NORTH CAROLINA
CONSTRUCTION AGREEMENT UNDER $250,000.00
ORANGE COUNTY
THIS CONSTRUCTION AGREEMENT (hereinafter called “Agreement”), made as of the 21st
day of June, 2021, by and between Simens Industry, Inc. , (hereinafter called the “Contractor”), and
Orange County, a political subdivision of the State of North Carolina, (hereinafter called the “County,”
“Orange County,” or “Owner”).
W I T N E S S E T H:
That the Contractor and the Owner, for the consideration herein named, agree as follows:
1. CONTRACT DOCUMENTS; PRIORITY
The Contract Documents consist of this Agreement, the Request for Proposals, Proposal,
Construction Drawings, and Written Specifications. The Contract Documents form the Contract. In the
event of any inconsistency between or among the Contract Documents the Contract Documents shall be
interpreted in the following order of priority:
a. This Agreement.
b. Designer Approved Bulletins and Field Orders.
c. Request for Proposals and addenda thereto.
d. Proposal.
2. SCOPE OF WORK
The Contractor shall furnish and deliver all of the materials, and perform all of the work
required by this Agreement within the time period stipulated in a written Notice-to-Proceed to be
executed by the Contractor and Owner and in accordance with the following enumerated documents,
which are made a part hereof as if fully contained herein:
a. Construction Drawings prepared by Smith Sinnett Architecture (Sheet G0-01, G0-02, S1-
01, A0-01, A0-02, A1-01, A5-01, M0-00, M0-01, M0-02, M0-03, M1-01, M1-03, M2-01,
M3-01, M5-01, M5-02, M5-03, M6-01, M6-02. M6-03. M7-01, E0-00, E0-01, E2-01, E2-
02, E4-01, E5-01 dated 1/29/2021, SHSC Roof and HVAC Specifications dated
Addendum 1 dated 3/8/2021, Addendum 2 dated 3/11/2021, Addendum 3 dated 3/15/2021
and Addendum 4 dated 3/17/2021)
b. Written specifications prepared by the project engineer.
c. Siemens Industry, Inc. 0063V000006ycFmQAI proposal dated March 30, 2021 which
fully describes the work to be performed. Such work will hereafter be called the “Work”.

d. Related documents listed under Section 1 above.
3. TERM AND SCHEDULING
a. The Contractor agrees to commence work pursuant to the written Notice to Proceed.
b. The Contractor agrees to complete substantially all Work by June 30, 2022.
c. Time is of the essence with respect to all dates specified in the Contract Documents as
Completion Dates.
d. The Contractor shall perform the Work in the time, manner, and form required by the
Contract Documents and as stipulated in a written Notice-to-Proceed to be executed by the
Contractor and Owner.
e. It is expressly understood that the Owner will employ other contractors to perform work as
a part of the Project whose work will be performed simultaneously and sequenti ally with
the performance of the Work by the Contractor. It shall be necessary for the Contractor to
coordinate its activities with such other contractors, particularly with respect to access to
work areas, storage of materials and other common facilities.
f. Should the Owner determine that the Contractor is behind schedule Owner may require, at
no additional cost to the Owner, the Contractor to expedite and accelerate its efforts,
including providing additional resources and working overtime, as necessary, to perform
the Work in accordance with the approved project schedule.
4. STANDARD OF CARE
a. The Contractor shall exercise reasonable care and diligence in performing the Work in
accordance with the highest generally accepted standards of this type of Contractor
practice throughout the United States and in accordance with applicable federal, state and
local laws and regulations applicable to the performance of these services. Contractor is
solely responsible for the professional quality, accuracy and timely completion and
submission of all work.
b. The Contractor shall not load or permit any part of the Work to be loaded with a weight
that will endanger its safety, intended performance or configuration.
c. Contractor shall be responsible for all errors or omissions caused by its employees, agents,
contractors, or assigns in the performance of the Agreement. Contractor shall correct any
and all errors, omissions, discrepancies, ambiguities, mistakes or conflicts at no additional
cost to the Owner.
d. Contractor is an independent contractor of Owner. Any and all employees of the
Contractor engaged by the Contractor in the performance of any work or services required
of the Contractor under this Agreement, shall be considered employees or agents of the
Contractor only and not of the Owner, and any and all claims that may or might arise under
any workers compensation or other law or contract on behalf of said employees while so

engaged shall be the sole obligation and responsibility of the Contractor.
e. If activities related to the performance of this Agreement require specific licenses,
certifications, or related credentials Contractor represents that it or its employees, agents
and subcontractors engaged in such activities possess such licenses, certifications, or
credentials and that such licenses certifications, or credentials are current, active, and not in
a state of suspension or revocation.
f. The Contractor is responsible for all physical damage to owned or rented machinery, tools,
equipment, forms, and other items owned, rented or used by the Contractor and
Subcontractor(s) in the performance of the Work including all of Owner’s property in
Contractor’s care, custody, or control, and all such property while it is in transit.
g. The Contractor is solely responsible for obtaining all permits necessary to complete the
Work in compliance with all local, state, and federal laws.
5. PAYMENT & TAXES
a. The Owner hereby agrees to pay to the Contractor for the faithful performance of this
Agreement, and the Contractor hereby agrees to perform all of the Work for a sum not-to-
exceed Two Hundred Three Thousand, Four Hundred Fifty Dollars ($203,450.00). Not
later than the fifth (5th) day of each calendar month the Contractor shall submit to the
Owner’s Representative, generally the architect if an architect is retained on the Work, a
Request for Payment for work done during the previous calendar month.
i. The Request for Payment shall be in form of a standardized invoice or AIA
Document G702-703 appropriately addressed to Owner’s Representative at PO Box
8181, Hillsborough, NC 27278 and shall show substantially the value of work done
during the previous calendar month.
ii. The amount due for payment shall be ninety-five percent (95%) of the value of
work completed since the last Request for Payment and this amount shall be paid
by the Owner on or before the last business day of the month. Owner shall retain
five percent (5%).
1. Upon Owner’s Representative’s certification that ninety percent (90%) of
the Work has been satisfactorily completed retainage may be discontinued.
Retainage may be discontinued, at Owner’s Discretion, so long as work
continues to be completed satisfactorily and on schedule.
iii. Final payment shall not be due to the Contractor until thirty (30) days after one
hundred percent (100%) of the Work, including punch list work, has been
satisfactorily (as determined by the County) completed and an appropriate affidavit
as required in Section 7(c) below has been received by Owner.
b. Should Owner reasonably determine that Contractor has failed to perform the Work related
to a Request for Payment, Owner, at its discretion may provide the Contractor ten (10)
days to cure the breach. Owner may withhold the accompanying payment without penalty
until such time as Contractor cures the breach.
i. Should Contractor or its representatives fail to cure the breach within ten (10) days,
or fail to reasonably agree to such modified schedule, Owner may immediately
terminate this Agreement in writing, without penalty or incurring further obligation
to Contractor.

ii. This section shall not be interpreted to limit the definition of breach to the failure to
perform the Work related to a Request for Payment.
c. The Contractor has included in the Contract Price and shall pay all taxes assessed by any
authority on the Work or the labor and materials used therein. It shall be the Contractor's
responsibility to furnish the Owner documentary evidence showing the materials used and
sales and use tax paid by the Contractor and each of its subcontractors.
6. INSURANCE AND BONDS
a. Minimum requirements – Contractor shall obtain, at its sole expense, Commercial General
Liability Insurance, Automobile Insurance, Workers’ Compensation Insurance, and any
additional insurance as may be required by Owner’s Risk Manager as such insurance
requirements are described in the Orange County Risk Transfer Policy and Orange County
Minimum Insurance Coverage Requirements (each document is incorporated herein by
reference and may be viewed at
http://www.orangecountync.gov/departments/purchasing_division/contracts.php). If
Owner’s Risk Manager determines additional insurance coverage is required such
additional insurance shall be designated here N/A (if no additional insurance required mark
N/A as being not applicable). Contractor shall not commence construction work until such
insurance is in effect and certification thereof has been received by the Owner's Risk
Manager.
b. Performance Bonds – Contractor shall furnish bonds covering the faithful performance of
the Contract and payment of all obligations arising under any of the Contract Documents
or related in any way to the Work. Contractor shall immediately furnish a copy of such
bonds to any requesting person who appears to be a potential beneficiary of bonds
covering payment obligations arising under any of the Contract Documents. This
subsection 6(b) applies only to Contracts of fifty thousand dollars ($50,000.00) or more
where the total cost for the project is three hundred thousand dollars ($300,000.00) or
more.
7. INDEMNITY
a. To the extent authorized by North Carolina law the Contractor shall indemnify, without
limitation, and hold harmless to the maximum extent permitted by law the Owner and its
agents and employees from and against any and all claims, damages, losses and expenses,
including attorney's fees, arising out of or resulting from the performance or
nonperformance of the Work, provided that any such claim, damages, loss or expense (A)
is attributable to bodily injury, sickness, disease or death or injury to, or destruction of,
property, including the loss of use resulting therefrom; and (B) is caused in whole or in
part by any breach of any provision of the Agreement or by any negligent or wrongful act
or omission of the Contractor, any Subcontractor, or supplier of the Contractor, anyone
directly or indirectly employed by any of them or anyone for whose acts any of them may
be liable. The indemnification obligation under this paragraph shall not be limited in any
way by any limitation of the amount or type of damages, compensation or benefits payable
by or for the Contractor or any subcontractor under workers' compensation acts, disability
benefits acts or other employee benefit acts. It is the intent of this section that the
Contractor shall indemnify the County to the maximum extent allowed by law.

