(Mix of evergreens and hardwoods) Proposed Site Conditions Roads: • The subdivision will be accessed from Mill Creek Road (SR 1343). • All roads shall be public and built to NCDOT standards and in accordance with County requirements. • Proposed Pintail Drive will serve as a major local road with a Type A Land Use Buffer. • Stub out to the eastern property line for future connectivity is provided. • Access along Pintail Drive limited to six (6) lots with joint driveways required except for Lot P10. Open Space • Open space areas in this phase are comprised primarily of evergreen forest. • 15.95 acres (37.1% by this phase) • Orange County Subdivision Regulations do not specify a minimum open space requirement for conventional subdivision. Homeowners Association required to maintain open space and land use buffers. • Protection of the intermittent stream (on entire tract)with stream buffer to be provided on the final plat. • Connectivity exists between open space provided for Mill Creek 11 and High Rock Farms Subdivision. Water— Sewer • Individual wells and septic tanks provided for each lot. Recreation & Parks • Cheeks District Parks • No public recreational resources found on site • Payment in lieu reasonable alternative to dedication. [12 lots x $455 = $5460] Development Process. Schedule. and Action • First Action: Concept Plan approved by the Planning Board (by unanimous vote) November 2, 2000, with concerns raised about adequate ground water resources to support additional houses without adversely affecting existing wells. • The USGS Water Resources Report has been received. • Planning Board asked that a disclosure be provided on the Final Plat that Pintail Drive is subject to future extension. (Condition B. Roads 11 addresses this concern and will also require disclosure on the development restrictions recorded along with the Final Plat) • Interconnectivity of open space was discussed. A question regarding Lot P10 intruding into the open space area was raised. • Second Action: Planning Board unanimously recommended Preliminary Plan Approval. January 9, 2002 with concerns raised that additional condition be included on Resolution of Approval that Final Plat include a statement the Pintail Drive has potential to connect to adjacent development in future and will become a major local road. Applicant was agreeable to this condition. 3 • Third Action: Board of County Commissioners to consider Preliminary Plan 1. The application shall be placed on the Board of County Commissioners agenda within 90 days of the Planning Board recommendation. 2. The Board shall consider the application within a reasonable amount of time. 3. During deliberations and consideration of the application, the Board may defer consideration at any point in time to pursue additional analysis and review. 4. If the Preliminary Plan is approved by the County Commissioners, the applicant shall have one (1) year to prepare and submit a Final Plat or to request a one-year extension from the Planning Director. FINIANCIAL IMPACT: A Fiscal Impact Analysis is attached. RECOMMENDATION: Administration Approval, in accordance with the attached Resolution of Approval. Planning Staff Approval, in accordance with the attached Resolution of Approval 4 RESOLUTION OF THE ORANGE COUNTY BOARD OF COUNTY COMMISSIONERS Date of Meeting: February 19, 2002 Name of Subdivision: Mill Creek II (Section One) Owner/Applicant: C. Norman and Peggy Walker/Brad Walker The Board of County Commissioners hereby approves Mill Creek II (Section One) Subdivision Preliminary Plat, dated May 31, 2001, revised on 9/13/2001 and 11/02/2001 and containing 12 lots, subject to the fulfillment of requirements specified herein. All roads shall be irrevocably dedicated to the general public and constructed to standards of the North Carolina Department of Transportation (NCDOT). The approval of this resolution authorizes and directs the Orange County Manager to accept for the County on behalf of the public generally, the offer of dedication of Teal Street, Pintail Drive and Widgeon Way. This acceptance of dedication of the general public shall be without maintenance responsibility. These roads shall be maintained by the owner/applicant (C. Norman Walker and Brad Walker) until such time as they are accepted for maintenance by NCDOT or some other government body. Before the Final Plat of Mill Creek II (Section One) can be recorded: A Sewage Disposal 1. Each residential lot shall contain an adequate area for well, septic disposal and repair area, approved by the Orange County Division of Environmental Health. 2. Disclosure that the septic system location may require the size and location of improvements shall be included in a document describing development restrictions to be recorded concurrently with the Final Plat. The document shall also disclose that information regarding the tentative location of septic systems and is available from the Orange County Health Department, Division of Environmental Health. B Roads and Access 1. Teal Street, Pintail Drive and Widgeon Way shall be constructed to NCDOT standards within a 50-foot right of way with 5-foot utility easements on each side. Construction shall be inspected and approved by NCDOT. OR A letter of credit or escrow agreement or other security shall be submitted to secure construction of Teal Street, Pintail Drive and Widgeon Way to NCDOT standards. An estimate of the construction cost must be prepared by a certified/licensed engineer or grading contractor and submitted to the Orange County Planning Department and verified by the County Engineer. The financial guarantee must reflect 110 percent of 5 that estimate and be issued by an accredited financial institution licensed to do business in North Carolina. The document describing development restrictions to be recorded with the Final Plat shall state that the financial guarantee will not be released until the road construction has been inspected and approved by NCDOT. 