PURPOBE:
1. To approve the submission of an Application far Funding [o the N.C. Housing Finance
Agency for approximately $]5,000 in footling for the local Urgent Repair Prpgrem antl
author¢a fhe County Manager to submit the application on behe6 of the County.
2. To approve the Assistance Policy associated with the Urgent Repair Pogram and
authorize the Chair of the eoaN to sign the policy tlocument.
BACKGROUND:
The N G. Housing Finance Agency has recently announcing the availability of funtls for [he
Urgent Repair Program (URP). Approximately $1.5 million is available statewide fcrthe Urgent
Repair Program antl the maximum allocation perjurisdiction Is $]5,000.
Urgent Repa'r Program
The stated obleclives of the Urgent Repair Program are:
L To assist very law-inwme homeowners with special needs (eltlerly t 62 years of age,
handicapped cr disabled, single parent, large households (five (5) or more persons), antl
families with children with elevated Mood levels between 10 antl 20 mcgltll;
2. To serve hpuseholtls with urgent repair neetls which cannot be met through oNer state or
federally funded housing assistance progrems; antl
3. To enable trail eltlerly homeowners, antl others with physical disabilifies, to remain in
[heir homes by providing essential accessibility motli6cations.
Specifically, funtls are usetl to alleviate housing wnditions that pose an imminent threat to the
life or safety of very low-income homeowners or the ability of frail or physically disabled very
low-income homeowners to remain in their homes independent of insiitutionel confinement.

Eligible applicants to receive footling under this program are owner-occupants wish incomes
below 50%of [he area metlian Income. Atltll[ionally, assistance may not exceetl $3,500 in har0
costs per dwelling unit; thus, it is estimatetl that $]5,000 will assist approximately 25
homeowners. Specifc eligibility antl prior'M1y standards For selection of participating units are
detailed in the atlechad Assistance Policy that must be approved by the Boertl of
Commissioners.
The Agency is requesting that applications be submided and executed by the Chief
Adminlstrative ORCial of [he judstlimicn or the County Manager by October 12, 2001. There is a
$50 application fee for each progmm application After reviewing [he appllcatlons, the N.C.
Housing Finance Agency expects to announce conditional awaros in January 2002.
FINANCIAL IMPACT: Approximately $]5,000 in Housing Trost funtls is appropdatetl for the
County's Urgent Repair Program in the FV 2001-2002 Budget Thia application represents iha
opportunity to access en additional $75,000 forour local program.
Additionally, the progmm tloes provide funtls for adminletrative support ranging from $150 to
$450per house depending on the repair costs per dwelling. These funds can supplement our
existing administrative budget

For the 2002 Cycle of the
Urgent Repair Program
What is the Urgent Repair Program? The County ofOmnge Has applietl to the
North Carolina Housing Finance Agency ("NGHFA") for $15,000 in footling untler [he
2002 cyGe of the Urgent Repair Program ('URP2002'). This program provitles funds
to alleviate housing contlitions that pose an imminent threat to the life ar safety of
very low-Income homeowners or the ability of freil ar physically tlisebletl very low-
income homeowners. In atltlition to the $15,1100 from the NCHFA, the County has
pledged an additional $15,000 tD the pmjeG. The County plans to apply the funds
towartl [he rehabilitation of about twenty-flue (25) houses In the County of Orange.
This Assistance Policy deacdbes who is eligible to apply for aaaietance under the
URP program, haw applicationsfor assistance will be rbtetl antl ranked, what the
terms of assistance are and how the whole rehabilitation process will be managed.
The County has Metl tctlesign [his URP2002 project [c be fair, open, antl consistent
with the Countys approvetl application for footling antl wI[h NCHFA'S URP Program
Guidelines.
Who ie eligible to apply? There are two major requiremenk to be eligible for
UPR2gg2 assistance. First, the homeowner's family or household must be belowa
certain income limit. Secondly, the applicant's house has an emergency health or
safety deficiency.
Mare specifically, to be eligible for wnsideration, homeowners must meet the
following requirements:
Applicants for URP Program funtls mus[prove that they own antl occupy the
property to ba rehabilitated as their primary resitlence.
• Applicants must no[have any aveNUe loans or loans in tlefault from Ne County of
Orange.
Applicants moat reside within the County Limifs of Orange.
• Applicants' homes must meet all of the tests listetl below. (See "What types of
houses are elgible?"below) '

