PURPOSE: To clarify the Board's position on a request to extend the terms for three members
of the Board of Health.
BACKGROUND: On June 30, 2001, two members of the Board of Health will complete 2 full
terms on that Board. At the time these two members were appointed, they received letters,
which indicated that they would be eligible to serve three three-year terms as provided for by
the General Statute and which had been the Board's policy for appointments to the Board of
Health. Since that time the County Commissioners adopted guidelines for appointments to
County Boards and Commissions which limits the number of terms for any member of County
Boards and Commissions to two three-year terms. This policy may be waived if the Board of
Commissioners determines that the removal of an individual made ineligible by this policy would
be detrimental to the functioning of that board or commission.
FINANCIAL IMPACT: If these terms are not extended, the costs involved would be for
recruitment of a dentist and a physician to serve on this Board.
RECOMMENDATION (S): Options include the following:
• Approv.e extending the terms as requested by the Board of Health Chair Jonathan Klein
and as endorsed by Commissioner Carey;
• Extend the terms of the three Board of Health members by one year and add one year to
all terms of the remaining members to keep the terms staggered;
• Extend the terms of the three Board of Health members by three years and develop a
policy for implementing aone-year training period for all boards and commissions;
• Establish for selected permanent board and commission a one year training period to be
followed by two three-year terms in accordance with the Board's policy;
• Confirm that the terms of Dr. Janet Southerland and Dr. Jonathan Klein will end on June
30, 2001 a'nd direct the Clerk to the Board to recruit for these positions.
The Manager recommends that:
1) The BOCC suspend its policy of two term limits until it has had sufficient time to re-
examine a long-term policy for Board appointments;
2) During this time, the Board may wish to extend the terms of selected Board members
whose second three year terms are set to expire by one additional year;
3) The Board is encouraged to consider establishing for selected permanent boards and
commissions a ane year training period to be followed by two three-year terms in
accordance with the Board's policy.

The attached letter was received while I was Chair. Therefore, I wanted to
follow-up by making the following request of you when we next consider
the appointments for the listed Board of Health members. As indicated in
;the attached letter, the board of health has a considerable number of new
members. Dr. Kline (sp) has requested that those listed be allowed to
continue to serve for another term as an exception to our county policy of a
maximum two terms in order to provide some continuity of leadership and
allow the new members sufficient time to become familiar with board
operations. I support his request and ask that you consider doing so as an
exception to our policy for the reasons noted. The board of health has an
important role and. experienced leadership can help improve the overall
performance of the agency.

Dear Mr. Carey,
As you are aware the Orange Crnmty Board of Health has in the past twelve months appointed
six new members. With the broad range and complexity of issues the board deals with as well as
the history of several 4raage Cotmty public health concerns it can take several years to become a
fully oriented and effective board member.
In June 1995, I was originaIly appointed to serve a fall three year term a$er which T was to be
eligible to serve two additional three year terms. Janet Southerland and Melvin Hurston were
sim~arly appointed to be eligible for three 3 year terms. Wh11e a year ar two ago the
commissioners changed the length of service for appointed board members to two 3 year teams, I
would like to complete the original eligibl7ity service appointment through June 2004, I have
spoken with Dr. Southerland and Mr. Flurston and they world also like the opportlmtily to
complete their three terms. Given the large number of new board members and the fact that
recruitment and orientation of new members is very time consuming I believe, and the Health
Dixectar, Dr, Rosemary Summers conaus, it to be important to maintain this continuity on the
board, .

The Board of Health. at their May and June meetings discussed at length the Commissioners
desire to limit Board terms to six years {two three-year terms). The Board respectfully requests
that the Boazd of Commissioners make an exception to this guideline for the Board of Health.
The following points represent the Board's rationale far the exception:
o Seven of the eleven members of the Board are professional designations. While
Orange County is fortunate in having all professions in the county, in the past it has
,been difficult to recruit certain professional members to sit on the Board. For
example, the optometrist and veterinarian were difficult to recruit as members. Both
Dr. Adler and Dr. Cammarata were first appointed to a partial term because the off ce
was unfilled due to recruitment difficulties.
o The wide range of issues that the Board deals with requires a lengthy orientation and
training period for members to feel comfortable making decisions. Mel Hurston and
Barry Adler, the two mast recent members, reported that it took them a minimum of
one full year before they could offer substantive input.
o Revision of current rules like On-Site Wastewater Rules and Groundwater Protection
Rules require both a historical perspective and the ability to understand technical
aspects of the rules. The appeals process has not been used in the past three yeazs
(9/96 was the last one). With .six-year terms it is conceivable that a majority of Board
members will only experience one appeal. It is sometimes difficult for new board
members to understand the nature and pazameters of an appeal until they actually
experience one; Even with attorney guidance, the appeals pmcess is difficult for
experienced board members.
v Due to resignations and the inability to recruit replacements, there were four new
board members appointed in 1995 or 36a/a of the members. The Board reported that
1995 and 1996 were spent training these four new board members.

a During Board elections this past year, several board members expressed a need to
serve one mare year before being considered for a leadership position as chair or
vice-chair. Most felt that a person needed to serve a minimum of one full three-year
terns before being considered as chair or vice-chair.
n Those individuals expressing the need to serve afull-term before consideration would
rotate off'the board six months after fulfilling one year as chair and vice-chair,
leaving a leadership void on the board.
v . If the two-term scenario were followed, nearly half the board would be replaced every
three years.
o State Statute allows for three terms. All of the current members received a letter _
statin that the were eligible far three terms (for a total of nine years). All~~cuirent
board members have expressed a esue an commitment o serve a 11 three terms.
o It should be noted that the Board Chair monitors attendance closely and makes
individual contact with members that miss two meetings in consecutive months.
The Board ofHealth unanimously felt that limiting members to two terms would seriously
weaken the Board's effectiveness in carrying forward the work of the health department.
For these reasons the Board of Health is requesting that the Commissioners alter their two-term
guideline for board service to three terms for this board.
