PUBLIC CHARGE Introduction to the Public Charge The Board of County Commissioners, under the authority of North Carolina General Statute, appoints the Orange County Planning Board (OCPB)to uphold the written land development laws of the County. The general purpose of OCPB is to guide and accomplish coordinated and harmonious development. OCPB shall do so in a manner which considers the present and future needs of its residents and businesses through efficient and responsive process that contributes to and promotes the health, safety,and welfare of the overall County. The OCPB will make every effort to uphold a vision of responsive governance and quality public services during our deliberations, decisions,and recommendations. Public Charge The Planning Board pledges its respect to all present. The Board asks those attending this meeting to conduct themselves in a respectful, courteous manner toward each other, County staff, and Board members. At any time should a member of the Board or the public fail to observe this charge, the Chair will take steps to restore order and decorum. Should it become impossible to restore order and continue the meeting, the Chair will recess the meeting until such time that a genuine commitment to this public charge is observed. CHAIR COMMENTS No. Page(s) • ' •. Item 7. 15 — 72 MAJOR SUBDIVISION CONCEPT PLAN REVIEW-To review and take action on a Concept Plan application for a Major Subdivision called Pyewacket. The proposal within Orange County is for a 2 lot subdivision on 70.79 acres (PIN 9757-51-3504) located in Bingham Township, south of the junction of Jones Ferry Road and Ferguson Road, straddling the Orange-Chatham County line. An Orange County major subdivision review process is necessary for this subdivision because a new public road and open space are proposed to be dedicated. The portion of the subdivision within Chatham County contains 128.39 acres and all 93 habitable lots will be in Chatham County. Presenter: Molly Boyle, Planner II 8. Review Process The Planning Board is an appointed volunteer advisory board which makes recommendations to the Board of County Commissioners (the elected officials). The Board of County Commissioners holds a formal public hearing and makes decisions. Should 79 decorum fail to be restored, the Chair will recess the meeting until such time that a genuine commitment 80 to this public charge is observed. 81 82 83 AGENDA ITEM 7: CHAIR COMMENTS 84 85 There were none 86 87 88 AGENDA ITEM 8: UNIFIED DEVELOPMENT ORDINANCE(UDO)TEXT AMENDMENTS—"160D"LEGISLATION —To make a 89 recommendation to the Board of County Commissioners on UDO text amendments related to State 90 legislation that is referred to as 160D(a reference to the statute section).The amendments are also 91 require changes to Appendix F of the Comprehensive Plan and to the Planning Board Rules of 92 Procedure. This item is scheduled for BOCC public hearing on May 4, 2021. 93 Presenter: Perdita Holtz, Planning Systems Coordinator 94 95 Perdita Holtz reminded the Board that the item was reviewed at the March 3, ORC meeting and at the conclusion of that 96 meeting the Board decided they did not need to see the presentation again. She reviewed the recommendations for the 97 Planning Board to consider. 98 99 Charity Kirk: I have a question about how you notify people; a half a page ad in a newspaper seems potentially ineffective 100 in this day of people not having newspapers subscriptions. I was wondering if you could talk about why that was chosen. 101 102 Perdita Holtz: We are not necessarily, choosing to do this. Currently, before 160D and for many years, statutes allowed 103 for local governments to place a half page ad in a paper for large scale amendments. Orange County never adopted that 104 provision. We have always done mailed notifications. However, our County Attorney's office feels that we need to include 105 the option in the UDO so that we are in conformance with the State regulations that allow local governments to do this. 106 We don't really anticipate that something like that would be used unless it's for a project that already had a public 107 participation component leading up to amendments so that people would be informed,they would already know that 108 something was going on. 109 110 Lamar Proctor: In terms of that notice, are these things put on the Orange County website? The notice in the newspaper 111 ad or the signage that appears next to parcels where there's a zoning amendment or letters, do those reference back to 112 the website. I have the same kind of concern that Charity has. I've looked at 160D and I know that it's an option for the 50 9 DRAFT 113 parcels or greater that you can do that with the newspaper. I guess the legislature thinks that people still get newspapers. 114 1 was wondering in terms of informational purposes whether we put that kind of stuff on the website. 