PURPOSE: To accept a Guaranteed Maximum Price (GMP) of $36,354,082 as presented by
Bordeaux Construction (Attachment 1) for the development of the Orange County Northern
Campus.
BACKGROUND: In July 2018, the County retained Bordeaux Construction to serve as its
Construction Manager at Risk (CMAR) for the development of the Northern County Campus.
The Construction Manager at Risk project delivery method was chosen to improve cost
containment and cost certainty compared to other project delivery methods. Cost containment
is improved by allowing the Construction Manager to work collaboratively with the project
designers to yield the most cost effective design solutions from a construction standpoint. Cost
certainty is secured through a contractually binding guaranteed maximum price that is provided
to the County prior to start of construction. The CMAR process is also more transparent as the
CMAR provides more detailed financial accounting information with the entire project team
compared to a general contractor on a design-bid-build project.
In February 2019, the Board of Commissioners reviewed schematic design cost estimates for
the Northern County Campus and authorized a total budget of $40.2 million. The Campus,
located off of Highway 70 in Hillsborough, is intended to include a replacement Detention
Center, Environment and Agriculture Center, and Parks Operations Base. Substantial
completion is scheduled for March 9, 2021, and final completion is scheduled for May 9, 2021.
Campus Elements
• Detention Center
The new Detention Center would consist of one hundred forty-four (144) beds in
approximately 48,900 square feet. The new facility would replace the existing 40,227
square foot detention facility located in downtown Hillsborough that was originally
constructed in 1925 with additions and modifications occurring in the early 1980's and
mid-1990's.

• Environment and Agriculture Center (EAC)
The new 17,200 square foot Environment and Agriculture facility would replace the
19,087 square foot office building currently located on Revere Road that houses the
Department of Environment, Agriculture, Parks and Recreation, Cooperative Extension,
Farm Service Agency, and Soil and Water Conservation.
• Parks Operations Base
The new 8,500 square foot Parks Operations Base would replace scattered facilities and
a base and shop at Millhouse Road Park that is used primarily for office space and
equipment storage.
Bordeaux Construction advertised a request for qualifications in March 2019 and solicited over
850 firms for 36 different bid packages. Nineteen (19) of those packages included reduced
prequalification thresholds and bonding requirements to encourage the participation of small
and minority owned businesses. A local and minority business outreach session was held on
April 22, 2019.
Competitive bids from first tier subcontractors were opened on August 13, 2019 and on August
23, 2019. These bids were used to identify the lowest, responsible subcontractor bid for each
bid package. The bid packages totaled over $31.7 million in construction costs and ranged from
a $5.3 million bid for earthwork to a $14,600 bid for lockers. Over twenty-one percent (21%) of
the cost of work is anticipated to be contracted with Minority Owned Businesses (MBEs) that are
certified with the State of North Carolina Department of Administration (NC DOA). The
statutorily required goal for public works projects is ten percent (10%).
After the subcontractor bids were finalized, the Construction Manager led a value engineering
exercise to identify cost reduction options that would not affect the functionality of the project
elements. Those options were reviewed by County staff and the project architects, and a total
of over $466,000 in value engineering options are recommended to reduce the overall cost of
the project.
Bordeaux Construction has presented the County with a total guaranteed maximum price (GMP)
of $36,354,082 to deliver all of the elements of the Northern Orange County Campus after
deducting the value engineering options. The components of the GMP are detailed in
Attachment 1 and summarized in the following table:

