Theraport containeq mong other recommentlations, the recommendation that the County atlopt a mandatory recycling oMinance. The primary objective ofthie regulatory approach was to enceurage more responsible management of highly recyclable materials from the C&D waste stream entl [o tlivert these entl potentially other materials from landfill diapoael. At thefime. Orange County was involved in a search for a new censtmclign entl tlemolition lantlfill to replace fhe existing facility, which is expected to reach capacdy in 2002. The difficulty of siting a new CSD landfill in Orenge County provided an adddional impetus for the ortlinance in that it reflects a desire to make any new such facility last as long as possible by tliversion of selected materiels. The purpose of the proposetl ortlinance is to regulate both recyclable C&D materials and potentially other materiels in [he waste stream by keeping those materials from being landfilled and requiring[haRhey be separetetl for recycling insteatl. While the oNinance is not specifically a C&0 recycling ortlinance, the initial focus of [he oNinence is on what are typically considered CfiD materiak-for example, untreetetl/unpeintetl wootl waste, wooden palle4, and scree metal. Cartlboard is also inclutletl. Other materials may be added in the future to the liat of regulated materials. The proposed ordinance regulates the on-site separation of [he regulated materials, requires Regulated Recyclable Materiel Permits tp be obtainetl along with the tratlificnal buildingldemolilicn permits, and the licensing of waste haulers that haul wastes that typically contain the regulated materials. Passage of the ordinance would si9nifican8y alter the ways in which construction and pemolition waste is managetl in Orenge County, and has the potential to reduce the amount of material landflled, if properly implemeMetl antl atlminisfered. The current tlisposal ban on cardboard in the Orange County lentlfill would be expandetl to mantla[e recycling of all commercially generated cadboard, whether It Is delNered to the in-county lentlfill or other out-of-county facilities. One atltli[ional provision of the ordinance is to prohibit the open burning of solitl waste, including lantldearing tlebds. Implementation of such an odinance requires staffnq, facilities tlevelopmenl, end coordination with other tlapartmenls and governments within Orenge County as well as with the regulated communTy of tlevelopere, wntredors, end waste haulers. If the ortlinance is atloptetl, the County woultl prcceetl to develop [he necessary local recycling'mfras[mctu re to recycle antl market theregulatetl materials. The County woultl also tlevelop an etlucafional antl enforcement capability [o: • make the regulated community ewaro of what the objectives of [he ortlinance ere and how l[benefis the wmmunity • educatethe development community on how to comply with the ordinance,and provitle continuing enforcement of the ordinance A substantial grace periotl is proposed to follow adoption of the ortlinance. During the past year, Solid Weate stall has met or otherwise wmmunicated with various stakeholders who woultl be affectetl by the ortlinance antl has made numerous mod~cetipns to the drag oNinance based on these intaractlons. Adtlltlonally, the Beaty of Commissioners has previously tliscussed versions of the deft odinance et meetings in November 2000, January 2001, antl October 2001, and provitletl further direction to stall. The ordinance has now progressed to the point where the County is seeking {ormal public comment ptlor to further mnsitleration by the Board and possible atloptlon. If the Boak ultimately atlopts the ortlinance,Rweultl be tlesirable for the TOwnsto lmplementihe same ordinance within the municipal bountlaries so that the same mlea woultl be applicable throughout the County. Sfeff notes that Representative Jae Hackney is sponsoring similar legislation on the State level that woultl ban ceNboaN, clean wood waste and wooden pellets from being burietl in landfills. FINANCIAL IMPACT: Adoption of the ordinance would resul[in an obligation to develop recycling facllltles al existing Gounry waste management facilities to receive the regulated materials. Such facilities, equipment antl staff would be footled fmmthe solitl Waste/Lentlfll Operations enterprise fund antl would not involve any General FUnd expenditures. Permit fees, licensing fees antl lentlfill surcharges would supplement existing tipping fees and reserves io fund these services. The FV 2007-025olid waste butlget contains footling for the immetliete hiring of a recycling education specialist; following the adoption of the odinance.
