exception of LOt #32 (GUrtdn Grove LLC). Thai
sign (locatetl on property of Churton Grove, LLC) hatl been removed.

FINANCIAL IMPACT: Attorney fees associated with actual assessment of civil
penalties should the matter go tq wort.
RECOMMENDATION(S): The Atlmihistmdon recommentla that each property owner
held in violefion be essesetl civil penalties in the amount of $100 per day that have
awmetl from November 6, 2007. The amount to be assessed each pmpedy ownaq as
of November 19, 2001 (14 days), is as follows:

2001, end found it to be in violation of Article 9 (Signs) of the Omnoe County Zon ng
Orr i9apr~. A sign advertising the matlei home located on the lot has keen erec[etl in
vloletion df the Zoning Ortlinance. The PO-H-R2 (Plennetl Development-Housing-Law
Density Resitlentiag Zoning District tloes not allow signs on intlivitlual kts. The only
signs approvetl in the zoning process are the mein aubtlivision signs.

The sign locatetl on the property appears to be over this sae limit. Please have the

Also, on July 24, 2001, a smell A-frame slgn was observetl that le locatetl on the street
next to the curb. The sign staled that en agent was on duty. Real estate agent offices
ope2tlng from model homes are not allowed as a petmidetl use in the subdivision.

You receivetl a Notice of Zoning Violation (attached) dated July 24, 2001 from this office
that Informed you that your property locatetl al Lol #30. Churton Grove Subdivision,
Phase 1 (Orenge County Tax Map W.fiB..30) was being used in violation of the Omnge
Countv NC Zon na Ortl'nance es R relates [o the square footage for signs allowed in
resitlential Eoning. tlistdcts. The property is tuned PO-H-R-2 (Planned Development-
Haueing-Medium Density Residential).
In [hat Notice you were requested to remove the signs located on We property
immediately. Site Inspections parformetl on October 24, 2001 end November 6, 2001

8 feet in height and over 16 square feet in area. The maximum square footage that is
allowed for the sign is 4 square feet
Therefore, I will request that the gcarq of Count' Commiasionere assess you civil
penalties in the amount of $100.00 per day beginning on Ncvember 8, 2001, and
continuing each day until the violation Is corrected. I will notify you of the date, time,