At the end of the construction project, any unspent owner contingency funds or allowances are
retained by the County. If any amount of the Construction Manager contingency is unspent,
seventy percent (70%) is retained by the County, and thirty percent (30%) is shared with the
construction manager as an incentive to avoid unnecessary construction costs.
The GMP is one of the required elements to seek approval from the Local Government
Commission (LGC) to borrow money for the project. LGC approval is scheduled for October 1,
and approximately $10 million of the total project costs are recommended for financing in the
Fall financing package based on cash flow needs.
Bordeaux Construction has requested a notice to proceed on the initial site work and long lead
time materials immediately following acceptance of the GMP in order to avoid winter site
conditions and remain on schedule for project delivery. As a result, the proposed GMP is
recommended in two parts. The first part (GMP #1) is $10,019,850 million would be allowed to
proceed prior to formal approval by the LGC on October 1. This strategy has precedent and
poses minimal risk to the County. The notice to proceed for the balance of the project (GMP #2)
totaling $26,334,232 would occur following formal approval by the LGC as the construction
schedule dictates.
FINANCIAL IMPACT: The Board of Commissioners authorized a total project budget of $40.2
million. Given a GMP of $36.4 million, projected professional fees of approximately $3.3 million,
and a furniture, fixtures, and equipment budget of $625,000, the project is expected to be on
budget assuming that contingency funds and other allowances are not entirely exhausted during
construction.
SOCIAL JUSTICE IMPACT: The following Orange County Social Justice Goals are applicable
to this item:
• GOAL: FOSTER A COMMUNITY CULTURE THAT REJECTS OPPRESSION AND
INEQUITY
The fair treatment and meaningful involvement of all people regardless of race or color;
religious or philosophical beliefs; sex, gender or sexual orientation; national origin or
ethnic background; age; military service; disability; and familial, residential or economic
status.

• GOAL: CREATE A SAFE COMMUNITY
The reduction of risks from vehicle/traffic accidents, childhood and senior injuries, gang
activity, substance abuse and domestic violence.
• GOAL: ENABLE FULL CIVIC PARTICIPATION
Ensure that Orange County residents are able to engage government through voting and
volunteering by eliminating disparities in participation and barriers to participation.
The facilities located at the Northern County Campus are designed to provide a safe, efficient,
and functional work environment for County employees and an engaging, welcoming, and
utilitarian public space for residents. The new Detention Center will offer space consistent with
modern correctional standards as well as space for enhanced programming, medical and mental
health treatment, attorney consultation, and other due process considerations. The Environment
and Agriculture Center will provide improved space for training and education and will be more
accessible to its stakeholders. Finally, the Parks Operation Base will allow for a more efficient
organization of equipment, improved shop capabilities, and more effective deployment of staff.
ENVIRONMENTAL IMPACT: The following Orange County Environmental Responsibility Goal
impacts are applicable to this item:
• ENERGY EFFICIENCY AND WASTE REDUCTION
Initiate policies and programs that: 1) conserve energy; 2) reduce resource consumption;
3) increase the use of recycled and renewable resources; and 4) minimize waste stream
impacts on the environment.
• RESULTANT IMPACT ON NATURAL RESOURCES AND AIR QUALITY
Assess and where possible mitigate adverse impacts created to the natural resources of
the site and adjoining area. Minimize production of greenhouse gases.
The facilities on the Northern County Campus will include photovoltaic systems to produce solar
energy. The Environment and Agriculture Center will also use solar energy to produce hot
water, and the Detention Center will be heated and cooled using a geothermal based HVAC
system.
RECOMMENDATION(S): The Manager recommends that the Board:
1. After comparing the advantages and disadvantages of using the construction
management at risk method for this project versus those methods identified in North
Carolina General Statute 143-128(a1)(1) through North Carolina General Statute 143-
128(a1)(3), conclude that construction management at risk services is in the best interest
of the project and is the preferred method of proceeding with the project;
2. Accept a total Guaranteed Maximum Price (GMP) of $36,354,082 as presented by
Bordeaux Construction (Attachment 1) for the development of the Orange County
Northern Campus; and
3. Authorize the County Manager to approve change orders up to the total project budget
amount.

Guaranteed Maximum Price#1: $10,019,850
The GMP#1 scope includes the following bid scopes: BP-02A Surveying, BP-03A Building Concrete (bond
and reinforcing engineering), BP-05A Structural Steel (bond and detailing), BP-11C DEC/SCSC, BP-13A
Prefabricated Steel Cells (engineering), BP-13B Pre-engineered Metal Building, and BP-31A Earthwork
(Mobilization, Erosion Control, Clearing, Grading, Offsite Water,Allowances Pertaining to Grading).
In addition to cost of work items above, GMP#1 includes general (full 20 month duration), CM
allowances, Building permit allowance, and Owners contingency(partial). CM Contingency, Fee, Early
Completion Bonus, and Bonds and Insurances are calculated on each GMP individually. Unused CM
allowances, Owner Contingency, Building permit allowance, and Subcontractor allowances will be
returned in full to the owner at completion of the project. Unused CM contingency will be returned to
Owner with 70% returned to Owner in accordance with Article 5.7 of the Contract.
