HomeMy WebLinkAboutABC Board minutes 091818 Orange County ABC Board Open Meeting Board Minutes Tuesday October 16,2018 The Orange County ABC Board held its regular meeting on Tuesday, October 16,2018 at 8:30 AM at the ABC Board Administrative Office 601 Valley Forge Road Hillsborough,N.C.These are the minutes of the Open Session. Present: Keith Bagby,Chairman Jane Cousins,Vice Chairman Mice Lassiter,Member Penick Bums,Member Jamezetm Bedford,Member Tony DuBois,General Manager Ron McCoy,Finance Officer Angela Willoughby,Ant.General Manager Angel Neighbours,Board Secretary Absent: Chris Willett,Beemer,Hadler&Willett,P.A., Renee Price,BOCC Liaison Visitors: Mason Barringer,Accountant,DMJ&Co. Call to order: at 8:27 am a quorum was present and Mr. Bagby, Board Chairman, called the regularly scheduled Board Meeting to Order. Mr.Bagby read the Mission Statement: The Mission of the Orange County ABC Board and our employees is to serve our locality responsibly by controlling the sale of spirituous liquor,returning profits to Law enforcement,Alcohol Education, and the County Fund while providing excellent service in customer friendly,modern and efficient stores. Mr.Bagby read the Conflict of Interest Statement.The question was asked:if anyone has a conflict of interest with respect to any matters on the agenda?AB present say no. I Approval of the Open meeting Agenda:Mr. Bedford made a motion to approve the Open meeting agenda,Mr.Burns seconded the motion and the vote carried 2 Meeting Minutes: The Open and Closed Meeting Minutes for September 18, 2018 were presented. Discussion was held. Ms. Bedford made a motion to accept the open session minutes, Mr. Loins, seconded the motion and the vote carried 3 Consent Agenda: September 2018 a. Financial Reports: i.Comparative Statement of Net Assets ii.Competitive Revenue and Expenses for September 2018 and September 2017 iii Actual-te-Budget September 2018 b.September 2018 and Year-to-Date Retail Sales c.Statewide Sales Report Discussion was held.Ms. Cousins made a motion to approve the September 2018 Consent Agenda, Ms. Bedford seconded the motion and the vote carried Open Session 10/16/2018 Page 1 of 2 pages Orange County ABC Board Open Meeting Board Minutes Tuesday October 16,2018 4 Audited Financial Statement for Fiscal Year 2018: Meson Barringer of DMJ&Co.presented the audited financial statements for fiscal yew ending Jane 30,2018.He also addressed questions from the Board. Ms. Bedford made a motion to approve the Audited Financial Swenventa for Fiscal Year 2018 and to move$213,118 in revenues(change in nelposidon)to Caphal Bank,Ms.Cousinrsecondedthe motion and the vote carried 5 Holiday Policy/Part Time Benefits:The Holiday Policy and Part Time Benefits Policy with recommended charges was presented.Discussion was held Ms.Cousins mode amation to approve changer on thepoBcies, Ms.Bedfordseconded the motion and the vote carried (See Attached). 6 Management Updates: 1.latcra: We are currently running a background check an an inmm candidate from UNC to work on special projects and the employee handbook. 2.Store Security Survey:The Orange County Sheriffs department has started the security evaluations for each store.Deputy T.Daniel Roberson will be at the November meeting to present his findings. 3.Salary Chart: A recommendation was made to table any decisions on the salary chart until the budget process begins for FY 2019. 4.Carrboro Store:The Carrboro store will reopen on Tuesday October 23id A tentative grand opening dam bas been set for Thursday November 8".The lease runs out on the temporary location at the end of November. 5.Oakdale Project Timeline:The contact was advertised and bids will be opened on October 26'a at 3:00 pm.The next couple of weeks will involve checking references and looking into the work of the commissars so that we may recommend hiring the lowest suitable bidder.A recommendation will be brought to the November board meeting.The contract with the builder will be looked at by the board attorney.Anticipated start date is January 2019. 