115 116 Perdita Holtz: The Planning Department has a section on the website called Current Interest Projects where we put 117 projects that are currently being considered, not only for rezonings but also for Special Use Permits and things like Major 118 Subdivisions. When the notification letters go out, information is included in the letters on accessing the website to learn 119 more. Sometimes depending on the scope of the project, things go out in the weekly email that our Public Information 120 Officer does or depending on the scope of the project, he might also post something on Facebook. 121 122 Lamar Proctor: In terms of the days of notice, it's not more than 25 days and not less than 10. My concern is why can't 123 we just do 25? I've seen several examples of a 10 day notice for letters or whatever it is, it gets mailed on a Friday, postal 124 service has issues, people get it on a Thursday and then it references a meeting on a Monday or Tuesday. If they take a 125 long weekend then it's sorry, they don't know. I've seen examples in our community where people find out about things in 126 passing amongst neighbors and interested parties by a hair's breadth. So was there any talk or consideration of making it 127 the maximum that you are allowed, 25 days, to give people proper notice. 128 129 Perdita Holtz: We do almost always send out notices well in advance of 10 days. I think the County Attorney's office would 130 have a concern about saying we will do 25 days because statutes allow you to do 10 and they feel that our UDO should 131 conform to the language in the statutes. I also want to point out that Orange County sends out notices for the Planning 132 Board meeting which is not required by statutes,we send out meetings to property owners within 1000 feet of a parcel and 133 statutes require only abutting property owners be notified so Orange County already goes far beyond what statutes require 134 for notice. There would also be concerns about saying we are going to do 25 when we normally send them out about 15 135 days in advance because of the way our cycles work. There might be instances where an applicant is still trying to get 136 some things worked out and to hold up the notice because they were a day late from 25 days, as you suggest,would add 137 another month to the process. 138 139 Lamar Proctor: Personally, I'm looking at this as a community member, I would love to see it be at least 15 days. I think 140 the general language is notice shall be posted or mailed a minimum of 10 days prior. It's kind of permissive language, 141 meaning you can do it more. There were other notices,weren't there for 15 days? 142 143 Perdita Holtz: Yes,you can do it more than 10 days but it can't be more than 25 days in advance. Yes, I believe there 144 was one either for the Comp Plan or SUPs that required 15 days. We are now standardizing it all to be in conformance 145 with State statutes. 146 147 Lamar Proctor: I understand the conformity and I think the uniformity within our own UDO is to notice so you don't have to 148 say, it's 15 for this and 17 for that, 12 for that. That's ridiculous. My position is that I would like the minimum to be greater 149 than 10 days because I think there are instances where people don't get proper notice because of the timing of things. 150 That's one thought I had. My other concern was the exclusions being removed on page 158, 1 don't understand the history 151 of those exclusions. When I read about a non-residential Conditional Use District that is really a blank slate,other than 152 some limitations within the Rural Buffer,that combined with removing exclusions, makes me think that there could be a 153 Conditional District approved for a crematorium in somebody's backyard or something that clearly fell within the exclusions 154 previously and is now going to be game on for anything, anywhere other than what's specifically excluded in the NR-CD 155 list. 156 157 Perdita Holtz: I understand the concern but there's also another piece to the puzzle which is Appendix F of the 158 Comprehensive Plan that shows which land use classifications that NR-CD can be applied to. That is found on the very 159 last page of the amendment packet, page 348. NR-CD would be allowed for consideration in all of the land use 160 classifications because currently the Conditional Use District also is allowed for consideration in all those classifications. 1 161 understand that it is correct that you could now apply for these uses where previously,you could not. When Conditional 162 Use Districts were set up, at least in the '90s if not earlier,the people who set them up said we don't want these uses to be 163 considered. 164 165 Lamar Proctor: When I read this and I think about worst-case scenario, I see a 10-day notice requirement for a zoning 166 change with an NR-CD or Conditional District that allows anything. Anything is on the table unless it's in the Rural Buffer. 