Hillsborough Area EDD. BACKGROUND: The Orange County/Hillsborough Economic Development Districts Task force has been working since February of 2000 on zoning districts that would permit certain uses by right and some uses through a planned development rezoning and/or a special use permit process. Rather than create numerous new districts, staff is using the Economic Development District as the broad land use category. Within the broad Economic Development land use category new subdistricts will have prefixes of `ED' and specific subdistricts associated with them. For example, ED-O would be called Economic Development -Office District and ED-FLX would be the Economic Development - Office/Flex District.. By using this approach we are able to adhere to the existing Comprehensive Plan designations of Economic Development Activity Node for the Hillsborough Area EDD. It retains the classification of Economic Development District with which everyone is familiar. It. also provides a way to designate specific areas of the EDD for certain types of uses. Section 2 of the proposed ardinance is a housekeeping item that refers users to the Economic Development Design Manual for development standards. Section 3 of the proposed ordinance changes the name of the I~0/Old NC 86 Economic Development District to the Hillsborough Area Economic Development District within the text of the EDD Design Manual. 2 Section 4 of the proposed ordinance allows a rewrite of the section of the EDD Design Manual for the Primary and Secondary Areas. The new subdistricts have standards and an associated table of permitted uses that sets.forth the types of uses that will be allowed in the Hillsborough Area EDD. The old classification of primary and secondary areas will not be needed under the subdistrict approach. Section 5 of the proposed ordinance provides the requirements of Planned Developments within the new Hillsborough Area EDD. This section creates the Master Development Plan approach for large projects (2D acres and over) using a Planned Development district with a project Special Use Permit, Class A. The Master Development Plan sets the perimeters of uses, buffers, roadways, environmental concerns in the special use permit. No development can occur on the site with only a Master Development Plan approval. A Final Development Plan, with a higher degree of detail, and. a Special Use Permit, Class A would have to be approved for all tracts over 2.0 acres and/or structure(s) cumulatively over 20,000 square feet before development on the site could commence. Far sites 2.0 acres and less and/or structures 2D,DD0 square feet and less the Planning Director has final approval authority. Additional, reasonable conditions not addressed at the master plan level can be added at the Final Development Plan stage. For uses permitted by right, the 2.0 acre/2D,000 square foot building threshold would require a Special Use Permit, Class A if these limits are exceeded. The two-phase approach provides flexibility to the County and the developer. The County is assured of a certain type of development and intensity while the developer is allowed the flexibility of marketing the site far specific uses and in accordance with Master Development Plan approval. Should a.petitioner want to submit far a Planned Development for immediate approval the procedure would fallow the Small Scale Development Plan with a Special Use Permit, Class A. This is the method far planned development approvals in Orange County now. The Small Scale Development Plan and the Final Development Plan will have the same level of detail provided. FINANCIAL IMPACT: No fiscal impact is associated with this action. RECOMMENDATION(S): Planning Staff recommends Approval of the proposed amendments. AN ORDINANCE AMENDING THE ZONING ORDINANCE OF ORANGE COUNTY THE BOARD OF COMMISSIONERS OF ORANGE COUNTY ORDAINS THAT THE ORANGE COUNTY ZONING ORDINANCE IS AMENDED AS FOLLOWS: Section 1. Amend Article 6.29.3 Part Two: Performance Standards. of the Orange County Zoning Ordinance entitled `Econamic Development Districts Design Manual (Abridged Version)' by adding a new subsection 2.1A under section 2_1 Develo aLment Areas as follows: 2.1A ECONOMIC. When an Economic Development subdistrict rezoning proposal is considered, the request shall be consistent with the Comprehensive Plan. The commercial, office and light industrial land use goals and recommendations identified in other sections of this EDD Design Manual shall be used as a guide, in conjunction with other factors, in determining the appropriateness of the proposed district. Nothing in this section is intended to limit the discretion of the Board of Commissioners to deny a petition to rezone property if it determines that the proposed rezoning is not in the public interest. a i./ 4 ~~ (A) ED-LQ-1 Economic Development-Limited Office-1 District (1) Purpose. The ED-LO-1 District is primarily intended to accommadate law intensity affice uses and supporting services. The district is intended to be located on small areas (5 acres and less) within the Economic Development District. The district may contain limited commercial uses within employment centers or where vehicular access is provided internally to the development. (2) General Dimensional Requirements - ED-LO-1. (B) ED-LO-2 Economic Development-Limited Office-2 