To authorize the Manager to implement the HOME Program as approved by the BOCC including the ability to execute agreements with partnering non-profit organizations after consultation with the County Attorney. BACKGROUND: In 2000, a Consolidated Plan for Housing and Community Development Programs in Orange County was developed and approved by the U.S. Department of Housing and Urban Development (HUD). This document details the housing needs of very low income, low income and moderate income families and special population groups in addition to outlining the strategies and plans for addressing those needs. The Consolidated Plan is required for all communities receiving HOME funds (Orange County HOME Consortium) and CDBG entitlement funds (Town of Chapel Hill). Each year, local communities are required to submit an Annual Update to the Consolidated Plan to the State HUD OfFice by May 15~". This Update includes the 2001-2002 Community Development Plan for the Town of Chapel Hill and the 2001-2002 HOME Program Action Plan for the Orange County HOME Consortium. Public hearings were held by the Chapel Hill Town Council on January 23 and March 38 and by the BOCC on February 7, 2001 to receive citizen comments regarding the Update prior to development and subsequent submission to HUD. Additionally, the Update contains amendments to the FY 1999 and 2000 HOME Program Design as well. The HOME Program Review Committee comprised of an elected official from each local elected board as well as the Manager or his representative reviewed applications for HOME Program funding and developed the proposed HOME Program Design for the 2001-2002 Program Year. Further, the committee also considered reallocation of available funding from the 1999 and 2000 program years and proposes amending the 1999 and 2000 HOME Program designs. A total of twelve applications were received from local non-profit organizations and other local governmental units requesting approximately $1,148,750. The proposed program design for 2001 includes $721, 925 in 2001 HOME funding and $130,250 in reallocated FY 2000 HOME funds and is in accordance with the Consolidated Housing Plan. A public comment period as required by HUD was established for April 9 -- May 10, 2001 by notice in the Chapel Hill Herald. Copies of the Annual Update were made available at the Chapel Hill and Orange County Libraries. Further, in accordance with the Orange County HOME Consortium Agreement approved in June 1996, as amended, the HOME Program Design for each year must,be approved by all jurisdictions prior to submission to HUD. The Program Design is scheduled for approval by Chapel Hill on April 23, Carrbora on May 1, and Hillsborough on April 9th. FINANCIAL IMPACT: The Orange County HOME Consortium is scheduled to receive approximately $43$,000 in federal housing program funding. The required total local government match is $108,675. Orange County's share of the match is $45,644. RECOMMENDATION(S): The Manager recommends that the Board adopt resolutions approving the 2001 Consolidated Housing Plan Annual Update; the proposed HOME Program Activities for 2001-2002; and the proposed amendments to the HOME Program Activities for Fiscal Years 1999 and 2000. Additionally, the Manager recommends that the BOCC authorize the Manager to implement the HOME Program as approved by the BOCC including the ability to execute agreements with partnering non-profit organizations after consultation with the County Attorney. ORANGE COUNTY BOARD OF COMMISSIONERS RESOLUTION AUTHORIZING THE ORANGE COUNTY 2001-2002 HOME PROGRAM DESIGN BE IT RESOLVED, by the Orange County Board of Commissioners, that the Commissioners as a member of the Orange County HOME Consortium approve following activities for the 2001-2002 HOME Program. New Construction Funds would be allocated to Orange Community Housing Corporation, an approved Community Housing Organization (CHDO) to assist in the construction of thirty-two (32) townhouses in the Meadowmont development. (Requested amount: $80,000) $80,000 Funds would be allocated to Habitat for Humanity, an approved Community Housing Organization (CHDO) to assist th the construction of one single family dwelling in Carrboro. (Requested amount: $20, 000) $20,000 Funds would be allocated to Residential Services, Inc. with the construction of a continuing care facility that will provide housing and services for 15 senior citizens with developmental