• Propertes cannot be located in the rightbf-way of any impentling or plannetl
public improvements. Tha County's Rehabilitation Spedalist will assist in making
this tleterminatlon.
• The property must be current with all [axes. If the owner is unsure about Nis,
they can call the County Revenue Office a[ 245-2]25.
• The property cannot be located on asRe that is entlangered by mudslitles,
landslides or other natural or environmental hazartls. The Rehabilitellon
Specialist will work with the homeowner to make [his tle[erminatipn, if needed.
• The property met' not be lOCatetl in a flood hazard area. (The County will vent'
whether the home is in the /bod plain.)
• The property rannot have been ropairetl or rehabilitatetl with public footling of
$S,DDO or more within [he past 10 years.

Recipients of assistance untler the URP progrem will be chosen by the above criteria
without regartl m race, creetl, sex, color or national origin.
What are the [arms of assistance untler URP2002? The Counly will provide
severel types of assistance to [he homeowners whose homes are selected for
rehabilitation. The County will tletermine the scope of work needed to meetURP

To pay for the rehabilila[ion work, the County will provide part of the funtls In the form
of grant.
What kintls of work will be tlonei Each house selectetl for assistance will be
rehabilita[etl to atltlress an identifietl health antl/or safety dazartl. Upon completion,
the work performed under the program must meet North Caroline State Resltlential
Builtling Gotle (VIIj stantlartls antl be performetl in acramance with all state antl local
peimiding, inspections, licensing, antl insurance requirements, This does not mean,
however, that the whole house must be brought up fa Builtling Code or Minimum
Housing Code Stantlartls.
Generally, iha County will apeciN that rehabilitation tasks be accomplishetl in the
least-expensive method [hat Is deemed adequate to meet program standards. The
URP assistance cannot be usetl for luxury or non-essential work.
Of course, mn[radors performing work funtletl antler URP2002 are responsible for
meeting all local requirements for permits and inspections.
Whaf about leatl~basatl pain[? Until it was tllscoveretl to be a health hazarQ the
metal leatl was usetl for centuries to make house paints. Now we know that eating
chips or tlus[ of lead-basetl paint can cause very serious problems for small chiMren.
Selling lead paint was outlawed In 19]8, but many alder bulltlings still contain lead
paint antl children are ebll being poisoned
Untler URP2002, a lead hazard evaluation will be pertormetl on every home selectetl
for rehabilitation That was built before 19]8. The speufic type of evaluation antl the
apprcpriate lead hazaN retluc[ion work pertormetl will tlepentl on the nature of the
work to be done antler the URP proposal.
Who will do the work on the homes? The CCUnN IS Obligated underURP2002 to
ensure that quality woB is tlone at reasonable prices antl Nat all work Is contractetl
through a faiq cpen and competitive process. To meet [hose very tliffcult
requirements, iha County will invite bitls from contrectors who are part of en
"approved contractors registry'.
To be on the registry, contrecors must (1) fill out an application farm, listing several
references and recent lobs completeQ antl (2) receive the'condltlonal approval' of
the County. Once a mnimclor who has been cpntlitlonally approved has
successfully completed one lab for the County, his or her status is upgratletl to
"regular approval", meaning [ha[ They will be allowetl to bitl on a regular rotation as
long ee [hey remain in good standing. (Homeowners who know of quality
rehabilitation contractors that are not on the County's ApProvetl Contracture Registry
are welcome [c invite them to apply.)
At least three approved contractors will be invitetl to bitl on each job, antl the lowest
responsive and responsible bidtler will be selectetl for the wnfrect. "Responsive antl

