WHEREAS, the Arts Commission is a countywide arts agency that ensures the growth of local arts experiences by providing funding and support for diverse high quality programs and projects. WHEREAS, the Arts Commission administers the annual Grants Program to provide economic opportunities to Orange County artists and non-profit organizations coordinating arts projects benefiting the citizens of Orange County. WHEREAS, the annual Arts Grants Program is supported by Arts Commission with funds from the Grassroots Arts Program of the North Carolina Arts Council, a division of the Department of Natural and Cultural Resources, a state agency. WHEREAS, the Grant Recipient was selected by the Arts Commission to receive the annual Arts Grant through the procedures duly adopted by the Arts Commission; and WHEREAS, both parties wish to promote and maintain the integrity and clarity of the Grant Recipient's ideas and statements and delineate the Grant Recipient's obligations to the County; NOW, THEREFORE, the County and the Grant Recipient, for the consideration and under the conditions hereinafter set forth, agree as follows: 1. Approved Grant Project. Grant funds are provided under this Agreement for the project ("Project") described in the Grant Recipient's Grant Application, attached hereto and incorporated herein as Exhibit A. 2. Grant Award. Grant funds in an amount not to exceed six thousand three hundred thirty- three dollars and ninety-two cents ($ 6333.92) have been awarded by the Arts Commission to the Grant Recipient for the approved Project. The Recipient shall be required to match funds at least dollar-for-dollar with cash from the Grant Recipient's funds not derived from either Orange County appropriations or the North Carolina Arts Council, as outlined in the attached Exhibit A. 3. Contingency. This grant is contingent on North Carolina Arts Council Grassroots Program funding to the Arts Commission. Final decisions on Grassroots Program funds to the North Carolina Arts Council are subject to approval by the North Carolina General Assembly. 4. Responsibilities of the Grant Recipient 1 Revised July 2018 DocuSign Envelope ID:06CEEEC8-EDB6-42D5-AD51-21357BE60FF7 A. Implementation. The Project implementation shall take place between July 1, 2019 and June 30, 2020. The Project shall be implemented in the manner described in Exhibit A. Time is of the essence in the implementation of the Project. B. Modifications to project. Grant Recipient shall present major changes to the original proposal, including but not limited to changes in design, implementation schedule and increase in Project budget by more than 10%, in writing to the Arts Commission for approval. Arts Commission shall approve or disapprove Grant Recipient's request for modifications within seven (7) days of receipt thereof. Consent to project modifications shall not be unreasonably withheld. Arts Commission's decisions shall be in writing. In the event the Arts Commission fails to approve or disapprove the requested modifications within the time stated herein, the modifications shall be deemed approved. C. Non—assignment. The grant cannot be assigned or transferred to a different project or artist without prior written approval of the Arts Commission. D. Records. Grant Recipient must maintain records and other evidence pertaining to costs incurred and revenues acquired during the Project implementation. Grant Recipient shall maintain financial records pertaining to the Project for three (3) years from the date of this Agreement, in case of audit. E. Use of Funds. Grant Recipient shall not use the grant funds to repay outstanding taxes or other debts of any nature. The grants shall be utilized solely for the purpose described in the attached Exhibit A. F. Final Report. Grant Recipient shall submit to the Arts Commission a Final Report on July 13, 2020. The Final Report shall be in the format required by the North Carolina Arts Council. Failure to submit the Final Report or late submission of the Final Report, for any reason, shall be grounds for denial and/or cancellation of grant funds for the Project and future grant proposals. 5. Responsibilities of the Arts Commission A. Payment. The Arts Commission shall release the grant funds in the amount of $6333.92 to the Grant Recipient. 6. Publicity A. Acknowled eg ment. Credit must be given to the Orange County Arts Commission and/or the North Carolina Arts Council using the proper logo(s) and credit line in brochures, news releases, programs, and all other printed and online publications. Copies of such printed materials must accompany the evaluation report. Official Orange County Arts Commission and North Carolina Arts Council logos may be downloaded at www.artsorange.org_/grantee-resources and may not be altered in any way. In addition, all print and promotional material must include the following credit line and logo(s) (check all that apply): i. County Funds Only. Orange County Arts Commission logo required. The Orange County Arts Commission and the North Carolina Arts Council logos are required. Credit line: "This program is supported by the N.C. The Grant Recipient must enter all events, exhibits, and performances open to the public and related to this grant award on the Orange County Arts Commission website at www.artsorange.org/events. In addition, the Grant Recipient must add a link to www.artsorange.org (Orange County Arts Commission logo preferred)to their main webpage. 