BACKGROUND: Request Applicant: Phil Post of Philip Post ~ Associates, agent for Perry's Construction Corporation • 50.93 acre tract +/- Fifty-eight (58) single-family residential lots on the conservation-cluster flexible development option Average lot size = 15,fi47 square feet Proposed open space = 24.03 acres (47% of site) Location • Cheeks Township • North side of US Hwy 70 West between Efland-Cedar Grove Road (SR 1004) and Richmond Road (SR 1312) Existing Site Conditions Land Use: • 10 Year Transition Zoning: • Rural Residential (R-1 ); Upper Eno-Protected Watershed • Adjacent Land Uses: Single-family residential, church, firehouse, undeveloped lots Physical Description: • Gently sloped land with a few scattered rock outcrops near high points on the site 2 • Approximately two-thirds (2/3) of the site is covered with 12-to 18-inch hardwoods • McGowan Creek flows diagonally across the northern end of the tract • There is floodplain associated with this section of McGowan Creek • A USGS blue-line stream meanders through the southern portion of the tract • An intermittent stream in the southeast portion of the site drains into the USGS blue-line stream Proposed Site Conditions Roads: • The subdivision will be accessed from US Hwy. 70 West • All seven roads (Ashwick Drive, Glenwick Drive, Norwich Court, Farris Wick Place, Chadwick Lane, Benwich Lane, and Straywick Court) will be public and constructed to NCDOT standards • Residential Lots: • Fifty-eight (58) single-family residential lots per the conservation-cluster flexible development option • Average lot size = 15,647 square feet; Gross average lot size = 38,243 square feet • Minimum lot size per R-1 Zoning District = 40,000 square feet (0.92 acre) • Minimum lot size for cluster option (a lot size reduction of up to 65%) = 14,000 square feet • Minimum to actual lot size ratio (MTAR) = 1.12 • Maximum number of lots permitted by R-1 zoning = 55 + 7 (density bonus**) = 62 _ • One additional lot is allowed per each additional acre of protected open space (Orange County Subdivision Regulations, Section IV-B-10, G, ,Flexible Development Standards) • Impervious Surface limit for Upper Eno PW = 12% Open Space: • Proposed open space = 24.03 acres (47% of site) • Most of the open space serves as a buffer for McGowan Creek • Minimum open space required for Flexible Development = 16.81 acres (33% of site) • Bonus open space = 7.23 acres** Buffers: • 100-foot open space or building buffer area along the site perimeter and between the subdivision and any off-site public street right-of--way (per Section IV-B-10, D2, Flexible Development Standards) • 75-foot Type-E Land Use Buffer is required along US Hwy 70 West • Type-E Buffer = a buffer composed of predominately (at least 75%) evergreen vegetation that is opaque to a height of at least thirty feet • 100-foot building buffer satisfies the Type-E Land Use Buffer (width) requirement • Typical lot landscape plan specifies primary and secondary tree protection areas Recreation ~ Parks: Public Recreatiion Space • Cheeks Township District Park (per the Recreation Service Area Boundaries Map) • All subdivisions (located within a floodplain) must provide a minimum of 1/20 acre of recreation space per lot (Section IV-B-7-b) • A minimum of 2.9 acres (126,324 square feet) of land is required for public recreation space • Or a payment in-lieu-of parkland dedication = $26,390 ($455 * 58 lots) 3 • The applicant has offered 4.46 acres (194,278 square feet) of land along the northern side of McGowan Creek. The location and amount of the proposed dedication is consistent with the County's objectives to preserve natural areas and provide public recreation space. Private Recreation Space • All subdivisions must provide a minimum of 0.028 square feet of recreation space per every square foot of land area dedicated far residential use (Articles 5.1.1 8~ 6.12 of the Orange County Zoning Ordinance, outline Land Use Intensity (LUI) requirements) • 0.028 * 46 = 1.29 acres (56,192 square feet), (46.03 =Total area (50.92) -rights-of- way (4.89)) • In those cases where the LUI calculation results in a larger amount than the public recreation space requirement of 1/20 acre per to#, the difference shall be established as private recreation space for the use of the residents of the development • No private recreation space is required (LUI calculation (1.29) is less than the public recreation space requirement (2.9)) Water-Sewer: • All lots to be served with Orange-Alamance water and Orange County sewer • Final number of proposed lots does not exceed the number approved with the concept plan Agency Comments • Requests for agency review were sent to: NCDOT, Recreation and Parks, Orange County Schools, Soil and Water Conservation, Erosion Control, the County Attorney, and the. Fire Marshal. Comments are attached. Development Process~Schedule, and Action • First Action: Planning Board to consider Concept Plan The Planning Board approved the flexible development concept plan for Ashwick on September 6, 2000 with the following conditions: 1. The size and boundary locations for both parent tracts shall be verified with Orange County Land Records and any discrepancies resolved prior to filing for preliminary plat approval: 2. A left turn lane, built to NCDOT standards, shall be required on US 70 to access the subdivision. . 