b. The Contractor shall indemnify and hold harmless Owner from any lien of whatever type
through the purchase of appropriate bonds and insurance as designated in Section 6 above.
In the event any such lien is filed against Owner’s property Contractor shall, through such
bonds and insurance or at Contractors expense, defend Owner against all such claims of
lien.
c. Upon completion of the Work the Contractor shall execute an affidavit stating there are no
unpaid debts for any work that has been done or materials that have been furnished to the
project prior to and as of the date of substantial completion and further stating that
Contractor shall indemnify, save and protect Owner and Owner’s lender, if any, harmless
from and against any and all claims, liabilities, losses, damages, causes of action, and
expenses (including court costs and reasonable attorney’s fees related thereto) arising out
of, in connection with, or resulting from any such debts and liens. Such indemnification
shall be in a form and substance acceptable to Owner.
d. By executing this Agreement Contractor agrees to abide by and be bound by the
indemnification provisions herein and of Section 7(c) specifically.
8. DISPUTE RESOLUTION AND GOVERNING LAW
a. Any dispute with respect to any provision of, or the performance or non-performance of,
this Agreement shall be subject to the Dispute Resolution Rules and Procedures for Orange
County Design, Building Construction, Renovation, and Repair Projects. The policy is
incorporated herein by reference and may be viewed at
http://www.orangecountync.gov/departments/purchasing_division/contracts.php).
b. The laws of the State of North Carolina shall apply to the interpretation and enforcement of
this Agreement. Any and all suits or actions to enforce, interpret or seek damages with
respect to any provision of, or the performance or nonperformance of, this Agreement or
the Contract shall be brought in the General Court of Justice of North Carolina sitting in
Orange County, North Carolina and it is agreed by the parties that no other court shall have
jurisdiction or venue with respect to such suits or actions.
c. Notice of any claim by Owner or Contractor must be initiated by written notice to the other
Party within thirty (30) days of the occurrence of the event giving rise to the claim or
within thirty (30) days of the discovery of the event or condition giving rise to the claim,
whichever is later.
i. Should any claim be made, regardless of whether such claim is made by Owner or
Contractor, Contractor shall continue to faithfully and diligently perform the Work
in such a manner as to meet all scheduled timelines. Any failure to faithfully and
diligently perform the Work may be deemed, by the Owner, a breach of the
Contract.
ii. If a claim is made such claim shall be made to the initial decision maker, if
applicable, who may request more supporting data, reject the claim in whole or in
part, approve the claim in whole or in part or advise the parties the claim is unable
to be resolved.
iii. If a claim is made by the Owner the Owner may, but is not obligated to, notify the
surety.
9. NON–APPROPRIATION

a. Contractor acknowledges that Owner is a governmental entity, and the validity of this
Agreement is based upon the availability of public funding under the authority of its
statutory mandate.
b. In the event that public funds are unavailable and not appropriated for the performance of
Owner’s obligations under this Agreement, then this Agreement shall automatically expire
without penalty to Owner immediately upon written notice to Contractor of the
unavailability and non-appropriation of public funds. It is expressly agreed that Owner
shall not activate this non-appropriation provision for its convenience or to circumvent the
requirements of this Agreement, but only as an emergency fiscal measure during a
substantial fiscal crisis.
c. In the event of a change in the Owner’s statutory authority, mandate or mandated
functions, by state or federal legislative or regulatory action, which adversely affects
Owner’s authority to continue its obligations under this Agreement, then this Agreement
shall automatically terminate without penalty to Owner upon written notice to Contractor
of such limitation or change in Owner’s legal authority.
10. NOTICES
Any notice required b y this Agreement shall be in writing and delivered by certified or registered
mail, return receipt requested to the following:

11. MISCELLANEOUS
a. Duties and Obligations imposed by the Contract Documents shall be in addition to any
Duties and Obligations imposed by state, federal or local law, rules, regulations and
ordinances.
b. No act or failure to act by the Owner or Contractor shall constitute a waiver of any right or
duty granted them under the Contract Documents, nor shall any act or failure to act
constitute any approval except as specifically agreed in writing.
c. The Work shall be tested and inspected as required by the Contract Documents and as
required by law. Unless prohibited by law the costs of all such tests and inspections
related to state and federal codes such as ADA, Administrative, Electrical, Plumbing,
Mechanical and Building Codes shall be borne by the Contractor. The costs for material
and structural testing shall be conducted by an independent third party at the expense of the
Owner. Delays related to any of the aforementioned tests and inspections shall not be
grounds for delaying the completion of the work. If any such tests and inspections reveal
deficiencies in the Work such that the Work does not comply with terms or requirements
of the Contract Documents and the requirements of any code or law the Contractor is
solely responsible for the cost of bringing such deficiencies into compliance with the terms
of the Contract Documents and any code or law.

d. Should the Architect, if an architect is retained for the project involving the Work, or
Owner reject any portion of the Work for failing to comply with the Contract Documents
Contractor shall immediately, at Contractor’s expense, correct the Work. Any such
rejection may be made before or after substantial completion. If applicable, any additional
expense borne by the Architect under this section shall be paid at Contractor’s expense.
e. The Contractor shall not assign any portion of this Agreement nor subcontract the Work in
its entirety without the prior written consent of the Owner.
f. By executing this Agreement Contractor affirms that Contractor and any subcontractors of
Contractor are and shall remain in compliance with Article 2 of Chapter 64 of the North
Carolina General Statutes.
g. By executing this Agreement Contractor certifies that Contractor has not been identified,
and has not utilized the services of any agent or subcontractor identified, on the list created
by the State Treasurer pursuant to G.S. 147-86.58.
h. By executing this Agreement Contractor certifies that Contractor has not been identified,
and has not utilized the services of any agent or subcontractor identified, on the list created
by the State Treasurer pursuant to G.S. 147-86.81.
i. The County has designated (Angel Barnes) to act as the County's representative with
respect to the Work and shall have the authority to render decisions within guidelines
established by the County Manager or the County Board of Commissioners and shall be
available during working hours as often as may be reasonably required to render decisions
and to furnish information.
j. Contractor shall at all times remain in compliance with all applicable local, state, and
federal laws, rules, and regulations including but not limited to all state and federal non-
discrimination laws, policies, rules, and regulations and the Orange County Non-
Discrimination Policy and Orange County Living Wage Policy (each policy is incorporated
herein by reference and may be viewed at
http://www.orangecountync.gov/departments/purchasing_division/contracts.php). Any
violation of the Orange County Non-Discrimination Policy is a breach of this Agreement
and County may immediately terminate this Agreement without further obligation on the
part of the County. This paragraph is not intended to limit and does not limit the definition
of breach to discrimination.
k. This Agreement together with any amendments or modifications may be executed
electronically. All electronic signatures affixed hereto evidence the consent of the Parties
to utilize electronic signatures and intent of the Parties to comply with Article 11A and
Article 40 of North Carolina General Statute Chapter 66.
l. In the event of a breach by Contractor Owner has sole authority to determine the
reasonableness of Contractor’s actions to remedy such breach or complete the performance
of its obligations.
m. Upon request of the Owner, the Contractor shall submit to County all relevant
documentation, including but not limited to, job cost records, to support its claims for final

compensation and if such request is made final compensation shall not be due until all
relevant documentation is received, reviewed, and approved by Owner.
12. CONSEQUENTIAL AND LIQUIDATED DAMAGES
a. Owner and Contractor mutually waive any claim against each other for consequential
damages. Consequential Damages include:
i. Damages incurred by Owner for loss of use, income, financing, or business.
ii. Damages incurred by Contractor for office expenses, including personnel, loss of
financing, profit, income, business, damage to reputation, or any other non-direct
damages.
b. Liquidated damages shall be in accord with the Contract Documents. If the Contract
Documents do not otherwise address liquidated damages, such damages shall be in the
amount of five hundred dollars ($500.00) per day.
13. TERMINATION OR SUSPENSION
a. The Owner may, without cause, order the Contractor to terminate, suspend, delay or
interrupt the Work in whole or in part for such period of time as the Owner may determine.
i. If Owner issues a written order to delay, suspend, or interrupt the Work, and such
order is not due to or as a result of any fault on the part of the Contractor or any
subcontractor, the Contractor may recover a per diem amount of five hundred
dollars ($500.00) per day with a not-to-exceed limit of ten thousand dollars
($10,000.00).
ii. In the event of termination by the Owner under this Agreement, the Contractor
shall be entitled to receive its reasonable and documented direct costs prior to
termination, including the cost of materials purchased for the Work which
purchases cannot be canceled or which material cannot reasonably be used by the
Contractor on other work, and the cost of closing down the work in a safe and
efficient manner.
iii. If Owner elects to suspend or terminate the contract pursuant to subparagraphs
13.a.i. or 13 a.ii. the sole remedy available to the Contractor are those listed in the
subparagraphs and Contractor is not entitled to any right to further claims for any
amount owed or disputed or for payment of damages alleged to have been sustained
as a result of Owner’s order to delay, suspend, or interrupt the Work.
b. The Owner may, with cause, order the Contractor to suspend, delay or interrupt the Work
in whole or in part for such period of time as the cause remains.
i. If Owner issues a written order to delay, suspend, or interrupt the Work, and such
order is due to or as a result of any fault on the part of the Contractor or any
subcontractor, the Owner may reduce payment at a per diem amount of five
hundred dollars ($500.00) per day.
c. Contractor may terminate the Contract if, at the Owner’s written direction, the Work is

stopped for twenty one (21) consecutive days through no act or fault of the Contractor,
their agents or employees, or a subcontractor or their agents or employees or any other
person performing work pursuant to the Contract Documents. Contractor may terminate
the Contract if a Court or other Public authority having jurisdiction enters a lawful order
that requires all work to be stopped and such stoppage lasts for twenty one (21)
consecutive days.
d. Either party may terminate this Agreement upon notice to the other party that obligations
pursuant to this Agreement are made impossible due to declarations of emergency by
Orange County or by North Carolina due to events directly impacting Orange County.
Both parties shall remain responsible for all payment and performance due up to the receipt
of such notice, but shall have no further obligation or responsibility beyond that date
provided the terminating party has taken all reasonable steps to complete the performance
of its obligations.
14. ENTIRE AGREEMENT
All of the documents listed, referenced or described in this Agreement, the written Notice-to-
Proceed, together with Modifications made or issued in accordance herewith are the Contract Documents,
and the work, labor, materials and completed construction required by the Contract Documents and all
parts thereof is the Work. The Contract Documents constitute the entire agreement between Owner and
Contractor. This Agreement may be amended only by written instrument signed by both parties.
Modifications may be evidenced by facsimile signatures. If any provision of the Agreement shall be
declared invalid or unenforceable, the remainder of the Agreement shall continue in full force and effect.
IN WITNESS WHEREOF, the Parties hereto have executed this Agreement as of the day and
date first above written wholly or in a number of counterparts each of which shall, without proof or
accounting for other counterparts, be deemed an original contract.

**As a result of the global Covid-19 Virus outbreak, temporary delays in delivery, labor or services from Siemens and its sub-suppliers or subcontractors
may occur. Among other factors, Siemens’ delivery is subject to the correct and punctual supply from sub-suppliers or subcontractors, and Siemens

This Addendum shall be included in the contract for the above referenced project. All General,
Supplementary and Special Conditions, etc., as originally specified or as modified below shall apply to these
items.
General
1. The period for questions and request for substitutions has ended.
2. Clarification: Roof drain bodies are to be replaced throughout.
3. Clarification: All existing parapet coping is to be replaced with new.
4. Clarification: Masonry control joint replacement is not included in the scope of work.
5. Clarification: The roof of the detached boiler plant is to be replaced in the same manner as main
building. See plans.
6. Clarification: Regarding on site storage – space will be determined for staging in the parking lot at
the front of the building. Enclosed/secured storage is the responsibility of the contractor.
7. Clarification: Temporary facilities will be required. Building restrooms are off-limits.
8. A commissioning authority has not been selected for the project yet.
9. Light fixtures are not included within the project scope other than those damaged during
construction. These will be replaced in kind and are the responsibility of the contractor.
10. Any new ceiling tile/grid, hard ceiling, bulkheads required to be replaced due to above ceiling
activity are to be accounted for in base bid. These materials are to be replaced in kind.

