HomeMy WebLinkAbout2020-904-E AMS - Summit Engineering and Design Northern Campus amendment DocuSign Envelope ID:27028AA0-327E-4DEF-B3D5-A4F12D5863EC NORTH CAROLINA CONTRACT AMENDMENT ORANGE COUNTY THIS CONTRACT AMENDMENT("Amendment")is made and entered into this I Ith day of November, 2020 by and between ORANGE COUNTY (hereinafter referred to as "County") and SUMMIT DESIGN AND ENGINEERING SERVICES,PLLC (hereinafter referred to as"Consultant"). WITNESSETH: THAT WHEREAS,the County and Consultant entered into a contract dated October 18, 2019, (hereinafter the"Original Agreement"), for the provision of professional services for Northern Campus Expansion- Construction Materials Testing(CMT) and Special Inspections(SI) Services; and WHEREAS, the County and Consultant desire to amend the Original Agreement while keeping in effect all terms and conditions of the Original Agreement not inconsistent with the terms and conditions set forth below. NOW THEREFORE, for and in consideration of the mutual covenants and agreements made herein, the parties agree to amend the Original Agreement as follows: 1. In order to ensure the completion of the Services identified in the term of the Original Agreement is amended to reflect an end date by which all Services shall be completed as of July 1,2021. 2. Exhibit 1 to the Original Agreement is amended by adding the following tasks and services to the Services to be provided by the Consultant: Complete remaining special testing and construction materials testing for the Northern Campus project. 3. Article 5, Section 5.1.1 is amended to reflect a maximum payable not-to-exceed amount of Two Hundred Sixty-Five Thousand,Two Hundred Thirty-Eight Dollars ($265,238.00). 4. Except for the changes made herein,the Original Agreement shall remain in full force and effect to the extent it is not inconsistent with this Amendment. In the event that there is a conflict between the Original Agreement and this Amendment,this Amendment shall control. So here is a quick rundown of what I understand per conversations with Bordeaux and our onsite inspector: Prolonged Construction Schedule: • Please note we are required to be onsite when structural work is ongoing, per building code. • Our time onsite is totally controlled by contractor's schedule; therefore, if they are working at a pace slower than the base schedule (see attached) then we have to be onsite for that additional time. o For one example, item "STR 205 Structural Masonry Walls".The late finish for this activity was suppose to be June 17t", 2020... so that is when we anticipated no longer needing to perform masonry inspections and testing. In realty,the structural masonry is still not finished as of middle of last week, so clearly that has required additional onsite hours not anticipated, per GC schedule in our original proposal. o "STR 220 Set Roof Joists—Detention Areas" and "STR 225 Roof Metal Decking—Detention Areas"were supposed to be completed July 151", 2020 and August 121", 2020, respectively.These items are still not completed. Work remaining: 1 DocuSign Envelope ID:27028AA0-327E-4DEF-B3D5-A4F12D5863EC • Structures: Detention Facility and POB—will need approximately 3-4 more weeks (est.—130 hours) here for steel joists, miscellaneous masonry and concrete, and structural steel for POB. Structures will be at Special Inspector rate ($75)to complete Special Inspections. • Sitework& Paving:total for remaining sitework, hardscapes, roadway subgrade, roadway abc stone, concrete paving and asphalt paving. Based off of our understanding from Bordeaux's schedule,this will be approximately 4 weeks (est. —160 hours) of onsite time to wrap up sitework inspections and testing. Once we get into this last phase of work, Summit will utilize the Field Technician 2 rate ($60)to complete sitework& paving. Given what is left,we feel we have a good grasp on what is remaining and can manage to these requested additional hours.