3. All roads shall be public and proposed to be built to NCDOT standards with additional five (5) foot utility easements on each side. The right-of-way at street intersections shall be improved to NCDOT standards. Sight distance triangles (10' x 70') shall be delineated on the plat for each street at intersections, as appropriate. 4. The Benwich Lane right-of--way shall extend to the northwestern, external property line of the subdivision in the proximity of lots 31, 35, and 34. A conveyance of a 50-foot right-of- way with 20-foot construction easements on each side of this northwestern most portion of Benwich Lane is acceptable in-lieu-of construction. 5. Driveway access points shall be a minimum of 50 feet from the intersection of street rights-of--way. 6 All corner lots shall be designed to access from the street with lower traffic volume: i.e. lot 6 to Farnswick Place, lots 7 and 21 to Glenwick Lane, lot 31 to Straywick Court, lot 43 to Benwich Lane, and lots 48 and 58 to Chadwick Lane. 4 7. If an entrance sign is anticipated and will not be placed within the 100-foot building buffer, maintained by the Homeowners Association, a sign easement must be reserved within one of the residential lots. 8. All common areas (stream buffers, building buffers, landscape buffers) must be clearly identified on the preliminary and final plats and maintained by the Homeowners Associatian. The common areas cannot be subdivided or recombined with adjacent lots. Draft forms of the Homeowners Association documents, including restrictive covenants and conservation easements, that contain use and maintenance provisions for the open space and buffers must be submitted for review by the County Attorney as part of the preliminary plat approval process. The restrictive convenants or conservation agreement shall designate a backup grantee in the event that the Homeowners Association is eliminated. 9. The developer shall submit documentation granting the use of public water and sewer services prior to filing for preliminary plat approval. 10. The preliminary plat shall indicate areas for on-site infiltration of storm water that demonstrates compliance with Article 6.23.3a of the Orange County Zoning Ordinance. 11.The location of all drainage ways, stream. buffers and floodplains shall be delineated on the preliminary and final plats, along with appropriate information regarding restrictions. 12. The preliminary plat shall show a building footprint on the approximate location of each house site to ensure that there is sufficient buildable area on every proposed residential lot. 13. The preliminary plat shall show the location of tree protection fencing and contain a note requiring the installation of tree protection fencing prior to any grading to ensure the _ protection of vegetation within all buffers and open space. 14.The preliminary and final plats shall contain a note restricting further subdivision. 15.The applicant shall dedicate a minimum of 2.9 acres (1/20 acre per residential lot) for public recreation space as part of the preliminary plat approval process. (Section IV-B-7_ b Recreation Sites, Orange County Subdivision Regulations) 16.A11 street names to be reserved with GIS section of Planning Department prior to submittal of preliminary plat subdivision request. • Second Action: Planning Board to consider Preliminary Plat The Planning Board recommended approval of the preliminary plat for Ashwick on December 6, 2000 in accordanc® with the attached Resolution for Approval. • Third Action: Board of County Commissioners to consider Preliminary Plat 1. The Board shall consider the application within a reasonable amount of time. 2. During deliberations and consideration of the application the Board may defer consideration at any point to pursue additional analysis and review. 3: If the Preliminary Plat is approved by the County Commissioners the applicant shall have one (1) year to prepare and file a Final Plat or to request aone-year extension from the Planning Director. FINANCIAL IMPACT: Fiscal Impact Analysis (attached) RECOMMENDATION(S): Administration Recommendation The Administration recommends that the Board; 5 (1) Approve the Sewer Service Extension Agreement for Ashwick subdivision per the Orange County Sewer Collection and Treatment Service Rules and Regulations adopted on November 19, 1985 and Section IV-B-6-b of the Subdivision Regulations. (2) Approve the Ashwick subdivision preliminary plan with the Board of County Commissioners selected sewer system option and the conditions contained in the attached Administration Resolution of Approval. Planning_Board, Recommendation December fi, 2000 The Planning Board recommends approval in accordance with the attached resolution. (Vote: 6-1) Staff Recommends ion The Planning Department Staff recommends approval in accordance with the attached resolution. 