BACKGROUND: The North Carolina Department of Transportation (NCDOT) has issued a call for projects to be included in the CMAQ program, which funds transportation projects and programs that reduce transportation-related emissions in non-attainment and maintenance areas. The deadline for CMAQ applications to be submitted to NCDOT is January 24, 2005. NCDOT has targeted CMAQ Program allocations of $7,503,584 and $481,269, respectively far Durham-Chapel Hill-Carrborc Metropolitan Planning Organization (DCHC) and Triangle Area Rural Planning Organization (TARPO), The targeted allocations are fora 7-year period and funding will be reallocated after the Environmental Protection Agency (EPA) designates particulate matter (PMz e) non-attainment areas. Allocations are based on population in non-attainment and maintenance areas and severity of the air quality problem, The Triangle Ozone Non-Attainment Area is a basic (sub-marginal) area. The CMAQ program is a reimbursement program in which the local jurisdiction manages the projects and submits eligible expenses to NGDOT for reimbursement, Preliminary projected costs far construction of the proposed park and ride lot and operation of the proposed transit service are in the neighborhood of $735,000 over athree-year period. The required local match is about $325,000. Amore detailed account of projected casts is within the CMAQ application attached to this abstract, It is possible that NCDOT would consider Orange County's ownership of transit center land as a portion of the local match. The Town of Hillsborough has endorsed a resclution in support of the Intra-Hillsborough transit route that states its willingness to participate in the local match and a marketing campaign. However, it is important to note that there is no firm funding commitment from the Tawn at this time, 2 Orange County projects will be submitted through DCHC and TARPO, DCHC and TARPO will prioritize projects based on air quality emissions benefits, DCHC or TARPO priorities and cast of construction, and will select and submit the highest ranked projects from their areas to NCDOT for inclusion in the 2006-2012 State Transportation Improvement Program (STIP) and local supplements, Timing is such that in order for the DCHC and TARPO Transportation Advisory Committees (TAC) to approve applications from the local jurisdictions, the applications must be reviewed at the TAC meetings prior to the January 24`h deadline far submitting applications to NCDOT, The DCHC TAG will meet January 12, 2005, but the TARPO TAC meets December 16, 2004, and will not meet again until February 2005. The attached application proposes development of a transportation center at Water Stone with new transit service to connect the transportation center with the justice facility/government complex in downtown Hillsborough, as well as residential, employment and retail centers in Hillsborough. During the December 6, 2004 BOCC meeting, Commissioners also expressed interest in submitting applications for the following projects: constn~ction of a park and ride lot at the Orange County Middle School #3/West Ten Soccer Complex located in the I-85/Buckhorn Road Economic Development Center; construction of a park and ride lot at the Northern Human Services Center located in Cedar Grove; and/or construction of bicycle facilities located outside the DCHC Metropolitan Area Boundary. Applications for those projects are not included in this proposal for reasons stated in the following paragraphs. Orange County Middle School #3/West Ten Soccer Complex located in the I-85/Buckhorn Road Economic Development Center Park & Ride Lot There is insufficient information at this time to complete an application, Park & ride lots should be accompanied by a transit route or a ride-share program. Staff has configured a preliminary east-west route far a park & ride lot at this location; however, the local match may be a problem considering Orange County's obligation for the proposed Intra-Hillsborough transit service, Also, Orange Public Transportation (OPT) has no information that would enable staff to estimate rider ship an this route; therefore, no way to determine emissions reductions as required for the application. Triangle Transit Authority (TTA) has indicated that it has endeavored to establish carpools and vanpcols in Orange County, and only been able to establish 2 currently operating vanpools, • Northern Human Services Center located in Cedar Grove The existing unpaved lot is not being used by carpools or vanpools and OPT reports that, routinely, there are no riders at this location. Bicycle facilities (located outside the DCHC Metropolitan Area Boundary) The mast plausible route in the rural area in Orange County's Bicycle Transportation Plan would be West Ten Road from Mt, Willing Road to Buckhorn Road, a distance of approximately 3 miles. This route would serve the 3`d Middle School and Soccer Fields, Estimated construction cost for 1 mile of 4-ft, paved shoulders on both sides of a two-lane road is between $200,000 and $300,000. TARPO's annual CMAQ allocation totals $68,753 over aseven-year period for a total of $481,269. Based an population, Orange County's portion of the CMAQ finding allocation would be approximately 59%, 3 FINANCIAL IMPACT: Should NCDOT award the grant for the Orange Public Transportation Intra- Hillsborough route, the County would be required to provide a local funding match. With regard to capital costs, the required match equates to 20 percent of total grant related capital expenditures. For annual operating costs, there would be a required County match ranging from 25 percent in the first year of the grant to 75 percent in the third year of the grant. It is important to note that after year 3 of the grant, the County would assume 100 percent of operating