PURPOSE: To receive authorization to submit Quarterly Public Hearing Legal Advertisement
for publication.
BACKGROUND: The next regular quarterly public hearing is scheduled for May 29, 2001. A
summary of each item proposed for public hearing is provided. The text of specific
proposals will be sent to the BOCC approximately May 15, 2001; staff will be available
to research and answer questions prior to the public hearing.
Requests•
• A. Com rehensive Plan Text Amendments
• In order to reserve potential school sites during the subdivision process the sites must
be identified in the Comprehensive Plan.
• The identified sites will be presented at the Public Hearing.
• B. Orange County Zoning Text Amendments
• 1. Amendments to both the Payment in Lieu of Dedication Fees and in the calculation
of Land Dedication amounts
• 2. Establish a `Bed and Breakfast/Country Inn' use in the Permitted Use Table
• The current ordinance only allows for historical structures to be considered for Bed
and Breakfasts. There are other structures and situations that may be suitable to
accommodate the Bed and Breakfast/Country Inn uses.
• 3 Amend all references to Best Management Practices (BMP) in the Zoning
Ordinance to be consistent with the Orange County Stormwater Program for Lands
within the Neuse River Basin.
• C. Special Use Permit. Class A
Purpose: Elizabeth P. Davidson is requesting a Historic Sites Non-Residential-Mixed
Use, Special Use Permit, Class A for a Bed and Breakfast. The property located at 7015
NC 57 and is identified by Orange County Tax Records as Little River Township, Map 15,
Lot $. The acreage is 47.17 acres more or less including NC 57 right-of--way.

• 1. Clarifies the Definition of Resultant Lots in the Subdivision Definition
• Adds language to require all recombination Tots to also adhere to the minimum lot
standards set forth in the Private Road Standards.
• 2. Modify the Private Road Standards
• Allow for sliding scale of lot sizes in exchange for greater ratios of open space and
reducing impervious surface
• 3, Clarify minor subdivision approval time limits
• The time limit provisions of minor subdivision approval will be set to the same time
period as major subdivisions. The requirement will be to record the final plat
within one year of approval or request an approval extension for a maximum of
one additional year (two years total).
• 4. Amend cluster provisions in all development proposals
• Sets minimum `cluster dawn' lot sizes at a sustainable level

r ose: Strikes all language pertaining to permitting and physical enclosures. Clarifies
that the keeping of wild animals dangerous to ,persons and property within Orange County
is not allowed. The only exemption allowed is for animals used for teaching and/or
research purposes at the University of North Carolina at Chapel Hill. The ordinance, if
adopted, will become effective upon approval unless otherwise specified by the Orange
County Board of Commissioners.'

Countv
Purpose: This purpose of this ordinance is to prohibit the display of wild and exotic
animals within Orange County specifically for the purposes of entertainment or
amusement. It does not prohibit the exhibition of animals for educational purposes by
non-profit groups, institutions or individuals. It does not prohibit the ownership of exotic
animals. The ordinance, if adopted, will become effective upon approval unless otherwise
specified by the Orange County Board of Commissioners.
FINANCIAL IMPACT: There is no financial impact associated with this decision. Advertisement
casts are included in the departmental budget.
RECOMMENDATION(S): Administration recommends APPROVAL of the items for the May
29, 2001 Quarterly Public Hearing.
NOTICE OF PUBLIC HEARING
ORANGE COUNTY BOARD OF COMMISSIONERS
A public hearing will be held in the Judge F. Gordon Battle Superior Courtroom of the
New Orange County Courkhouse,. 106 E. Margaret Lane, Hillsborough, North Carolina,
on Tuesday, May 29, 2001, at 7:30 PM for the purpose of giving all interested citizens an
opportunity to speak for ar against the following items:
A. COMPREHENSIVE PLAN TEXT AMENDMENTS
1. Identification of Potential School Sites
The Orange County Subdivision Regulations contain a provision for the
reservation of potential public school sites; however, the provision has
never been utilized. Over the last few years the acreage consumed by
subdivisions and the number of lots being created has prompted a
reassessment of the need to identify potential school sites. For this
provision to be effective, potential school sites must first be designated
in the adopted Comprehensive Plan. A notification of property owners,
including an explanation of the amendment to the Comprehensive Plan
and how it affects subject properties, will be included in property owner
notification letter. This subdivision regulation for reservation of school
sites has been in effect since 1980.
Purpose: To receive public comment on a map and listing of potential
elementary, middle, and high school sites for inclusion in the Land Use
Element of the Orange County Comprehensive Plan.
B. ORANGE COUNTY ZONING TEXT AMENDMENTS
1. Establish a Bed and BreakfastlCountry Inn use in the Permitted Use
Table and create all associated criteria (approval procedures,
performance standards, parking, etc).
Purpose: The zoning ordinance does not have a land use catogory for
bed and breakfast establishments. Traditionally, the county has only
considered bed and breakfast operations as part of the Historic Sites
Non-Residential Reuse/Mixed Use category. Restricting bed and
breakfast operations to historic sites excludes all other properties that
may be otherwise suitable for this type of land use.
2. Amend all references to Best Management Practices (BMP) to be
consistent with the Orange County Stormwater program for Lands
within the Neuse River Basin
Pu rpose: To provide consistency in both the terms and regulatory
requirements for both the Stormwater Ordinance and Zoning Ordinance.
C. SPECIAL USE PERMIT, CLASS A
Elizabeth P. Davidson, Applicant is requesting a Historic Sites Non-
Residential-Mixed Use, Special Use Permit, Class A for a bed and.
breakfast use at 7015 NC 57. The property is zoned R-1 and is
identified as Little River Township, Map 15, Lot 8 and contains 47.17
acres more or less (including right-of--way). (SUP 2001-01)
Purpose: To hold a public hearing to receive evidence and comments on
the proposed reuse of an historic property.
D. ORANGE COUNTY SUBDIVISION AMENDMENTS
1. Clarify the definition of Resultant Lots in the Subdivision
Regulations to include minimum lot sizes for all lots served by a
private road or an access easement.
Pur ose: To eliminate the possibility that parcels may be recombined in
such a manner that would create lots at less than the minimum area
required in the Private Road Standards section of the Subdivision
Regulations.
2. Modify the private road standards.
Purpose: The current private road standards do not have a provision far
sliding scale lot area minimums. The two main reasons for a sliding
scale are to provide an incentive for preservation of open space and also
to lower the impervious surface associated with length of private roads.
3. Clarify minor subdivision approval time limits
Pu~, rpose: Will provide a time limit provision far recordation of final plats
for minor subdivisions that is consistent with the time limits set on major
subdivision approvals by the BOCC.

and discussion at the hearing.