District (1) Purpose. The ED-LO-2 District is primarily intended to accommodate low intensity office uses and supporting services. The district is intended to be located on small areas (5 acres and less) within the Economic Development District.' Parcels existing as of the date of this ordinance containing cumulatively mare than 2 acres shall only be developed through a Planned Development process or after issuance of a Special Use Permit, Class A approval. The district may contain low to moderate density residential uses (1-$ units per acre). (3) Application Criteria a. This district will be applied in the Hillsborough Area Economic Development District. b. This district shall only be applied where water and sewer is available at the site or is to be made available to the site as part of the development approval process. EXCEPTION: Single-family lots located south of I- 40 may use ground absorption septic systems on minimum size lots of 40,000 square feet provided at least 33% of the tract is preserved as open space. c. Single family uses shall follow Section IV-B-10 Flexible Develo ment of the Subdivision Regulations. d. Single-family lot sizes shall be a minimum of 7,500 square feet and a maximum of 14,000 if connected to public sewer. e. Multi-family structures shall be limited to a two-story maximum. f. Duplex and multi-family uses shall be connected to a public water and public sewer system. g. A structure or structures exceeding 20,000 square feet cumulatively on one zoning lot shall only be approved through a Special Use Permit, Class A process regardless of use. h. All zoning lots greater than 2.0 acres shall only be approved through a Special Use Permit, Class A process regardless of use. i. No drive through facilities may be constructed in this district. (C) ED-FLX Economic Development -Office/Flex District (1) Purpose. The ED-FLX District is intended to accommodate a wide range of assembling, fabricating and light manufacturing activities, and such ancillary industrial activities as warehousing and distribution. Some commercial services are also permitted accessory to industrial development provided all access is provided internally. (D) ED-LNO Economic Development -Linear Office District (1) ,Purpose. The ED-LNO District is intended to accommodate low to moderately intense medical, professional, administrative and government ofFce on small to mid-sized sites. The district is intended to be located on the periphery of established residential areas and along major and minor. thoroughfares. The district is established to provide convenient locations for offices, the size and operating characteristics of which require limited parking and which generate little traffic. Standards are designed so that this district may serve as a transitional land use between residential districts and higher, more intense land uses. This district will be applied in the Hillsborough Area Economic Development District. b. This district shall only be applied where water and sewer is available at the site or is to be made available to the site as part of the development approval process. (4) Supplementary District Requirements. Structures in the LNR District shall not exceed 5,000 square feet in gross floor area. (5) Hours of Operation. If hours of operation are to exceed the EDD limits of 6:00 AM until 11:00 PM, a Class A Special Use Permit shall be required. ~~ (6) Trash Facilities. Dumpsters shall be enclosed on three (3) sides with walls at least eight (8) feet high and constructed of the same material as the principal building on the zoning lot; the fourth side of the enclosure shall be a permanent gate of wood or other opaque material. (7) Exterior Lighting. Exterior lighting on the property shall not be installed at height of more than eight (8) feet above the finished grade and shall be so shielded as to cast no direct light upon adjacent property. (8) Buffer around exterior boundary of the EDD. When a site within the ED-LNR District adjoins the exterior boundary of the EDD, the perimeter buffer of the EDD may be reduced to fifty- (50) feet. Landscaping in accordance with the EDD design manual shall be installed. (9) Interconnectivity between parcels. All parcels shall provide for interconnectivity between parking areas if determined necessary by staff. (E) ED-O Economic Development -Office District Planned Development-Economic Development -Office (1) Purpose. The ED-O District is primarily intended to accommodate high intensity office uses and supporting services. The district is intended to be located on large areas within the Economic Development District. The district may contain limited commercial uses within. employment centers. This district is only permitted through the planned development district zoning process. The minimum size ofi a PD-MU district shall be 20 acres. d. There are no minimum lot sizes in the Mixed Use District; the, Master Development Plan or Small Scale Development Plan will set forth the setbacks as indicated in the General Dimensional Requirements listed above. Single-family and duplex residential uses foNowing the flexible development guidelines may reduce the minimum setbacks by 50 percent and the lot width by 60 percent. e. All autparcels within the PD-ED-MU district shall have internal access to the development. Section 2: Add new Section 