11. The existing Fire Alarm system is inspected, serviced and repaired by First Fire: Chris Register

12. Building water and electric service charges shall not implemented. These are available for use at
no charge.
13. A site enclosure fence is not required, however, the contractor is responsible for the security and
safety of their on-site equipment and stored materials. Contractor is also required to provide
pedestrian protection as this building will be occupied while work is occurring. A temporary
barrier/wall will be needed between phase areas. Refer to new drawing sheet G0-03.
Request for Substitutions
Manufacturers are required to submit products which meet the specifications. Those products which do not
comply may be rejected in the submittal stage of the project.

PART 1 - GENERAL
1.1 RELATED DOCUMENTS
A. Drawings and general provisions of the Contract, including General and Supplementary Conditions and
Division 01 Specification Sections, apply to this Section.
1.2 SUMMARY
A. This Section includes the following:
1. Adhered membrane roofing system.
B. Related Sections include the following:
1. Division 06 Section "Rough Carpentry for wood blocking.
2. Division 05 Section “Steel Decking” for roof deck.
3. Division 07 Section "Sheet Metal Flashing and Trim" for metal roof penetration flashings,
flashings, counter flashings, gutters and downspouts.
4. Division 07 Section “Thermal Insulation” for insulation thickness and type.
5. Division 07 Section "Joint Sealants."
C. Products offered for installation on this project shall have no limitations in their installation or warranty
over the roof deck system. Requirements for installations over this deck system which are not indicated
in the project drawings or are different from what is shown shall be the responsibility of the roofing
installer and shall be included as part of the work of this section.
1.3 DEFINITIONS
A. Roofing Terminology: Refer to ASTM D 1079 and glossary of NRCA's "The NRCA Roofing and
Waterproofing Manual" for definition of terms related to roofing work in this Section.
B. Design Uplift Pressure: Comply with the requirements of Section 1609 NCSBC 2006. In addition, meet
the uplift pressure, calculated according to procedures in SPRI's "Wind Load Design Guide for Fully
Adhered and Mechanically Fastened Roofing Systems," before multiplication by a safety factor. The most
stringent requirements shall apply.
C. Factored Design Uplift Pressure: The uplift pressure, calculated according to procedures in SPRI's "Wind
Load Design Guide for Fully Adhered and Mechanically Fastened Roofing Systems," after multiplication
by a safety factor.
D. Plywood: A structural board consisting of an odd number of thin layers of wood glued together under
pressure, with the grain of one layer at right angles to the grain of the adjoining layer in 5, 7, 9 ply layers
as required to achieve the required thickness.
1.4 PERFORMANCE REQUIREMENTS
A. General: Provide installed roofing membrane and base flashings that remain watertight; do not permit the
passage of water; and resist specified uplift pressures, thermally induced movement, and exposure to
weather without failure.
B. Material Compatibility: Provide roofing materials that are compatible with one another under conditions
of service and application required, as demonstrated by roofing membrane manufacturer based on testing
and field experience.

C. Roofing System Design: Provide a membrane roofing system that is designed by an engineer licensed in
North Carolina to resist uplift pressure calculated according to ASCE 7.
D. Roof shall meet all requirements per Code for 120 mph wind zone.
E. Low sloped roof systems shall be designed and installed for wind loads in accordance with Chpt. 16 of
the North Carolina Building Code – latest version and tested for resistance in accordance with
ANSI/SPRI ES-1.
1.5 SUBMITTALS
A. Product Data: For each type of product indicated.
B. Shop Drawings: For roofing system. Include plans, elevations, sections, details, and attachments to other
Work.
1. Base flashings and membrane terminations.
2. Tapered insulation, including slopes.
3. Insulation fastening patterns.
C. Samples for Verification: For the following products:
1. 12-by-12-inch square of sheet roofing, of color specified, including T-shaped side and end lap
seam.
2. 12-by-12-inch square of roof insulation.
3. 12-inch length of metal termination bars.
4. Six insulation fasteners of each type, length, and finish.
5. Six roof cover fasteners of each type, length, and finish.
D. Installer Certificates: Signed by roofing system manufacturer certifying that Installer is approved,
authorized, or licensed by manufacturer to install roofing system.
E. Manufacturer Certificates: Signed by roofing manufacturer certifying that roofing system complies with
requirements specified in "Performance Requirements" Article.
1. Submit evidence of meeting performance requirements.
F. Qualification Data: For Installer and manufacturer.
G. Product Test Reports: Based on evaluation of comprehensive tests performed by manufacturer and
witnessed by a qualified testing agency, for components of roofing system.
H. Research/Evaluation Reports: For components of membrane roofing system.

1.6 QUALITY ASSURANCE
A. Installer Qualifications: A qualified firm that is approved, authorized, or licensed by roofing system
manufacturer to install manufacturer's product and that is eligible to receive manufacturer's warranty.
B. Manufacturer Qualifications: A qualified manufacturer that has UL listing for membrane roofing system
identical to that used for this Project.
C. Testing Agency Qualifications: An independent testing agency with the experience and capability to
conduct the testing indicated, as documented according to ASTM E 548.
D. Source Limitations: Obtain components for membrane roofing system roofing membrane manufacturer.
All components including but not limited to fascia, gravel stops, copings shall be supplied and warranted
as a total roof assembly.
E. Fire-Test-Response Characteristics: Provide membrane roofing materials with the fire-test-response
characteristics indicated as determined by testing identical products per test method below by UL, FMG,
or another testing and inspecting agency acceptable to authorities having jurisdiction. Materials shall be
identified with appropriate markings of applicable testing and inspecting agency.
1. Exterior Fire-Test Exposure: Class A; ASTM E 108, for application and roof slopes indicated.

F. Preliminary Roofing Conference: Before starting roof deck construction, conduct conference at Project
site. Comply with requirements for preinstallation conferences in Division 01 Section "Project
Management and Coordination." Review methods and procedures related to roof deck construction and
roofing system including, but not limited to, the following:
1. Meet with Owner, Architect, Owner's insurer if applicable, testing and inspecting agency
representative, roofing Installer, roofing system manufacturer's representative, deck Installer, and
installers whose work interfaces with or affects roofing including installers of roof accessories and
roof-mounted equipment.
2. Review methods and procedures related to roofing installation, including manufacturer's written
instructions.
3. Review and finalize construction schedule and verify availability of materials, Installer's
personnel, equipment, and facilities needed to make progress and avoid delays.
4. Examine deck substrate conditions and finishes for compliance with requirements, including
flatness and fastening.
5. Review structural loading limitations of roof deck during and after roofing.
6. Review base flashings, special roofing details, roof drainage, roof penetrations, equipment curbs,
and condition of other construction that will affect roofing system.
7. Review governing regulations and requirements for insurance and certificates if applicable.
8. Review temporary protection requirements for roofing system during and after installation.

1.7 DELIVERY, STORAGE, AND HANDLING
A. Deliver roofing materials to Project site in original containers with seals unbroken and labeled with
manufacturer's name, product brand name and type, date of manufacture, and directions for storing and
mixing with other components.
B. Store liquid materials in their original undamaged containers in a clean, dry, protected location and within
the temperature range required by roofing system manufacturer. Protect stored liquid material from direct
sunlight.
1. Discard and legally dispose of liquid material that cannot be applied within its stated shelf life.
C. Protect roof insulation materials from physical damage and from deterioration by sunlight, moisture,
soiling, and other sources. Store in a dry location. Comply with insulation manufacturer's written
instructions for handling, storing, and protecting during installation.

D. Handle and store roofing materials and place equipment in a manner to avoid permanent deflection of
deck.
1.8 PROJECT CONDITIONS
A. Weather Limitations: Proceed with installation only when existing and forecasted weather conditions
permit roofing system to be installed according to manufacturer's written instructions and warranty
requirements.
1.9 WARRANTY
A. Special Manufacturer’s Project Warranty: Non-prorated Warranty, without monetary limitation, in which
manufacturer agrees to repair or replace any and all components of membrane roofing system and edge
material that fail in materials or workmanship within specified warranty period. Failure includes roof
leaks and 120mph blow off. Roof shall be warranted for 120mph Ultimate wind. The Manufacturer shall
EXCLUDE any references to Hurricanes with wind speeds less that the warranty requires. The warranty
shall cover damages for winds which include hurricane categories 1, 2 and 3 up to 120 mph. All
components including but not limited to fascia, gravel stops, copings shall be supplied and warranted as a
total roof assembly.
1. Special warranty includes roofing membrane, base flashings, roofing membrane accessories, roof
insulation, fasteners, cover boards, substrate board, vapor retarder, roof pavers, parapets, walkway
products, and other components of membrane roofing system.
2. Warranty Period: 20 years from date of Substantial Completion.
B. Special Contractor/Installers Project Warranty: Submit roofing Installer's warranty, on warranty form at
end of this Section, signed by Installer and the Prime Contractor, covering Work of this Section,
including all components of membrane roofing system such as roofing membrane, base flashing, roof
insulation, fasteners, cover boards, substrate boards, vapor retarders, roof pavers, parapets and walkway
products, for the following warranty period:
1. Warranty Period: Two years from date of Substantial Completion. All repairs shall be made
within 48 hours of notification.
PART 2 - PRODUCTS

A. In other Part 2 articles where titles below introduce lists, the following requirements apply for product

2.3 AUXILIARY MATERIALS

permeable and resistant to ultraviolet degradation, type and weight as recommended by roofing system
manufacturer for application. Location as shown on the drawings.
PART 3 - EXECUTION
3.1 EXAMINATION
A. Examine substrates, areas, and conditions, with Installer present, for compliance with the following
requirements and other conditions affecting performance of roofing system:
1. Verify that roof openings and penetrations are in place and set and braced and that roof drains are
securely clamped in place.
2. Verify that wood blocking, curbs, and nailers are securely anchored to roof deck at penetrations
and terminations and that nailers match thicknesses of insulation.
3. Verify that surface plane flatness and fastening of steel roof deck comply with requirements in
Division 05 Section "Steel Decking."
4. Proceed with installation only after unsatisfactory conditions have been corrected.
3.2 PREPARATION
A. Clean substrate of dust, debris, moisture, and other substances detrimental to roofing installation
according to roofing system manufacturer's written instructions. Remove sharp projections.

