PURPOSE: To conduct a public hearing on the North Carolina Community Transportation
Program (CTP) grant application by Orange Public Transportation far FY 2005-2006, approve
the grant application, and approve a Transportation Memorandum of Understanding authorizing
the application and entering into agreement with the North Carolina Department of
Transportation for all necessary assurances,
BACKGROUND: Each year, the North Carolina Department of Transportation (NCDOT) Public
Transportation Division accepts requests for administrative and capital needs from county
operated community transportation programs, Orange Public Transportation (OPT) is eligible to
make application for both administrative and capital funding, The FY 2004/2005 grant
application included an administrative request of $170,389 with no request for capital funds.
The total amount requested far 2005-2006 is $219,293 far administration ($148,149 State;
$26,144 Local Match) and for capital ($40,500 State; $4,500 Local Match). The requested
amount for FY 2005-2006 administrative funds is an increase due to adjustments in payroll and
fringe benefits consistent with approved County pay and benefits. The request for capital funds
for FY 2005-2006 of $45,000 is new as no capital funds were requested in FY 2004-2005, The
capital request is to purchase new scheduling/management software as recommended in the
draft Community Transportation Improvement Plan (CTIP) and endorsed by both the CTIP
Steering Committee and the Transportation Services Board, The new software will allow OPT
to modernize its scheduling methodology and enact cone-day advance service request policy
that is much desired by its clients,
Administrative funds will continue to be used to support the overall transit system management
and continue to promote general ridership,
The BOCC will receive the consultant's report on the CTIP at its second meeting in December.
The reason far bringing this grant application forward ahead of the Board's consideration of the
CTIP is because the signed grant documents are due to the State no later than November 19,
A public hearing is required with opportunities for public discussion and comments before the
Board takes action on the Memorandum of Understanding,
The Chair also asked that OPT include as information the NCDOT memo regarding
transportation of riders to the polls,
FINANCIAL IMPACT: The NCDOT Community Transportation Program Grant requires a 15%
local match for administrative funding of $26,713 and a 10% local match for capital funding of
$4,500. The total County match is $31,213,
RECOMMENDATION(S): The Manager recommends that the Board
1. Conduct a public hearing to receive public comments on the proposed grant application;
2, Approve the Community Transportation Program Grant application far FY 2005-2006 in the
total amount of $223,086;
Authorize the Chair to sign the Community Transportation Program Memorandum of
Understanding.

Transportation Memorandum of Understanding
WITNESSETH THAT
WHEREAS, Governor James B. Hunt, .Ir. issued Executive Order No. 29 in December
1978 which initiated a statewide effort in North Carolina to utilize transportation
resources in the most cost effective manner.
WHEREAS, subsequently, the North Carolina Deparhnent of Transportation (NCDOT)
adopted a policy requiring a locally endorsed and implemented Community
Transportation Services Plan (CTSP) prior to receiving funds under NCDOT
administered programs, such as Section 16; Section 18; Elderly and Disabled
Transportation Assistance Program (EDTAP) and the Human Services Transportation
Management (HSTM) Program,
WHEREAS, Administrative, operating, and capital funds are available through the
NCDOT Public Transportation Division (PTD) for the coordination of Community
Transportation Programs that demonstrate a high level of coordination among a group of
core Human Service agencies, other agencies and community organizations that elect to
participate in the local transportation system to meet the demands of the Community's
transportation needs. Core agencies include: local Department of Social Services, Aging
Services, Area Mental Health Program, Area Rehabilitative Program former known as
(Vocational Workshop) and Health Department,

in cooperation with the NCDOT Public Transportation Division will participate in the
Community Transportation Program (CTP) with the understanding of the following
responsibilities and undertakings as related in the following items:
1. All Core agencies must actively coordinated their client transportation needs and
resources at the highest level of ridesharing and cost sharing possible through the
local community transportation system;
2. Core agencies may have situations when some of their transportation needs will be
met outside the coordinated community transportation system because it is more cost
effective. However, every effort shall be made by the core agencies to insure that the
coordinated system has an opportunity to evaluate the costs of these services outside
their system to compare fully allocated costs;
3. All other agencies and community organizations in the service area should be
encouraged to utilize the community transportation system so as to increase
opportunities for more ridesharing and cost sharing;
4. The local Community Transportation Service Plan shall be updated periodically (at a
minimum, annually) to reflect changes in agency pazticipation, and these changes will
be coordinated with the NCDOT Public Transportation Division and the local
community transportation advisory board. Upon completion of by all parties, this
Memorandum of Understanding will service as an official addendum to the local
CTSP.
5. CTP funds are to be used exclusively to assist in funding administrative, operating,
and capital needs of the Comrunity Transportation System, in which the amount of
funding will based on the level and/or type of service provided (i.e. Rural General
Public, Employment Assistance, etc.)
6. All parties understand that if PTD determines that one or more core agencies is not
participating in the coordinated system when the system could provide it more cost
effectively, then CTP funds will be withheld until corrective action has been taken by
the core agency (ies).

PUBLIC HEARING NOTICE
This is to inform the public of the opportunity to attend a public hearing on the proposed
Community Transportation Program grant application to be submitted to the North
Carolina Department of Transportation no later than November 19, 2004. The public
hearing will be held at 7:30 p.m., November 16, 2004 by the Board of County
Commissioners at the Southern Human Services Building, 2501 Homestead Road,
Chapel Hill, N.C.
The Community Transportation Program provides assistance to coordinate existing
transportation programs to operate in Orange County as well as to provide transportation
options and services for the communities within this service area. These services are
currently provided using demand response, deviated routes, fixed route, and trip referral..

SUBJECT: Policy Guidance for Transporting Passengers to Vote
Federal and state funded vehicles may not be utilized for transportation to a place of
voting or voter registration when the express purpose of the trip is to carry voters or
potential registrants. The reason for this policy is that the grants are not provided for this
purpose and there are potential partisan political activities that could occur that are
beyond the legitimate scope of the services offered by the grantee and beyond the
capability of the grantee, FTA, and the state to monitor.
Transportation to a place of voting or voter registration is allowed when provided under
the normal route structure/ service design of the system, with the service open to any
member of the general public, and not provided exclusively for the purpose of voting or
voter registration.
Please contact your regional transportation consultant if you have any questions
concerning this policy.