167 If there are a few landowners that are abutting or its homeowners that aren't concentrated around a parcel,they miss it 168 and they are out of luck. 10 DRAFT 169 170 Perdita Holtz: Conditional Districts, as they are now called, require a Neighborhood Information Meeting so there are 171 multiple steps that happen before notices for a Planning Board meeting or a Public Hearing ever goes out. For instance, 172 on page 68 there are the requirements for a Neighborhood Information Meeting for Conditional Districts. Notices for 173 Neighborhood Information Meetings are sent out 14 days prior and it is a 1,000 feet requirement and a sign is also 174 required to be posted on the property. 175 176 Lamar Proctor: My concern is notice, there are plenty of spots where notice gets sent but they seem to be shrinking under 177 these amendments. Is there a mechanism when there is an application for a zoning amendment that would include an 178 informational meeting in front of the County Commissioners prior to the Planning Board considering it? It feels like these 179 applications go out and come through the Planning Board and then we get surprised or even they get surprised at what is 180 being put in front of them. Is there any mechanism that could be initiated or put in place where there is an application and 181 then there is an informational session with the Board of Commissioners at a Public Hearing that says this is a zoning 182 change that's being applied for,the process has starting and we're letting you know this is coming and we are following the 183 process next where the Commissioners are put on notice and the public is put on notice. I feel like things kind of popped 184 up and then interested parties hear about them by word of mouth and I want to make sure the public is getting the proper 185 notice. Most people don't get newspapers anymore so those are some of my concerns regarding notice. 186 187 Michael Harvey: When an application is submitted, staff has five business days to determine sufficiency. Once it's 188 sufficient and formally accepted, that's when our internal clock for the UDO starts. There is an internal review by Planning 189 Department staff and other County staff through our Development Advisory Committee(DAC),we then schedule the 190 Neighborhood Information Meeting. With Conditional District applications,the Neighborhood Information Meeting is 191 required to occur in a set timeframe before Public Hearing. Notices of the Neighborhood Information Meeting are sent to 192 property owners within 1,000 feet. The notices have to be sent 14 days prior to the date of the Neighborhood Information 193 Meeting and we post signs on the property. After the Neighborhood Information Meeting it then goes to the Planning 194 Board and there is a separate mailing required for Conditional District applications before the Planning Board, not required 195 by State law but something the County is going to continue to do. After the Planning Board, there is a Public Hearing with 196 a separate advertising component. There are three public meetings, Neighborhood Information Meeting, Planning Board 197 meeting and Public Hearing with three separate advertisings for each application.As for an initial public review, at last 198 night's meeting,there was a petition submitted by a County Commissioner to study whether or not we need to amend the 199 Unified Development Ordinance to create a concept plan meeting where a conditional application would be reviewed by 200 the County Commissioners before a Neighborhood Information Meeting is scheduled to offer comments to the applicant. 201 That is in an infant stage in terms that we haven't been given formal direction by the BOCC to investigate that process but 202 it is something that is being discussed. It was looked at several years ago but we were not authorized to submit the formal 203 procedure to amend the UDO to include it but it is something the BOCC is tinkering with having us look at again. 204 205 Craig Benedict: It did come up last night and it will be referred to BOCC Chair/Vice-Chair to be discussed and will include 206 the County Manager/Deputy Manager and myself on what modifications could be necessary to have such a process. The 207 reason it wasn't followed through with before was in the interest to have as much technical input on an application to offer 208 to the applicant before someone looks at an application that might not be fully vetted. It may be part of our process that 209 after all the various departments, NCDOT, Emergency Services, Fire,everybody makes their comments, and we let 210 everybody know that we are looking at the aspects of an application. Then maybe there's another opportunity for the 211 public to see it sooner rather than later. It might not—they thought having an un-vetted project by all those different 212 internal agencies would make it look like the work was not being done. 213 214 Lamar Proctor: Board of Adjustment is appealed to Superior Court and does not go before the County Commissioners? 