responsible" means the contractor (7 )is tleemetl able to complete the work In a
timely fashion, and (2) that the bitl is within 15°/a (in either tlirection) of the County's
wst estlmete. In [he event that mare than five approvetl con[mcors wish to
compete. licensed contractors will fake precetlence. If required, lead basetl pain[
hazard retluctlon andlor abatement will be performed by contacors who are tminetl
and certifed to perform such work
What are the steps in the process,from application [o completion? Now that
you have the information about how to qualify for the 2002 Orenge County Urgent
Repair Program, what work can be tlone, and who will do it,.let's go through all the
major steps in the process
1. Completing an Application(orm: Homeowners who wish tc apply for assistance
must do so by Mey 1, 2002. Apply by wnlacting the Orange County Housing and
Community Development Department at (918)245-2490. Proof of ownership and
income will ba required. Those who have applletl for housing assistance from the
County in the past will ppt.automatically be reconsitleretl. Anew application will
need to be submitted.
2. Preliminary lnspectlan: The County's Rehabilitation Specialist will visit the
homes of potential redpients to determine the neetl and feeaibility of the home for
rehabilitation
3. Screening of applicants: Applications will be ratetl and rsnketl by the County
based on the priority system ou[linetl on page 3 and the feasibility of rehabilitating
Yha house. The householtls to be offeretl assistance will be selected by June 15,
2002. Houaeholtl inwme will be veritietl for program purposes only(information
will be kept conftlentlal). Ownemhip of property will be verified along with other
rating factors. From this review, the ten (10) moat quelifed applicants will be
chosen accortling b the priority system described above. There will also be a list
of three (g)alterndles.
4. Applicant Interviews: Approved applicants will be provitletl tletailed'mformation
on assistance, leatl hezertls; progrem rehabilitation statrtlaNS antl the mntrecting
procedures associated wdh their pro(ect at this informational interview. Before
proceetling with the rehabilitation of their home, the applicant will ba given five (5)
days in which to tleditle whether N padicipzte in the URP program or nat.
Applicants will be encouragetl to consult with family members antl legal
professionals in oNer to determine the best course of action for them.
5. Work write-up: The Countys Rehabllite[ion Specialist will visltthe home again
for a more thorough inspection. All parts of the home must be matle accessible
for inspection, Including the attic end crawlspace, 'rf any. The owner should repod
any known problems such as electrical short circuits, blinking lights, roof leaks
and the like. The Rehabilitatlon Specialis[will prepare complete antl tletailetl
wodc specifications (known as the'Work wrke-up". Afinal cost asfimate will also
be preparetl by the Rehabilitation Specalist antl held in cenfitlence until bitldin9 is
completed.
6. Formal agreement After approval of the work writs-up, the homeowner will sign
a formal agreement that will explain antl govern the rehabilitation process. This
agreement will define the roles of the parties involved dimughout the rehabilitation
process.
). Bitltling: The work write-up antl bitl documents will be mailed or faxetl to at least
three to five contractors from the Approvetl Contractors Registry who will be given
one [o two weeks in which to inspect Ne property and prepare bid proposals. The
names of the invRed wntmctors will be supplied fo the homeowner Each will
neetl access ro all parts of the house in abler to prepare a bid. A bid opening will
be contluctetl at [he Community Development offce at a specified tlate and time,
with all bidders and the homeowner invited to attend.
8. Con[redoreelec[fon: Within 24 hours of the bitl opening, after review of bitl
breaktlowns andliming factors, the winning bidder will be selected. All bidders
end the homeowner will ba notified of (7) fhe selection. (2) the amount, (8J the
amount of the County's ces[estimate, antl l4)if other than the lowest bitlder is
selected, of the specifc reasons (or the selection.
9. Cpntrad execution: Grant antl contract documents will be executeq these will
bintl all parties antl make [he project official. The contract will be between fhe
cen[mctor antl the homeowner, with fhe County signing as an interested third
party. Contractors mus[submh pnxf of liability insurance.
10.Pre-construction conference: Apra-consfmction conference will be held at the
home or pifce. At this time, the homeowner, centmctor and program
representafiveswill tliscuss the tletails of [he work [o be tlone. Starting and
entling tlates will be agreed upon, along with any special arrangements such as
weekentl or evening work hours and tlisposition M items to be removed from the
home (such as oltl cabinets, etc.). Within 24 hours of the pre-censtmNOn
cenference, the County will issues"proceed order"formally instructing the
centmctor to commence by the agreed-upon tlete.
11.COns[ruction: The contractor will be responsible for obtalningabuiltling permit
for the project before beginning work. The permit must be posted of the house
during the entire period cf construction. Program staff will closely monitor [he
centractpr tludng the constmction pedotl to make sure that the work is being done
eccortling m the work write-up (which is made a part of the rehabilitation contract
by reference) and in a timely fashion. Coda Enforcement Officers will inspect new
work for compliance wifh[he Slate Building Code, as with any ofherjob. The
homeowner wll be responsible for working with the wntraaor towartl protecting
personal property by clearing woB areas as much as prectlcable.
12.Change Ortlers: All changes to fhe scope of work must be approved by fhe
owner antl the County M Orange Rehabilifaficn Specialist, and reduced to writing

