Agricultural District Properties
PURPOSE: To consider applications from multiple landowners /farms to certify qualifying
farmland within the Cedar Grove, Cane Creek /Buckhorn, High Rock /Efland, and Caldwell
Voluntary Agricultural Districts; and enroll the lands in the Orange County Voluntary Agricultural
District (VAD) and the Enhanced Voluntary Agricultural District (EVAD) programs.
BACKGROUND: Orange County's Voluntary Farmland Preservation Program was started in
1992. To date, 25 farms have enrolled in the Voluntary Agricultural District (VAD) program,
totaling 4,994 acres within the seven districts comprising the non -urban portions of the County.
The County's Voluntary Farmland Protection Ordinance (VFPO) outlines a procedure for the
Agricultural Preservation Board to review and approve applications for qualifying farmland, and
to make recommendations to the Board of Commissioners concerning the establishment and
modification of agricultural districts. Section VII of the VFPO contains the requirements for
inclusion in a voluntary agricultural district. To be certified as qualifying farmland, a farm must:
1. Consist of the minimum number of contiguous acres to participate in the present -use-
value taxation program (20 acres for forestry, 10 for agriculture and 5 for horticulture);
2. Be participating in the farm present- use -value taxation program established by
N.C.G.S. §105 -277.2 through §105- 277.7, or is otherwise determined by the county to
meet all the qualifications of this program set forth in G.S. 105 - 277.3;
3. Be certified by the Natural Resources Conservation Service (NRCS) of the United
States Department of Agriculture as being a farm on which at least two - thirds of the
land is composed of soils that:
a. Are best suited for providing food, seed, fiber, forage, timber, forestry
products, horticultural crops and oil seed crops;
b. Have good soil qualities;
C. Are favorable for all major crops common to the county where the land is
located;
d. Have a favorable growing season; and
e. Receive the available moisture needed to produce high yields for an average
of eight out of ten years;
OR at least two - thirds of the land has been actively used in agricultural, horticultural
or forestry operations as defined by N.C.G.S. §105 -277.2 (1, 2, 3) during each of the
five previous years, measured from the date on which the determination must be
made as to whether the land in question qualifies;
4. Be managed, if highly erodible land exists on the farm, in accordance with the Natural
Resources Conservation Service defined erosion - control practices that are addressed
to said highly - erodible land; and
5. Be the subject of a non - binding conservation agreement, as defined in N.C.G.S. §121-
35, between the County and the owner that prohibits non -farm use or development of
such land for a period of at least ten years, except for the creation of not more than
three lots that meet applicable County zoning and subdivision regulations.
On May 15, 2013 the Orange County Agricultural Preservation Board (APB) reviewed the
findings of the staff assessments for the attached applications for the VAD program. All farm
applications were reviewed and verified to have met or exceeded the minimum criteria for
certification into the program. The Agricultural Preservation Board voted unanimously to
recommend approval of the certification for the seven farms and 1,052 acres of farmland and
their inclusion in the Voluntary and Enhanced Voluntary Agricultural District program. The
certification documentation is on file in the DEAPR /Soil and Water Conservation District office.
The farms are described briefly below.
Brief Farm Descriptions:
1) The owner of the Norman Walker Farm has submitted an application to enroll three (3)
parcels of land totaling 244.11 acres, located in the Caldwell Community on Norman Road,
Kiger Road, and Guess Road, as qualifying farmland for the Voluntary Agricultural District
(VAD) program (Caldwell Agricultural District). The farm operation is comprised of hay land,
pasture, livestock, and managed forestry/woodland acres. The Norman Walker Farm has been

evaluated against each of the VAD certification requirement standards and meets or exceeds all
of the measures above.
2) The owners of the Kirk Farms (Kenneth, Ronald, Donald, and Aaron Kirk) have submitted an
application to enroll six (6) parcels of land totaling 278.65 acres, located in the Cane Creek
community on Orange Grove Road, as qualifying farmland for the Voluntary Agricultural District
(VAD) program (Cane Creek /Buckhorn Agricultural District). The farm operation is comprised of
beef cattle, corn, soybeans, grain, hay crops, pasture, and managed forestry/woodland. Kirk
Farms has been evaluated against each of the VAD certification requirement standards and
meets or exceeds all of the measures above.
