Present: Keith Bagby,Chairman Patrick Bums,Vice Chavman Jane Cousins,Member Mike Lassiter,Member Tony DuBois,General Manager Angela Willoughby,Asst.General Manager Ron McCoy,Finance Officer Renee Price,BOCC Liaison Angel Neighbours,Bound Secretary Chris Willett,Banner,Hadler&Willen,P.A. Absent: Elizabeth Carter,Member Visitors: Call to order: at 8:30 am a quorum was present and Mr. Bagby, Board Chairman, called the regularly scheduled Board Meeting to Order. Mr. Bagby read the Mission Statement: The Mission of the Orange County ABC Board and our employees is to serve our locality responsibly by controlling the sale of spirituous liquor,returning profits to law enforcement,Alcohol Education,and the County Fund while providing excellent service in customer friendly,modem and efficient stores. Mr. Bagby read the Conflict of Interest Statement The question was asked: does anyone has a conflict of interest with respect to any matters on the agenda?AB present said nay. 1 Approval of the Open meeting Agenda: Me Buru made a motion to approve the Open meeting agenda,Ms.Cousins seconded the motion and the was carried 2 Meeting Minutes:The Open Meeting Minutes for September 17,2019 were presented.Discussion was held. Mr. Lassiter made a motion m approve the open session minutes, Mr. Burns seconded the manors and the vote carried. 3 Consent Agenda:September 2019 a.Financial Reports: i.Competitive Statement of Net Assets ii.Comparative Revenue and Expenses for Sept.2019 and Sept.2018 iii Actual-m-Budget Sept.2019 b.Sept 2019 and Year-to-Date Retail Sales a Statewide Sales Report Discussion was held.Ms. Cousins made a motion to approve the Sept 2019 Consent Agenda, Mr. Bums seconded the marion and the vote carried Open Session 10/15/2019 Page 1 of 2 pages Orange County ABC Board Open Meeting Board Minutes Tuesday October 15,2019 4.Management Updates: 1. law Enforcement Reports:This report is required by the NCABC.Reports were not available at the time of board meeting. 2. Store Security Update: Security updates have begun. A meeting with Officer Roberson is scheduled on Oct 24 at the Eno Sarre on Hwy 70 in Durham to go over the new security system. 4.Property Sale Update: The inspection period has passed with no issue and the property at 112 John Earl St,Hillsborough is scheduled to close on December 9. 5.Oakdale Project Update: The project is moving forward and still has a completion date to finish near the first week of November.Updated photos were presented m the meeting.The date tentatively set for opening is November 12.Grind opening will be early December. 5. Oakdale Project Update: Work on the new Hillsborough Store 410 at Oakdale Drive is underway. An updated Project Budget was presented to the Board. 6. Medical leave Policy:A staff recommendation was made to add wording to the Medical Leave policy.The recommendation would allow employees to supplement their short-tern disability payment with their accrued sick or vacation time. Discussion was held.Mr. Lassiter made a motion to approve the updated Medico(Leave Policy,Ms Cousins seconded the motion and the vote carried (See Atmched) 7.Board Comments: • Mr.Burns thanked Ms.Willoughby for the security upgrades. • Mr.Rugby stated he would like the names of past Board Members that were involved early in the Oakdale project in be on the dedication plaque. 9:20 am Ron McCoy and Renee Price left the meeting. Mr.Lassiter recused himself from closed session. Closed Session in accordance with NCGS 143-315.11 Personnel Matters. 9:21 am Ms Cousins made a motion to go Into closed session,Mr. Bums seconded the modon and the vote carried 9:45 am Ms. Cousins made a motion to return to open session,Mr. Bums seconded the madan and the vote carried 9:47 am Mr.Bums made a motion to adjourn,Ms.Cousin,seconded the motion and the vote carried Meeting adjourned. j j H \- ✓ I j L I 1 Chair's Signal=and Board Secretary's Signature and Da / Open Session 10/15/2019 Page 2 of 2 pages Orange County ABC Board Policy and Procedure Manual Medical Leave Overview: The Family and Medical Leave Act(FMLA) went into effect in 1993. Under FMLA, employees who qualify are granted leave for certain family-related events and illnesses. Family Leave mainly pertains to an employee's family; whereas, Medical Leave pertains to the employee themselves. Employees Eligible for Medical Leave: In general, to be covered, an employee must be a regular full-time employee and must have worked for at least 12 months and must have performed at least 1,250 hours of work (approximately 25 hours per week) during the 12 months before leave begins. There are also some other qualifications that must be met. Employees Considering Medical Leave: The information contained in this manual is not all inclusive or exhaustive. Additional information should be requested from management and additional sources to ensure a particular situation qualifies for FMLA treatment. The Board provides leaves of absence without pay to eligible employees who are temporarily unable to work due to a serious health condition or disability. For purposes of this policy, serious health conditions or disabilities include inpatient care in a hospital, hospice, or residential medical care facility; continuing treatment by a health rare provider; and temporary disabilities associated with pregnancy, childbirth, and related medical conditions. Eligible employees should make requests for medical leave to their supervisors at least 30 days in advance of foreseeable events and as soon as possible for unforeseeable events. Use Time-Off Request and Approval Form 9-10 for this purpose. A health care provider's statement must be submitted verifying the need for medical leave and its beginning and expected ending dates. Any changes in this information should be promptly reported to the General Manager. Employees returning from medical leave must submit a health care provider's verification of their fitness to return to work. Eligible employees are normally granted leave for the period of the disability, up to a maximum of 12 weeks within any 12 month period. Any combination of medical leave and family leave may not exceed this maximum limit. If the initial period of approved absence proves insufficient, consideration will be given to a request for an extension. Extensions may be granted only upon recommendation by the General Manager and by approval of the Board of Directors. Employees will be required to use any accrued leave time (such as vacation or sick time) before taking unpaid medical leave. If an employee has elected to enroll in a short-term disability insurance policy thorugh payroll deductions, accrued leave time may only be used to supplement the amount not covered by short term disability payments. Total medical leave payments paid by disability and/or accrued leave time shall not exceed 100% of regular pay earnings. 4-9 10/25/2019 Orange County ABC Board Policy and Procedure Manual Employees who sustain work-related injuries are eligible for a medical leave of absence for the period of disability in accordance with all applicable laws covering occupational disabilities. Subject to the terms, conditions, and limitations of the applicable plans, the Board will continue to provide health insurance benefits for the full period of the approved medical leave. The employee is responsible for 100% of dependent health and dental coverage (and any other contributory insurance) during this period. Vacation leave is earned by Full-time employees in any month that they work or are on paid leave for Y: of the month or greater. Vacation does not accrue in any month that the employee is on unpaid leave for more than '/ of the month. If a recognized holiday falls during an eligible employee's paid absence holiday pay will be provided instead of the paid time off benefit that would otherwise have applied. If the absence is unpaid then the holiday will also be unpaid. So that an employee's return to work can be properly scheduled, an employee on medical leave is required to provide the General Manager with at least two weeks advance notice of the date the employees intends to return to work. When a medical leave ends, the employee will be reinstated to the same position, if it is available, or to an equivalent position for which the employee is qualified. If an employee fails to report to work promptly at the end of the medical leave, the Board will assume the employee has resigned and reimbursement will be requested for health insurance for the period of medical leave. The employee must return to work for a minimum of 30 calendar days to fulfill the health insurance obligation to the company. Employees are prohibited from performing unauthorized work for personal gain while on medical leave. 4-9 10/25/2019