7.21.2 to refer users to Economic Development District Design Manual for all development specifications. Development Standards within Economic Development Districts All developments shall meet the standards for approval as specified in the Economic Development District Design Manual (Section 6.29.3 of the Zoning Ordinance). Section 3: Amend Article 6.29.3 Economic Development Districts Design Manual by removing all references to the I-40/Old NC86 District and replacing all refierences with Hillsborough Area EDD. . Section 4: Amend Article 6.29.3 Economic Development Districts Design Manual by creating new designations for primary and secondary areas in the Hillsborough Area EDD. Section 5: Add a new section to Article 6.29.3 of the Orange County Zoning Ordinance entitled Economic Development Districts Design Manual to set forth the requirements of Planned Developments using either the Master Development Plan approach or the Small Scale Development Plan approach. If the petitioner elects to petition for a Economic Development Planned Development district, the petition must specify the actual use(s) intended, one or more of the permitted uses listed in the Permitted Use Table in the EDD Design Manual (Abridged Version) for the entire tract or any part or parts thereof, for the property specified in the petition, and the proposed use(s) must be a use(s) permitted in the corresponding general use district. Uses in the subcategories of the Permitted Use Table may be limited by either the petitioner ar the County Commissioners. If the .petitioner petitions for two (2) or more Planned Development districts, the petitioner shall submit a separate petition for each district. The County Commissioners, in considering whether to approve or disapprove a Planned Development district petition, shall do so on the basis of the specific use(s) requested. B. General Com liance Provisions 1) Any petition to amend district boundaries to create an Economic Development Planned Development district shall comply with procedures for both general use district amendments and Planned Developments set forth in the Zoning Ordinance. 2) The petitioner may elect to submit a Planned Development, Special Use Permit, Class A as either a Master Development Plan or as a Small Scale Development Plan. a. Site Plan Submittal. Development plans shall be submitted for the Master Development Plan in accordance with Section C below. Site plans shall be submitted for Small Scale Development Plans in accordance with Section D below. Final Development Plans of Master Development Plans shall be submitted in accordance with Section E below. b. Final Development Plan. The Final Development Plan of projects using the Master Development Plan approach shall not be accepted until the Master Development Plan and project Special Use Permit, Class A has been approved by the County Commissioners. 3) Performance standards for Special Use Permits., Class A within Hillsborough Area EDD This section establishes criteria pertaining to appearance in the design of a site, buildings and structures, landscaping, signs, and other miscellaneous features that are observed by the public. Aesthetic criteria are not intended to restrict imagination, innovation, or variety, but rather to assist in focusing an design principles which result in creative solutions that will promote visual appearance within the city and county, preserve taxable values, and promote the public health, safety and welfare. ono Standards generally a) Harmonious and e~cient organization. The site plan shall be organized harmoniously and efficiently in relation to existing topography, the size and type of plot, the character of adjoining properly, and the type and size of buildings. The site will be developed to facilitate orderly development of surrounding property and with minimal disturbance to the natural environment. b) Preservafion of natural state. Desirable vegetation or other unique natural features shall be preserved in their natural state when practical. The Environmental Protection Plan shall include the locations of all existing trees 12"diameter four feet above the ground. c) Enhancemenf of residential privacy. The site plan shall provide reasonable visual, lighting, and sound privacy for all adjacent dwelling units. d) Emergency access. Structures and other site features shall be arranged to permit practical emergency vehicle access to all sides of buildings. e) Access to public ways. Every structure and dwelling unit shall have access to a public street, walkway or other area dedicated to common use. f) Non-motorized circulafion. Anon-motorized circulation. system shall be provided which is direct, efficient, and pleasant. The system shall be complementary to, but independent of the vehicular circulation system. g) Design of access and egress drives. The location, size, and numbers of ingress and egress drives to a site will be strictly limited to minimize the negative impacts on public streets and on adjacent property. This shall include formal entryways and access to outparcels from inside the development only. h) Coordination with off-site circulation systems. The arrangement of rights-of-way or easements for circulation shall coordinate with the pattern of existing and planned streets, pedestrian and/or bicycle pathways and transit routes in the