costs of the proposed route. Annual operating costs are estimated tc be $198,000. As noted in the Background section above, there is a passibility that a portion of the County's local match could be met by ownership or operation of land, facilities or other physical assets. Local funding requirements would be included in future County budgets. RECOMMENDATION (S): The Manager recommends that: The Board approve the Resolution Conceptually Endorsing Application for Congestion Mitigation and Air Quality Funds for a Park and Ride Facility and Intra-Hillsborough Transit Route, and direct staff to proceed with submittal to the Durham-Chapel Hill-Carrboro Metropolitan Planning Organization and the Triangle Area Rural Planning Organization, and to enable Staff to proceed forward far further evaluation and feedback on the proposal from aforesaid local agencies and other County departments; and Orange County requests the Town of Hillsborough to commit continued participation in the local match for operating assistance for the Intra-Hillsborough transit route. 4 ORANGE COUNTY BOARD OF COMMISSIONERS RESOLUTION IN CONCEPTUAL SUPPORT OF CONGESTION MITIGATION AND AIR QUALITY FUNDING ALLOCATION TO ORANGE COUNTY, NORTH CAROLINA FOR A TRANSIT CENTER INCLUDING A PARK AND RIDE FACILITY AND NEW ORANGE PUBLIC TRANSPORTATION INTRA- HILLSBOROUGH ROUTE WHEREAS, the United States Congress included requirements in Section 176(c) of the 1990 Clean Air Act Amendments, Public Law 101-549, November 15, 1990, for federally assisted transportation programs to ensure the timely implementation of transportation control measures as specified in the state air quality implementation plans and to provide the highest priority for funding to implement these transportation control measures; and WHEREAS, the United States Congress assured the compliance with these transportation control measures through the provision of the Congestion Mitigation and Air Quality (CMAQ) Program and Categorical Funds in the Intermodal Surface Transportation Efficiency Act (ISTEA), Public Law 102-240, December 18, 1991, and through its reauthorization of the CMAQ Program and Categorical Funds in the Transportation Equity Act of the Twenty First Century (TEA-21), Public Law 95-198, June 6, 1998; and WHEREAS, the CMAC2 program has been officially transcribed into federal surface transportation regulations and policies under Title 23, Chapter 1, Section 149 of the United States Code; and WHEREAS, the primary purpose of the CMAQ Program has been to fund transportation projects and programs in air quality non-attainment and maintenance areas which will reduce transportation related emissions; and WHEREAS, the Federal Highway Administration and the Federal Transit Administration have been directed through federal programs to recommend to state transportation departments and local transportation planning organizations the identification of transportation control measures and related projects to provide alternatives to single occupancy vehicle use and to reduce vehicle miles of travel; and WHEREAS, these transportation control measures may include projects far improved public transit, high occupancy shared ride services, employer based transportation management plans and flexible work schedules, and other appropriate projects to reduce vehicle miles of travel in air quality impacted areas: and WHEREAS, the eligibility provisions under TEA-21 allow any area designated as non-attainment or maintenance for carbon monoxide, ozone, or fine particulate matter (PM2,5) after December 1, 1997 to be eligible for CMAO federal funds; and WHEREAS, Orange County, North Carolina was designated as non-attainment for the national eight hour ozone standard on April 15, 2004, NOW, THEREFORE, BE IT RESOLVED, that the Orange County Board of County Commissioners conceptually endorses the attached Congestion Mitigation and Air Quality (GMAQ) Program grant application far a Transit Center at the Durham Tech satellite campus site at Waterstone, including a Park and Ride Facility and new Orange Public Transportation Intra-Hillsborough service, for submittal to the Transportation Advisory Committees of the Durham-Chapel Hill-Carrboro Metropolitan Planning Organization and the Triangle Area Rural Planning Organization, FURTHERMORE, BE IT RESOLVED, that Orange County, subject to any additional information and review, commits to providing the required local match for each year's allocation of these CMAQ grant funds for capital and operating costs and future operating expenses for the Intra-Hillsborough route, Upon motion of Commissioner ,seconded by Commissioner the foregoing resolution was adopted this the day of 2004, I, Donna Baker, Clerk to the Board of Commissioners for the County of Orange, North Carolina, DO HEREBY CERTIFY that the foregoing is a true copy of so much of the proceedings of said Board at a meeting held on December 14, 2004, as relates in any way to the adoption of the foregoing and that said proceedings are recorded in the minutes of said Board. What is the source(s) of the matching funds? Orange county will provide 1.5 acres needed for the Durham Tech satellite campus park & ride lot. The land is in a mixed-use development and the purchase price is $62,500/acre ($93,750 total). Orange County also has money budgeted for the new justice facility expansion that can be used for the match for improvements at that site. Orange County will supply the local match for OPT operations through the county's yearly budgeting process as indicated in attached resolution, The Town of Hillsborough has also agreed to participate in the local match, but the exact amount has not been agreed upon. Hillsborough has also agreed to participate in a marketing campaign for the transit service, Match for operating expenses is discussed