7. Indemnity. The Grant Recipient agrees to indemnify and hold harmless the County, the Arts Commission and the North Carolina Arts Council and their officers and employees from any and all claims or actual injury, damage or loss to a person, or real or personal property that results from or is in any way connected to the use of the grant funds. 8. Independent Contractor. The Grant Recipient is an independent contractor and not an employee, agent or other representative of the County and/or the Arts Commission. Nothing contained in this Agreement shall be construed to create the relationship of principal and agent, or employer and employee, between Grant Recipient and Arts Commission or Orange County Government. Grant Recipient understands and agrees that he/she is not authorized to incur any expenses or any liability whatsoever on behalf of the County or the Arts Commission and has no authority, expressed or implied, to obligate or make representations on behalf of the County or the Arts Commission. In addition, Grant Recipient agrees to maintain his or her own worker's compensation insurance for himself/herself and his or her employees for the duration of the art work's installation. 9. Termination A. In the event of any of the circumstances set forth below (hereinafter referred to as "default"), the Arts Commission may immediately terminate this Agreement: (i) Any fraudulent representation in any verification required to obtain payment under this Agreement or other dishonesty on a material matter relating to the performance of services under this Agreement. (ii) Nonperformance, incomplete service or performance, or failure to satisfactorily perform any part of the Project or to comply with any provision of this Agreement, as determined by the Arts Commission in its sole discretion. 3 Revised July 2018 DocuSign Envelope ID:06CEEEC8-EDB6-42D5-AD51-21357BE60FF7 (iii) Failure to adhere to the terms of applicable county, state or federal laws, regulations, or stated public policy. B. In the event of default by the Grant Recipient, the Arts Commission has the discretion to elect to terminate this Agreement, in whole or in part and/or require the Grant Recipient to repay the grant funds within seven (7) from written notice of default or allow the grant recipient the opportunity to cure the default. This clause shall not be interpreted to limit the County's or the Arts Commission's remedies in law or in equity. 10. Miscellaneous. A. Entire Agreement. This Agreement and the attachments contain the final and entire understanding of the parties with respect to the subject matter of this Agreement. All modifications and amendments to this Agreement shall be in writing. This Agreement shall be binding upon the parties, their heirs, successors and assigns. B. Governing Law. Governing Law and Priority Both parties agree that this Agreement shall be governed by the laws of the State of North Carolina and Orange County. Grant Recipient shall at all times remain in compliance with all applicable local, state, and federal laws, rules, and regulations including but not limited to all state and federal anti-discrimination laws, policies, rules, and regulations and the Orange County Non-Discrimination Policy and Orange County Living Wage Policy (each policy is incorporated herein by reference and may be viewed at htip://www.oran eg countygc. og v/departments/purchasing_division/contracts.php.). Any violation of this requirement is a breach of this Agreement and Arts Commission may immediately terminate this Agreement without further obligation on the part of the Arts Commission. This paragraph is not intended to limit and does not limit the definition of breach to discrimination. By executing this Agreement the Grant Recipient certifies that they has not been identified, and has not utilized the services of any agent or subcontractor identified, on the list created by the State Treasurer pursuant to G.S. 147-86.58. By executing this Agreement the Grant Recipient certifies that they has not been identified, and has not utilized the services of any agent or subcontractor identified, on the list created by the State Treasurer pursuant to G.S. 147-86.81. By executing this Agreement Grant Recipient affirms they are and shall remain in compliance with Article 2 of Chapter 64 of the North Carolina General Statutes. In determining the basic services to be provided, should any documents be referenced in