HomeMy WebLinkAbout2020-119-E IT - Columbia Telecommunications extend fiber to ASRevised 11/19 1 [Departmental Use Only] TITLE CTC Tech & Energy FY 2020 NORTH CAROLINA SERVICES AGREEMENT NO RFP/RFQ ORANGE COUNTY This Services Agreement (hereinafter “Agreement”), made and entered into this 20th day of January, 2020, (“Effective Date”) by and between Orange County, North Carolina a political subdivision of the State of North Carolina (hereinafter, the "County") and Colombia Telecommunications Corporation, (hereinafter, the "Provider"). WITNESSETH: That the County and Provider, for the consideration herein named, do hereby agree as follows: 1. Services a. Scope of Work. i) This Agreement is for services to be rendered by Provider to County with respect to (insert type of project): Extend fiber infrastructure from Public Works – Bldg. 1 (6850 Millhouse Rd. Chapel Hill, NC 27516) to Animal Services (1601 Eubanks Road Chapel Hill, NC 27516). ii) By executing this Agreement, the Provider represents and agrees that Provider is qualified to perform and fully capable of performing and providing the services required or necessary under this Agreement in a fully competent, professional and timely manner. iii) Time is of the essence with respect to this Agreement. iv) The services to be performed under this Agreement consist of Basic Services, as described and designated in Section 3 hereof. Compensation to the Provider for Basic Services under this Agreement shall be as set forth herein. 2. Responsibilities of the Provider a. Services to be provided. The Provider shall provide the County with all services required in Section 3 to satisfactorily complete the Project within the time limitations set forth herein and in accordance with the highest professional standards. b. Standard of Care. i) The Provider shall exercise reasonable care and diligence in performing services under this Agreement in accordance with the highest generally accepted standards of this type of Provider practice throughout the United States and in accordance with applicable federal, state and local laws and regulations applicable to the DocuSign Envelope ID: FDEE3CE5-2218-4290-8CC7-E06D1211E72A Revised 11/19 2 performance of these services. Provider is solely responsible for the professional quality, accuracy and timely completion and/or submission of all work related to the Basic Services. ii) Provider shall be responsible for all errors or omissions of its agents, contractors, employees, or assigns in the performance of the Agreement. Provider shall correct any and all errors, omissions, discrepancies, ambiguities, mistakes or conflicts at no additional cost to the County. iii) The Provider shall not, except as otherwise provided for in this Agreement, subcontract the performance of any work under this Agreement without prior written permission of the County. No permission for subcontracting shall create, between the County and the subcontractor, any contract or any other relationship. iv) Provider is an independent contractor of County. Any and all employees of the Provider engaged by the Provider in the performance of any work or services required of the Provider under this Agreement, shall be considered employees or agents of the Provider only and not of the County, and any and all claims that may or might arise under any workers compensation or other law or contract on behalf of said employees while so engaged shall be the sole obligation and responsibility of the Provider. v) If activities related to the performance of this Agreement require specific licenses, certifications, or related credentials Provider represents that it and/or its employees, agents and subcontractors engaged in such activities possess such licenses, certifications, or credentials and that such licenses certifications, or credentials are current, active, and not in a state of suspension or revocation. vi) In determining the Basic Services to be provided, should any documents be referenced in this Agreement, the terms of this Agreement shall have priority in any conflict between the terms of referenced documents and the terms of this Agreement. vii) Should this Agreement involve project designs, the construction or creation of which is to be bid out and/or fulfilled by other contractors, and bidding or negotiation with contractors produce prices which, when added to the other elements of the approved total project cost, produce a cost that is in excess of the approved total project cost, the Provider shall participate with the County in negotiation and design adjustments to the extent such are necessary to obtain prices within the approved total project cost. All activity of the Provider with respect to these matters shall constitute Basic Services and shall be performed by the Provider without additional compensation. If negotiation and design adjustments fail to bring costs within the total project cost the County may reject all bids and Provider will redesign and/or reduce portions of the project in an effort to reduce the bid prices to within the total project cost and rebid the project. One such redesign is included within Basic Services. If this second letting for bids does not produce bids that are within the approved total project cost initially or after negotiations with the contractor the cost is not reduced to an amount DocuSign Envelope ID: FDEE3CE5-2218-4290-8CC7-E06D1211E72A Revised 11/19 3 within the total project cost, the Provider is not obligated to engage in further redesign. 