215 216 Perdita Holtz: Correct. 217 218 Lamar Proctor: The minimum 10 days and the removal of the exclusions is a huge deal and I question that. It seems to 219 be something that is part of the history of our UDO and now it's wide open and those exclusions are removed. Those are 220 my concerns. 221 222 Perdita Holtz: Maybe it would help you to know, all of these uses are allowed somewhere already they just weren't going 223 to be allowed as a Conditional Use District but they are allowed in certain Zoning Districts if you look in the Table of 11 DRAFT 224 Permitted Uses. It's not like these uses were not allowed anywhere, all of these use types occur in the Table of Permitted 225 Uses as allowed somewhere. 226 227 Lamar Proctor: For some specific zoning, all of it is allowed? 228 229 Perdita Holtz: Correct. These were not prohibited Countywide uses. 230 231 Lamar Proctor: I saw on Special Use Permits,the Planning Director is allowed to modify those by,there's a list,for minor 232 changes and I think that's under 2.7.14; how many times can an applicant come back for a minor modification like that? 233 234 Perdita Holtz: There isn't a limit to how many times they can come back but I will say, it's exceedingly rare. 235 236 Craig Benedict: In my 22 years, less than five times. It is exceedingly rare because our SUP conditions that are approved 237 are very finite and specific to the project. 238 239 Lamar Proctor: Asking directly about the 10 days, could we just make it 15 days? Is that crazy? 240 241 Perdita Holtz: The Planning Board could vote to recommend that it be 15 days and it could go to the Board of County 242 Commissioners as the Planning Board's recommendation. 243 244 Lamar Proctor: The exclusions used to apply to Conditional Districts and the new LIDO would remove that exclusion list, 245 correct? 246 247 Perdita Holtz: It used to apply to Conditional Use Districts which no longer are allowed to be a zoning mechanism in North 248 Carolina. The whole construct of Conditional Use Districts is gone. 249 250 Lamar Proctor: Under 1.6.2 that whole section was stricken and I think the footnote says it's in policy documents, does 251 taking that out of the UDO change it in substantive way? 252 253 Perdita Holtz: No, unless you consider that changing it would currently require a UDO text amendment whereas changing 254 it in the future would only require an amendment to the Planning Board Rules of Procedures. 255 256 Craig Benedict: When the UDO was developed there was no separate policy mechanism for the advisory boards and over 257 the last 10 years the Commissioners and Attorneys' Office have put together policies for each of the advisory boards. 258 259 Lamar Proctor: Who can make the Planning Board amendments? If it's just a policy? 260 261 Perdita Holtz: It could start with staff,the Planning Board, or BOCC but the BOCC has to approve it. 262 263 Lamar Proctor: I would love to see that 10 days become 15 days, that's a motion by me. Signage that's posted in a yard or the right-of-way 282 needs to meet standards for legibility and readability just like we expect billboards to be able to be read when someone is 283 driving by at 35 mph. There are a number that pop up around that western side of Orange County that I just can't read. If 284 that could somehow be specified. I'm sure the DOT folks could tell you how big the letters need to be to be seen at various 285 speed limits. 286 287 Perdita Holtz: If I could address that, the County does attempt to put a lot of information on those signs. I don't know if 288 you have seen other places in North Carolina where you'll see an 8'h x 11 yellow sign that just has a Z on it,which means 289 zoning, and it has the phone number for the planning department. That is how a lot of places advertise that something is 290 happening on the property. We could go to something like that. Having a sign with all the information that we attempt to 291 put on it could result in a 4 ft. by 8 ft. sign and staff puts those up and staff does it in a County vehicle or personal vehicle 292 and that would be pretty big to fit into those vehicles. The 11.24 acre parcel will be part of the Pyewacket Subdivision, a 93 lot single-family residential subdivision proposed on 128.39 acres within Chatham County's planning jurisdiction. The remaining 59.55 acre parcel in Orange County is not part of the project (i.e., it will be a separate lot). BACKGROUND: Per Section 7.2 Subdivisions- Classification of Subdivisions of the Unified Development Ordinance (UDO), this Concept Plan