disabilities. (Requested amount: $212,500) $100,000 Prop~y Acquisition Funds would be used to assist the Orange-Person_Chatham Mental Health Agency acquire, and if necessary, rehabilitate houses in Orange County for rental occupancy by County residents with disabilities. (Requested amount: $100,000) $58,625 Funds would be allocated to Orange Community Housing Corporation/Community Land Trust in Orange County to acquire a lot in Carrboro for future building purposes. (Requested amount: $30, 000) $30,000 Funds would be allocated to EmPOWERment, Inc. to assist in the purchase of five (S) rental units for lease to low income families with incomes at 50% and below of median income. (Requested amount: $S0, 000) $50,000 Funds would be allocated to the Town of Carrboro to assist in their efforts to acquire approximately purchase condominiums for lease to low income families with incomes at 50% and below of median income. (Requested amount: $135,000) $135,000 Homebnyer Assistance Funds would be allocated to EmPOWERrrient, Inc. to provide deferred second mortgages to first-time hornebuyers with incomes below SO% of median income. (Requested amount: $100,000) $ 69,750 Program Administration $48,300 TOTAL PROGRAM FUNDS $ 591,675 BE IT FURTHER RESOLVED, that the Manager is hereby designated as the authorized representative of the County to act in connection with the submission of this plan and to provide such additional information as may be required by the U.S. Department of Housing and Urban Development. HOME PROGRAM DESIGN BE IT RESOLVED, by the Orange County Board of Commissioners, that the Commissioners as a member of the Orange County HOME Consortium approve the following amendment to the activities of the 2000-2001 HOME Program. New Construction Funds would be allocated to Orange Community Housing Corporation, an approved Community Housing Development Organization (CHDO) to assist in the construction of thirty-two (32) townhouses in the Meadowmont development. $80,000 Funds would be allocated to Habitat for Humanity of Orange County, Tnc. to provide second mortgage assistance to five (5) first-time homebuyers. $62,500 Housing Rehabilitation Funds would be allocated for the Urgent Repair Program administered by the Orange Community Housing Corporation. Eligible properties must have repair needs that pose a threat to the life, safety, or health of the occupants, or need accessibility modifications for an elderly or disabled occupant earning less than 50% of median income. This the 1st day of May 2001. 5 ORANGE COUNTY BOARD OF COMIVIISSIONERS RESOLUTION AUTHORIZING AN AMENDMENT TO T ORANGE COUNTY 19 9-2000 HOME PROGRAM DESIG BE IT RESOLVED, by the Orange County Board of Commissioners, that the Commissioners as a member of the Orange County HOME Consortium approve the following amendment to the activities for the 1999-2000 HOME Program. New Construction Funds would be allocated to Orange Community Housing Corporation, an approved Community Housing Development Organization (CHDO) to assist in the construction of fourteen (14) new townhouses on Scarlett Drive ($74,000) and thirty-two (32) townhouses in the Meadowmont development. $94,000 ousin Rehabilitation Funds would provide deferred loans to rehabilitate low-income owner-occupied and rental housing units. Homeowners with less than 60% of median income would be eligible for these loans. Original Arnt. $147,628 New Amt. $152,150 Funds would be allocated for the Urgent Repair Program administered by the Orange Community Housing Corporation. Eligible properties must have repair needs that pose a threat to the life, safety, or health of the occupants, or need accessibility modifications for an elderly or disabled occupant earning less than 50% of median income. Original Amt. $60,000 New Amt. $38,450 Property Acquisition Funds would be used to assist the Orange-Person-Chatham Mental Health Agency acquire, and if necessary, rehabilitate houses in Orange County for rental occupancy by County residents with disabilities. $60,000 Funds would be allocated to Habitat for Humanity of Orange County, Inc. to acquire lots for future building purposes. $50,000 Funds would be allocated to EmPOWERrnent, Inc. to assist in the purchase of an eleven (11) unit apartment complex in the Carr Court neighborhood in Carrboro. EmPOWERrnent, Inc. would renovate the building and make the apartments available to families at 50% and below of median income.