6 RESOLUTION OF THE ORANGE COUNTY BOARD OF COMMISSIONERS TO APPROVE THE SEWER SERVICE EXTENSION AGREEMENT FOR ASHWICK SUBDIVISION WHEREAS, the Board of County Commissioners established an Overall Sewer Policy far the County of Orange to determine the extent of future public sewer service, and WHEREAS, the Board of County Commissioners adopted the Sewer Collection and Treatment Service Rules and Regulations on November 19, 1985, and WHEREAS, Provision IX of the Rules and Regulations, EXTE S NS OF THE SYSTEM, outlines six criteria to determine to whether or not the County shall extend the system to serve undeveloped land, and WHEREAS, the proposed Ashwick subdivision meets all six of the following criteria: A. Extending service to Ashwick subdivision is consistent with the overall System plan adopted by Orange County. Extension is subject to the County Engineer's approval. B. All regulations of the Orange County Zoning Ordinance and Subdivision Regulations have been met by the preliminary plat for Ashwick subdivision. The property is located within the transition area along the Highway 70 West corridor. The extension of public services within the 10-year transition area is consistent with the Land Use Element of the Comprehensive Plan and other long-term goals for county planning. The Orange Caunty Engineer has reviewed and approved the engineering components of the preliminary plat with regards to water and sewer service. The County Engineer has approved preliminary plans for the sewer service extension. C. Extension of the System around the Elfand community is consistent with Goal 9.3 of the Orange County Land Use Plan, which prohibits the establishment of public water and sewer services in the areas designated as water quality critical areas .except to address emergency situations. The proposed subdivision is outside of the Upper Eno Critical Area. D. The System extension shall be installed according to and in compliance with approved plans. E. The construction of the System extension will be inspected by Orange County at intervals determined by the County. Perry Construction Corporation agrees to permit access to the, System and the System extension for inspection purposed. 7 User connections to the System will only be permitted after the extension of the System is finally approved in writing by Orange County. F. Upon the completion of the System extension Perry Construction Corporation will convey to Orange County by deed or other appropriate instrument all portions of the System extension, including by not necessarily limited to right-of--way easements, collection lines, service lines, stub-outs, permits, pump stations and equipment. All System extensions will be at no cost to Orange County. NOW, THEREFORE, BE IT RESOLVED, That the Board of County Commissioners hereby approves the extension of the Orange County Sewer Collection and Treatment System serving the Efland areas of Orange County for Ashwick sudivision as shown on the preliminary plat dated April 4, 2000 (last revised October 26, 2000). The County agrees to extend public sewer service to Ashwick subdivision per the Orange County Water & Sewer Policy approved on April 3, 1989 (and last amended on September 3, 1991), and the Sewer Collection and Treatment Service Rules and Regulations adapted on November 19, 1985. Halkiotis, Chair County of Orange Board of Commissioner; WITNESS: Beverly Blythe Clerk to the Board 8 RESOLUTION OF THE ORANGE COUNTY BOARD OF COMMISSIONERS TO APPROVE ASHWICK SUBDIVISION PRELIMINARY PLAN Date May 15, 2001 Name of Subdivision Ashwick Owner/Applicant Perry's Construction Corporation The Board of County Commissioners hereby approves the Preliminary Plan for Ashwick subdivision as shown on the preliminary plat dated April 4, 2000 (last revised October 26, 2000) and subject to fulfillment of requirements specified herein. All roads shall be irrevocably dedicated to the general public and be constructed to standards of the North Carolina Department of Transportation (NCDOT). The approval of this resolution authorizes and directs the Orange County Manager to accept for the County and on behalf of the public generally, the offer ofi dedication of Ashwick Drive, Glenwick Drive, Norwich Court, Fams Wick Place, Chadwick Lane, Benwich Lane, and Straywick Court. This acceptance of dedication to the general public shall be without maintenance responsibility. These roads shall be maintained by the owner/applicant (Peny's Construction Corporation) until such time as they are accepted for maintenance by NCDOT or some other governmental body. Before the Final Plat of Ashwick Subdivision can be recorded: A. Sewage Disposal and Water System 1. Each residential lot shall be provided a sewer line stub out in accordance with Orange County sewer connection guidelines. 