B. Prevent materials from entering and clogging roof drains and conductors and from spilling or migrating
onto surfaces of other construction. Remove roof-drain plugs when no work is taking place or when rain
is forecast.
C. Complete terminations and base flashings and provide temporary seals to prevent water from entering
completed sections of roofing system at the end of the workday or when rain is forecast. Remove and
discard temporary seals before beginning work on adjoining roofing.
D. Install acoustical roof deck rib insulation strips, specified in Division 05 Section "Steel Decking,"
according to acoustical roof deck manufacturer's written instructions.
3.3 INSULATION INSTALLATION
A. Coordinate installing membrane roofing system component’s so insulation is not exposed to precipitation
or left exposed at the end of the workday.
B. Comply with membrane roofing system manufacturer's written instructions for installing roof insulation.
C. Install tapered insulation under area of roofing to conform to slopes indicated.
D. Install one or more layers of insulation under area of roofing to achieve required thickness. Where
overall insulation thickness is 1-1/2 inches 2 inches or greater, install 2 or more layers with joints of each
succeeding layer staggered from joints of previous layer a minimum of 6 inches in each direction.
E. Trim surface of insulation where necessary at roof drains so completed surface is flush and does not
restrict flow of water.
F. Install insulation with long joints of insulation in a continuous straight line with end joints staggered
between rows, abutting edges and ends between boards. Fill gaps exceeding 1/4 inch with insulation.
1. Cut and fit insulation within 1/4 inch of nailers, projections, and penetrations.
G. Mechanically Fastened Insulation: Install each layer of insulation and secure to deck using mechanical
fasteners specifically designed and sized for fastening specified board-type roof insulation to deck type.
1. Fasten to resist uplift pressure at corners, perimeter, and field of roof. Fasteners shall be installed
at a spacing not greater than one fastener per 4 square feet area of roof in the field of the roof and
not greater than one fastener per 2 square feet area of roof in the perimeter of the roof.
H. Coordinate with Part 1 "Performance Requirements" Article. Fastener numbers will increase at corners
and perimeter over number required for field of roof.
3.4 ADHERED ROOFING MEMBRANE INSTALLATION
A. Install roofing membrane over area to receive roofing according to membrane roofing system
manufacturer's written instructions. Unroll roofing membrane and allow to relax 30 minutes before
installing.
1. Install sheet according to ASTM D 5036.
B. Start installation of roofing membrane in presence of membrane roofing system manufacturer's technical
personnel.
C. Accurately align roofing membrane and maintain uniform side and end laps of minimum dimensions
required by manufacturer. Stagger end laps.
D. Bonding Adhesive: Apply solvent-based bonding adhesive to substrate and underside of roofing
membrane at rate required by manufacturer and allow to partially dry before installing roofing membrane.
Do not apply bonding adhesive to splice area of roofing membrane.
E. Adhesively fasten roofing membrane securely at terminations, penetrations, and perimeter of roofing.
F. Apply roofing membrane with side laps shingled with slope of roof deck where possible.
G. Seams: Clean seam areas, overlap roofing membrane, and hot-air weld side and end laps of roofing
membrane according to manufacturer's written instructions to ensure a watertight seam installation.
1. Test lap edges with probe to verify seam weld continuity. Apply lap sealant to seal cut edges of
roofing membrane.
2. Verify field strength of seams a minimum of twice daily and repair seam sample areas.
3. Repair tears, voids, and lapped seams in roofing membrane that does not meet requirements.

H. Spread sealant or mastic bed over deck drain flange at deck drains and securely seal roofing membrane in
place with clamping ring.
I. Install roofing membrane and auxiliary materials to tie in to existing roofing.
3.5 BASE FLASHING INSTALLATION
A. Install sheet flashings and preformed flashing accessories and adhere to substrates according to
membrane roofing system manufacturer's written instructions.
B. Apply solvent-based bonding adhesive to substrate and underside of sheet flashing at required rate and
allow to partially dry. Do not apply bonding adhesive to seam area of flashing.
C. Flash penetrations and field-formed inside and outside corners with sheet flashing.
D. Clean seam areas and overlap and firmly roll sheet flashings into the adhesive. Weld side and end laps to
ensure a watertight seam installation.
E. Terminate and seal top of sheet flashings and mechanically anchor to substrate through termination bars.
3.6 FIELD QUALITY CONTROL
A. Testing Agency: Owner will engage a qualified independent testing and inspecting agency to perform
roof tests and inspections and to prepare test reports.
B. Final Roof Inspection: Arrange for roofing system manufacturer's technical personnel to inspect roofing
installation on completion and submit report to Architect.
1. Notify Architect or Owner 48 hours in advance of date and time of inspection.
C. Repair or remove and replace components of membrane roofing system where test results or inspections
indicate that they do not comply with specified requirements.
D. Additional testing and inspecting, at Contractor's expense, will be performed to determine compliance of
replaced or additional work with specified requirements.
3.7 PROTECTING AND CLEANING
A. Protect membrane roofing system from damage and wear during remainder of construction period. When
remaining construction will not affect or endanger roofing, inspect roofing for deterioration and damage,
describing its nature and extent in a written report, with copies to Architect and Owner.
B. Correct deficiencies in or remove membrane roofing system that does not comply with requirements,
repair substrates, and repair or reinstall membrane roofing system to a condition free of damage and
deterioration at time of Substantial Completion and according to warranty requirements.
C. Clean overspray and spillage from adjacent construction using cleaning agents and procedures
recommended by manufacturer of affected construction.

This Addendum shall be included in the contract for the above referenced project. All General,
Supplementary and Special Conditions, etc., as originally specified or as modified below shall apply to these

General
1. A mandatory PreBid meeting was held on Tuesday March 2nd. The Sign in sheet and agenda are

services-hvac-and-roof-replacement/. The prebid meeting was mandatory and thus only general
contractors in attendance may submit bids.

4. A walkthrough meeting was held for mechanical contractors to tour the interior of the building on
Friday, March 5th. Questions arising from that meeting:
1. Do you require controllers to be factory mounted to the new VAV boxes?
A: Refer to VAV Box Schedule on M7-01, note B, which requires factory mounting. Also,
spec section 23 36 00 – 2.01(H).1.c.. (See attached PME Addendum)
2. Pneumatic to DDC will require new low voltage power to the vav controls…. who is
to provide the power -- contractor or Siemens?
A: VAV boxes should be furnished with a 120/24V transformer per Schedule note I and
233600 – 2.01(G). Electrical contractor is running 120V to boxes (E2-01), and factory
transformer is stepping down for low voltage. (See attached PME Addendum

accepted being added to or deducted from the Base Bid to give the total cost of the Contract. Bidders are required to
give a price for Base Bid, all Alternates, and all Unit Prices as applicable to their Contract. All Bidders are required
to be licensed and in good standing with their respective North Carolina Licensing Board.

MINORITY BUSINESS PARTICIPATION REQUIREMENTS
Provide with the bid - Under GS 143-128.2(c) the undersigned bidder shall identify on its bid (Identification of
Minority Business Participation Form) the minority businesses that it will use on the project with the total dollar
value of the bids that will be performed by the minority businesses. Also list the good faith efforts (Affidavit A)
made to solicit minority participation in the bid effort.
NOTE: A contractor that performs all of the work with its own workforce may submit an Affidavit (B) to that
effect in lieu of Affidavit (A) required above. The MB Participation Form must still be submitted even if there is
zero participation.
After the bid opening - The Owner will consider all bids and alternates and determine the lowest responsible,
responsive bidder. Upon notification of being the apparent low bidder, the bidder shall then file within 72 hours of
the notification of being the apparent lowest bidder, the following:
An Affidavit (C) that includes a description of the portion of work to be executed by minority businesses, expressed
as a percentage of the total contract price, which is equal to or more than the 10% goal established. This affidavit
shall give rise to the presumption that the bidder has made the required good faith effort and Affidavit D is not
necessary;

If less than the 10% goal, Affidavit (D) of its good faith effort to meet the goal shall be provided. The document
must include evidence of all good faith efforts that were implemented, including any advertisements, solicitations
and other specific actions demonstrating recruitment and selection of minority businesses for participation in the
contract.
Note: Bidders must always submit with their bid the Identification of Minority Business Participation Form listing
all MB contractors, vendors and suppliers that will be used. If there is no MB participation, then enter none or zero

SECTION 01 21 00 - ALLOWANCES
PART 1 - GENERAL
1.1 RELATED DOCUMENTS
A. Drawings and general provisions of the Contract, including General and Supplementary Conditions and
other Division 01 Specification Sections, apply to this Section.
1.2 SUMMARY
A. This Section includes administrative and procedural requirements governing allowances.
1. Certain items are specified in the Contract Documents by allowances. Allowances have been
established in lieu of additional requirements and to defer selection of actual materials and
equipment to a later date when additional information is available for evaluation. If necessary,
additional requirements will be issued by Change Order.
2. The Contractor shall include in the Contract Sum all allowances states in the Contract Documents.
The Contractor’s costs for unloading and handling at the site, labor, installation costs, overhead,
profit and other expenses contemplated for the original allowance shall be included in the Contract
Sum and not in the allowance. Coordinate allowance work with related work to ensure that each
selection in completely integrated and interfaced with related work. Include all allowance
amounts as a separate line item amount on each application for payment.
B. Types of allowances include the following:
1. Unit-cost allowances.
2. Quantity allowances.
3. Lump Sum Allowances
C. Related Sections include the following:
1. Division 01 Section "Contract Modification Procedures" for procedures for submitting and
handling Change Orders for allowances.

1.3 SELECTION AND PURCHASE
A. At the earliest practical date after award of the Contract, advise the Architect of the date when final
selection and purchase of each product or system described by an allowance must be completed to avoid
delaying the Work.
B. At Architect's request, obtain proposals for each allowance for use in making final selections. Include
recommendations that are relevant to performing the Work. Provide a minimum of three (3) proposals
for each allowance for use in making final selections, unless instructed otherwise by the Architect.
Furnish proposals in time so as not to delay the project. Include recommendations that are relevant to
performing the Work.
C. Purchase products and systems selected by Architect from the designated supplier.

1.4 SUBMITTALS
A. Submit proposals for purchase of products or systems included in allowances, in the form specified for
Change Orders.
B. Submit invoices or delivery slips to show actual quantities of materials delivered to the site for use in
fulfillment of each allowance.
C. Coordinate and process submittals for allowance items in same manner as for other portions of the Work.
1.5 COORDINATION
A. Coordinate allowance items with other portions of the Work. Furnish templates as required to coordinate
installation.
1.6 ALLOWANCES
A. Refer to Schedule of Allowances for Amounts and Quantities
B. Quantity & Lump Sum Allowances
1. Allowance shall include cost to Contractor of specific products and materials ordered by Owner
under allowance and shall include taxes, freight, and delivery to Project site.
2. Contractor's costs for receiving and handling at Project site, labor, installation, overhead and
profit, and similar costs related to products and materials ordered by Owner under allowance shall
be included as part of the Contract Sum and not part of the allowance.
C. Unit-Cost Allowances
1. Each change order amount for unit-cost type allowances shall be based solely on the difference
between the actual unit purchase amount and the unit allowance, multiplied by the final measure
or count of work-in-place, with reasonable allowances, where applicable, for cutting losses,
tolerances, mixing wastes, normal product imperfections and similar margins.
2. Include installation costs in the purchase amount only where indicated as a part of the allowance.
When requested, prepare explanations and documentation to substantiate the margins as claimed.
Prepare and submit substantiation of a change in the scope of work (if any) claimed in the change
orders related to unit-cost type allowances. The Owner reserves the right to establish the actual
quantity of work- in-place by an independent quantity survey, measure or count.
D. Contingency Allowances
1. Use the contingency allowance only as directed by Architect for Owner's purposes and only by
Change Orders that indicate amounts to be charged to the allowance.
2. Contractor's related costs for products and equipment ordered by Owner under the contingency
allowance are included in the allowance and are not part of the Contract Sum. These costs include
delivery, installation, taxes, insurance, equipment rental, and similar costs.
3. Allowances for overhead and profit shall be provided within the contract price and not included as
part of any change order till the allowance amount has been spent.
1.7 CHANGE ORDER MARK-UP
A. Except as otherwise indicated, comply with provisions of General Conditions and other requirements
stated in this section. For each allowance, Contractor's claims for increased costs (for either purchase
order amount or Contractor's handling, labor, installation, overhead, and profit), because of a change in
scope or nature of the allowance work as described in contract documents, must be submitted within 60
days of initial change order authorizing work to proceed on that allowance; otherwise, such claims will be
rejected.
B. As a procedural restriction no mark-up (increase or decrease) shall be included in the change order
amount for Contractor's increase or decrease in handling, labor, installation, overhead or profit unless
purchase order amount varies from allowance.