2. An erosion control plan for construction of all streets shall be submitted by the applicant for review and approval by the Orange County Erosion Control Division prior to any disturbance on the site. 3. Prior to any construction or any alteration of any existing access within the right-of- way of Mill Creek Road (SR 1343) the developer/owner shall secure a driveway permit from the NCDOT District Office. Submit a copy of the NCDOT-approved permit and letter to the Planning Department at the same time as the request for Planning Department signatures on the Final Plat. Sight distance triangles as prescribed by the subdivision regulations shall be shown at all intersections within the subdivision, or included within the right-of-way of the proposed street. 4. All lots shall secure access from an internal street within the subdivision. No comer lot access shall be allowed within 50 feet of the right-of-way of an intersection. This restriction shall be stated in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. 5. Approved street name signs shall be erected at the intersection of streets as required in Section IV-13-3-c-12 of the Orange County Subdivision Regulations. The signs are to be erected and approved prior to Planning Department signatures on the final plat. 6. Record a minimum five-foot, non-vehicular access (NVA) easement along the subdivision frontage of Mill Creek Road, with the exception of Pintail Drive right-of- way, and also along the Pintail Drive frontage of Lots P9 and P11. 7. Lots P5, P6, P7, P8, P10 and P12 shall be limited to one driveway. This restriction shall be stated in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. 8. Temporary turnarounds built to NCDOT standards shall be constructed at the end of Pintail Drive and Widgeon Way. 9. The platted right-of-way of Widgeon Drive shall extend to the southernmost boundary of Lot P11 when Section One is recorded. 10. A twenty-foot temporary construction easement shall be shown on the final plat along the northern side of Pintail Drive at Lot 03. 6 11.A statement shall be provided on the Final Plat identifying Pintail Drive as a Major Local road subject to future extension and shall be disclosed in the development restrictions recorded along with the final plat. C Land Use Buffers and Landscaping 1. Landscaping shall be preserved as indicated on the approved landscape plan, and must be inspected and approved by the Planning and Inspections Department prior to Planning Department signatures on the final plat. Landscaping shall be placed behind the sight distance triangles at intersections. 2. Provisions for protection of existing trees as shown on the approved landscape plan shall be included in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. 3. A Type A Land Use Buffer shall be provided along the entire subdivision frontage on Mill Creek Road (SR 1343) exclusive of the areas designated as sight distance easements. The required buffer width (i.e. minimum) is 30 feet and shall be composed of deciduous and/or evergreen vegetation, forming semi-opaque intermittent visual obstructions from the ground to a height of at least thirty (30) feet. Said buffer shall be so noted on the final plat, and described in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. Maintenance of the buffer shall be the responsibility of the Homeowners Association. 4. A 30' Type A Land Use Buffer as described in above Condition # 3 shall be provided along Pintail Drive. Said buffer shall be so noted on the final plat, and described in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. D Drainage 1. Impervious surface data, as pursuant to Article 6.23.3c.1 of the Zoning Ordinance shall be included in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. 2. Locate drainage easements on Final Plat as required following review and approval of the Erosion Control Plan. E Parkland 1. The payment in-lieu parkland dedication fee shall be paid prior to Planning Department signatures on the Final Plat. The fee is $455 per recorded lot. F Miscellaneous 1. The Final Plat shall contain a title block and vicinity map in accordance with Section V- D-2 and V-D-3 of the Orange County Subdivision Regulations. 2. The following easements shall be shown on the plat: 7 (a) Drainage easements as required by D.2 above. 1. The minimum building setback requirements and impervious surface maximums shall be stated on the Final Plat, and in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. 2. If sign is anticipated, reserve a sign easement location on open space lot. G Certifications 1. A Certificate of Survey and Accuracy signed by a Professional Land Surveyor shall be notarized on the face of the Final Plat. 2. A Certificate of Dedication and Maintenance in the form provided in Section V-D-6-b of the Orange County Subdivision Regulations signed by the landowner and developer shall be on the face of the plat and included in a document describing development restrictions to be recorded concurrently with the Final Plat. 3. The Division of Environmental Health shall certify that each lot contains a suitable area for septic disposal. 4. A Certificate of Approval signed by the Orange County Planning and Inspections Department. 5. NCDOT shall certify that Teal Street, Pintail Drive and Widgeon Way have been constructed to NCDOT standards or that construction plans have been approved in accordance with NCDOT standards. NOW THEREFORE BE IT RESOLVED by the Board of Orange County Commissioners that the Preliminary Plan for Mill Creek II (Section One) is approved in accordance with the above mentioned conditions and attached Preliminary Plat dated May 31, 2001, revised on 9/13/2001 and 11/02/2001. [12 lots x$455 = 12 $5460] 13 14 Development Process,Schedule,and Action 15 16 • First Action: Planning Board to consider Concept Plan 17 The Planning Board approved the conventional concept plan for Mill Creek H on November 2,2000 with the 18 following conditions: 19 20 1. All roads shall be public and proposed to be built to NCDOT standards with additional five(5)foot utility 21 easements on each side. The right-of-way at street intersections shall be improved to NCDOT standards. Sight 22 distance triangles(10' x 70') shall be delineated on the plat for each street at intersections,as appropriate. 