3) The owners of the Donald and Faye Pope Farm have submitted an application to enroll
three (3) parcels of land totaling 268.63 acres, located in the Cedar Grove Community on
Efland -Cedar Grove Road and Highway 86 North, as qualifying farmland for the Voluntary
Agricultural District (VAD) program (Cedar Grove Agricultural District). The farm operation is
comprised of beef cattle, pasture, organic tobacco, grain, hay crops, and managed
forestry/woodland. The Donald and Faye Pope Farm has been evaluated against each of the
VAD certification requirement standards and meets or exceeds all of the measures above.
4) The owners of the John Pope Farms, LLC (John H. (Jr.)and Kimberly Pope) have submitted
an application to enroll two (2) parcels of land totaling 75.27 acres, located in the Cedar Grove
Community on Hurdle Mills Road and Stewart Farm Road, as qualifying farmland for the
Voluntary Agricultural District (VAD) program (Cedar Grove Agricultural District). The farm
operation is comprised of poultry, tobacco, grain, hay crops, and managed forestry/woodland.
John Pope has an additional 65 acres of farmland currently in the VAD program. John Pope
Farms, LLC has been evaluated against each of the VAD certification requirement standards
and meets or exceeds all of the measures above.
5) The owner of the Betty Walters Hill Farm has submitted an application to enroll one (1)
parcel of land totaling 34.83 acres, located in the High Rock Community on High Rock Road, as
qualifying farmland for the Voluntary Agricultural District (VAD) program (High Rock /Efland
Agricultural District). The farm operation is comprised of beef cattle and pasture, hay crops and
forestry/woodland. The Betty Walters Hill Farm has been evaluated against each of the VAD
certification requirement standards and meets or exceeds all of the measures above.
6) The owners of the Fickle Creek Farm (Noah Ranells and Ben Bergmann) have submitted an
application to revise and add acreage for four (4) parcels of land totaling 154.45 acres, located
in the Buckhorn and High Rock communities on Buckhorn Road and High Rock Road, as
qualifying farmland for both the Voluntary and Enhanced Voluntary Agricultural District
(VAD /EVAD) program (Cane Creek /Buckhorn and High Rock /Efland Agricultural Districts).
Fickle Creek Farm has requested to revise acreage in the program. Two (2) parcels of land
totaling 131.78 acres will be enrolled in the EVAD. Two (2) parcels of land totaling 17.73 acres
will be enrolled in the VAD. The farm is very diverse; including beef cattle, hogs, chickens, and
produce /vegetable crops grown for farmers markets, restaurants, and farm market sales. The
farm also includes pastures and managed forestry/woodland acres. Fickle Creek Farm has
been evaluated against each of the VAD and EVAD certification requirement standards and
meets or exceeds all of the measures above.
7) REVISION: The owners of the Allan and Christine Green Farm have submitted an
application to revise the approved (May 7, 2013) VAD application to EVAD and enroll one (1)

parcel of land totaling 12.28 acres, located in the Cane Creek - Buckhorn area on Dairyland
Road, as qualifying farmland for the Enhanced Voluntary Agricultural District (EVAD) program
(Cane Creek - Buckhorn Agricultural District). The farm is very diverse with a primary focus on
beef cattle and organically grown market produce for farm and farmers market sales. The Allan
and Christine Green Farm has been evaluated against each of the EVAD certification
requirement standards and meets or exceeds all of the measures above.
It should also be noted that staff has consulted with all of these farm owners regarding the
proposed revisions to the Voluntary Farmland Protection Program Ordinance also on the
Board's June 4, 2013 agenda. All of the owners are aware that their VAD /EVAD applications, if
approved, will proceed under the new Ordinance provisions as approved by the Board.
To be formally designated as part of a voluntary agricultural district, the Board of
Commissioners must approve that the farms meet the certification requirements as per the
APB's findings.
FINANCIAL IMPACT: There is no fiscal impact associated with this item. Voluntary agricultural
districts are non - monetary and non - binding conservation agreements. Enhanced Voluntary
Agriculture Districts are non - monetary and are binding 10 -year conservation agreements.
RECOMMENDATION(S): The Manager recommends that the Board certify the seven (7) farm
properties noted above totaling 924.16 acres (VAD) and 144.06 acres (EVAD) as denoted in the
attached documentation as qualifying farmland, and designate the farms as Voluntary or
Enhanced Voluntary Agricultural District farms within the Caldwell, Cane Creek - Buckhorn,
Cedar Grove, and High Rock /Efland Agricultural Districts. With approval of these additional
acres, the Orange County Voluntary Agricultural District Program will have 5,347 acres in the
VAD and 491 acres in the EVAD for a total of 5,838 acres (rounded) to close fiscal year 2012-
13.
