PURPOSE: To consider approval of a request from the North Carolina Department of
Transportation (NCDOT) that Orange County provide three easements on the eastern and
western boundaries of McDougle Elementary School property as necessary to construct
roadway improvements on both Hillsborough and Old Fayetteville Roads.
BACKGROUND: NCDOT is poised to commence roadway improvement projects (widening
roadways and constructing sidewalks) on the both Hillsborough and Old Fayetteville Roads in
Carrboro. Hillsborough Road borders the McDougle school property on the east side and Old
Fayetteville Road borders the property on the west side. The construction will require some
limited encroachment (one very small temporary construction easement and a very small
permanent right-of-way and one larger temporary construction easement) on the McDougle
Elementary School property. CHCCS staff are aware of the roadway project and the need to
encroach. upon McDougle school property because DOT staff initially talked with them in
summer 2000 about the needed easements. DOT staff have subsequently been coordinating
with the County Engineer, since they became aware that the County actually holds title
(because of the installment financing arrangement under which the school was constructed) to
the land on which McDougle Elementary School is located.
The roadway improvements to Hillsborough Road will slightly modify both the horizontal
(roadway location) and vertical (roadway grade) alignments of the existing roadway in the
vicinity of the McDougle school property. In turn, this will require some slight modification of the
existing horizontal and vertical alignments of the Hillsborough Road entrance drive to the school
(at the north east comer of the property). NCDOT project construction contractors will make
those modifications as a part of the project, but it must have a temporary construction easement.
to accomplish the portion of the necessary construction work that will occur on school property.
The total 'size of the temporary construction easement is approximately 11,000 square feet.
The roadway improvements to Old Fayetteville Road will involve adjusting the access drive to
OWASA's elevated water storage tank, which adjoins the northern boundary of the McDougle
Elementary School property. NCDOT needs approximately 190 square feet of permanent right-
of-way and approximately 260 square feet of temporary construction easement to install
sidewalk and to modify the radii to the OWASA entrance drive at this point. The roadway
improvements will also require relocation/reconstruction of fencing on the McDougle Elementary
School site. These modifications will also be accomplished by NCDOT project construction
contractors as a part of the overall project.
FINANCIAL IMPACT: NCDOT has offered compensation to the County in the amount of
$5,175 for the easements. Staff believes that this represents fair compensation in that the
County's permanent conveyance of property title to NCDOT is limited to.190 square feet at the
far northwest corner of the property.
RECOMMENDATION(S): The Manager recommends that the BOCC authorize the Chair to
execute the documents conveying the necessary easements to NCDOT with the' following
stipulations: 1) NCDOT and its construction forces repair, replace, remediate, etc., as. required
all construction related damage to school property, infrastructure and landscaping; and
2) NCDOT and its construction forces coordinate any on-site (McDougle school property)
construction activities impeding ingress and egress to McDougle school with CHCCS and
McDougle school officials.