or attached to this Agreement, the terms herein shall have priority in any conflict between the terms of referenced documents and the terms of this Agreement. C. Dispute Resolution: Neither party may initiate binding arbitration. Any disputes shall be resolved by nonbinding mediation. If such mediation fails either party may initiate litigation to resolve the dispute. D. Signatures. This Agreement together with any amendments or modifications may be executed electronically. New Hope Elementary is a Title 1, preK-5, school located just north of Chapel Hill with approximately 582 students and the largest ESL population in the district. Central Elementary is a Title 1, preK-5, school near downtown Hillsborough with approximately 268 students and is a designated Engineering Excellence school. Efland-Cheeks Global Elementary is a Title 1, preK-5, school located in Efland with approximately 458 students. Global studies are integrated throughout the curriculum and provide students opportunities to connect with people and cultures from across the globe through a project-based learning environment. Grady Brown Elementary is a Title 1, preK-5, school located in Hillsborough with approximately 463 students, and a growing number of ESL students. All four schools have Art and Music special area classes, which students visit once per week to learn concepts covered in the Arts Education Essential Standards. DocuSign Envelope ID:06CEEEC8-EDB6-42D5-AD51-21357BE60FF7 Project/Program Approximately 1,771 students in grades K-5 at New Hope Elementary, Summary Efland-Cheeks Elementary, Central Elementary and Grady Brown Elementary will work with professional teaching artists to learn curriculum through a variety of art forms, equating to 24 total residencies. Through the program, students will participate in Arts- Based Learning Experiences (ABLE) residencies, which are five-day residencies designed to coincide with a School show they will see at The ArtsCenter. During the residencies, teaching artists will go into all classrooms in a grade level for four sessions prior to the show, and then one session following the show. On this final day classroom teachers will co-teach alongside the teaching artists, and parents/families are invited to come observe. For many students this residency experience is the only opportunity they will have to work with professional artists, and for many who struggle with learning via traditional methods, this opportunity to learn curriculum through the arts gives them a chance to shine. In addition, grade levels often times highlight the residencies during parent nights, family sharing events or even district-wide events, such as Cultural Explosion. In order to ensure teachers are also learning new instructional strategies to teach curriculum moving forward, they will also participate in at least one school-wide professional development workshop on arts integration. This will be the ninth year the Artist in Residence program will be implemented with all Title 1 elementary schools in the district, and the twelfth year since initial implementation with the first Title 1 school. Project Start Date August 26, 2019 (no earlier than July 1, 2019) Project End Date (no June 11, 2020 later than June 30, 2020) Project Goals The Artist in Residence program is an Arts in Education program that integrates the arts into the grade level curriculum. The following are goals of the program: • To reach students with varied learning styles, thus increasing academic achievement in the designated curriculum area(s) • To increase student engagement, motivation and creativity • To provide underserved students opportunities to engage in the arts when they would otherwise not have the opportunity to do so • To provide classroom teachers with professional development opportunities on arts integration • To bring parents/families into learning experiences, thus creating an even deeper impact that far exceeds learning in the classroom. For example, in October 2018, Teaching Artist Kim Arrington worked with students to enhance writing (through poetry, scripts, etc.) and public speaking skills through drama (improvisation) and other art techniques, which aligned with the English Language Arts Curriculum Standards and the Arts Education Essential Standards (using movement, voice and writing to communicate ideas and feelings, understanding how to adapt sources, such as literature texts, poetry and speeches into scripts, etc.) and connected to the School Show "Spelling 2-2-5." All teaching artists develop detailed lesson plans prior to the start of residencies based on School Shows chosen by teachers and requested curriculum areas to be covered. The focused curriculum concepts are interwoven into the lesson plans to ensure solid connections to what students are learning in their classrooms. Furthermore, teachers also learn new arts integration techniques through professional development workshops where the