C. Change orders prepared to return unused allowance amounts to the Owner shall be subject to the same
requirements for the return of appropriate profit and overhead as other change orders in accordance with
the Conditions of the Contract. Where the Contractor has been directed not to include his related costs
(profit and overhead) in the Contract Sum for contingency allowances, the return of profit and overhead
shall not be excepted.
1.8 UNUSED MATERIALS
A. Return unused materials purchased under an allowance to manufacturer or supplier for credit to Owner,
after installation has been completed and accepted.
1. If requested by Architect, prepare unused material for storage by Owner when it is not
economically practical to return the material for credit. If directed by Architect, deliver unused
material to Owner's storage space. Otherwise, disposal of unused material is Contractor's
responsibility.

3.1 EXAMINATION
A. Examine products covered by an allowance promptly on delivery for damage or defects. Return damaged
or defective products to manufacturer for replacement.
3.2 PREPARATION
A. Coordinate materials and their installation for each allowance with related materials and installations to
ensure that each allowance item is completely integrated and interfaced with related work.

1.3 DEFINITIONS
A. Unit price is an amount proposed by bidders, stated on the Bid Form, as a price per unit of measurement
for materials or services added to or deducted from the Contract Sum by appropriate modification, if
estimated quantities of Work required by the Contract Documents are increased or decreased.
1.4 PROCEDURES
A. Unit prices include all necessary material, plus cost for delivery, installation, insurance, applicable
taxes, overhead, and profit.
B. Measurement and Payment: Refer to individual Specification Sections for work that requires
establishment of unit prices. Methods of measurement and payment for unit prices are specified in those
Sections.
C. Owner reserves the right to reject Contractor's measurement of work-in-place that involves use of
established unit prices and to have this work measured, at Owner's expense, by an independent surveyor
acceptable to Contractor.
D. List of Unit Prices: A list of unit prices is included in Part 3. Specification Sections referenced in the
schedule contain requirements for materials described under each unit price.

1. The cost or credit for each alternate is the net addition to the Contract Sum to incorporate alternate
into the Work. No other adjustments are made to the Contract Sum.
1.4 PROCEDURES
A. Coordination: Modify or adjust affected adjacent work as necessary to completely integrate work of the
alternate into Project.
B. Include as part of each alternate, miscellaneous devices, accessory objects, and similar items incidental to
or required for a complete installation whether or not indicated as part of alternate.
C. Notification: Immediately following award of the Contract, notify each party involved, in writing, of the
status of each alternate. Indicate if alternates have been accepted, rejected, or deferred for later
consideration. Include a complete description of negotiated modifications to alternates.
D. Execute accepted alternates under the same conditions as other work of the Contract.
E. Schedule: A Schedule of Alternates is included at the end of this Section. Specification Sections

PART 1 - GENERAL
1.1 RELATED DOCUMENTS

1.2 SUMMARY
A. This Section includes the following:
1. Demolition and removal of selected portions of existing roof, including but not limited to:

e. Any and all other materials down to existing light weight concrete and/metal deck

B. Existing Conditions:
1. The existing roofing system is a ballasted built-up EPDM over insulation and metal roof deck or
Standing seam metal over plywood substrate. Any areas damaged during construction shall be
repaired at the Contractor’s expense.
C. Examination:
1. Roof Contractor shall examine existing metal roof deck or plywood substrate surface after
demolition and prior to new roof installation and correct all deficiencies prior to proceeding with
roof installation. Assure all conditions of the existing roof deck are acceptable in every respect
before proceeding. Proceeding with roof installation constitutes acceptance by the Contractor of
the roof deck and sub surface in its entirety.

1.3 DEFINITIONS
A. Remove: Remove and legally dispose of items except those indicated to be reinstalled, salvaged, or to

Remove, clean, and pack or crate items to protect against damage. Identify contents of containers and

1.4 SUBMITTALS
A. General: Submit each item in this Article according to the Conditions of the Contract and Division 1
Specification Sections, for information only, unless otherwise indicated.
1. Proposed noise-control measures.
B. Schedule of selective demolition activities indicating the following:
1. Detailed sequence of selective demolition and removal work, with starting and ending dates for
each activity.
2. Detailed sequence of selective demolition and removal work to ensure uninterrupted progress of
Owner's on-site operations.
3. Coordination of Owner's continuing occupancy of portions of existing building.
C. Record drawings at Project closeout according to Division 1 Section "Contract Closeout."
1. Identify and accurately locate capped utilities and other subsurface structural, electrical, or
mechanical conditions.
1.5 PROJECT CONDITIONS
A. Owner will occupy portions of the building to be reroofed. Remove no more roof than can be completely
dried-in at any time.
B. Owner assumes no responsibility for actual condition of buildings to be selectively demolished.
1. Conditions existing at time of inspection for bidding purpose will be maintained by Owner as far
as practical.
C. Storage or sale of removed items or materials on-site will not be permitted.
D. Scheduling: Arrange roof demolition schedule so as not to interfere with Owner's on-site operations.
PART 2 - PRODUCTS
2.1 REPAIR MATERIALS
A. Use repair materials identical to existing materials.
1. Where identical materials are unavailable or cannot be used for exposed surfaces, use materials
that visually match existing adjacent surfaces to the fullest extent possible.
2. Use materials whose installed performance equals or surpasses that of existing materials.

B. Survey existing conditions and correlate with requirements indicated to determine extent of selective
demolition required.
C. Inventory and record the condition of items to be removed and reinstalled and items to be removed and
salvaged.
D. When unanticipated mechanical, electrical, or structural elements that conflict with the intended
function or design are encountered, investigate and measure the nature and extent of the conflict.
Promptly submit a written report to the Architect.
E. Survey the condition of the building to determine whether removing any element might result in
structural deficiency or unplanned collapse of any portion of the structure or adjacent structures during
selective demolition.
F. Perform surveys as the work progresses to detect hazards resulting from selective demolition activities.
3.2 UTILITY SERVICES
A. Maintain existing utilities and protect them against damage during selective demolition operations.
1. Do not interrupt existing utilities serving occupied or operating facilities, except when authorized
in writing by Owner and authorities having jurisdiction. Provide temporary services during
interruptions to existing utilities, as acceptable to Owner and to governing authorities.
2. Provide not less than 72 hours' notice to Owner if shutdown of service is required during
changeover.
B. Utility Requirements: Locate and identify utility services serving building.
1. Arrange to shut off indicated utilities with utility companies if required.
2. Where utility services are required to be removed, relocated, or abandoned, provide bypass
connections to maintain continuity of service to other parts of the building before proceeding with
selective demolition.
3.3 PREPARATION
A. Conduct demolition operations and remove debris to ensure minimum interference with roads, streets,
walks, and other adjacent occupied and used facilities.
1. Do not close or obstruct streets, walks, or other adjacent occupied or used facilities without
permission from Owner and authorities having jurisdiction. Provide alternate routes around closed
or obstructed traffic ways if required by governing regulations.
B. Conduct demolition operations to prevent injury to people and damage to adjacent buildings and
facilities to remain. Ensure safe passage of people around selective demolition area.
1. Erect temporary protection, such as walks, fences, railings, canopies, and covered passageways,
where required by authorities having jurisdiction.
2. Protect existing site improvements, appurtenances, and landscaping to remain.
3. Provide temporary weather protection, during interval between demolition and removal of existing
construction, on exterior surfaces and new construction to ensure that no water leakage or damage
occurs to structure or interior areas.
C. Remove and transport debris in a manner that will prevent spillage on adjacent surfaces and areas.
D. Clean adjacent structures and improvements of dust, dirt, and debris caused by selective demolition
operations. Return adjacent areas to condition existing before start of selective demolition.
1. Absolutely no roofing debris will be allowed to remain on the property including but not limited to
shingles, nails, felts and flashing.

3.4 SELECTIVE DEMOLITION
A. Demolish and remove existing construction only to the extent required by new construction and as
indicated. Use methods required to complete Work within limitations of governing regulations and as
follows:
1. Remove roofing system and fasteners in a manner that will not damage the existing decking
below.
2. Cut or drill from the exposed or finished side into concealed surfaces to avoid marring existing
finished surfaces.
3. Remove decayed, vermin-infested, or otherwise dangerous or unsuitable materials and promptly
dispose of off-site.
4. Dispose of demolished items and materials promptly. On-site storage or sale of removed items is
prohibited.
5. Return elements of construction and surfaces to remain to condition existing before start of
selective demolition operations.
B. Remove no more existing roofing than can be covered before rain and within one day by new roofing.
See applicable Division 7 Section for new roofing requirements.
C. Protect all work to remain.
D. Repair all work to remain where damaged during demolition or installation of the new roof system.
E. Relocation of existing plumbing roof vents:
1. Relocate existing plumbing roof vents to align with center of panel units. Patch and repair existing
roof deck assemblies where plumbing vents are relocated. Provide pipe off-set assembly. Pipe
material to match existing vent material. Extend vent to 12 inches above finish roof surface unless
otherwise shown or required.
3.5 PATCHING AND REPAIRS
A. Promptly patch and repair holes and damaged roof deck surfaces caused by removal of the existing
roof such as nail holes. Depressions, gouge marks, etc.
B. Where repairs to existing surfaces are required, patch to produce surfaces suitable for new materials.
1. Completely fill holes and depressions in existing decking materials to remain with an approved
deck patching material, applied according to manufacturer's printed recommendations.
C. Restore exposed finishes of patched areas and extend finish restoration into adjoining construction to
remain in a manner that eliminates evidence of patching and refinishing.
3.6 DISPOSAL OF DEMOLISHED MATERIALS
A. General: Promptly dispose of demolished materials. Do not allow demolished materials to accumulate
on-site.
B. Burning: Do not burn demolished materials.
C. Disposal: Transport demolished materials off Owner's property and legally dispose of them.
D. Cleaning: Sweep the roof deck broom clean on completion of demolition and prior to installation of new
roof system.
3.7 METAL DECK REPAIR AND REPLACEMENT
A. Metal Deck Repair: Deterioration pr damaged areas greater than 2” and less than 12” square or diameter
or less shall be repaired with either 16ga. steel sheet or 2 layers of 22ga. metal. Sheet shall be sized to
extend a minimum of 6” on all sides beyond the size of the deficient area. Secure sheet to top of existing
deck flange with fasteners, minimum 3 perside equally spaced.