application must go through the Major Subdivision review process as it proposes development of a new public road, Pyewacket Trail. The application is being reviewed in accordance with Section 2.15 Procedures- Major Subdivisions of the UDO. The basic facts of the application are as follows: Owner: Dr. Wyndell Merritt 7601 N. Based on the preliminary Site Assessment staff prepared (Attachment 2), the County will require 65' stream buffers on both sides of these streams. Buffers are measured from the top of the bank on both sides of the stream. The Concept Plan denotes wetland areas as well. i. Roads: The parcel has approximately 2,500 ft. of frontage on Jones Ferry Road. The proposed public road, Pyewacket Trail, would access Jones Ferry Road. Pyewacket Trail is the only proposed means of ingress/egress for the Pyewacket subdivision. The 128.39 acre parcel proposed for development in Chatham County is landlocked. j. Water and Sewer Service: The property is not located within a primary utility service area. It is designated as "OWASA Long- Term Interest Area" on the Water and Sewer Management Planning and Boundary Agreement. The entire Pyewacket project proposes three community wells, one of which is 17 proposed in Orange County. The applicant is proposing septic systems in Chatham. Surrounding Zoning/Land Uses: a. NORTH: Single-family residential subdivision, Turkey Run. The subdivision is split-zoned AR and RB (Rural Buffer). Lots adjacent to the subject parcel are zoned AR. b. SOUTH: Undeveloped acreage in Chatham County, which the applicant is proposing to develop as the 93-lot subdivision, Pyewacket. The Morgan Ridge subdivision in Chatham County is to the southwest. c. EAST: Undeveloped 119 acre parcel zoned AR. d. WEST: Single-family residential subdivision, The Enclave at Jones Ferry. All lots zoned AR. PROPOSAL: The Concept Plan proposes two lots in Orange County, specifically an 11.24 acre parcel and a 59.55 acre parcel. The 11.24 acre parcel involves the following: • Preservation of 9.24 acres of land as dedicated Common Open Space, • Location/development of a community well, and • Development of a new public road, Pyewacket Trail, serving the proposed 93-lot single- family residential subdivision within Chatham County. STAFF COMMENT.-At this time, there are no single-family residential parcels proposed within Orange County. Please refer to Attachment 3 for the Concept Plan for the 11.24 acre parcel within Orange County. The portion of the Pyewacket subdivision proposed within Chatham County, currently under review in Chatham, contains 128.39 acres of land and is proposed to be subdivided to create 93 individual parcels for development of single-family residences. Density for the proposed development in Chatham County is 1 dwelling per 1.38 acres of land area. Attachment 4 contains a rendering of the Concept Plan for the proposed development in Chatham County. STAFF COMMENT.-As previously indicated, our review of the proposal is predicated on the development of a new public roadway within Orange County's planning jurisdiction. If a public road were not proposed, it would not be reviewed through the Major Subdivision process. Roads: The applicant proposes development of a new public road, Pyewacket Trail, in Orange County to serve the 93 proposed lots in Chatham County. NC DOT will review the proposal to ensure roadway design meets its standards for State maintenance. STAFF COMMENT.-The proposed public road within Orange County is the only means of ingress/egress to serve the development. NC DOT review and approval is not required at the Major Subdivision Concept Plan phase. NC DOT's analysis, however, is required during Preliminary Plat review. The Orange County Fire Marshal's Office has confirmed that the proposed road meets emergency access requirements. See Attachment 7 for the Fire Marshal's comments. 18 After the Neighborhood Information Meeting, staff recommended that the applicant submit trip generation data for the subdivision. Although not required for the Concept Plan application, staff suggested that the data could help facilitate discussion about traffic at the Planning Board meeting. See Attachment 6 for the applicant's ITE Trip Generation Report. Utilities: The Pyewacket project proposes three community wells, one of which is proposed in Orange County. The proposed location is shown on the Concept Plan in Attachment 3. According to the NC Department of Environmental Quality, its Public Water Supply Section must review and permit public water systems. Public water systems are those that provide piped drinking water to: a) At least 15 connections, or b) 25 or more people for 60+ days per year. At this time, the community well proposed in Orange County is projected to serve approximately 31 lots (1/3 of the Pyewacket subdivision). Permitting of the well will go through the NC