as a contract amendment ("change oNer'j. If the changes require an adjustment
in the loan amount, the change must be specified in the change order. Also, a
motlifcation agreement stating these changes in the contract amount must be
wmpleted by the County, antl executed by the owner.
13.Closeout When the contractor declares the work complete, program staff will
thoroughly inspect work. If deficiencies are observetl, the contractor will be
required to correct them. When the Rehabilitation Specialist and the homeowner
are satisfietl That the rgnVact has been fdlfJled, each will elgn off antl, after receipt
of [he conbaMdr'sinal invoice, the foal payment will be ortlered. The contrector
will submit all lien releases pilot to release of [he final payment. All materiel and
workmanship will be guarenteetl for aone-year period after the date of project
completion
14.POSt-cons[ruc[lon conference: Following constmction the contmaor antl[he
Rehabilitation Specialist will sit tlown with the homeowner one IastAime. At this
conference the contractor will hantl overall owner's manuals antl warrentles on
equipment. The contractor antl Rehabilitation Specialist will go over operating antl
maintenance requirements for the new equipment antl appliances end tllscuss
generel maintenance o5 the home with the homeowner. The homeowner will have
the opportunity to ask any final questions about work.
1S.The warranty periotl: It Is extremely impoitsnt that any problems with the work
that was pertormetl be repotletl tome RehabllRaticn Specialist as soon as
passible. All bone fide tlefec[s in materials antl workmanship reportetl within one

appeals.
Durino the aoollcation process
1. If an applicant feels [hat hislher application was not fairly revlewetl or ratetl antl
woultl like to appeal the tlecision matle about ip helshe shoultl centad the
appropriate Housing Technician within five tlays of the initial tlecision antl voice
their concern. If the applicant remains tllssatisfietl with the tlecision, the tletailetl
complaint shoultl be put into writing.
2. A written appeal must be made within 1g business tlays of the inttisl tlecision on
an application.
3. The County of Orange will reapontl in writing to any complaints or appeals within
1o business tlays of receiving written comments.
D Edna the rehab'I' a(nn
1. If the homeowner feels that cpnstruUion Is no[ being completed according to [he
contract, helshe must inform the contractor antl the Rehabilitation Specialist.
2. The Rehabilitation Speclalis[will inspeM [hework in questlon. If he fntls that the
work js not being completetl accoding to contract, the Rehabilitation Specialist
will review the cpn[mM with the con[raMOr and ask the contractor to remedy the
problem.
3. If problems persist, a metliation conference between Ne homeowner antl the
contractor may be convened by [he Rehabilitation Specialist and facilitatetl by the
Countys Housing antl Community Development Director
d. Shouldthe mediation conference fail to resolve the tlispute, the Community
Development Director will render a written final tlecision.
S If the Rehabilitation Specialist Ends that Iha work j& being completetl according [o
conlraM, the complain[will be notetl antl [he Rehabilitation Specialist and the
homeowner will tliscusb the concern antl the reason for the Rehabilitation
Specialist's decision.

before the County Commissioners and written permission from NCHFA.
What about favoritism? All activities under URP2002, Inclutling reting antl ranking
applicatlona, InviVng bitls, selecting con[rectcra end resolving rnmplalnts, will be
conductetl in a lair, open antl nomtlischminatory manner, entirely without regartl to
race, creed, sex, color or national origin.