23 2. Driveway access points shall be a minimum of 50 feet from the intersection of street rights-of-way. 24 3. If an entrance sign is anticipated and will not be placed within the 100-foot building buffer,maintained by the 25 Homeowners Association,a sign easement must be reserved within one of the residential lots. 26 4. All common areas(stream buffers,building buffers,landscape buffers)must be clearly identified on the 27 preliminary and final plats and maintained by the Homeowners Association. The common areas cannot be 28 subdivided or recombined with adjacent lots. Draft forms of the Homeowners Association documents, 29 including restrictive covenants and conservation easements,that contain use and maintenance provisions for the 30 open space and buffers must be submitted for review by the County Attorney as part of the preliminary plat 31 approval process. The restrictive covenants or conservation agreement shall designate a backup grantee in the 32 event that the Homeowners Association is eliminated. 33 5. The location of drainage ways,stream buffers and floodplains shall be delineated on the preliminary and final 34 plats,along with appropriate information regarding restrictions. 35 6. The preliminary plat shall indicate areas for on-site infiltration of storm water that demonstrates compliance 36 with Article 6.23.3a of the Orange County Zoning Ordinance. 37 7. The preliminary plat shall show the location of tree protection fencing and contain a note requiring the 38 installation of tree protection fencing prior to any grading to ensure the protection of vegetation within all 39 buffers and open space. 40 8. All street names to be reserved with GIS section of Planning Department prior to submittal of preliminary plat 41 subdivision request. 42 9. Non vehicular access easements shall be shown on Preliminary Plan. 43 44 • Second Action: Planning Board to consider Preliminary Plat 45 46 Options: 1. Action(recommend approval,approval with conditions, or denial)within two 47 regularly scheduled meetings or; 48 2. Within such further time consented to in writing by the applicant. 49 3. If the Planning Board renders at tie vote, or fails to act within the specified period, approval of 50 the Preliminary Plat is directed to the Board of County Commissioners with the Planning 51 Board's minutes and the Planning Department staff s recommendations. 52 53 FINIANCIAL IMPACT: A Fiscal Impact Analysis is attached. 54 12 1 RECOMMENDATION: Staff Recommendation 2 The Planning Staff recommends approval in accordance with the attached resolution. 3 4 Triebel asked about the reasoning for no circular driveways. Bateman said that there is a potential for a major 5 collector and they want to limit as many accesses as possible. 6 7 Preston made reference to page 56 and the analysis. She asked why the figures did not add up. Bateman said that 8 this was a mistake and it was not the revised version. Benedict said that the numbers were due to rounding up. 9 10 Chair Gooding-Ray asked about the minutes for the concept plan. This was in November 2000. They were not 11 included in the agenda packet. Benedict said that the issues at that time had to do with water resources in the area. 12 The USGS Water Resources Report has been received. One of the projects this year is to look at some lot size 13 sustainability standards. 14 15 Chair Gooding-Ray asked if the concept plan was approved for all three phases and Bateman said yes. Chair 16 Gooding-Ray asked if it had changed from what was approved. 17 18 Steve Yuhasz, surveyor for the project, said that the plan has changed a little bit,but only in final arranged lot lines 19 to adjust to the soils. The overall concept is identical. 20 21 Schofield asked how subsequent phases might connect open space to create both recreation and an open space 22 corridor. He also asked about lot P 10. Yuhasz said that the concept plan has more lots on the west side of the main 23 road than on this plan. My comments are generally intended to a) address any concerns that ERCD may have with respect to potential impacts on important natural and cultural resources, and b) identify any areas that could be desirable for possible dedication to the County for public recreation/open space pursuant to current subdivision regulations. The preliminary plat for Mill Creek II (Section 1) shows that over 17 acres (40%) are to be set aside as permanent open space and deeded to a homeowners' association. From the 1998 orthophoto it appears that that open space is comprised of mixed hardwoods and pine, while most of the areas to be developed are younger pine. From a natural resource protection standpoint, the proposed subdivision does a nice job of providing open space (more than what is required!) and protecting portions of the more mature, wooded section of the property. There does not appear to be any streams flowing through this section, however a future section of the subdivision will need to address-a perennial stream in the Back Creek protected watershed. In conclusion, the plan appears consistent with the County's desire to minimize adverse environmental impacts with respect to the protection of floodplains, wetlands, natural areas and wildlife habitat, historic and cultural resources and prime farmland. I do not recommend that any land be considered for possible dedication for public recreation/open space. The approved septic areas should be kept free of vehicular traffic, lowing, grading, and compacting activities It is the responsibility of the property owner or developer to maintain the integrity of the septic areas prior to system construction and installation. No parking, cutting or filling shall be allowed in or around the drain field areas. Drainage ways and easements should be utilized to convey storm water run-off to the storm water retention areas. These conveyances should not be located through designated septic drain field areas. This report is for planning purposes only and does not constitute any approval.