Department of Environmental Quality, not Orange County Environmental Health. The application in Chatham County proposes individual septic systems to serve proposed lots. No septic systems are proposed in Orange County. STAFF COMMENT: Approval of proposed well and septic areas typically occurs during the Preliminary Plat review process as detailed within the UDO. Orange County will have no regulatory/permit authority on well/septic systems developed within Chatham County. Stormwater Drainage: Overall drainage will be engineered according to applicable standards when the applicant submits for development permits. The property is subject to adopted erosion control and stormwater management guidelines. STAFF COMMENT: Staff of the Orange County Erosion Control and Stormwater Division did not identify any concerns with the proposed Concept Plan. Open Space: Of the 11.24 acre parcel proposed as part of the project, 82% (9.24 acres) is proposed to be Common Open Space, preserved through a conservation easement or other restrictions as required by Section 7.12 Flexible Developments of the UDO. The Pyewacket Homeowners' Association would own and maintain the open space. The Concept Plan proposes both Primary and Secondary Open Space, specifically: o Primary Open Space:4.24 acres, or 45.89% of the total proposed Common Open Space. This area includes streams, required buffers, and wetland areas. Primary Open Space areas are those that have sensitive environmental features or cultural resource areas. These areas are for passive or low-impact uses (e.g., forests, pastures, trails, nature observation). o Secondary Open Space: 5 acres, or 54.11% of the total proposed Common Open Space. Secondary Open Space areas do not have sensitive environmental or cultural features and can support more active uses if desired (e.g., playground, clubhouse). STAFF COMMENT: Staff has determined that the proposal meets the open space requirements as detailed in UDO Section 7.12. 19 Land Use Buffers/Setbacks: The Concept Plan for Orange County does not propose structures or habitable lots, so building setbacks and land use buffers do not apply. However, of the 11.24 acre lot proposed as part of the Pyewacket subdivision, the majority (82%, 9.24 acres) is proposed as Common Open Space. See the Concept Plan in Attachment 3. STAFF COMMENT.- For public water system wells, the State requires a 100' setback from the well. This setback is denoted on the Concept Plan. PROCESS, SCHEDULE, AND ACTION: The UDO requires the following process for Major Subdivision Flexible Development applications: 1. Neighborhood Information Meeting: Staff held this meeting on April 20, 2021. Please refer to Attachment 5 for meeting materials and notes. 2. Planning Board (Concept Plan): The Planning Board reviews and takes action on the Concept Plan application. This review begins on May 5, 2021. The Concept Plan review is intended to allow Board members and the applicant to discuss the proposal and identify possible solutions to any concerns with the proposed plan. If approved, the Concept Plan serves as a "roadmap" for the applicant in preparing their Preliminary Plat application submittal. 3. Planning Board (Preliminary Plat): Once a Concept Plan is approved, the applicant submits a Preliminary Plat application to Planning staff. The Planning Board reviews and makes a recommendation on the approval of the Preliminary Plat. 4. BOCC: The BOCC reviews and takes action on the Preliminary Plat application. 5. Final Plat: Once all construction is completed or appropriate bonds have been approved, staff coordinates the recordation of a Final Plat legally creating the proposed lots. PUBLIC NOTICE: UDO Section 2.15.2 requires that staff mail letters to property owners within 1,000 feet of the subject property to notify them of the Neighborhood Information and Planning Board meetings. Staff is required to post notification signs on the subject property as well. Staff mailed notices and posted the subject property as required. See Attachment 5 for meeting correspondence and staff's mailing/sign certifications. Staff held the Neighborhood Information Meeting (NIM) on April 20, 2021. Ten residents, Planning staff, and the applicant attended the meeting. See Attachment 5 for notes from the meeting. ANALYSIS: UDO Section 2.15.2 (E) requires that the Planning Director prepare and submit a recommendation on the Concept Plan to the Planning Board for consideration. The Planning Director offers the following information, analysis, and recommendation: 1. The application has been deemed complete in accordance with the requirements of UDO Sections 2.2 and 2.15.2; 2. The County is, essentially, being asked to approve development of a new public road to serve a residential development within Chatham County. Similar proposals have been reviewed and approved by the County in the past for developments within both Durham and Chatham counties; 20 3. Staff has determined that the proposal complies with UDO subdivision regulations found in Article 2 Procedures and Article 7 Subdivisions. 