B. Metal Deck replacement: Deteriorated or damaged areas greater than 12” but less than 24” square sor
diameter shall be repaired with decking. Decking shall be sized to extend a minum of 12” beyond the size
of the deficient area. Nest new deck and secure to existing deck with fasteners, spaced 3” per side equally
spaced and one in each flute.
C. Metal Deck Replacement (larger areas): Deteriorated or damaged areas greater that 24” square or
diameter shall be repaired with metal deck. Replacement deck shall extend a minimum of three spans.
Permanently anchor units to joists and fasten side laps by the end of each working day. At a minimum,
fasten every rib at all supports and 6” o.c. along laps at perimeters and corners.
D. Immediately after placement and alignment, and after correcting innacuracies, permanently fasten steel
deck units to structural supports and to adjacent deck units with screws at 8” o.c. Attachment of adjacent
deck units by bottom punching is prohibited.
3.8 METAL DECK RESTORATION
A. Wire brush and sweep all loose rust from affected area. Areas of deck evidencing pinholes shall be
replaced in accordance with the requirements of this section.
B. Install one coat of rust inhibitor to affected area
C. Allow area to dry before proceeding with roof system installation.

1.3 DEFINITIONS
A. Roofing Terminology: Refer to ASTM D 1079 and glossary of NRCA's "The NRCA Roofing and
Waterproofing Manual" for definition of terms related to roofing work in this Section.
B. Design Uplift Pressure: Comply with the requirements of Section 1609 NCSBC 2006. In addition, meet
the uplift pressure, calculated according to procedures in SPRI's "Wind Load Design Guide for Fully
Adhered and Mechanically Fastened Roofing Systems," before multiplication by a safety factor. The most
stringent requirements shall apply.
C. Factored Design Uplift Pressure: The uplift pressure, calculated according to procedures in SPRI's "Wind
Load Design Guide for Fully Adhered and Mechanically Fastened Roofing Systems," after multiplication
by a safety factor.
D. Plywood: A structural board consisting of an odd number of thin layers of wood glued together under
pressure, with the grain of one layer at right angles to the grain of the adjoining layer in 5, 7, 9 ply layers
as required to achieve the required thickness.
1.4 PERFORMANCE REQUIREMENTS
A. General: Provide installed roofing membrane and base flashings that remain watertight; do not permit the
passage of water; and resist specified uplift pressures, thermally induced movement, and exposure to
weather without failure.
B. Material Compatibility: Provide roofing materials that are compatible with one another under conditions
of service and application required, as demonstrated by roofing membrane manufacturer based on testing
and field experience.

the North Carolina Building Code – latest version and tested for resistance in accordance with
ANSI/SPRI ES-1.
1.5 SUBMITTALS
A. Product Data: For each type of product indicated.
B. Shop Drawings: For roofing system. Include plans, elevations, sections, details, and attachments to other
Work.
1. Base flashings and membrane terminations.
2. Tapered insulation, including slopes.
3. Insulation fastening patterns.
C. Samples for Verification: For the following products:
1. 12-by-12-inch square of sheet roofing, of color specified, including T-shaped side and end lap
seam.
2. 12-by-12-inch square of roof insulation.
3. 12-inch length of metal termination bars.
4. Six insulation fasteners of each type, length, and finish.
5. Six roof cover fasteners of each type, length, and finish.
D. Installer Certificates: Signed by roofing system manufacturer certifying that Installer is approved,
authorized, or licensed by manufacturer to install roofing system.
E. Manufacturer Certificates: Signed by roofing manufacturer certifying that roofing system complies with
requirements specified in "Performance Requirements" Article.
1. Submit evidence of meeting performance requirements.
F. Qualification Data: For Installer and manufacturer.

1.6 QUALITY ASSURANCE
A. Installer Qualifications: A qualified firm that is approved, authorized, or licensed by roofing system
manufacturer to install manufacturer's product and that is eligible to receive manufacturer's warranty.
B. Manufacturer Qualifications: A qualified manufacturer that has UL listing for membrane roofing system
identical to that used for this Project.
C. Testing Agency Qualifications: An independent testing agency with the experience and capability to
conduct the testing indicated, as documented according to ASTM E 548.
D. Source Limitations: Obtain components for membrane roofing system roofing membrane manufacturer.
All components including but not limited to fascia, gravel stops, copings shall be supplied and warranted
as a total roof assembly.
E. Fire-Test-Response Characteristics: Provide membrane roofing materials with the fire-test-response
characteristics indicated as determined by testing identical products per test method below by UL, FMG,
or another testing and inspecting agency acceptable to authorities having jurisdiction. Materials shall be

1.7 DELIVERY, STORAGE, AND HANDLING
A. Deliver roofing materials to Project site in original containers with seals unbroken and labeled with
manufacturer's name, product brand name and type, date of manufacture, and directions for storing and
mixing with other components.
B. Store liquid materials in their original undamaged containers in a clean, dry, protected location and within
the temperature range required by roofing system manufacturer. Protect stored liquid material from direct
sunlight.
1. Discard and legally dispose of liquid material that cannot be applied within its stated shelf life.
C. Protect roof insulation materials from physical damage and from deterioration by sunlight, moisture,
soiling, and other sources. Store in a dry location. Comply with insulation manufacturer's written
instructions for handling, storing, and protecting during installation.

D. Handle and store roofing materials and place equipment in a manner to avoid permanent deflection of
deck.
1.8 PROJECT CONDITIONS
A. Weather Limitations: Proceed with installation only when existing and forecasted weather conditions
permit roofing system to be installed according to manufacturer's written instructions and warranty
requirements.
1.9 WARRANTY
A. Special Manufacturer’s Project Warranty: Non-prorated Warranty, without monetary limitation, in which
manufacturer agrees to repair or replace any and all components of membrane roofing system and edge
material that fail in materials or workmanship within specified warranty period. Failure includes roof
leaks and 120mph blow off. Roof shall be warranted for 120mph Ultimate wind. The Manufacturer shall
EXCLUDE any references to Hurricanes with wind speeds less that the warranty requires. The warranty
shall cover damages for winds which include hurricane categories 1, 2 and 3 up to 120 mph. All
components including but not limited to fascia, gravel stops, copings shall be supplied and warranted as a
total roof assembly.
1. Special warranty includes roofing membrane, base flashings, roofing membrane accessories, roof
insulation, fasteners, cover boards, substrate board, vapor retarder, roof pavers, parapets, walkway
products, and other components of membrane roofing system.
2. Warranty Period: 20 years from date of Substantial Completion.
B. Special Contractor/Installers Project Warranty: Submit roofing Installer's warranty, on warranty form at
end of this Section, signed by Installer and the Prime Contractor, covering Work of this Section,
including all components of membrane roofing system such as roofing membrane, base flashing, roof
insulation, fasteners, cover boards, substrate boards, vapor retarders, roof pavers, parapets and walkway
products, for the following warranty period:
1. Warranty Period: Two years from date of Substantial Completion. All repairs shall be made
within 48 hours of notification.

2.3 AUXILIARY MATERIALS
A. General: Auxiliary materials recommended by roofing system manufacturer for intended use and
compatible with membrane roofing. All components including but not limited to fascia, gravel stops,
copings shall be supplied and warranted as a total roof assembly.
B. Sheet Flashing: Manufacturer's standard sheet flashing of same material, type, reinforcement, thickness,
and color as PVC sheet membrane.
C. Sheet Flashing: Manufacturer's standard unreinforced thermoplastic polyolefin sheet flashing, 55 mils

D. Bonding Adhesive: Manufacturer's standard solvent-based bonding adhesive for membrane, and solvent-

2.5 ACCESSORIES
A. Protection Mat: Woven or nonwoven polypropylene, polyolefin, or polyester fabric mat, water
permeable and resistant to ultraviolet degradation, type and weight as recommended by roofing system
manufacturer for application. Location as shown on the drawings.
PART 3 - EXECUTION
3.1 EXAMINATION
A. Examine substrates, areas, and conditions, with Installer present, for compliance with the following
requirements and other conditions affecting performance of roofing system:
1. Verify that roof openings and penetrations are in place and set and braced and that roof drains are
securely clamped in place.
2. Verify that wood blocking, curbs, and nailers are securely anchored to roof deck at penetrations
and terminations and that nailers match thicknesses of insulation.
3. Verify that surface plane flatness and fastening of steel roof deck comply with requirements in
Division 05 Section "Steel Decking."
4. Proceed with installation only after unsatisfactory conditions have been corrected.
3.2 PREPARATION
A. Clean substrate of dust, debris, moisture, and other substances detrimental to roofing installation
according to roofing system manufacturer's written instructions. Remove sharp projections.
B. Prevent materials from entering and clogging roof drains and conductors and from spilling or migrating
onto surfaces of other construction. Remove roof-drain plugs when no work is taking place or when rain
is forecast.

C. Complete terminations and base flashings and provide temporary seals to prevent water from entering
completed sections of roofing system at the end of the workday or when rain is forecast. Remove and
discard temporary seals before beginning work on adjoining roofing.
D. Install acoustical roof deck rib insulation strips, specified in Division 05 Section "Steel Decking,"
according to acoustical roof deck manufacturer's written instructions.
3.3 INSULATION INSTALLATION
A. Coordinate installing membrane roofing system component’s so insulation is not exposed to precipitation
or left exposed at the end of the workday.
B. Comply with membrane roofing system manufacturer's written instructions for installing roof insulation.
C. Install tapered insulation under area of roofing to conform to slopes indicated.
D. Install one or more layers of insulation under area of roofing to achieve required thickness. Where
overall insulation thickness is 1-1/2 inches 2 inches or greater, install 2 or more layers with joints of each
succeeding layer staggered from joints of previous layer a minimum of 6 inches in each direction.
E. Trim surface of insulation where necessary at roof drains so completed surface is flush and does not
restrict flow of water.
F. Install insulation with long joints of insulation in a continuous straight line with end joints staggered
between rows, abutting edges and ends between boards. Fill gaps exceeding 1/4 inch with insulation.
1. Cut and fit insulation within 1/4 inch of nailers, projections, and penetrations.
G. Mechanically Fastened Insulation: Install each layer of insulation and secure to deck using mechanical
fasteners specifically designed and sized for fastening specified board-type roof insulation to deck type.
1. Fasten to resist uplift pressure at corners, perimeter, and field of roof. Fasteners shall be installed
at a spacing not greater than one fastener per 4 square feet area of roof in the field of the roof and
not greater than one fastener per 2 square feet area of roof in the perimeter of the roof.
H. Coordinate with Part 1 "Performance Requirements" Article. Fastener numbers will increase at corners
and perimeter over number required for field of roof.
3.4 ADHERED ROOFING MEMBRANE INSTALLATION
A. Install roofing membrane over area to receive roofing according to membrane roofing system
manufacturer's written instructions. Unroll roofing membrane and allow to relax 30 minutes before
installing.
1. Install sheet according to ASTM D 5036.
B. Start installation of roofing membrane in presence of membrane roofing system manufacturer's technical
personnel.
C. Accurately align roofing membrane and maintain uniform side and end laps of minimum dimensions
required by manufacturer. Stagger end laps.
D. Bonding Adhesive: Apply solvent-based bonding adhesive to substrate and underside of roofing
membrane at rate required by manufacturer and allow to partially dry before installing roofing membrane.
Do not apply bonding adhesive to splice area of roofing membrane.
E. Adhesively fasten roofing membrane securely at terminations, penetrations, and perimeter of roofing.
F. Apply roofing membrane with side laps shingled with slope of roof deck where possible.
G. Seams: Clean seam areas, overlap roofing membrane, and hot-air weld side and end laps of roofing
membrane according to manufacturer's written instructions to ensure a watertight seam installation.
1. Test lap edges with probe to verify seam weld continuity. Apply lap sealant to seal cut edges of
roofing membrane.
2. Verify field strength of seams a minimum of twice daily and repair seam sample areas.
3. Repair tears, voids, and lapped seams in roofing membrane that does not meet requirements.
H. Spread sealant or mastic bed over deck drain flange at deck drains and securely seal roofing membrane in
place with clamping ring.
I. Install roofing membrane and auxiliary materials to tie in to existing roofing.

