HomeMy WebLinkAbout2021-425-E-AMS-Carolina Contracting & Investments-Hillsborough Commons skylights credit for flashing add general conditionsRevised 07/20 NORTH CAROLINA CONTRACT AMENDMENT ORANGE COUNTY THIS CONTRACT AMENDMENT (“Amendment”) is made and entered into this 30th day of July 2021 by and between ORANGE COUNTY (hereinafter referred to as “County”) and Carolina Contracting & Investments, Inc., (hereinafter referred to as “Provider”). WITNESSETH: THAT WHEREAS, the County and Provider entered into a contract dated October 27, 2020, (hereinafter the “Original Agreement”), for the provision of services to replace the existing skylights at the Orange County Department of Social Services; and WHEREAS, the County and Provider desire to amend the Original Agreement while keeping in effect all terms and conditions of the Original Agreement not inconsistent with the terms and conditions set forth below. NOW THEREFORE, for and in consideration of the mutual covenants and agreements made herein, the parties agree to amend the Original Agreement as follows: 1. In order to ensure the completion of the Services identified in the term of the Original Agreement is amended to reflect an end date by which all Services shall be completed of June 30, 2021. 2. Exhibit A to the Original Agreement is amended by adding the following tasks and services to the Services to be provided by the Contractor: Provide credit to Orange County for flashing removed from the scope of work and add for general conditions for extension for contract for owner coordination per Contractor Proposal for Contract Modification dated June 4, 2021 . 3. Article 5 Payment & Taxes, Section “A” is amended to reflect a maximum payable not-to-exceed amount of One Hundred Sixty Seven Thousand, One Hundred Forty-Eight Dollars and Twenty-Eight Cents ($167,148.28) 4. Except for the changes made herein, the Original Agreement shall remain in full force and effect to the extent it is not inconsistent with this Amendment. In the event there is a conflict between the terms of the Original Agreement and the terms of this Amendment, this Amendment shall control. Then the metal should be installed as shown in the detail that was provided by Garland and on the Architect details, and then new skylight installed. Unfortunately, the roofing manufacturer and the roof warranty that appears to be the driving element in this decision- making process, but was not disclosed in the bid documents and therefore not considered by CCI. The issue of the roof warranty only surfaced a little over a week ago when we started to receive phone calls from a roofing installer. Of course, the skylight manufacturer will not let a roofing manufacturer dictate the details of the fabrication and installation of their product and still provide the warranty required by specification. We spoke with the skylight installer this morning regarding the roofer’s detail and his response was that he would ask the skylight manufacturer if they would refabricate some of the skylight, but likely, it will not be entertained. As initially indicated, it appears that this project being asked to sacrifice the skylight guarantee in exchange for the roofing guarantee, which again was not disclosed to us. We have directed the not installer not to proceed with any further work until you have resolved the competing interest between Cushman Wakefield, Garland and the design documents. Hopefully, these issues can be resolved, and clear direction provided not later than March 8, 2021. It also modifies the detail beyond what was originally drawn and outside of the skylight manufacturers recommended installation for guarantees. If the existing base flashing is installed according to the Garand details on their website, in all likelihood we will be penetrating the flashing in several places. It looks like we should follow the details of the skylight manufactures and install the supplementary flashing as shown on the contract drawings. We will proceed in the above fashion. For others’ clarification, the first attached is the approved Garland detail which was used as a basis for the designed detail. Calvin, per Paxton’s direction below and referring to the second detail attached with revised membrane routing, let’s proceed as such: 1. Remove existing skylights and existing metal flashing. 2. Examine the curb and base flashing. The existing term bar is new and should not need to be replaced. 3. Install approved fully adhered transition membrane over top of curb, overlapping term bar by 1”. Refer to third attached for sample of approved membrane. 4. Install metal flashing/counterflashing as shown in the original detail 5. Install skylight metal flashing 6. Review sample section on-site 7.