4. The proposal appears consistent with the various goals of the Orange County Comprehensive Plan concerning development, including: a. Land Use Overarching Goal: Coordination of the amount, location, pattern, and designation of future land uses, with availability of County services and facilities sufficient to meet the needs of Orange County's population and economy consistent with other Comprehensive Plan element goals and objectives. b. Land Use Goal 2: Land uses that are appropriate to on-site environmental conditions and features and that protect natural resources, cultural resources, and community character. c. Land Use Goal 3: A variety of land uses that are coordinated within a program and pattern that limits sprawl, preserves community and rural character, minimizes land use conflicts, supported by an efficient and balanced transportation system. 5. Staff supports the approval of the Concept Plan using the Flexible Development option as detailed in the submitted Concept Plan and application materials. The neighbors expressed their concerns, which are summarized below. The neighbors wondered why the Concept Plan proposes a community well in Orange County to serve lots in Chatham County. Couldn't the well be in Chatham County? 2. Some neighbors said wells in the area have run dry in the past. What will the County do to protect the neighbors' wells? 3. Will the 93 lots in Chatham be allowed to have individual swimming pools,which could further impact wells nearby? Answers: Warren Mitchell explained that there are two other community wells proposed in Chatham County. The third well is proposed in Orange County to distribute the three wells as evenly as possible. The well in Orange County would serve about one third of the subdivision (+/- 31 lots). Mr. Mitchell said he hadn't considered a prohibition on individual pools, but that he would consider it. The plans for the Pyewacket neighborhood include a community pool already, plus the proposed lots are small enough (+/- 0.66 acres) that individual pools might not be practical. Some neighbors were glad to hear about the possibility of prohibiting individual pools but still 1 41 expressed concern about the subdivision's potential impact on wells for Orange County residents. Molly Boyle explained that well permitting is done through Orange County Environmental Health and that the well would need to be permitted prior to subdivision approval. Ms. Boyle was not sure of the exact permitting requirements since she works in a different department, but she said she would follow up with Environmental Health.* *Post-Meetinz Note: OC Environmental Health permits individual private wells. Will there be any road improvements to Jones Ferry Road to handle the increase in traffic? Answers: The proposed public road onto Jones Ferry Road, tentatively called Pyewacket Trail, is the only proposed ingress/egress for the Pyewacket subdivision. Warren Mitchell said that the parcel on the Chatham County side is landlocked. Wyndell Merritt owns both parcels proposed for development: one in Chatham and one in Orange. The Orange County parcel fronts onto Jones Ferry Road. That's why the access is proposed in Orange County. Mr. Mitchell said he has not formally submitted anything to the North Carolina Department of Transportation(NC DOT)yet. Since Pyewacket Trail is proposed as a public road, it will need to 2 42 be reviewed and approved by NC DOT. NC DOT approval is not required at the Concept Plan phase of Orange County's major subdivision review,but it is required during the next phase (Preliminary Plat Review). Molly Boyle asked Mr. Mitchell is a Traffic Impact Analysis (TIA) would be required for the development. Mr. Mitchell said he didn't believe so but that would be determined by NC DOT. What is the anticipated value of the homes in this subdivision? Will this help address affordable housing issues in and around Orange County? 3. What safety precautions will be taken when constructing the road over the existing natural gas line/easement? Answers:NC DOT may require road improvements to Jones Ferry Road in Orange County; NC DOT will be reviewing the road proposal during the Preliminary Plat phase, and their comments will be available to the public at that time. The 9.24 acres of open space proposed in Orange County will be dedicated and preserved. However, Orange County will not see tax revenue from the 93 homes in Chatham County. Mr. Mitchell said affordable housing development was not required with this project. He said that the gas company would have employees present during road construction to make sure safety protocols are followed in relation to the existing gas line. Neighbors requested that no pedestrian or vehicular access be made to the greater Emily Lane neighborhood. 