SUBJECT: Acceptance of Real Property Donation — Future Millhouse Road Park Addition

PURPOSE: To authorize Orange County's acceptance of the donation of approximately 10
acres of land from the Dorothy Gochnauer Heirs for an addition to the future Millhouse Road
Park
BACKGROUND: The Dorothy Gochnauer Heirs are interested in donating a 10-acre parcel
located between Orange County's future Millhouse Road Park and Duke Forest. The 10-acre
parcel contains a cell tower with a permanent easement around the cell tower and access
easement from Millhouse Road through the Orange County-owned land. The lease from the
cell tower company to the landowner has been paid out in full, and therefore would not generate
a source of income.
This property comes with a permanent easement around the cell tower as well as a lease that
states the 180-foot radius "fall down zone" of the cell tower must remain undeveloped. It also
has a SUP allowing the cell tower.
The proposed donation property is entirely forested with mature mixed hardwoods and pines,
except where the cell tower stands. The property contains 750-feet of a tributary to Old Field
Creek located in the Jordan Lake Unprotected Watershed.
The property is adjacent to Orange County's future Millhouse Road Park and Duke Forest. The
property is surrounded on all sides by County-owned land and Duke Forest. Conservation of this
property will ensure that this parcel is not developed as well as further protecting Old Field
Creek. Ownership of the property would provide the County greater authority to work with the
cell tower company if changes become needed to the access easement located through
Millhouse Road Park (which may be the case during future park design).

FINANCIAL IMPACT: The land will be donated, so the only cost to the County will be
transaction costs. Funds for the donation acceptance would come from Orange County ($8,000
for closing costs).
The County's share of funds (approximately $8,000) will come from existing funds budgeted and
approved in the Lands Legacy Capital Project, so this does not require separate budget
amendment action.
With this allocation, approximately $2.33 million remains available in the Lands Legacy Capital
Project.
SOCIAL JUSTICE IMPACT: There is no Orange County Social Justice Goal impact associated
with this item.
RECOMMENDATION(S): The Manager recommends the Board:
1) Accept the donation of approximately 10-acres of land for the future Millhouse Road Park
located at 6915 Millhouse Road, Chapel Hill from Dorothy Gochnauer Heirs, with a
closing and recordation of the document expected to occur on or about June 30, 2019;
and
2) Authorize the County Manager to execute all necessary documents subject to review by
the County Attorney.