3. Basic Services a. Basic Services. The Services to be rendered pursuant to this Agreement are as follows (fully describe services to be provided): CTC will provide engineering and design services to extend the County’s fiber network approximately 4,600 feet from Public Works to Animal Services. This work will produce documentation required for the County and its selected construction contractor to procure materials and construct both outside plant (OSP) and inside plant (ISP) portions of the network. This proposal anticipates a single railroad crossing will be required to complete the fiber extension. CTC will take into account future needs when identifying the optimal crossing location, such as potential connectivity to the Park Operations Center. (see Attachment A) 4. Duration of Services a. Term. The term of this Agreement shall be from 1/20/2020 to 6/30/2020. b. Scheduling of Services. i) The Provider shall schedule and perform its activities in a timely manner. ii) Should the County determine that the Provider is behind schedule, it may require the Provider to expedite and accelerate its efforts, including providing additional resources and working overtime, as necessary, to perform its services in accordance with the approved project schedule at no additional cost to the County. iii) The Commencement Date for the Provider's Basic Services shall be 1/20/2020. 5. Compensation a. Compensation for Basic Services. Compensation for Basic Services shall include all compensation due the Provider from the County for all services satisfactorily (as determined by the County) performed pursuant to this Agreement. The maximum amount payable for Basic Services shall not exceed fifty-five-thousand and no/100 Dollars ($55,000.00). Payment for satisfactorily performed Basic Services shall become due and payable within thirty (30) days of Provider properly invoicing County. Payment shall be subject to provisions of Section 5(b). b. Disputes. In the event the amount stated on an invoice is disputed by the County, the County may withhold payment of all or a portion of the amount stated on an invoice until the parties resolve the dispute. Should Provider fail to perform its duties under the terms of this Agreement, County may, without fault or penalty, withhold any payment associated with the work to be performed until such time as said work is completed. c. Additional Services. County shall not be responsible for costs related to any services in addition to the Basic Services performed by Provider unless County requests such DocuSign Envelope ID: FDEE3CE5-2218-4290-8CC7-E06D1211E72A Revised 11/19 4 additional services in writing and such additional services are evidenced by a written amendment to this Agreement. 6. Responsibilities of the County a. Cooperation and Coordination. The County has designated (Jim Northrup) to act as the County's representative with respect to the Project and shall have the authority to render decisions within guidelines established by the County Manager and/or the County Board of Commissioners and shall be available during working hours as often as may be reasonably required to render decisions and to furnish information. 7. Insurance a. General Requirements. Provider shall obtain, at its sole expense, Commercial General Liability Insurance, Automobile Insurance, Workers’ Compensation Insurance, and any additional insurance as may be required by County’s Risk Manager as such insurance requirements are described in the Orange County Risk Transfer Policy and Orange County Minimum Insurance Coverage Requirements (each document is incorporated herein by reference and may be viewed at http://www.orangecountync.gov/departments/purchasing_division/contracts.php). If County’s Risk Manager determines additional insurance coverage is required such additional insurance shall consist of N/A (See Attachment B) (if no additional insurance required mark N/A as being not applicable). Provider shall not commence work until such insurance is in effect and certification thereof has been received by the County's Risk Manager. 8. Indemnity a. Indemnity. To the extent authorized by North Carolina law the Provider agrees, without limitation, to defend, indemnify and hold harmless the County from all loss, liability, claims or expense, including attorney's fees, arising out of or related to the Project and arising from property damage or bodily injury including death to any person or persons caused in whole or in part by the negligence or misconduct of the Provider except to the extent same are caused by the negligence or willful misconduct of the County. It is the intent of this provision to require the Provider to indemnify the County to the fullest extent permitted under North Carolina law. 9. Amendments to the Agreement a. Changes in Basic Services. Changes in the Basic Services and entitlement to additional compensation or a change in duration of this Agreement shall be made by a written Amendment to this Agreement executed by the County and the Provider. The Provider shall proceed to perform the Services required by the Amendment only after receiving a fully executed Amendment from the County. 