2. Sewer line construction drawings shall be approved by the County Engineer prior to submittal to NCDOT or any state regulatory agencies for permitting or approval. Sewer shall be designed in such a way to allow far future extension of lines to adjacent properties as outlined in Section IV-B-6-a and IV-B-6-b of the Orange County Subdivision Regulations. The proposed 25-foot easement crossing McGowan Creek shall be dedicated for future sewer extensions and for temporary public access to the public recreation space until that future time when other forms of public access are available. Any changes in design to comply with requirements from either NCDOT or other agencies shall also be approved by County Engineer. Sewer lines and sewer system improvements shall be constructed as provided herein prior to final plat approval. OR A letter of credit or escrow agreement or other security shall be submitted to secure construction the sewer system to Orange County standards. An estimate of the construction cost must be prepared by a certified/licensed engineer and submitted to the Orange County Planning Department and County Engineer. The financial guarantee must reflect 110 percent of that estimate and be issued by an accredited financial institution licensed to do business in North Carolina. The document describing development restrictions to be recorded with the Final Plat shall state that the financial guarantee will not be released until the sewer system construction has been inspected and approved by Orange County. 3. All existing and proposed sanitary sewer easements to be dedicated to Orange County shall be shown on the preliminary and final plats. The developer shall submit a copy of a letter from the County Engineer certifying that all sanitary sewer lines have been installed per the approved plans and dedicated to Orange County prior to the issuance of any building permits. As-built drawings shall be submitted to and approved by County Engineer prior to issuance of the first certificate of occupancy. 4. Each residential lot shall be provided water line stub aut in accordance with Orange-Alamance Water System connection guidelines. 5. Water line construction drawings shall be approved by the Orange-Alamance Water System, Inc. prior to submittal to NCDOT or any state regulatory agencies for permitting or approval. The document describing development restrictions to be recorded with the Final Plat shall state that the financial guarantee will not be released until the water system and hydrant construction has been inspected and approved by Orange- Alamance-Water System, Inc. and the Orange County Fire Marshal. 10 5. All fire hydrant locations, fire flow and water line pressures shall be approved by the Orange County Fire Marshal prior to issuance of the first certificate of occupancy. 6. Sewer tap, acreage. access, availability. capital facility fees Sewer fees based on an acreage or a per lot charge shall be paid to Orange County prior to Planning Department signatures on the final plat. Sewer fees based on house size shall be paid to Orange County when obtaining individual building permits.. B. Roads and Access 1. Ashwick Drive, Glenwick Drive, Norwich Court, Farns Wick Place, Chadwick Lane, Benwich Lane; and Straywick Court shall be constructed to NCDOT minor local standards with a 50-foot right-of--way and 5-foot utility easements on each side. Canstruction shall be inspected and approved by NCDOT. OR A letter of credit or escrow agreement or other security shall be submitted to secure construction of Ashwick Drive, Glenwick Drive, Norwich Court, Fams Wick Place, Chadwick Lane, Benwich Lane, and Straywick Court to NCDOT standards. An estimate of the construction cost must be prepared by a certified/licensed engineer or grading contractor and submitted to the Orange County Planning Department. The financial guarantee must reflect 110 percent of that estimate and be issued by an accredited financial institution licensed to do business in North Carolina. 2. An erosion control plan for the entire project, including streets, shall be submitted by the applicant for review and shalt be approved by the Orange County Erosion Control Division prior to any disturbance on the site. The Erosion Control Plan shall include a stormwater management plan that meets the requirements of both the County and the Neuse River Basin rules. 3. Prior to any construction or any alteration of any existing access within the right- of-way of US Hwy. 70 West, the developer/owner shall secure a driveway permit from the NCDOT District Office. The applicant shall submit a copy of the NCDOT permit and approval letter to the Planning Department when requesting Planning Department signatures on the Final Plat. Sight distance triangles shall be shown at all intersections within the subdivision, or included within the right-of--way of the proposed street. This restriction shall be stated in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. 