7 Ten Year sales Trend and Expense Analysis: Over the past decade, the Board has continued to see a steady growth in sales revenues.However,the change in net position for fiscal year 2018 was the second lowest in ten years,due to a general increase in operational expenses.Due to the less than expected amount of revenues available for transfer at the end of fiscal year 2018,the staff intends to tansfer additional funds($300,000)from the SunTrust account into the Capital Bank account 8 Board Comments: • Mr. Burns is continuing to work with local law enforcement to ensure compliance with reporting requirements. • Mr.Lassiter inquired about when we should put store 810 at John Earl Street on the market • Mr.Bagby attended the Lunch and Learn with Criminal Justice in Chapel Hill. At 10:26am Mr.Lassiter made a motion to adjourn,Ms. Bedford secondedthe motion and the vote carried Meeting adjourned. (� et c llk Chair's Signal=and D Board Secretary's SignaR and Data Open Session 10/16/2018 Page 2 of 2 pages Orange County ABC Board Policy and Procedure Manual Holiday Policy Holidays The Orange County ABC Board grants paid holiday time off to all full-time employees on the holidays listed below: 1. New Year's Day' 2. M.L. King, Jr. Day 3. Memorial Day 4. July 0 - 5. Labor Day " 6. Thanksgiving ' 7. Christmas . The General Statutes list required closing days and are annotated above with an "•" and are subject to change pursuant to changes in the General Statutes of North Carolina. Other holidays are authorized by the Orange County ABC Board of Directors and are subject to change. If the holiday falls on Sunday, the following Monday will be observed as a holiday. Retail stores will close at 6:00 pm on Christmas Eve Pay for Approved Holidays All employees are eligible on date of hire for holiday pay Holiday pay will be calculated based on the employee's straight-time pay rate (as of the date of the holiday) To be eligible for holiday pay, employees must work the last scheduled day immediately preceding and the first scheduled day immediately following the holiday. If a recognized holiday falls during an eligible employee's paid absence (such as vacation or sick leave), holiday pay will be provided instead of the paid time off benefit that would otherwise have applied. All full-time employees will be paid for 8 hours of holiday pay on the day the holiday falls whether the store is open or closed. Any hours worked on a holiday when the store is open will be paid at the standard rate along with the 8 hours of holiday pay. All Part-time employees are eligible for 4 hours Paid time off for holidays will not be counted as hours worked for the purposes of determining overtime. 5-2 1/1/2019 Orange County ABC Board Policy and Procedure Manual Hourly Employees who are required to work on an approved holiday will be paid time and a half for all hours worked on the holiday. Salaried Employees who are required to work on an approved holiday will be allowed to take compensatory time "comp time" off at a later date but within 90 days following the holiday. The time off will be mutually agreed upon between the employee and immediate supervisor. Employees are eligible for holiday pay for established holidays starting on their first day of employment. Floating Holidays Floating holiday allow employees who would like to recognize other holidays or simply have a day off the ability to be paid on the days they choose. 5 Floating Holidays will be granted to full-time employees in each calendar year for a total of 40 hours. They can be used for any reason but must be scheduled in advance and cannot be taken during peak times. The time can also be used to make up the difference in hours on a paid holiday when an employee is normally scheduled for a shift longer than the standard 8 hours of holiday pay will cover. Personal time eligibility starts on January 1 of each year when all hours are available for immediate use. All floating holiday hours must be used during the calendar year and cannot be carried over. Any unused hours will not be paid out at the end of the year and will be forfeited as of December 31 of each year. There will not be any automatic payment of unused hours. Floating holiday hours must be used prior to any request to borrow vacation time. All current employees will follow this policy with new hire eligibility dates listed below. New Hire Eligibility Employees hired before June 30 will receive 2 days (18 hours) and anyone hired after will be eligible January 1 of the following year. Page 2 5-2 1/1/2019