below, 8, For agencies seeking operating assistance, how will the program be funded after year three? Orange County will supply the local match for OPT operations through the county's yearly budgeting process as indicated in attached resolution, Orange County anticipates that ridership on the proposed service will increase OPT ridership and, therefore, farebox collections, The existing OPT general service route generates 18% of current operating expenses for that route, Orange County also anticipates the Town of Hillsborough's continued participation in providing the local match, as the proposed service is an intra- Hillsborough route. The park & ride lot would provide a place for people from outside the Metropolitan Area Boundary to access transit services, and would also provide a place where carpools and vanpools can meet. Project Description Park & Ride Lot. Transportation Center The proposed location of the park & ride lot transportation center is a 20-acre county- owned parcel, which will be the site of a new Durham Tech satellite campus, located in Waterstone, a 337-acre mixed use development currently under construction in south Hillsborough, off the east side of Old NC 86 near Interstate 40, The Durham Tech satellite campus is scheduled to open fall of 2006. Waterstone, anticipated to be completed in 2014, will contain 134 single-family houses, 128 townhome/patio homes (part affordable housing), 271 apartments, a day care, a hotel with restaurant, the previously mentioned 20-acre community college site, a continuing care retirement center (280 units at different care levels), a 3-acre civic-use site, 450,000 square feet of retail space, 408,000 square feet mixed use, and 150,000 square feet of office space, The 20-acre Durham Tech site is adequate to house the proposed 40,000 square-foot community college structure with parking and the proposed 125-space park & ride lot and transit shelter, Durham Tech officials have indicated their approval of siting a park and ride lot on the campus. The park & ride lot will also provide parking for students attending evening classes at the Durham Tech satellite campus. The majority of students are evening students so the proposed park and ride lot will allow Durham Tech to provide a smaller parking area needed far daytime students. As a part of this application, Orange County proposes to install a transit shelter at the justice complex as well as at the park and ride lot. The estimated cost of the park and ride lot and transit shelters is $135,676, This location will provide a convenient place for county residents, particularly those having business at the county justice complex, to access transit to downtown Hillsborough, Expansion of the justice facility, scheduled for completion in 2006, will eliminate some of the 100 (approximate) parking lot spaces, which are currently not enough to accommodate court traffic. Clients currently park off the paved surface in areas not designated for parking as well as along both sides of the street in front of the courthouse, The Clerk of Court and Senior Assistant estimate that approximately 80,000 people per year attend Orange County Superior Court, which, on a busy day, has 400 cases on the docket, That figure does not include people attending civil court, child support court, juvenile court, criminal Superior Court, nor selection of jurors. Court has a morning session and an afternoon session, with different "set" of clients attending each session, 10 The transportation center will also provide a convenient stop/transfer point for current OPT service between Hillsborough and Chapel Hill. The park & ride lot should qualify for partial CMAQ funding through the RPO, as it will provide anon-single occupancy vehicle transportation choice for traffic coming into the urban area from rural areas of the county. The method for determining potential funding through the RPO CMAQ allocation has not yet been determined. New Transit Service Proposed new OPT service would connect the transportation center with the county justice facility/government services complex, Hillsborough government services, residential areas, shopping and employment centers. The service would operate Monday through Saturday from 7:00 a.m, to 9:00 p..m. at 30-minute intervals during peak hours (8:00 a.m. to 6:00 p,m.) and 60-minute intervals during non-peak hours. The estimated yearly operation cost of the service is $198,000. The figure is based on hours of operation (for one bus during non-peak hours and two buses during peak hour) times the hourly operating cost of $37,39 as provided in the Five Year Financial Plan of the recently completed Community Transportation Improvement Plan. The service will use ADA-equipped 20 or 18 passenger buses, OPT will not need any additional buses to provide the service as the buses will be acquired in 2006 according to the OPT Five Year Capital Plan replacement schedule. Bicycle Racks for OPT Buses As a part of this application, Orange County would like to provide bicycle racks on four of OPT's minibuses, The cost per rack is $850,00. Buses provided with bicycle racks will allow greater modal choice at transit destinations, and enhance transit and bicycling as viable alternatives to single occupancy vehicles. Orange County anticipates that ridership on the proposed service will greatly increase OPT overall ridership, Based on historical ridership for medical/nutrition trips, OPT anticipates an average daily ridership of 24, not including ridership from the proposed park & ride to the justice facility. The transportation center will also provide a convenient stop/transfer point for current OPT service between Hillsborough and Chapel Hill. The park & ride lot will also provide parking for students attending evening classes at the Durham Tech satellite campus.