4. All lots shall secure access from streets internal to the subdivision. Lots with frontage on more thane one road shall be designed to access from the street with lower traffic volume: i.e. lot 1 and 6 to Farnswick Place, lots 7 and 21 to Glenwick Lane, lot 31 to Straywick Court, lot 43 to Benwich Lane, and lots 4$ and 58 to Chadwick Lane. Driveway cuts shall be a minimum of 50 feet from street intersections. These restrictions shall be stated in a document describing development restrictions and requirements to be prepared by Planning Staff and 11 recorded concurrently with the final plat. Non-vehicular access easements (NVA)--areas where vehicles are prohibited from traveling--shall also be shown on the final plat. 5. Approved street name signs shall be erected at the intersection of streets as required in Section IV-B-3-c-12 of the Orange County Subdivision Regulations. Evidence shall be submitted by the applicant that the signs are in place or a copy of the receipt for purchase of the signs shall be submitted to the Planning Department at time of request to record the Final Plat. 6. The applicant shall dedicate, in fee simple, an additional 20 feet or 50 feet from the centerline of the existing right-ofi way whichever is greater, along the entire frontage of US Hwy 70 West to the North Carolina Department of Transportation for future road improvements. The dedication shall be shown on final plat. Property lines to stop at new public right-of-way. 7. The Benwich Lane right-of--way shall extend to the narthwestem, external property line of the subdivision in the proximity of lots 31, 3A~, and 35. A conveyance of a 50-foot rightof--way with 20-foot construction easements on each side of this northwestern most portion of Benwich Lane is acceptable in- lieu-of construction. C. Land Use Buffers and Landscaping 1. Landscaping shall be installed or preserved as indicated on an approved landscape plan and shall be inspected and approved by the Planning Department prior to Final Plat approval and again prior to the transfer of control of the Homeowners Association from the developer to the home owners as provided by the recorded Declaration of Covenants, Conditions and Restrictions for Highridge Subdivision. Landscaping shall include a 75-foot Land Use Buffer along US Hwy 70 West. OR A letter of credit or escrow agreement ar other security shall be submitted to secure the required landscape installation and preservation. An estimate of the cast for required preservation, new plantings, and their installation must be provided. The financial guarantee shall reflect 110 percent of the estimate and must be issued by an accredited financial institution licensed to do business in North Carolina 2. Provisions for the protection of existing trees as shown on the approved landscape plan shall be included in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Pla#. D. Drainage Impervious surface data for all lots, pursuant to Article 6.23 Extra Requirements for Watershed Protection Overlay Districts of the Orange County Zoning Ordinance, shall be included in the development restrictions and requirements 12 document to be prepared by Planning Staff and recorded concurrently with the Final Plat. The impervious surface limitations for each lot shall indicate whether the impervious surFace includes or excludes one-half (1/2) of the roadway width in the calculations. 2. Drainage easements shall be located on the Final Plat as required following review and approval of the Erosion Control Plan. 3. Drainage culverts shall be sized and located as required by NCDOT and the Orange County Erosion Control Officer. E. Parkland (Public Recreation Space) and Open Space 1. The proposed fifty-eight (58) lot subdivision is located within the Cheeks Township District Park area.' Per Section IV-B-7-b of the Orange County Subdivision Regulations, subdivisions (located within a floodplain) must provide a minimum of 1/2Q acre of recreation space per residential lot. Based on the number of proposed residential lots, the applicant shall dedicate a minimum of 2.9 acres (126,324 square f®et) to the County for public recreation space or submit an in-lieu of payment. The applicant has offered 4.46 acres (194,278 square feet) of land along the northern side of McGowan Creek. The location and amount of the proposed dedication is consistent with the County's objectives to preserve natural areas and provide public recreation space. The 4.46 acres of public recreation space shall be dedicated to the County during the construction of Phase 1. The applicant shall maintain a minimum of thirty- three (33) percent open space during all phases of construction. F. Miscellaneous 1. The Final Plat shall contain a title block and vicinity map in accordance with Section V-D-2 Title Block and V-D-3 V_icini_ Mao of the Orange County Subdivision Regulations. 2. The building buffer, stream buffers, minimum building setbacks, easements, public (along US Hwy 70 West), public and private open space areas shall be stated on the plat and in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. 