PURPOSE: To review and disass a revised drak of the Regulatetl Recyclable Materials
Ordinance antl to consider setting a Public Hearing date to receive formal public comment on
the proposetl oNinance.
BACKGROUND: One of the key recommentlations in the August 2000 report from the
Opnstruclicn antl Demoltion Waste Recycling Task Fume is atlop8on of an oNinance
regulating recyclable constmction & demolition (C8D) materiels. Implemen[etlon of such an
ortlinance requires staffing, facilities development, antl cccNination with other departments and
govemmen(s wdhln Orange County, as well as the regulated community of developere end
waste haulers.
The proposed oNinance has potential to regulate both recyclable C&D materials and char
materiels with a goal of keeping those metedala from being lantlfllletl antl requiring that they be
separetetl for recycling instead. The proposed ordinance regulates on-site separation, requires
submission of materiels management plena for larye conatmction projects, antl licensing gf
waste haulere b haul the separated regulatetl materials. Passage of the ordinance would
significan8y alter the ways in which constmc[ion and demolition waste is managetl in Orange
County and has the potential to retluce the amount of material lantlfilletl if properly implemented
antl atlministaretl.
The Board discussetl previous versions of [he drefl oNinance e[ meetings in November 2000
and January 2001, and raised a number of questions, including concerns that any oNinance the
SoaN might adopt shcultl not have unintended adverse consequences on agtlcultural antl
forestry operations. Since that time, the staff and [he Attorney have wcdcetl with various
stakeholders and other interested parties to produce appmpdate changes to the draft
oNinance, based on their input antl previous tlirection from the eOCC. Among other points, the
accompanying staff memo Isys out the major features of the odinance, f6etlback received from
parties that would be affected by the oNinance, a Olswssion of enforcement issues, and a
proposed timeline for implementation if the BOCC feels that they are reatly to pursue adoption
of the odinance as revised. "
FINANCIAL IMPACT: Details of the financial implications related to adoption of the ordinance
are discussed in the Solitl Waste Facilities Master Plan report (agenda item #2 on this
September 11 work session). The Managers Recommended 2001-02 operating budget for the
Solid WastetLandfll Operations Funtl inclutletl funding for the C&O Education antl Enfomemen[
Specialist position recommentletl by the C&D Waste Recycling Task Force fo implement this
ordinance and the accompanying education eHOrts. The BOCC elected to postpone
consideration of [he oreatioq of that permanent position itself until there was an opportunity to
review the recyclable materials ordinance in more tlatail then coultl be achieved during the June
2001 budget work sessions. However, funding for the position antl associated costs Is already
available In the FV 2001-02 approvetl budget.