area. Connection to adjacent properties is encouraged where possible. i) Stonnwafer canfrol. Protective measures shall ensure that removal of stormwater runoff will not adversely affect neighboring properties or the public storm drainage system. Provisions shall be made for construction of wastewater facilities including grading, gutters, and piping to direct stormwater and prevent erosion. Surface water on all paved areas shall be collec#ed at intervals that do not obstruct vehicular or pedestrian trafFc. j) Exterior lighting. Location, type, size and direction of exterior lighting shall not glare or direct illumination that interferes with adjacent properties or safety of public rights-of--way. k) Protection of property values. Elements of a site plan shall be arranged to have minimum negative 'impact on values of adjoining property and other on-site uses. Specific standards Unless otherwise indicated here, the relevant standards for the OfFce Institutional district shall apply. Where actions, designs, or solutions proposed by the applicant are not literally in accord with the applicable regulations of this ordinance, but the Board of Commissioners makes a ~~ finding in the particular case that public purposes are satisfied to an equivalent or greater degree, the Board may make specific modification of the regulations in the particular case. Any modification of regulations shall be explicitly iridicated in the approved permit. a) Relationship of buildings to site. 1. The site shall be planned to provide for adequate planting, safe pedestrian movement, and parking areas. 2. Parking areas shall be treated with decorative elements, building wall extensions, plantings, berms, or other innovative means, so as to screen parking areas from view from public ways and reduce heat generated by paved. areas. 3. Without restricting the permissible limits of the applicable zoning district, the height and scale of each building shall be compatible with its site and existing or anticipated adjoining buildings. 4. All utility services shall be underground. b) Relationship of buildings and site to adjoining areas. 1. Attractive landscape transition to adjoining properties shall be provided. 2. Lighting intensity at the property line adjacent to residential uses shall not be greater than'/z footcandle. c) Building design. 1. Architectural style is not restricted. ,Evaluation of the appearance of a project shall be based on its relationship to the surroundings. Primary and pedestrian facades are encouraged to complement and reflect the characteristics of downtown Hillsborough. 2. Specific building materials are not endorsed. Evaluation of the appearance of a project shall be based on the relationship to surroundings. i. Materials and design shall be compatible with each other in multiple building projects. ii. Materials shall be selected for suitability to the type of buildings and the design in which they are used. Utilitarian materials shall be limited to inconspicuous facades and non- public or service areas. Materials with unique or special character are encouraged. 3. Buildings and building components, such as walls, windows, doors, eaves, and parapets, shall have human proportions and relationships to one another. 4. Mechanical equipment or other utility hardware on the. roof, ground, or buildings shall be screened from public view with materials harmanious with the building, or they shall be so located as not to be visible from any public ways. This provision does not apply to the installation of electric vehicle charging stations. 5. Exterior lighting shall be part of the architectural concept. Fixtures, standards, and all exposed accessories shall be harmonious with building design. ~'~ 2 6. Recycling and waste removal areas, service yards, storage yards, and exterior work areas shall be located away from and screened from view from public ways, using materials as stated in criteria for equipment screening. Areas shall be sized to accommodate changes in technology and local refuse ordinances. 7. Variation of detail, form, material, and siting may be used to provide visual interest. In multiple building projects, variable siting of individual buildings may be used to prevent a monotonous appearance. d) Landscaping and site treatment. Landscape elements included in these criteria consist of all forms of planting and vegetation, ground forms, rock groupings; water patterns, and all visible construction except buildings and utility structures. New and existing vegetation shall be maintained in a flourishing manner. 1. Natural or existing topographic patterns contributing to the beauty and utility of a development shall be preserved and developed. Modification to topography will be permitted where it contributes to good appearance and does not adversely affect significant natural features and drainageways. 2. Grades of walks, parking spaces, terraces, and other paved areas shall provide an inviting and stable appearance. 3. Landscape treatment shall be provided, to enhance architectural features, strengthen vistas and important visual corridors, and provide shade. 4. Unity of design shall be achieved by repetition of certain plan varieties and other materials and by correlation with adjacent developments. 