PURPOSE: To authorize the County Manager to reject the non-responsive apparent low bid for
the Remediation of the John M. Link, Jr. Government Services Center project that was opened
on Thursday, September 25, 2019.
BACKGROUND: Over a period of time, the John M. Link, Jr. Government Services Center
developed a number of water intrusion issues related to deficiencies in the building envelope.
Earlier this year, plans and specifications were developed to address these issues, and the
project was advertised for bids in August 2019. Bids for the project were opened on Thursday,
September 5, 2019 with the result of an apparent low bid of $4,286,300.
The bids that were opened on September 5, 2019 were formally rejected by the Board of
Commissioners on September 17, 2019 because insufficient information was required from the
bidders to thoroughly and diligently examine and evaluate the project bids.
The project was advertised a second time requesting the information that was not provided in
the September 5 bid packages. On September 25, 2019 the second round of bids for the
project were opened with an apparent low bid of $4,553,364. A thorough evaluation of the
bidders' documents revealed that the apparent low bid is non-responsive because the bidder
represented itself as a joint venture, but necessary documents and bid bonds reflecting a joint
venture were not submitted and because the apparent low bidder lacks the proper remediation
certification required in the bid documents.
FINANCIAL IMPACT: There are no financial impacts associated with this item.
SOCIAL JUSTICE IMPACT: There is no Orange County Social Justice Goal impact associated
with this item.

ENVIRONMENTAL IMPACT: There are no Orange County Environmental Responsibility Goal
impacts associated with this item.
RECOMMENDATION(S): The Manager recommends that the Board reject the non-responsive
apparent low bid for the Remediation of the John M. Link, Jr. Government Services Center
project that was opened on Thursday, September 25, 2019 and authorizes the Manager to notify
the non-responsive bidder.
