Gordon Battle Superior Courtroom of the New Orange County Courthouse, 106 E. Margaret Lane, Hillsborough, North Carolina, on Monday, February 26, 2001, at 7:30 PM for the purpose of giving all interested citizens an opportunity to speak for ar against the following items: A. COMPREHENSIVE PLAN TEXT AND MAP AMENDMENTS Hillsborough Area Economic Development Activity Node Purpose: To receive public comment on proposed amendments to the Land Use Element of the Orange County Comprehensive Plan for this activity node. 1. Expand the existing I-40/Old NC 86 Economic Development Activity Node to include: (CP-1-01) Area 1 Action: Change land use From: Rural Residential To: Ten-Year Transition and Economic Development Activity Node Size: 97.67+ acres Location: Between existing I-40/Old NC 86 Economic Development Activity Node and along the western side of NC 86 Identification: Hillsborough Township, Tax Map 49, Block B, Lots 15, 16, 17, 18, 19, 20, and 22 (part) and Tax Map 50, Lots 6, 7, and 8. Area 2 Action: Change land use From: Twenty-Year Transition (retain) To: Economic Development Activity Node Size: 92.57+ acres Location: Along the northeastern section of the I~0/Old NC 86 EDD between Beckett's Ridge Subdivision and Town of Hillsborough EDD Identification: Hillsborough Township, Tax Map 40, Block A, Lot 22 (part) and Tax Map 45, Lot 2 (part). 2. B, ORANGE COUNTY ZONING TEXT AMENDMENTS 1. Economic Development District (I-40 /Old NC 86) Zoning Text Amendments Purpose: To receive public comment regarding the proposed EDD Manual and Table of Permitted Uses Matrix Amendments. The manual has been abridged to Hate objective and subjective development standards and guidelines. In addition, permitted uses are being realigned in new zoning categories that support the Economic Development land use map. C. ORANGE COUNTY ZONING ATLAS AMENDMENTS 1. I-40/Old NC 86 EDfD Zoning Atlas Amendments Purgrose: Ta hear public comment on the revisions to the new, proposed Hillsborough Area Economic Development District. Proposed revisions include adding two new areas (Area 1 and 2) to the existing I-40 / Old NC 86 EDD and amending the existing I-40 /Old NC 86 EDD (Area A) by revising land uses and process. Hillsborough Area EDD Zoning Atlas Amendment Purpose: To hear public comment on the proposed Zaning Atlas Amendment within the new Hillsborough Area Economic Development District. PUBLIC SCHOOL IMPACT FEES Effective July 1, 1993, the Board of County Commissioners established a system of impact fees to help fund a portion of the school capital needs created by growth in the county. Since that date, an impact fee has been collected for each new housing unit constructed or installed in the county, including single-family homes, multi family housing units, apartments, and mobile homes. Fees collected in the Chapel Hill-Carrboro School District are deposited in a special account and used exclusively for the construction of new school facilities in that district. The same is true for fees collected in the Orange County School District. The impact fee supplements funds provided by the County from sales tax and property tax revenues for school capital projects. The public school impact fee collected is now $750.00 for each new residential unit located in the Orange County School District and $3,000 for each new residential unit located in the Chapel Hill-Carrboro School District. The Board of County Commissioners recently employed a consultant to evaluate the potential for a public school impact fee rate structure that could legitimately be the basis for a less regressive fee structure based on charging a different fee amount far different housing types. Also, the Orange County Board of Education has recently requested that the Orange County Board of Commissioners increase the amount of the fee for new residential dwelling units located in the Orange County School District. The 2001 Technical Report prepared by the consultant concluded that there was a legitimate basis for charging one fee for single family homes and a lower fee for all other residential dwelling units. The Report reflects new demographic data concerning the number of students per household and recommendations of the School Facilities Construction Standards Work Group, and calculates MAXIMUM fees that could be charged as follows: Maximum for Maximum for all other single-family residenial homes units Orange County School District $5,375 $2,53$ Chapel Hill-Carrboro School District $7,374 $3,304 The Board of Commissioners will consider whether or not to change public school impact fees following the February 26, 2001 public hearing. THE r ~ ~U MAXIMUM LEGALLY PERMISSIBLE FEES CALCULATED IN THE REPORT OF THE CONSULTANT ARE NOT A PROPOSAL TO CHARGE THOSE FEES. Any change in the present fees will be determined by the Board of Commissioners fallowing public comment at the public hearing and otherwise. In no event will public school impact fees be changed to an amount or amounts that exceed the maximums determined by the 2001 Technical Report. E. ORANGE COUNTY PLANNED DEVELOPMENT REZONING /SPECIAL USE PERMIT, CLASS A The Preserve -Planned Development Mixed Use (MU) District and Special Use Permit, Class A Action: Planned Development Zoning Atlas Amendment (Rezoning) & Special Use Permit, Class A From: Agricultural Residential (AR) To: PD -Mixed Use with Class A, Special Use Permit Size: 470+ acres (excluding proposed right-of--way) Location:-Between NC 57 and NC 86 adjacent to and north of the new Pathways Elementary School Identification: Hillsborough Township, Map 1, Block B, Lot 27; Map 2, Lot 2 and Map 3, Lots 14, 14B and 14C. Zoning Docket: PD - 2001 -- 01 Changes may be made in the advertised proposals that reflect debate, objections and discussion at the hearing.