5. Plant material shall be selected for its structure, texture, and color for interest and for its ultimate growth. Use of native plants is encouraged; others that will be hardy, harmonious to the design, and of good appearance can be allowed. 6. Appropriate curbs, tree guards or other devices shall be employed to protect plants susceptible to injury by pedestrian or motor trafFc. 7. Parking areas and trafficways shall be enhanced with landscaped spaces containing trees or tree groupings: 8. Service yards and other unsightly places shall be screened by use of walls, fencing and/or planting. e) Signs 1. Every sign shall have appropriate scale and proportion in its design and in its visual relationship to buildings and surroundings. A . unified signage plan shall be submitted and approved with the Special Use Permit. 2. Every sign shall be designed as an integral architectural element of the building and the site to which it principally relates. 3. The colors, materials and lighting of every sign shall be harmonious with the building and site to which it principally relates. 4. The number of graphic elements on a sign shall be held to the minimum needed to convey the sign's major message and shall be composed in proportion to the total area of the sign face. 5. Freestanding signs shall not exceed 7 feet in height and shall not be pole-mourited. f) Maintenance, planning and design factors. 1. Materials and finishes shall be selected for their durability and wear as well as far their beauty. Proper measures and devices shalt be incorporated for protection against the elements, neglect,. damage, and abuse. 2. Provisions for cleaning buildings and structures and control of dirt and refuse shall be included in the design. Configurations that tend to accumulate debris and dirt shall be avoided. g) Transportation Network Capacity C. Master Develo ment Plan Provisions 1) The Master Development Plan shall show, through a combination of graphic means and text (including without limitation proposed conditions to be included in the Special Use Permit, Class A for the proposed development): a. The total tract acreage along with location, types, maximum floor areas and impervious surface areas far non-residential and multifamily uses. b. The location and orientation of buildings, parking areas, recreational facilities, and open spaces; c. Proposed access points and circulation systems for vehicles, bicycles, and pedestrians; d. Preservation of unique natural or constructed features, including retention of existing vegetation and showing all district buffers; e. Right-of--way in accordance with transportation plan; f. Visual impact from along major transportation corridors; g. How the development plans to use design and architectural controls as well as screening and landscaping to ensure that the design flexibility provided in the proposed Planned Development district produces a high quality development. Calory shall be diverse and .harmonious and a palette of colors shall be submitted for approval. One color should not dominate any palette and bright colors should be used as accents only; h. How the development proposes to minimize or mitigate any adverse impacts on neighboring properties and the environment, including without limitation impacts from traffic and stormwater runoff; 2) The Planning Board (and other advisory boards to which the Board of County Commissioners ,may refer the application) shall review the proposed Master .Development Plan and Special Use Permit, Class A application at the same time it considers the petitioner's rezoning request. In response to suggestions made by the Planning Board (or other advisory boards), the applicant may revise the Master Development Plan and Special Use Permit, Class A application before it is returned to the Board of County Commissioners provided the changes are in response to items ~~~ raised at either the public hearing or subsequent to the Planning Board recommendation. 3) The Board of County Commissioners may only approve a rezoning application if it simultaneously approves the Master Development Plan and Special Use Permit, Class A for the development of the property, subject to such reasonable modifications and conditions as the Board may impose in the exercise of its legislative discretion. 4) If a Planned Development rezoning application is approved with a Master Development Plan and a Special Use Permit, Class A the approval of the Master Development Plan under this section does not obviate the need to obtain a Final Development Plan and Special Use Permit, Class A for the individual "pods" or buildings shown on the Master Development Plan in accordance with the special use permit provisions of Section 8 of the Orange County Zoning Ordinance. 5) A Master Development Plan approved under this section may only be amended in accordance with the provisions applicable to a rezoning of the property in question. 