PURPOSE: To amend the Richmond Hills Preliminary Plan to allow for platting in accordance
with CDBG grant funding and to allow for platting of the majority of the open space in Phase I.
BACKGROUND: The Richmond Hills Subdivision received preliminary approval at the August
15, 2000 BOCC meeting. Concurrently with the approval process, and also after approval was
granted by the BOCC, Habitat for Humanity pursued funding from various sources. Funding
has been granted but has come with conditions regarding the number homes to be built. This
is affecting the platting of the properly in phases as was originally shown on the preliminary
plan. There was no way to determine during the approval process how the phasing would be
best accomplished given the uncertainty of funding. The phasing lines were best guesses with
regard to build out and funding of the entire project.
The Orange County subdivision regulations require that final plats be recorded in accordance
with the preliminary phasing lines. Additionally, condition number F(4) in the Resolution of
Approval reiterated this ordinance requirement. We now know what Habitat needs to do with
regard to the phasing of the project. This request is to allow shifting the phasing lines to
accommodate grant requirements with regard to the number of lots being recorded and also to
allow the County to receive the open space dedication along McGowen Creek. The. McGowen
Creek land dedication was shown in Phase III on the original preliminary plan.
FINANCIAL IMPACT: No fiscal impact is associated with this action.
RECOMMENDATION: Administration recommends approval of amending condition
number F(4) to allow shifting the phasing lines for the subdivision.

The Board of County Commissioners hereby approves amended Richmond Hills Preliminary
Plan, dated March 9, 2000, revised March 15, 2000 and April 19, 2001 and containing 43 lots,
subject to the fulfillment of requirements specified herein.
Before the Final Plat of Richmond_Hills can be recorded all conditions of the original Resolution
of Approval dated August 15, 2000 shall be met with F. Miscellaneous (4) amended to read as
follows:
4. Phasing of the project shall occur only in accordance with the amended
Preliminary Plan revised on April 19, 2001.
NOW THEREFORE BE IT RESOLVED by the Board of Orange County Commissioners
that the amended Resolution of Approval for Richmond Hill Preliminary Subdivision is
approved.