principals and school leadership teams choose the specific curriculum and art foci for the workshops. Often times they choose concepts that tend to be difficult to students when learning via traditional teaching methods. Audience Description The following is a breakdown of demographic information per school: - Central Elementary (268 total students): 105 White, 90 African- American, 49 Hispanic, 24 Multi-Racial; 73% Free/Reduced Lunch - New Hope elementary (582 total students): 311 Hispanic, 193 White, 38 African-American, 33 Multi-Racial, 5 Asian, 2 American Indian; 64% Free/Reduced Lunch - Efland-Cheeks Global Elementary (458 total students): 190 White, 116 Hispanic, 96 African-American, 35 Multi-Racial, 19 Asian, 2 American Indian; 67% Free/Reduced Lunch - Grady Brown Elementary (463 total students): 224 White, 152 - Hispanic, 54 African-American, 29 Multi-Racial, 3 Asian, 1 American Indian; 55% Free/Reduced Lunch Location Description The art residencies will take place at all four Title 1 schools in the Orange County Schools' district: New Hope Elementary, Central Elementary, Efland-Cheeks Global Elementary and Grady Brown Elementary. Residencies will take place in regular classroom settings (K-5). All of the following artists have also completed an application and attended a Teaching Artist Training Workshop at The ArtsCenter prior to being chosen as a core artist: • Virginia Queen has over 20 years of experience working as an actor and teaching artist. She helped develop The ArtsCenter's Artist in Residence program 13 years ago and has worked as a highly sought after teaching artist with the program since that point. In 2016 she also began managing The ArtsCenter's Artist in Residence program. • Anita Woodley is an African-American literary and theatre teaching artist, as well as an Emmy award-winning journalist, producer, columnist, actress, poet, mixed-media folk artist, baker, and playwright. • Kim Arrington is an African-American teaching and performing artist who uses poetry, drama, and music to reach audiences of all ages. She has worked with The ArtsCenter's Artist in Residence program since 2008. In 2012, she was the recipient of North Carolina Central University's 40 Under 40 Award for excellence in the arts and is the co-founder of The Relative Pitch. • Erin Dangler is the owner of Broadway Bound, which is a company that teaches musical theatre to children. In addition, she is the Performing Arts Coordinator for Duke Arts in Health and a choreographer for mainstage productions for Playmakers Repertory Company in Chapel Hill. She has worked with The ArtsCenter's Artist in Residence program since 2009. • Jason Abide is a potter and ceramic artist who has taught classes to children and adults at The ArtsCenter since 2007. He has taught numerous residencies creating video and ceramic art on site with students, as well as summer camps teaching ceramics, writing and producing short films and documentary filmmaking. • Charles Pettee is a professional guitar and mandolin player, singer, songwriter and teaching artist. He has designed assembly programs and week-long curricula for artist residencies to teach the history of Bluegrass music and has been a part of The ArtsCenter's Artist in Residence program for several years. He is co-founder of The Shady Grove Band from Chapel Hill and has performed over 5,000 shows in his 32 years as a professional musician. • Teli Shabu is from Liberia, West Africa, and is the Musical Director and Lead Percussionist of The Magic of African Rhythm. He has toured with the African American Dance Ensemble and was awarded Best Original Music 2012 for his work on The Brothers Size at Manbites Dog theater. He teaches throughout North Carolina and performs with his touring unit Djembe Fire! • Jaki Shelton Green (guest artist) is North Carolina's poet laureate and has been teaching poetry and creative writing for forty years, in addition to being a community arts advocate. She currently teaches Documentary Poetry at Duke University Center for Documentary Studies. In addition, Orange County Schools hosts a district-wide event every Spring called Cultural Explosion, and every year several grade levels from schools participating in the Artist in Residence program participate either by hosting booths displaying created work or participating in performances. The ArtsCenter has a very successful School Show Series, and all students participating in the Artist in Residence program come to the theater to see shows directly linked to what they are learning in their classrooms. The School Show Series draws students from many different counties for field trips. Before the shows begin, the Artist in Residence program is promoted so other schools are aware of residency offerings. The School Show Series, as well as the Artist in Residence program, is also publicized through a color poster that is disseminated to all area schools, as well as through social media.