6) Not withstanding the foregoing provisions, if the Board of County Commissioners finds during its review of a request for approval of a Planned Development Master Development Plan that sufficiently detailed information has been submitted, the Board may approve the Master Development Plan as a Special Use Permit, Class A for an individual site or for the entire development. For purposes of this subsection, the ,phrase "sufficiently detailed information" means that type and degree of information which allows the Board to understand and .approve all of the major discretionary design elements of the project, leaving mostly technical or engineering matters to be approved by the staff. If a Master Development Plan is approved a Special Use Permit in this way, the approval process shall follow the ,same procedures and standards applicable to other special use permit applications. Any lot that is subdivided out of a tract for which a Master Development Plan has been approved as Small Scale Development Plan with a Special Use Permit, Class A under this subsection may then be developed after a zoning compliance permit has been secured. D. Small Scale Develo ment Plan Provisions 1. Site Plans drawings for Small ,Scale Development Plans shall meet the requirements of Article 14 of the Zoning Ordinance and the guidelines of the Economic Development Design Manual. 2. The Planned Development petition and Special Use Permit, Class A application shall be reviewed concurrently by the Board of County Commissioners according to the same procedures and in accordance with the same standards applicable to other special use permit applications. 3. The Board may not approve a Planned Development petition unless it ~I~ simultaneously approves the Special Use Permit, Class A application for the development of the property, .which special use permit may be approved subject to reasonable conditions and requirements as set forth in Article 8 of the Zoning Ordinance and the guidelines in Article 6.29.3 of the Zoning Ordinance. 4. In addition to other grounds for denial of a special use permit application, a special use permit may be denied on the basis that the application is inconsistent with an approved Master Development Plan far the same tract. However, if the special use permit is approved, the Board of County Commissioners shall be deemed to have amended the Master Development Plan to the extent necessary to bring it into conformity with the existing project Special Use Permit, Class A. E. Final Development Plan Provisions 1. Site Plans drawings for Final Development Plans shall meet the requirements of Article 14 of the Zoning Ordinance and shall be consistent with the approved Master Development Plan and address all conditions of the project Special Use Permit, Class A. 2. Tracts over 2.0 acres and/or structure(s) totaling cumulatively over 20,000 square feet on one zoning lot shall submit a Special Use Permit, Class A modification request for a Public Hearing and follow all procedures as specified in the zoning ordinance. Otherwise, the site plan may be approved by the Planning Director. 3. A metes and bounds legal description of the Final Development Plan shall be submitted along with either the application for the Special Use Permit, Class A modification or the site plan submitted for Planning Director approval. 4. No special use permit for a site governed by a Master Development Plan may be denied for reasons set Earth in Article 8 (Special Uses) if the basis for such denial involves an element or effect of the development that has previously been specifically addressed and approved in , the Master Development Plan approval process, unless (i) it can be demonstrated that the information presented to the Board of County Commissioners at the Master Development Plan approval stage was materially false or misleading, or (ii) conditions have changed substantially in a manner that could not reasonably have been anticipated, or (iii) a basis for denial for reasons set forth in Article 8 (Special Uses) is demonstrated by clear and convincing evidence. 5. No Final Development Plan shall be accepted by staff for review until the Master Development Plan has been approved and recorded. 6. The Planning Director shall have the discretion to require that a site plan follow the public hearing Special Use Permit modification procedures should the submitted site plan violate, in the Planning Director's opinion, the provisions set forth in provision # 4 above. . Section 6: Amends subdivision requirements in the Hillsborough Area EDD. Subdivision Regulations,in Economic Development Districts 1. When a Planned Development rezoning petition is approved, and the tract that is subject of said rezoning is proposed to be subdivided, all provisions of the Subdivision Regulations shall be satisfied. a) The applicant may obtain approval of the subdivision simultaneously with the approval of the rezoning if sufficient information (i.e. lot lines, lot size, etc) is shown on the site plan or at a later time. b) The subdivision shall be consistent with the terms of the Master Development Plan or Small Scale Development Plan and Special Use Permit, Class A (as applicable) that is approved along with the rezoning petition. c) If the Master Development Plan or Small Scale Development Plan and Special Use Permit, Class A (as applicable) that is approved along with the Planned Development rezoning petition establishes density, floor area, ,impervious surface, or similar limitations on the tract that is rezoned or any portion thereof, the subdivision final plat that creates lots out of any portion of the tract so encumbered shall indicate on the face of the plat with respect to each lot such limitations or restrictions as are necessary to ensure compliance with the Master Development Plan or Small Scale Development Plan.