3. Drainage easements shall be provided as required by section D. item 2. outlined above. 4. If any condition of this Resolution shall be. held invalid or void, the Resolution itself shall be void and of no effect. G. Certifications 1. A Certificate of Survey and Accuracy signed by a Professional Land Surveyor shall be notarized on the face of the Final Plat. 13 2. A Certificate of Declaration and Maintenance in the form provided in Section V-D- 6-b of the Orange County Subdivision Regulations signed by the landowners and developer shall be on the face of the plat and included in a document describing development restrictions to be recorded concurrently with the Final Plat. 3. The North Carolina Department of Transportation shall certify that all roads have been constructed to State standards or that construction plans have been approved. 4. A Certificate of Approval signed by the Orange County Planning and Inspections Department: NOW, THEREFORE BE IT RESOLVED, by the Board of Orange County Commissioners, that the Preliminary Plan for Ashwick subdivision is approved in accordance with the above mentioned conditions and attached Preliminary Plat dated April 4, 2000 and last revised October 26, 2000. The southern portion of site, as shown on the site aril utility plans date 4/4/2pOQ, is crossed by two branches of the sewer interceptor/outifall lines of the Eflarid sewer system. These lines may not be tapped for individual sewer services. However, new collector mains may be extended from existing manholes through the parcel to provide sewer service to individual lots. Furthermore, it may be possible in limited circumstances to connect individual service lines to existing manholes, although I discourage this practice and would allow this to occur only when other alternatives and connections are not practicable. The Post & Associates sewer utility site plan appears have followed the above criteria fairly closely. 'The site plan appears to show that sewer service will be provided via new gravity collector lines extended from existing manholes. The plan does not show any proposed sewer pumping/lift stations which, as you are.aware, would be at least somewhat problematic. There is or may ultimately be a minor final sewer design issue as to how service is extended to lots 8, 9 and 21, as these lots do not appear to front on the proposed collector lines; However, please be advised that, at this time and without sewer profile plans, I cannot verity or certify that the gravity sewer layout that is shown is actually a workable plan, In conclusion, I can state that: 1) the Efland sewer system can accommodate the sewer flow that can be projected from a 50 to 601ot subdivision; 2) the proposed sewer layout appears to conform to standard and acceptable engineering practice for gravity sanitary sewer layout; 3) nothing shown on the plans, as far as sewer layout is concerned, appears to be unacceptable in terms of general County or Efland sewer policies and practices; and 4) subject to all final design and state permitting requirements and approvals related to layout, materials, constriction and consnvction oversight practices, etc., and unless there is a significant flaw in the proposed collector layout, sewer service can be extended to the property as long as all County relative zoning, subdivision, land use, watershed, density, etc., ordinances and policies are satisfied. ~,, If I may provide additional information, please advise. From: :Rich Shaw, ERCD Land Conservation Manage - Date: November 30, 2000 Re: Ashvvick Subdivision (Cheeks Township) (TMBL 3.32.A.9 and TMBL 3.31.A.23) Thank you for the opportunity to review a plat the proposed Ashwick Subdivision (dated October 30, 2000). The following comments are intended to address any concerns with respect to impacts ~on natural and :cultural resources, and to identify areas that may desirable for possible dedication to the County for public recreation and open space pursuant to County subdivision regulations. My comments are based on an August 2, 2000 site visit and a review of resource information available for this property, including aerial photography, topographic maps, FEMA floodplain maps and NWI maps. The subject property is located in Efland_ on the north side of US 70 in Cheeks Township. The property is zoned R1 and is within the Upper Eno Watershed. McGowan Creek flows through the northern quarter the property, essentially cutting off about five acres from the majority of the parcel. McGowan Creek is flooded in this area due to the Efland Mill Pond dam located just downstream. There is also a sizable beaver dam, which contributes to flooding of the property. Aside from some periodic downed trees (likely from the May 2000 windstorm) the woodlands are comprised of fairly mature mixed hardwoods, which slope gentry down toward McGowan Creek. A small tributary of McGowan Creek flows through the