PURPOSE: To consider approving the Memorandum of Agreement between UNC School of
Dentistry and the Orange County Health Department for services to the Preschool Dental
Screening Project.
BACKGROUND: The Health Department has traditionally received funds from the Orange
County Partnership for Young Children for a preschool dental screening program for day care
and family child care homes in the county. The program usually begins in April and runs
through June and last year reached approximately 1900 preschoolers. The UNC School of
Dentistry is a partner with the Health Department in delivering this important program. This
memorandum of agreement stipulates that the UNC School of Dentistry will provide a Project
Director for the Program that schedules senior dental and dental hygiene students who perform
the dental screenings, examinations, education and preventive treatment; provides dental
attending staff that serve as preceptors to these students; and coordinate with Health
Department staff in the logistical arrangement for this program.
Health Department staff actually coordinate and implement the program, including follow-up for
children with identified dental needs. The agreement with the Dental School allows the actual
screening clinics to be conducted by Dental School students, faculty, and staff.
The goal of the Preschool Dental Screening Project is to promote preventive dental health
education and identify needs and barriers concerning access to dental care for children age 0-5
in day care centers, family day care homes and other settings.
FINANCIAL IMPACT: The Health Department has received a Smart Start grant this fiscal year
totaling $36,645 for this project. Costs associated with the Dental Screening project, including
the attached Memorandum of Agreement, will be covered by the grant. No County funds are
directly associated with the program.
RECOMMENDATION(S): The Manager recommends that the Board approve the
Memorandum of Agreement with the UNC School of Dentistry and authorize the Chair to sign
the agreement.
MEMORANDUM OF AGREEMENT BETWEEN
THE UNIVERSITY OF NORTH CAROLINA AT CHAPEL HILL

I. PURPOSE
This document is a Memorandum of Agreement between the University of North
Carolina at Chapel Hill, for its Department of Dental Ecology in the School of Dentistry,
hereafter referred to as the "University," and Orange County Health Department, as a part
of the County of Orange, hereafter referred to as the "OCHD", for. the purpose of
providing a Project Director for its Smart Start Grant awarded by the Orange County
Partnership for Young Children, hereafter referred to as "OCPYC".
II. EFFECTIVE DATES
This agreement shall be effective as of April 1, 2001 and shall remain in effect until June
30, 2001 unless terminated as set forth below. Either party may request a change in the
terms of this agreement. Any agreed to change to this agreement must be approved by
both parties' written endorsement thereto. Either party may terminate this agreement by
giving the other party 30 days written notice in advance of the desired termination date.
III. GENERAL AGREEMENT
During the performance of this agreement, both parties agree as follows:
A. The OCHD hereby agrees with the University that, in its educational and/or
employment practices, said contracting party will not discriminate against any
person because of race, color, religion, sex, national origin, age, or disability.
B. The OCHD will not be responsible for damages arising from personal injury to
students of the University while they are present at the OCHD unless personal
injury was caused by the negligence of the OCHD, its employees, or agents.
C. In the event the student is exposed to blood or body fluids, the OCHD will be
responsible for providing an initial response, according to the Institution's Blood-
Borne Pathogens Standard. The student will be required to return to University of
North Carolina Student Health Services for post-incident testing and counseling if
feasible. In the event the student is unable to do so in a timely manner, the
OCHD will provide access to testing and counseling for the student. The student
will be responsible for the payment of services, but will be able to request
reimbursement from the University.
D. The University will be responsible for the negligence of its employees and agents
to the extent permitted by the North Carolina Tort Claims Act.
E. The OCHD shall pay the University $6,000 by June 30, 2001 upon receipt of the
University's invoice. The University shall invoice the OCHD no later than May 1,
2001.
IV. SPECIFIC RESPONSIBILITIES OF THE UNIVERSITY
The University acknowledges the following specific responsibilities in connection with
this agreement:
A. To provide a Project Director for the Smart Start Program'who will: 1) Schedule
preselected senior dental and dental hygiene students to visit the Orange County
Health Department and the majority of day care centers in Orange County to
perform dental screenings, examinations, education and preventive treatment; 2)
be available to answer questions from parents and the day care center directors; 3)
consult with the NC Public Health Dental Hygienist in order to provide the
specific dental educational materials for the children, parents and the day care
personnel; 4) schedule dental attendings who will serve as preceptors to the
dental students and the dental hygiene students while at the OCHD Dental
Clinics.
B. To ensure that University students, who are the subject of this agreement, abide
by all existing rules and regulations of the OCHD in the performance of their
activities at the OCHD.
C. To be responsible for providing adequate professional liability insurance for the
University and its students who are the subjects of this agreement. While the
student is participating in the project, their professional liability insurance
coverage through Medical Security Insurance Company will be provided by the
School of Dentistry ($1,000,000 to $3,000,000 a year for all students).
D. The University shall be responsible for training its students to follow the OSHA
Blood-borne Pathogens Standards, ensuring that its students comply with health
requirements established by North Carolina state regulations and the University.
E. To maintain proper health records of its students while participating in the Smart
Start Program at the OCHD, and instructing its students about Hepatitis B
vaccinations, about the student's responsibility for post-exposure follow-up and
any incurred costs, about the student's responsibility for the provision of
protective equipment, and proper post-exposure record-keeping.

F. To provide proof of Blood-borne Pathogens training for each student.
V. SPECIFIC RESPONSIBILITIES OF THE OCHD
A. The OCHD shall reimburse the University for these services by June 30, 2001,
upon receipt of an invoice no later than May 1, 2001.
IN WITNESS WHEREOF, the OCHD and the University have executed this agreement as of the
date written herein.