10. This Agreement may be terminated without cause by the County and for its convenience upon seven (7) days’ prior written notice to the Provider. b. Other Termination. The Provider may terminate this Agreement based upon the County's material breach of this Agreement; provided, the County has not taken all reasonable actions to remedy the breach. The Provider shall give the County seven (7) days' prior written notice of its intent to terminate this Agreement for cause. c. Compensation After Termination. i) In the event of termination, the Provider shall be paid that portion of the fees and expenses that it has earned to the date of termination, less any costs or expenses incurred or anticipated to be incurred by the County due to errors or omissions of the Provider. ii) Should this Agreement be terminated, the Provider shall deliver to the County within seven (7) days, at no additional cost, all deliverables including any electronic data or files relating to the Project. d. Waiver. The payment of any sums by the County under this Agreement or the failure of the County to require compliance by the Provider with any provisions of this Agreement or the waiver by the County of any breach of this Agreement shall not constitute a waiver of any claim for damages by the County for any breach of this Agreement or a waiver of any other required compliance with this Agreement. e. Suspension. County may suspend the Basic Services and this Agreement at any time for County’s convenience and without penalty to County upon three (3) days’ notice to Provider. Upon any suspension by County, Provider shall discontinue work on the Basic Services and shall not resume the Basic Services until notified to proceed by County. 11. Additional Provisions a. Limitation and Assignment. The County and the Provider each bind themselves, their successors, assigns and legal representatives to the terms of this Agreement. Neither the County nor the Provider shall assign or transfer its interest in this Agreement without the written consent of the other. b. Governing Law. This Agreement and the duties, responsibilities, obligations and rights of respective parties hereunder shall be governed by the laws of the State of North Carolina. By executing this Agreement Provider affirms that Provider and any subcontractors of Provider are and shall remain in compliance with Article 2 of Chapter 64 of the North Carolina General Statutes. By executing this Agreement Provider certifies that Provider has not been identified, and has not utilized the services of any agent or subcontractor identified, on the list created by the State Treasurer pursuant to G.S. 147-86.58. By executing this Agreement Provider certifies that Provider has not been identified, and has not utilized the services of any agent or subcontractor identified, on the list created by the State Treasurer pursuant to G.S. 147-86.81. Provider shall at all times remain in compliance with all applicable local, state, and federal laws, rules, and regulations including but not limited to all state and federal non-discrimination laws, policies, rules, and regulations and the Orange County Non-Discrimination Policy and Orange County Living Wage Policy (each policy is incorporated herein by reference and may be viewed at http://www.orangecountync.gov/departments/purchasing_division/contracts.php.) Any violation of the Orange County Non-Discrimination Policy is a breach of this Agreement and County may immediately terminate this Agreement without further obligation on the part of the County. This paragraph is not intended to limit and does not limit the definition of breach to discrimination. d. Dispute Resolution. Any and all suits or actions to enforce, interpret or seek damages with respect to any provision of, or the performance or non-performance of, this Agreement shall be brought in the General Court of Justice of North Carolina sitting in Orange County, North Carolina. It is agreed by the parties that no other court shall have jurisdiction or venue with respect to such suits or actions. Binding arbitration may not be initiated by either Party, however, the Parties may agree to nonbinding mediation of any dispute prior to the bringing of such suit or action. e. Entire Agreement. This Agreement represents the entire and integrated agreement between the County and the Provider and supersedes all prior negotiations, representations or agreements, either written or oral. This Agreement may be amended only by written instrument signed by both parties. Modifications may be evidenced by facsimile signatures. f. Severability. If any provision of this Agreement is held as a matter of law to be unenforceable, the remainder of this Agreement shall be valid and binding upon the Parties. g. Ownership of Work Product. Should Provider’s performance of this Agreement generate documents, items or things that are specific to this Project such documents, items or things shall become the property of the County and may be used on any other project without additional compensation to the Provider. The use of the documents, items or things by the County or by any person or entity for any purpose other than the Project as set forth in this Agreement shall be at the full risk of the County. h. Non-Appropriation. Provider acknowledges that County is a governmental entity, and the validity of this Agreement is based upon the availability of public funding under the authority of its statutory mandate. In the event that public funds are unavailable and not appropriated for the performance of County’s obligations under this Agreement, then this Agreement shall automatically expire without penalty to County immediately upon written notice to Provider of the unavailability and non-appropriation of public funds. It is expressly agreed that County shall not activate this non-appropriation provision for its convenience or to circumvent the requirements of this Agreement, but only as an emergency fiscal measure during a substantial fiscal crisis. In the event of a change in the County’s statutory authority, mandate and/or mandated DocuSign Envelope ID: FDEE3CE5-2218-4290-8CC7-E06D1211E72A Revised 11/19 7 functions, by state and/or federal legislative or regulatory action, which adversely affects County’s authority to continue its obligations under this Agreement, then this Agreement shall automatically terminate without penalty to County upon written notice to Provider of such limitation or change in County’s legal authority. i. Signatures. This Agreement together with any amendments or modifications may be executed electronically. All electronic signatures affixed hereto evidence the consent of the Parties to utilize electronic signatures and the intent of the Parties to comply with Article 11A and Article 40 of North Carolina General Statute Chapter 66. j. Notices. This work will produce documentation required for the County and its selected construction contractor to procure materials and construct both outside plant (OSP) and inside plant (ISP) portions of the network. This proposal anticipates a single railroad crossing will be required to complete the fiber extension. CTC will take into account future needs when identifying the optimal crossing location, such as potential connectivity to the Park Operations Center. The engineering services, along with the resulting Engineering Work Documents (EWD), will cover the following tasks as required: •Site surveys •Path and facility-entrance designs •Desktop designs of OSP •Right-of-way (ROW) field surveys and walk-out maps •Desktop review of proposed routes over available environmental and wildlife mapping •Pole license applications and tracking support for construction contractor •CAD construction plans and permit application drawings •Engineering detail sheets/‘typicals’ (i.e., the standard set of required construction parameters, covering details such as depth of trenching and type of handhole, that will accompany all engineering prints) •ROW permit services •Material specifications •Bill of materials (BOM) •As-built documentation support We describe our tasks in detail below: Task 1: Site Surveys An experienced CTC engineer will perform comprehensive site visits at Public Works and Animal Services facilities. This proposal assumes the County will facilitate access to both sites and that appropriate building representatives will be available during both surveys to ensure the design is acceptable to the building owners. CTC will coordinate in advance with County staff for site access. Path verification and building points of entry and demarcation will be verified for constructability. Specific designs communicated by the local facility point of contact will be noted. CTC will develop a design drawing for the facility-entrance and ISP pathway. The designs will include site photos depicting the point of demarcation, fiber pathways, and barriers to DocuSign Envelope ID: FDEE3CE5-2218-4290-8CC7-E06D1211E72A CTC Proposal to Orange County – Public Works to Animal Services Page 2 construction along the route. The designs will also incorporate engineering field notes and the site’s existing facility plans (if available). Task 2: Desktop Design and Field Verification Using local base maps, as-built plans, fiber allocation maps, aerial imagery route maps, and any additional guidance received from the County, CTC will conduct a desktop design prior to a field verification and survey of the fiber routes. This proposal assumes the County will provide any available data in advance of the field survey. The CTC engineer will walk out the routes and will photograph, survey, and take detailed notes via a GPS device on all relevant physical features relating to OSP construction. CTC uses state-of- the-art field survey equipment, including Trimble Geo 7X handheld GPS receivers and related software (Trimble Pathfinder Office and TerraSync), to automate the OSP engineering and GIS surveying processes. A walkout map of the route will be designed and produced in ESRI ArcGIS. (See the figure below for a sample walkout map.) The field survey will include measuring features within the ROW for placement of aerial strand and underground conduit, and recording other pertinent details, including: x Utility poles x Slack storage x Storm drains and culverts x Edge of pavement x Municipal facilities x Street lights and signal poles x Splice cases x Equipment cabinets x Vaults and pedestals x Existing third-party utilities x Attachment heights x Green space x Pole attachments The information listed above will be recorded from visual observation while the survey is conducted, and those items necessary to aid in construction will be documented in the construction plans. CTC’s engineer will note any potential barriers to construction, as well as potential route improvements, and will also determine what permits will be needed to construct the fiber. DocuSign Envelope ID: FDEE3CE5-2218-4290-8CC7-E06D1211E72A CTC Proposal to Orange County – Public Works to Animal Services Page 4 Using the information from the survey, our team will complete a desktop review to identify and avoid potential impact to environmentally sensitive areas and vulnerable wildlife species. The scope of this proposal does not include wetland delineations or environmental permitting; however, we will advise the County as to our desk review findings and any likely areas of environmental permitting identified by our review. Moreover, CTC will support initial consultations with environmental permitting authorities that may be necessary to determine permitting requirements. Task 3: CAD Design of Routes and Generation of BOM Once designs are reviewed and accepted by the County and additional stakeholders, CTC’s