southern portion of the property in a northeasterly direction. The property slopes fairly gently (2 to 6%) with a narrow band of moderately sloped land (6 to 10%) draining to McGowan Creek. Away from the Creek, the soils are Geo~geville silt /oam~(Ge8 and GeC) and Herndon si/t /oam (Hr8), both quite suitable for residential development. It appears that the proposed lots are well outside of the floodplain and avoid the small area of Lignum soils, which are unsuitable for home sites. The Preliminary Plan shows 4.46 acres located in the northeast corner of the property proposed for dedication to Orange County for "public recreation space." This area is considerably larger than the minimum required dedication of land for recreation and open space. The subdivision regulations call far a minimum of 2.9 acres for a S~-~ snit ~~ ihrfivicinn l1 /7.0 acre for each unit). Such a dedication would be consistent with my earlier suggestions that this small area, which is cut off from the more developable section south of McGowan Creek, be set aside for wildlife habitat and future recreation/open space needs. This area would be ;accessible from the proposed McGowan Creek Subdivision, which is planning ta:dedicate an adjacent linear area along the north side of McGowan Creek. Fnally, the proposed site plan appears consistent with the County's desire to minimize adverse environmental impacts with respect to the protection of floodplains, wetlands, natural areas and wildlife,habitat, historic and cultural resources and prime farmland. This study is for projects 5 that are either using independent wells or a community well system. This subdivision is proposing a 6 community well that would offer its share of water to Qrange-Alamance, so it would be a different type of 7 system. 8 9 Whitaker said that he is concerned about delaying the decision because there would probably not be any 10 resolution to the hydrological issue in another month. Regarding the school impact issue, the impact fees are 11 not determined until the building permit stage. He urged the board to make a decision tonight. 12 13 Katz asked about the water system for this subdivision and if it affected the water table differently than 14 individual wells. Whitaker said that this was an issue that was raised in the concept plan stage and Orange- 15 Alamance wants the well that would serve this subdivision in a remote location elsewhere. He said that, as a 16 rule, it is better to have single-point discharges from deep wells. 17 18 Holtkamp asked Whitaker if he was saying that the board should ignore the concerns from EMS about water 19 pressure and fire protection. Whitaker said that there were two. different components of water supply -basic 20 daily water needs and fire protection. He said that.he was not proposing that the fire hydrants be installed 21 immediately because there is a concern about water pressure. 22 23 Chair Allison said that this subdivision meets all of the requirements in the standards. He said that the 24 Planning Board did not have the authority to set up a moratorium on development. A left turn lane, built to NCDOT standards, shall be required on US 70 to access the subdivision. 33 3. All roads shall be public and proposed to be built to NCDOT standards with additional five (5) foot 34 utility easements on each side. The right-of--way at street intersections shall be improved to NCDOT 35 standards. Sight distance triangles (10' x 70') shall be delineated on the plat for each street at 36 intersections, as appropriate. 37 4. The Benwich Lane right-of-way shall extend to the northwestern, external property line of the 38 subdivision in the proximity of lots 31, 35, and 34. A conveyance of a 50-foot right-of-way with 20-foot 39 construction easements on each side of this northwestern most portion of Benwich Lane is acceptable in- 40 lieu-of construction. 41 5. Moon pointed out (on 37 the plan) that the proposal provided an internal pedestrian corridor_system including designated crosswalks. 38 39 Allison asked how this project would match up to the subdivisions to the west of the site such as Richmond 40 Hills,'and asked about the potential road connection from Benwich Lane to the Tinnin Road network. 41 McAdams also asked about the Benwich Lane stubaut. Benedict said that there were no plans to extend 42 Tinnin, but that the Ashwick design provides for a future link from Benwich to a private road to the 43 northwest. 44 45 Selkirk asked about access to the McGowan Creek public recreation area. Moon explained that access would 46 be from the north and would not interfere with the daily activities at the subdivision. 47 48 Phil Post, the project engineer and agent for Perry's Construction Company, said that they were in total 49 agreement with the staff stipulations. Post offered to answer any technical questions, particularly about 50 water lines and fire hydrants. 51 37 Holtkamp asked for a list of all of the developments in the Cheeks area, approved and proposed.
