PURPOSE: To conduct a public hearing on the renaming of a portion of Teer Road (Secondary
Road 1100) to Flatrock Road (see attached "Renaming a Portion of a Public Road Known as
Teer Road to Flatrock Road with Attachment A").
BACKGROUND: North Carolina General Statute § 153A-239.1 (NCGS §153A-239.1) grants a
county the authority to rename any road within a county as provided by the statute and by a
County Ordinance after the Board of County Commissioners has held a public hearing. The
Public hearing must be held at least ten days prior to the renaming the road and a notice of the
time, place and subject matter of the hearing prominently posted at the courthouse, in at least
two public places in the township where the road is located, and the notice of the hearing must
be published in a newspaper of general circulation published in the County.
The Orange County Board of Commissioners adopted an Ordinance entitled "An Ordinance to
Assign and Regulate Road Names, House and Building Numbers in Orange County" (the
"Addressing Ordinance") on December 13, 2011. The Addressing Ordinance allows the
Addressing Administrator to rename a road according to NCGS § 6-34(b)(2)(a) which provides,
"Road names may be changed by the Address Administrator when the road name is a
duplicate of another road name within a designated postal area or within Orange County
and interferes with the accurate dispatch of emergency service or postal delivery. In
addition, a road name may be changed when one road has two commonly used names
or where portions of what appears to be the same road has two or more names."
The Addressing Administrator is considering a road name change of a portion of Teer Road
(Secondary Road 1100) to Flatrock Road (see attached "Renaming a Portion of a Public Road

Known as Teer Road to Flatrock Road with Attachment A"). Originally Teer Road was a single
road, but the Cane Creek Reservoir now intersects Teer Road. This has caused duplicate
named road segments and prevents free travel from one segment of the road to the other. The
duplicate name road segments on Teer Road interfere with the accurate dispatch of emergency
vehicles. Orange County Emergency Services has requested that a portion of Teer Road
(Secondary Road 1100) be renamed to avoid the inaccurate dispatch of emergency vehicles.
The Address Administrator has corresponded with all of the land owners that would be affected
by the renaming of the road and the land owners agree with the renaming of the road (see
attached "Responses from Affected Owners Teer to Flatrock") and with the new name of the
road.
In addition, the Address Administrator contacted the North Carolina Department of
Transportation to ensure that the State Board of Transportation approval was not required to
rename this portion of the road in accordance with NCGS §153A-239.1 (see attached
"Response from North Carolina Department of Transportation" highlighted sections).
As required by North Carolina law, a Notice of this Public Hearing was published in the News of
Orange on Wednesday, May 15, 2019, The Herald Sun on Sunday, May 19, 2019, and posted
at the following locations:
• Orange County Courthouse
• Piedmont Feed & Garden Center on Highway 54
• Intersection of Teer Road and Bradshaw Quarry Road
NCGS §153A-239.1 requires that after renaming a road, the County shall notify the local
postmaster with jurisdiction over the road, the Board of Transportation, and any city within five
miles of the road.
FINANCIAL IMPACT: The expected financial impact for this item is the cost of a replacement
road name sign to be installed on the newly named Flatrock Road. Estimate for the cost of the
sign is $300 and will be paid from Department of Environment, Agriculture, Parks and
Recreation's budget.
SOCIAL JUSTICE IMPACT: There is no Orange County Social Justice Goal impact associated
with this item.
RECOMMENDATION(S): The Manager recommends that the Board:
1. Receive comments from the public; and
2. Close the public hearing

RENAMING A PORTION OF A PUBLIC ROAD
KNOWN AS TEER ROAD TO FLATROCK ROAD
WHERAS, North Carolina General Statute § 153A-239.1 grants a county the authority to rename any
road within a county as provided by the statute and pursuant to a procedure established by Ordinance;
and
WHEREAS, the Orange County Board of Commissioners on December 13, 2011 adopted an Ordinance
entitled "An Ordinance to Assign and Regulate Road Names, House and Building Numbers in Orange
County' ("the Addressing Ordinance") establishing, among other things, a procedure for renaming roads
in Orange County; and
WHEREAS, the Board of County Commissioners in adopting the Addressing Ordinance delegated the
overall responsibility for the addressing and naming of private roads to the County Manager or her
designee; and
WHEREAS,the County Manager has designated the Tax Administrator as the Address Administrator; and
WHERAS,the Orange County Address Administrator has found the following:
1. That originally Teer Road was intended to be one road but the Cane Creek Reservoir traverses
across the Teer Road causing duplicate named road segments and prevents free travel from one
segment of the road to the other;
2. That the duplicate name road segments on Teer Road interfere with the accurate dispatch of
emergency vehicles and Orange County Emergency Services has requested that a portion of the
road be renamed; and
3. That the North Carolina Department of Transportation did not name the road and therefore the
County does not require the approval of the Department of Transportation to rename the state
maintained road; and
WHEREAS, the Board of County Commissioners has at least ten days prior to the public hearing being
held on the renaming the road, has caused notice of the time, place and subject matter of the hearing to
be prominently posted at the courthouse, in at least two public places in the township where the road is
located, and published notice of such hearing in a newspaper of general circulation published in the
County; and
WHERAS,a public hearing was held on the matter.
NOW THEREFORE that the portion of TEER ROAD, known as NCDOT Secondary Road (SR) 1100, and
further identified in Attachment A which is attached and hereby incorporated into this document, shall
be renamed FLATROCK ROAD, effective 60 days from the date this document was approved.

Further upon approval of this document the Address Administrator shall cause notice of this action to be
given to the local postmaster with jurisdiction over this road, to the Board of Transportation, and to any
city or town within five miles of the road.

The County should proceed under authority of NCGS 153A-239.1. I've checked our files and did not find any action by the State
Board of Transportation to name any of the subject roads affected by the Cane Creek Reservoir so, assuming that no changes in
SR#are proposed, no State Board of Transportation approval would be needed.The County should notify this office of the
action so that we can update our data base.The map excerpt below accurately depicts the State routes in the subject area. Feel

We think that we have the same situation with Teer Rd. (SR 1100 and 1101) as with Apple Mill Rd. in that both are split by the

Apologies for my delay in responding. Please refer to NCGS 153A-239.1 authorizing counties to name or rename any road in
unincorporated areas. I have checked our records and have found no indication that the State Board of Transportation ever took
action to name this road,therefore, approval of the renaming by that board is not necessary.The statute does require that the
County notify NCDOT. A letter to me with BOCC resolution authorizing the change will satisfy this requirement. Also, please note
that based on your description,the SR for this section of Apple Mill is SR 1225. NCDOT county maps are available at:

We received a phone call from Jim O'Connor who lives at 7500 Apple Mill Rd (SR 1116) .Apple Mill is split by Cane Creek
Reservoir. (Map attached) He and his wife are elderly, and are having issues with UPS, Fed Ex, other deliveries, and GPS systems
at the address.They have had to call 911 twice, but he says the ambulance did not have an issue finding them.
He is requesting to change the name of his portion of the road. (Southern portion,they are the only home).
I spoke with DeAngelo Jones about this just recently, and Land Records would like to confirm with you that the southern portion
of Apple Mill Rd can be renamed. (Mr.Jones said that the SR number 1116 would remain the same).