team will convert the walkout map drawings and the GIS data collected into AutoCAD drawings (see figure below for a sample). The drawings will include: •Running line of fiber •Position of existing utility poles •Road names •Railroad crossings •Bridges •Fixed markers/significant landmarks (e.g., fire hydrants, valves, poles) •Environmental protected areas (e.g., wetlands, bodies of water) •Flood plains •Easements •Rights-of-way •Any applicable public utilities or assets •Any applicable private utilities or assets •Termination points, coils, vaults, splices •Fiber entry and installation, as applicable CTC will provide a preliminary set of design drawings to the County for a single round of review and input. After feedback has been provided, CTC will update the design drawings and provide a final set of CAD documents to the County. Additionally, CTC will generate a BOM detailing the type and quantities of materials needed by the construction contractor to build the engineered design. CTC will review preliminary material specifications with the County, and will provide recommendations prior to finalizing the BOM, as appropriate. DocuSign Envelope ID: FDEE3CE5-2218-4290-8CC7-E06D1211E72A CTC Proposal to Orange County – Public Works to Animal Services Page 5 Figure 2: Sample Design Drawing Task 4: Permit Applications This proposal assumes that three separate permits will be required to extend fiber infrastructure from Public Works to Animal Services: one municipal ROW permit, one NCDOT ROW permit, and one railroad crossing permit. Upon the completion of CTC’s field verification work, we will prepare a complete list of required permits. Any special permits, such as railroad crossings (e.g., ROW and encroachment permits) and bridge attachments, will also be prepared to complete the engineering services, but may require additional input and discussion with the County and the appropriate permitting agency/organization. We note that some special permits may require one-time and/or ongoing payments directly from the County to the applicable permit authority. CTC will initiate and manage the submissions of all required permits and will track each application through to approval. To ensure the timely approval of permit applications, CTC will be prepared to quickly follow up on issues raised by the permitting authorities. When an issuing entity identifies any concerns in its initial review of a permit application, the reviewer will typically return the plans, send an e-mail about the issue, or call the engineer or project manager to discuss the concern. If an application or portion of an application is returned, CTC staff will discuss the necessary changes internally, then make appropriate revisions and resubmit the application (as needed), or simply e-mail or call the permit reviewer to provide the information DocuSign Envelope ID: FDEE3CE5-2218-4290-8CC7-E06D1211E72A CTC Proposal to Orange County – Public Works to Animal Services Page 6 requested. The scope of this proposal anticipates that at most one round of revisions would be required per permit application submitted. Task 5: As-builts and Fiber Optic Performance Test Data Review Engineering revisions necessary due to changes in the County’s functional requirements or other factors will be documented by the construction contractor. We anticipate the County will require its construction contractor to provide “redlines” of construction prints and/or electronic data detailing final as-built conditions, such as: x Cable slack coil lengths / fiber cable sequential footage markings x Conduit placement depth and/or offset measurements; x GPS coordinates of handholes x GPS coordinates of conduit paths and/or location data from directional boring guidance systems CTC will produce final as-built revisions to applicable EWDs, to include construction CAD prints, GIS data, and splice matrices/schematics. Task 6: Construction Bid Support CTC will assist the County through a competitive bid process for the construction of the County fiber network. Specifically, CTC will assist with the preparation of a Request for Proposal (RFP) for construction of the network based on County-approved engineering designs, to include technical specifications, scope of work language, and evaluation criteria. We anticipate these materials will be based substantially on permit-ready EWD materials prepared as part of Task 3. We anticipate that the completed bid document will serve as a template for future fiber construction projects. Further, CTC will assist in responding to vendor questions during the bid process and/or preparing addenda to the RFP, as needed. Task 7: Construction Oversight CTC will serve as the County’s representative overseeing the performance of the selected fiber construction Contractor to the extent needed to augment the County’s own project manager and/or inspectors. County of Westminster, Maryland Dr. Robert Wack, Former Common Council President (443) 340-3227, rwack1@comcast.net CTC prepared a fiber feasibility study and business case for the County of Westminster in 2012 and 2013. Our report, which included a technical design and cost estimates for a Countywide FTTP deployment, led to the implementation of two last-mile FTTP pilot projects (one focused on residential customers, one focused on businesses). Following the success of the County’s pilot projects, and ultimately the funding approval for the Countywide FTTP deployment, CTC continues to support the ongoing FTTP deployment over a range of tasks spanning fiber infrastructure engineering, network design, construction bidding, construction