3.5 BASE FLASHING INSTALLATION
A. Install sheet flashings and preformed flashing accessories and adhere to substrates according to
membrane roofing system manufacturer's written instructions.
B. Apply solvent-based bonding adhesive to substrate and underside of sheet flashing at required rate and
allow to partially dry. Do not apply bonding adhesive to seam area of flashing.
C. Flash penetrations and field-formed inside and outside corners with sheet flashing.
D. Clean seam areas and overlap and firmly roll sheet flashings into the adhesive. Weld side and end laps to
ensure a watertight seam installation.
E. Terminate and seal top of sheet flashings and mechanically anchor to substrate through termination bars.
3.6 FIELD QUALITY CONTROL
A. Testing Agency: Owner will engage a qualified independent testing and inspecting agency to perform
roof tests and inspections and to prepare test reports.
B. Final Roof Inspection: Arrange for roofing system manufacturer's technical personnel to inspect roofing
installation on completion and submit report to Architect.
1. Notify Architect or Owner 48 hours in advance of date and time of inspection.
C. Repair or remove and replace components of membrane roofing system where test results or inspections
indicate that they do not comply with specified requirements.
D. Additional testing and inspecting, at Contractor's expense, will be performed to determine compliance of
replaced or additional work with specified requirements.
3.7 PROTECTING AND CLEANING
A. Protect membrane roofing system from damage and wear during remainder of construction period. When
remaining construction will not affect or endanger roofing, inspect roofing for deterioration and damage,
describing its nature and extent in a written report, with copies to Architect and Owner.
B. Correct deficiencies in or remove membrane roofing system that does not comply with requirements,
repair substrates, and repair or reinstall membrane roofing system to a condition free of damage and
deterioration at time of Substantial Completion and according to warranty requirements.
C. Clean overspray and spillage from adjacent construction using cleaning agents and procedures
recommended by manufacturer of affected construction.

Roofing Installer is responsible for damage to work covered by this Warranty.
Owner shall promptly notify Roofing Installer of observed, known, or suspected leaks, defects, or
deterioration and shall afford reasonable opportunity for Roofing Installer to inspect work and to examine
evidence of such leaks, defects, or deterioration.
This Warranty is not recognized to be the only warranty of Roofing Installer on said work Other
warranties are listed in the specifications) and shall not operate to restrict or cut off Owner from other
remedies and resources lawfully available to Owner in cases of roofing failure. Specifically, this
Warranty shall not operate to relieve Roofing Installer of responsibility for performance of original work
according to requirements of the Contract Documents, regardless of whether Contract was a contract
directly with Owner or a subcontract with Owner's General Contractor.
Any litigation shall take place in Orange County, NC.
This warranty shall not exclude wind damage from hurricanes, damage from hurricanes specifically
caused by windborne debris is excluded. Warranty shall include parapets and all roof edge conditions.

BAS DIRECT DIGITAL CONTROL SYSTEM
PART 1 GENERAL
1.01 WORK INCLUDED:
A.A fully integrated Building Automation System (BAS), incorporating direct digital control (DDC) for
energy management, equipment monitoring and control, and subsystems with open
communications capabilities as herein specified.
B.Furnish all labor, materials, equipment and service necessary for a complete and operating
Building Automation System (BAS), utilizing Direct Digital Controls.
C.Coordinate with General Contractor and Mechanical Contractor on schedule and general
sequencing of Work. (ADD 01)
D.BID ALTERNATE:
E.The system that is installed under this project must be integrated to the Owner's existing Siemens
building automation server front end.
F.The system will integrate and communicate to the existing BMS server (Desigo by Siemens)
flawlessly so that all information and points can be viewed from the existing automation software
and BMS server. The Owner shall be able to log onto the existing automation server and navigate
to the control system that is being installed as part of this project. Information from other sites shall
be able to be transmitted and shared in its entirety.
G.BASE BID:
1.If the BAS Contractor does not have an existing server and front end with Orange County, the
y shall provide a server, a Niagara 4 license for the amount of points on the project plus 20%,
and integrate all equipment under this project to it.
2.Provide graphics similar to Owner's existing graphics (Add 01)
H.The installation of the control system shall be performed under the direct supervision of the
controls manufacturer representative with the shop drawings, flow diagrams, bill of materials,
component designation or identification number and sequence of operation all bearing the name of
the manufacturer. The installing contractor shall certify in writing, that the shop drawings have
been prepared by the equipment manufacturer representative and that the equipment
manufacturer representative has supervised their installation. In addition, the equipment
manufacturer representative shall certify, in writing, that the shop drawings were prepared by their
company and that all temperature control equipment was installed under their direct supervision.
I.Provide system graphics for each controlled device and/or integrated systems as required by the
Owner. Origin of information shall be transparent to the operator and shall be controlled, displayed,
trended, etc. as if the points were hardwired to the BMS.
1.02 GENERAL PRODUCT DESCRIPTION
A.All materials and equipment used shall be standard components, regularly manufactured for this
and/or other systems and not custom designed especially for this project. All systems and
components shall have been thoroughly tested and proven in actual use for at least two years.
B.The system shall be scalable in nature and shall permit expansion of both capacity and
functionality through the addition of sensors, actuators, DDC Controllers, and operator devices.
C.System architectural design shall eliminate dependence upon any single device for alarm reporting
and control execution. Each DDC Controller shall operate independently by performing its own
specified control, alarm management, operator I/O, and data collection. The failure of any single
component or network connection shall not interrupt the execution of any control strategy,
reporting, alarming and trending function, or any function at any operator interface device.
D.DDC Controllers shall be able to access any data from, or send control commands and alarm
reports directly to, any other DDC Controller or combination of controllers on the network without
dependence upon a central or intermediate processing device. DDC Controllers shall also be able
to send alarm reports to multiple operator workstations without dependence upon a central or

1.04 QUALITY ASSURANCE
A.The BAS system shall be designed and installed, commissioned and serviced by factory trained
personnel. BMS contractor shall have an in-place support facility within 100 miles of the site with
technical staff, spare parts inventory and necessary test and diagnostic equipment. The BMS
contractor shall provide full time, on site, experienced project manager for this work, responsible
for direct supervision of the design, installation, start up and commissioning of the BMS.
B.The BMS contractor shall maintain a service organization consisting of factory trained service
personnel and provide a list of 10 projects, similar in size and scope to this project, completed
within the last five years.
C.Materials and equipment shall be the catalogued products of manufacturers regularly engaged in
production and installation of automatic temperature control systems and shall be manufacturer's
latest standard design that complies with the specification requirements.
D.All BAS peer-to-peer network controllers, central system controllers, and local user displays shall
be UL Listed under Standard UL 916, category PAZX; Standard ULC C100; and under Standard
UL 864 and be so listed at the time of bid. All floor level controllers shall comply, at a minimum,
with UL Standard UL 916; Standard UL 864 and be so listed at the time of Bid.
E.This system shall have a documented history of compatibility by design for a minimum of 15 years.
Future compatibility shall be supported for no less than 10 years. Compatibility shall be defined as
the ability to upgrade existing field panels to current level of technology, and extend new field
panels on a previously installed network. Compatibility shall be defined as the ability for any
existing field panel microprocessor to be connected and directly communicate with new field
panels without bridges, routers or protocol converters.
1.05 SUBMITTALS
A.Product Submittal Requirements. Meet requirements of Submittal Section on Shop Drawings,
Product Data, and Samples. Provide six copies of shop drawings and other submittals on
hardware, software, and equipment to be installed or furnished. Begin no work until submittals
have been approved for conformity with design intent. Provide drawings as AutoCAD 2004 (or
newer) compatible files on optical disk (file format: .dwg, .dxf, .vsd, or comparable) or hard copies
on 11´x 17´prints of each drawing. When manufacturer¶s cut sheets apply to a product series
rather than a specific product, clearly indicate applicable data by highlighting or by other means.
Clearly reference covered specification and drawing on each submittal. General catalogs shall not
be accepted as cut sheets to fulfill submittal requirements. Select and show submittal quantities
appropriate to scope of work. Also include contractor Sequence of Operations as programmed.
1.06 WARRANTY
A.Warrant labor and materials for specified control system free from defects for a period of 12
months after final acceptance. Failures on control systems that include all computer equipment,
transmission equipment and all sensors and control devices during warranty period shall be
adjusted, repaired, or replaced at no additional cost or reduction in service to Owner.
B.Work shall have a single warranty date, even if Owner receives beneficial use due to early system
start-up. If specified work is split into multiple contracts or a multi-phase contract, each contract or
phase shall have a separate warranty start date and period.

C.Exception:
1.Contractor shall not be required to warrant reused devices, except those that have been
rebuilt or repaired. Installation labor and materials shall be warranted. Demonstrate operable
condition of reused devices at time of Engineer¶s acceptance.
2.Contractor shall not be required to warrant systems, equipment and devices or software if the
damages and/or failures were caused by lack of training, unauthorized use, negligence or
deliberate action of other parties, or job site conditions.
1.07 OWNERSHIP OF PROPRIETARY MATERIAL
A.Project specific software and documentation shall become Owner¶s property. This includes, but not
limited to:

PART 2 PRODUCTS
2.01 GENERAL
A.All products used in this project installation shall be new and currently manufactured and shall
have been applied in similar installations. Do not use this installation as a product test site unless
explicitly approved in writing by Owner or Owner's representative. Spare parts shall be available
for at least five years after completion of this contract.
2.02 BASE BID ITEMS
A.FRONT END LICENSE
1.The contractor shall be responsible for the hardware and software for the enterprise
framework and system integration required for the complete Building Automation System.
2.Provide software license for number of points above.
3.Provide a JACE 8000 controller to provide integrated control,supervision,data logging,
alarming,scheduling and network management.
4.Niagra 4 shall be used at the network level as the manager.
B.SERVER
1.The Server shall be a PC with minimum Intel Core i5 Quad core 3.4 GHz processor with 8 GB
RAM and a 1TB SATA hard drive with 6 GB/s transfer rate. It shall include a minimum 32X

2.03 COMMUNICATION
A.The design of the BMS shall support networking of operator workstation and Building Controllers.
The network architecture shall consist of two levels, an Ethernet based primary network for all
operator workstations, servers, and primary DDC controllers along with secondary Floor Level
Networks (FLN) for terminal equipment application specific controllers.
B.Data Communications Protocol: Panel Level (BLN) communication must be BACnet compliant
(AHRAE 135).