3. Wells—aquifer—will the new wells affect the water table for wells on and around Emily Lane. A few wells in the neighborhood have low yield already. 4. One neighbor on Jones Ferry Road near the proposed entrance is looking forward to having the new subdivision roads to walk in where it will be safer than walking on Jones Ferry Road. 5. What will be the price point of the proposed homes? 6. Is there any way to ask the NCDOT to post a lower speed limit than the current 55 mph for Jones Ferry Road? Developer Response: 1. We will continue to make the request and work with ATT or Spectrum to bring high speed internet to the Emily Lane neighborhood through the proposed Morgan Ridge Subdivision. ATT and Spectrum have indicated that they will carry their service to Emily Lane in an easement being proposed. The HOA president for Emily Lane is talking with these utility providers. 2. There is no plan to connect to Emily Lane and there is no access currently. No connection (pedestrian or vehicular) can be made without approval of all Emily Lane residents since Emily Lane is a private road. 3. We have proposed a community well+ distribution for the subdivision. The main proposed community well near the community clubhouse is approximately 2000 feet away from the common property boundary with the closest existing neighbor. A second well must be provided (which is shown closer to the existing neighbors). Two wells are required for a community system serving more than 49 homes. 4. Yes, it seems like a positive result for many. 5. The price of the homes will probably start in the $500K's and the average size of the homes will probably be about 2600sf—2800sf. 6. Please take a look at my revisions and let me know if you have any questions or comments: Comments and Requested Revisions You will need to submit the revised Concept Plan, inclusive of the following edits, to Planning staff no later than April 23, 2021 to get on the agenda for the May Sth Planning Board meeting. 1.The Fire Marshal requests the following road data be denoted somewhere on the Concept Plan: • The road will not be less than 20' in width. • There will be 13' 6" of vertical clearance as required by the NC Fire Prevention Code 2018 edition. • The roadway shall be an all-weather surface and capable of withstanding an imposed weight load of 75,000 lbs. The proposed roadway will be constructed to Public DOT standards and will comply with all of the 3 conditions mentioned above. 2. Contact Orange County Environmental Health about permitting for the community well shown on the plan.The proposed location is fine for the Concept Plan, but Environmental Health will need to review and approve the well location before approving the Preliminary/Final Plats. Per the Erosion Control and Stormwater Division, you will need an Erosion Control permit when disturbing 20,000 sq. ft. of land or more and a Stormwater Management permit when disturbing 43,560 sq. ft. (1 acre) or more. For stormwater, land disturbance is cumulative for the parent tract. Thank you for reminding me of these standards. 4.The NC DOT highway division that oversees Chatham County will be reviewing the proposed roads for Pyewacket, including the portion of Woodstock Lane on the Orange County side. Please refer questions for NC DOT to Jennifer Britt (see table above). 1 will be sending the plans to Jennifer Britt at NCDOT. The roadway has been designed to the NCDOT standards.Also, Chatham County has a condition that the name of the subdivision must be used in the entrance road. 1 wasn't aware of that when 1 named the entrance road Woodstock Lane. 1 have renamed the entrance road Pyewacket Trail and the Chatham County 911 operations administrator has checked with Orange County and that name is acceptable. 5. Please see the attached copy of the Concept Plan for Planning's comments and revisions. I have reviewed your comments on the Concept Plan and made the following revisions to that plan: 1. The Chatham County Concept Plan is being sent to you for your records. 2. The Subdivision Data has been revised as recommended. 3. The 500 foot boundary line has been removed. 4. We did not previously shade the stream buffer area outside of the parcel being subdivided, but we have now shaded all stream buffers and verified that they are all 65 feet from the top of the stream bank. Intermittent streams are jurisdictional and sometimes they have a different buffer width than perennial(outside of Orange County). 1 realize that they have the same stream buffer width in Orange County. 5. The map title has been revised. 6. 1 revised the vicinity map but 1 don't know if is what you were looking for. 7. 1 revised the legend and used 2 different colors to contrast primary and secondary open space. 8.