oversight, and quality assurance inspection. We also assisted the County in identifying a private partner to assume operating risk in providing services to the public over the County’s FTTP infrastructure; the County announced its public– private partnership in 2015.1 Town of Holly Springs, North Carolina Mr. Jeff Wilson, IT Director (919) 567-4013, jeff.wilson@hollyspringsnc.us CTC conducted a broadband needs assessment and developed a strategic approach and return on investment (ROI) analysis for the town’s proposed fiber network implementation. Our team of project managers, outside plant engineers, and network engin eers then designed and oversaw implementation of a middle-mile fiber network serving the town’s community anchor institutions (e.g., schools and libraries) and major economic development partners. The first sites on the 19- mile network went live in June 2014. In 2010 to 2012, CTC provided OSP engineering for a federally funded project to connect community anchor locations (e.g., government buildings, schools) and expand the county’s fiber infrastructure. The engineering for that project totaled over 70 miles, and included a rural FTTP network in the southern portion of the county. In 2015, CTC provided OSP engineering for a county-funded project to connect schools and traffic signal locations and further extend the county-built fiber infrastructure by 90 miles. CTC’s work on both projects included field surveys, generating engineering prints and bills of materials, network and splicing design, permitting, and acceptance testing. CTC also developed RFP language for OSP construction and fiber maintenance. CTC currently provides the county with ongoing engineering support for various last mile engineering projects and provides construction oversight and QA/QC work for the county. Arlington County, Virginia Mr. David Doulong, Engineering and Construction Manager, ConnectArlington (703) 228-7585, ddoulong@arlingtonva.us CTC currently is designing and managing the construction of ConnectArlington, the last-mile fiber network that will connect approximately 80 of the County’s government buildings, schools, and public safety facilities. CTC staff members, including an on-site project manager, are overseeing every aspect of the project, from network mapping to construction supervision and acceptance. CTC has also developed the business plan and strategy for the County's dark fiber leasing initiative, and is currently preparing an RFP for the County's use in selecting a fiber broker. This third-party broker innovation is the first of its kind among public entities in the United States. At the FiberNet manager’s direction, the team lead spends up to 20 hours per week at the FiberNet offices, supporting the FiberNet team on a range of significant short- and long-term design and planning engagements. CTC developed the initial design and architecture, in collaboration with the Department of Public Works and Transportation, for the network that would later become FiberNet. We did this in response to the immediate need to support traffic communications and cameras—but also in response to what we saw as the County’s future needs for networking, video, data services, and the Internet. Later, during the County's cable TV franchise renewal, we identified as a high priority the need to obtain fiber-optic infrastructure from the cable operator; this outside plant would complement the County’s existing infrastructure and become part of FiberNet— and enable the County to have high availability services at a r easonable cost. As a result, the County has become a national leader in its network and enterprise capabilities. CTC also assists the County by providing support for the technological evolution of FiberNet, so it can better meet the growing customer demand caused by the growth of the network’s physical footprint. Recently, CTC completed a preliminary analysis of optical network hardware platforms based on a high-level understanding of growing capacity demands and emerging requirements across FiberNet’s increasingly diverse customer base. The analysis identified differentiating attributes among market-leading optical network platforms offering strategic advantages aligned with the County’s objectives, and developed baseline specifications and a system-level design for an initial upgrade phase. We also evaluated options for DTS to use FiberNet to expand service to Montgomery College and Montgomery County Public Schools. CTC also completed an Organizational Governance Study that evaluated County goals and objectives against its current operational, technological, and organizational structure; to recommend a series of changes to improve its value delivery and DocuSign Envelope ID: FDEE3CE5-2218-4290-8CC7-E06D1211E72A CTC Proposal to Orange County – Public Works to Animal Services Page 12 operational efficiency; and to better align its operations and financial performance to key stakeholder objectives. x UltraMontgomery: To support development of the County’s UltraMontgomery fiber infrastructure, CTC prepared a fiber market analysis, conducted a competitive assessment of the fiber market, developed a set of proposed in-building wiring standards, and identified a likely evolution path to guide the County’s planning. During the initial stages of this ongoing project, we identified opportunities to cost-effectively expand County fiber to serve the Great Seneca Science Corridor and White Oak Science Gateway, as well as to link the area near NIST to the Equinix Data Center in Ashburn, Virginia. x Maryland Inter-County Broadband Network (ICBN): CTC provided technical leadership and detailed outside plant design services for the ICBN. As the Portfolio Manager for this project, we oversaw and directed engineering and fiber network construction contractors—including the expansion of FiberNet with 132 additional miles of fiber constructed to 100 new sites. x NCRnet: Through our engineering, planning, and integration efforts, the County continues to maximize the benefits of its interconnection with the National Capital Region interoperability network—supporting public safety, video conferencing, and other applications and ensuring reliable communications across jurisdictions. x Cable: We also provided engineering and strategic support to DTS and the Cable Office during the cable TV franchise renewals. We provided the ongoing technical oversight of the Comcast, RCN, and Verizon cable systems, including regular tests and field inspections, tests, and developing data and recommendations in support of the County’s franchise enforcement and renewal processes. We oversaw the twice-yearly FCC proof- of-performance. Our ongoing support of the County’s technical needs has included assisting the County in responding to economic development initiatives, such as planning fiber and broadband in downtown Silver Spring and strategies to bring broadband to unserved areas. We have also identified ways to support Montgomery County Public Schools and Montgomery College, and supported the implementation of public safety applications such as automatic vehicle location. His expertise includes emerging fiber and wireless technologies and state-of-the-art networking applications. As Director of Engineering, he oversees all engineering work performed by CTC Technology & Energy. He is a licensed Professional Engineer in the states of California, Delaware, Illinois, Maryland, and Virginia. He has over 19 years of engineering experience designing, developing, installing, and overseeing construction and integration of middle mile networks and last-mile fiber-to-the- premises (FTTP), in particular local and wide area networks for institutional, public safety, and Intelligent Transportation System (ITS) applications, video-networking solutions, and unified communications systems. Mr. DeHaven has experience at many levels of network design, procurement, and implementation for high-capacity metropolitan-area networks to support converged video, voice, and data communications. He leads network designs and the preparation of specifications for competitive bid processes, serves as project manager overseeing implementation and testing for a wide range of government clients. Mr. DeHaven prepares designs and cost models to support decision-makers in the deployment of a range of data network technologies, traditional telephone systems, voice-over-IP (VoIP) networks, one-way video distribution, and two-way videoconferencing. His data network experience includes work with a wide range of fiber optic, copper, and wireless technologies. He serves as CTC’s lead engineer on numerous wide area network projects. Among many other projects, he served as a one of the primary technical architects for the 19 jurisdiction fiber optic/microwave network currently deployed in the National Capital Region (NCRnet) to support public safety interoperable communications. Fiber-to-the Premises (FTTP) Mr. DeHaven has assisted in the planning and deployment of dozens of FTTP networks for public sector clients, providing expertise in varying roles from the development of system-level designs and cost estimates to detailed engineering and construction oversight. He led the engineering team responsible for the design of a rural FTTP network in southern Anne Arundel County, Maryland to serve more than 600 homes within a previously unserved neighborhood. Inter-County Broadband Network Originally serving as part of the grant application development team that successfully led the State of Maryland to a $115 million Broadband Technology Opportunities Program (BTOP) administered by the National Telecommunications and Information Administration (NTIA), Mr. DeHaven served as the Portfolio Manager for the One Maryland Inter-County Broadband Network BTOP grant project. The ICBN is a nine-jurisdiction consortium in central Maryland led by Howard County, Maryland, and was a key sub-recipient of the State’s grant award. Wireless Communications Mr. DeHaven assesses clients’ existing and projected wireless broadband needs and recommends potential strategies for using new technologies to enhance and improve network operations and services. Some select examples of his ongoing and past projects include: x Engineering support of the ongoing deployment of a Countywide 4.9 GHz public safety radio mesh network for the County of Port Angeles, WA. CTC conducted a needs assessment of the County’s network and reviewed public safety mobile data communications considerations, which led to the development of network specifications and overseeing the procurement for the expansion of the County’s fiber network and a Countywide wireless network serving both public safety and public access needs. x Developed a strategic plan for a wireless data network to meet public safety and local government needs in Seattle, WA. Public Safety Networking In addition to supporting the design and deployment of NCRnet, Mr. DeHaven is the lead engineer responsible for one of the key applications leveraging this regional network. He has previously provided program-level support and project management for the $115 million statewide One Maryland Broadband Network (OMBN) project.