C.Operator Workstation Communication:
1.The existing central database for Orange County will remain in the same facilities location.
The system graphics will be updated to monitor new equipment installed in this project. This
will provide consistency throughout all system workstations.
D.Primary Network - Panel to Panel Communication:
1.All Building Controllers shall directly reside on the primary Ethernet network such that
communications may be executed directly between Building Controllers, directly between
server and Building Controllers on a peer-to-peer basis.
2.Systems that operate via polled response or other types of protocols that rely on a central
processor, file server, or similar device to manage panel-to-panel or device-to-device
communications shall not be acceptable.
3.All operator interfaces shall have the ability to access all point status and application report
data or execute control functions for any and all other devices. Access to data shall be based
upon logical identification of building equipment. No hardware or software limits shall be
imposed on the number of devices with global access to the network data.
2.04 BUILDING CONTROLLER SOFTWARE
A.General
1.Furnish the following applications software to form a complete operating system for building
and energy management as described in this specification.
2.The software programs specified in this Section shall be provided as an integral part of
Building Controllers and shall not be dependent upon any higher level computer or another
controller for execution.
3.All points, panels and programs shall be identified by a 30 character name. All points shall
also be identified by a 16 character point descriptor. The same names shall be displayed at
both Building Controller and the Operator Interface.
4.All digital points shall have a user defined two-state status indication with 8 characters
minimum (e.g. Summer, Enabled, Disabled, Abnormal).
5.Building Controllers shall have the ability to perform energy management routines including
but not limited to time of day scheduling, calendar-based scheduling,holiday scheduling,
temporary schedule overrides, start stop time optimization, automatic daylight savings time
switch over, night setback control, enthalpy switch over, peak demand limiting, temperature-
compensated duty cycling, heating / cooling interlock, supply temperature reset, priority load
shedding, and power failure restart.
6.The Building Controllers shall have the ability to perform the following pre tested control
algorithms:
a.Two position control
b.Proportional control
c.Proportional plus integral control
d.Proportional, integral, plus derivative control
e.Automatic tuning of control loops
f.Model-Free Adaptive Control
7.Each controller shall be provided with an interactive HELP function to assist operators using
POTs and remote connected operators.
B.User Defined Control Applications
1.Controllers shall be able to execute custom, job-specific processes defined by the user, to
automatically perform calculations and special control routines.
2.It shall be possible to use any system measured point data or status, any system calculated
data, a result from any process, or any user-defined constant in any controller in the system.
3.Any process shall be able to issue commands to points in any and all other controllers in the
system.
4.Processes shall be able to generate operator messages and advisories to other operator I/O
devices. A process shall be able to directly send a message to a specified device or cause
the execution of a dial-up connection to a remote device such as a printer or pager.

5.Each controller shall support plain language text comment lines in the operating program to
allow for quick troubleshooting, documentation, and historical summaries of program
development.
6.Controller shall provide a HELP function key, providing enhanced context sensitive on-line
help with task oriented information from the user manual.
2.05 BUILDING CONTROLLERS
A.Building Controllers shall be 32 bit, multi-tasking, multi-user, real-time 48 MHz digital control
processors consisting of modular hardware with plug-in enclosed processors, communication
controllers, power supplies and input/output point modules. Controller size shall be sufficient to
fully meet the requirements of this specification and the attached point list.
B.Each Building Controller shall support a minimum of 3 directly connected Secondary Networks.
C.Each Building Controller shall support firmware upgrades without the need to change hardware.
D.Spare Point Capacity.
1.Each Building Controller shall have a minimum of 10 percent spare point capacity.
2.The type of spares shall be in the same proportion as the implemented I/O functions of the
panel, but in no case shall there be less than one spare of each implemented I/O type.
3.Provide all processors, power supplies, and communication controllers so that the
implementation of adding a point to the spare point location only requires the addition of the
appropriate:
a.Expansion modules
b.Sensor/actuator
c.Field wiring/tubing.
2.06 APPLICATION SPECIFIC CONTROLLERS (ASC)
A.General
1.Each Building Controller shall be able to communicate with application specific controllers
(ASCs) over the Secondary Network to control terminal equipment only.
2.Each ASC shall operate as a stand-alone controller capable of performing its specified control
responsibilities independently of other controllers in the network. Each ASC shall be a
microprocessor-based, multi-tasking, real-time digital control processor.
3.Communication. Each controller shall perform its primary control function independent of
other Secondary Network communication, or if Secondary Network communication is
interrupted. Reversion to a fail-safe mode of operation during Secondary Network interruption
is not acceptable.
4.Control Algorithms. The controller shall receive its real-time data from the Building Controller
time clock to insure Secondary Network continuity. Each controller shall include algorithms
incorporating proportional, integral and derivative (PID) gains for all applications. All PID
gains and biases shall be field-adjustable by the user via room sensor LCD or the portable
operator¶s terminal as specified herein. Controllers that incorporate proportional and integral
(PI) control algorithms only shall not be acceptable.
5.Control Applications. Operating programs shall be field-selectable for specific applications. In
addition, specific applications may be modified to meet the user's exact control strategy
requirements, allowing for additional system flexibility. Controllers that require factory
changes of all applications are not acceptable.
6.Calibration. Each controller shall include provisions for manual and automatic calibration of
the differential pressure transducer in order to maintain stable control and insuring against
drift over time.
PART 3 EXECUTION
3.01 PROJECT MANAGEMENT

3.02 EXAMINATION:
A.The project plans shall be thoroughly examined for control device and equipment locations. Any
discrepancies, conflicts, or omissions shall be reported to the architect/engineer for resolution
before rough-in work is started.
B.The contractor shall inspect the site to verify that equipment may be installed as shown. Any
discrepancies, conflicts, or omissions shall be reported to the engineer for resolution before rough-
in work is started.
C.The contractor shall examine the drawings and specifications for other parts of the work. If head
room or space conditions appear inadequate-or if any discrepancies occur between the plans and
the contractor¶s work and the plans and the work of others-the contractor shall report these
discrepancies to the engineer and shall obtain written instructions for any changes necessary to
accommodate the contractor¶s work with the work of others.
3.03 PROTECTION
A.The contractor shall protect all work and material from damage by its employees and/or
subcontractors and shall be liable for all damage thus caused.
B.The contractor shall be responsible for its work and equipment until finally inspected, tested, and
accepted.
3.04 COORDINATION
A.Site
1.The project coordination between trades is the responsibility of the prime contractor who is
the one tier higher contractual partner such as mechanical contractor, general contractor,
construction manager, owner or owner¶s representative as applicable.
2.The controls contractor shall follow prime contractor¶s job schedule and coordinate all project
related activities through the prime contractor except otherwise agreed or in minor job site
issues. Reasonable judgment shall be applied.
3.Where the work will be installed in close proximity to, or will interfere with, work of other
trades, the contractor shall assist in working out space conditions to make a satisfactory
adjustment.
4.If the contractor deviates form the job schedule and installs work without coordinating with
other trades, so as to cause interference with work of other trades, the contractor shall make
the necessary changes to correct the condition without extra charge.
5.Coordinate and schedule work with all other work in the same area, or with work that is
dependent upon other work, to facilitate mutual progress.
B.Submittals.
1.Refer to the ³Submittals´article in Part A, 7 of this specification for requirements.
C.Test and Balance
1.The contractor shall furnish a single set of all tools necessary to interface to the control
system for test and balance purposes.
2.The contractor shall provide training in the use of these tools. This training will be planned for
a minimum of 4 hours.
D.Coordination with controls specified in other sections or divisions.
1.Other sections and/or divisions of this specification include controls and control devices that
are to be part of or interfaced to the control system specified in this section. These controls
shall be integrated into the system and coordinated by the contractor as follows:
a.All communication media and equipment shall be provided as specified in Part B, 2,
³Communication´of this specification.
b.Each supplier of controls product is responsible for the configuration,programming,
startup, and testing of that product to meet the sequences of operation described in this
section.

c.The Contractor shall coordinate and resolve any incompatibility issues that arise
between the control products provided under this section and those provided under other
sections or divisions of this specification.
d.The contractor is responsible for providing all controls described in the contract
documents regardless of where within the contract documents these controls are
described.
e.The contractor is responsible for the interface of control products provided by multiple
suppliers regardless of where this interface is described within the contract documents.
3.05 GENERAL WORKMANSHIP
A.Install equipment, piping, and wiring/raceway parallel to building lines (i.e., horizontal, vertical, and
parallel to walls) wherever possible.
B.Provide sufficient slack and flexible connections to allow for vibration of piping and equipment.
C.Install all equipment in readily accessible locations as defined by Chapter 1, Article 100, Part A of
the National Electrical Code (NEC).
D.Verify integrity of all wiring to ensure continuity and freedom from shorts and grounds.
E.All equipment, installation, and wiring shall comply with acceptable industry specifications and
standards for performance, reliability, and compatibility and be executed in strict adherence to
local codes and standard practices.
3.06 FIELD QUALITY CONTROL
A.All work, materials, and equipment shall comply with the rules and regulations of applicable local,
state, and federal codes and ordinances as identified in Part A of this specification.
B.Contractor shall continually monitor the field installation for code compliance and quality of
workmanship.
C.Contractor shall have work inspected by local and/or state authorities having jurisdiction over the
work.
3.07 ELECTRICAL WIRING AND MATERIALS
A.Install, connect and wire the items included under this Section. This work includes providing
required conduit, wire, fittings, and related wiring accessories. All wiring concealed above ceilings
shall be plenum rated and shall be independently suspended from the structure or other supports
above the ceiling; it shall not be laid on the ceiling. Do not support cabling off the work of other
trades.
B.Anywhere wiring would be exposed to view, such wiring shall be installed in EMT conduit.
Raceway shall conform to Division 26 specifications.
C.All wiring to be compliant to local building code and the NEC.
D.Provide electrical wall box and conduit sleeve for all wall mounted devices.
3.08 TRAINING
A.The Contractor shall provide competent instructors to give full instruction to designated personnel
in the adjustment, operation and maintenance of the system installed. Factory employed/certified
instructors shall be thoroughly familiar with all aspects of the subject matter they are to teach. All
training shall be held during normal work hours of 8:00 a.m. to 4:30 p.m.weekdays.
B.Provide (3) full days (24 hours) of onsite training to instruct personnel designated by the owner.
C.Training shall include:
1.Explanation of drawings, operations and maintenance manuals
2.Walk-through of the job to locate control components
3.Operator workstation and peripherals
4.DDC controller and ASC operation/function
5.Operator control functions including graphic generation and field panel programming
6.Operation of portable operator's terminal
D.The instructor(s) shall be factory-trained instructors experienced in presenting this material.
