PURPOSE: To consider applications from seven (7) landowners/farms to certify qualifying
farmland within the Caldwell, Cedar Grove, Cane Creek/Buckhorn, and Schley/Eno Voluntary
Agricultural Districts; and enroll and/or update ownership for the lands in the Orange County
Farmland Preservation Voluntary and Enhanced Voluntary Agricultural District programs.
BACKGROUND: Orange County's Voluntary Farmland Preservation Program was started in
1992. To date, there are 86 farms totaling 9,701 acres in the Voluntary Agricultural District
(VAD) program and 2,234 acres in the Enhanced Voluntary Agricultural District (EVAD) program
—for a total of 11,935 acres (rounded) in the program.
The County's Voluntary Farmland Protection Ordinance (VFPO) outlines a procedure for the
Agricultural Preservation Board to review and approve applications for qualifying farmland, and
to make recommendations to the Board of Commissioners concerning the establishment and
modification of agricultural districts. Section VII of the VFPO contains the requirements for
inclusion in a voluntary agricultural district. To be certified as qualifying farmland, a farm must:
a) Be located in the unincorporated area of Orange County;
b) Be engaged in Agriculture as that word is defined in NC GS 106-581.1
c) Be certified by the Natural Resources Conservation Service (NRCS) of the United States Department of
Agriculture as being a farm on which at least two-thirds of the land is composed of soils that are best suited for
providing food, seed,fiber,forage, timber, forestry products, horticultural crops and oil seed crops;
d) Be managed in accordance with the Natural Resources Conservation Service and NC Soil and Water
Conservation Service defined erosion-control practices that are addressed to said highly-erodible land; and
have a current conservation farm plan and/or forestry management plan associated with the current usages
and owner; and
e) Be the subject of a non-binding conservation agreement, as defined in N.C.G.S. §121-35, between the County
and the owner that prohibits non-farm use or development of such land for a period of at least ten years, except
for the creation of not more than three lots that meet applicable County zoning and subdivision regulations.
The Agricultural Preservation Board reviewed the findings of the staff assessments for the
attached applications for the Orange County Voluntary Agricultural District program at the

September and November 2017 meetings. All farm applications were reviewed and verified to
have met or exceeded the minimum criteria for certification into the program. The Agricultural
Preservation Board voted unanimously to recommend approval of the certification for the seven
(7) farms, and their inclusion in the Voluntary (588 acres) and the Enhanced Voluntary
Agricultural District (31 acres) program. The certification documentation is on file in the
DEAPR/Soil and Water Conservation District office. The farms are described briefly below:
Brief Farm Descriptions:
1) Owners of Crabtree Farms Inc., Yvonne Crabtree and son, Gary Crabtree, have submitted
an application to enroll two (2) parcels of land totaling 156.51 acres as qualifying farmland
for the Voluntary Agricultural District program (VAD) in the Cedar Grove Agricultural District.
The farm operation includes grain crops, pasture/hayland, livestock, and managed
woodland. The farm has been evaluated against each of the VAD certification requirement
standards and meets or exceeds all of the measures above.
2) Owners of Hall Farm, Inc., Howard Hall, and family, Michael and Shelia Hall, have submitted
an application to enroll three (3) parcels of land totaling 156.35 acres as qualifying farmland
for the Voluntary Agricultural District (VAD) program in the Caldwell Agricultural District. The
farm operation includes tobacco, soybeans, grain crops, hayland and managed woodland.
The farm has been evaluated against each of the VAD certification requirement standards
and meets or exceeds all of the measures above.
3) Owners of Maple Spring Gardens, Kenneth Dawson and Elizabeth Outlaw, have submitted
an application to enroll two (2) parcels of land totaling of 80.04 acres as qualifying farmland
for the Voluntary Agricultural District (VAD) program located in the Cedar Grove Agricultural
District. The farm includes vegetables, herbs, fruits, and flowers. The farm has been
evaluated against each of the VAD certification requirement standards and meets or
exceeds all of the measures above.
4) Owners Geoffrey and Jane Gledhill have submitted an application to enroll one (1) parcel of
land totaling 29.61 acres as qualifying farmland for the Enhanced Voluntary Agricultural
District (EVAD) program in the Cedar Grove Agricultural District. The farm operation includes
managed forestry/woodland. The farm has been evaluated against each of the EVAD
certification requirement standards and meets or exceeds all of the measures above.
5) Owners Andy and Debra Gates have submitted an application to enroll two (2) parcels of
land totaling of 111.01 acres as qualifying farmland for the Voluntary Agricultural District
(VAD) program located in the Caldwell Agricultural District. The farm includes soybeans,
grain crops, pasture/hayland, beef cattle, and managed woodland. The farm has been
evaluated against each of the VAD certification requirement standards and meets or
exceeds all of the measures above.
6) Owners of Cane Creek Farms, Robert Kirk Jr., and son, Michael Kirk, have submitted an
application to enroll two (2) parcel of land totaling 84.09 acres as qualifying farmland for the
Voluntary Agricultural District (VAD) program in the Cane Creek/Buckhorn Agricultural
District. The farm operation includes livestock, pasture/hayland, vegetables, and managed
woodland. The farm property has been evaluated against each of the VAD certification
requirement standards and meets or exceeds all of the measures above.

7) Owners of Holden Roberts Farm, Nels and Nancy Anderson, have submitted an application
to update acreage ownership for one (1) parcel of land and to change this parcel of land
(58.42 acres) from the VAD to the EVAD designation. Due to the increase of 1.44 acres, the
parcel number has changed and the new acreage for the parcel is 59.86 acres. The
Andersons request the total acres, 59.86, to be enrolled as qualifying farmland for the
Enhanced Voluntary Agricultural District (EVAD) program in the Schley/Eno Agricultural
District. The farm operation includes beef cattle, pastures, hay crops and managed
woodland. The farm property has been evaluated against each of the EVAD certification
requirement standards and meets or exceeds all of the measures above.
FINANCIAL IMPACT: There is no fiscal impact associated with this item. Voluntary Agricultural
Districts are non-monetary and non-binding conservation agreements. Enhanced Voluntary
Agriculture Districts are non-monetary and are binding 10-year conservation agreements.
SOCIAL JUSTICE IMPACT: The following Orange County Social Justice Goal is applicable to
this item:
• GOAL: ENSURE ECONOMIC SELF-SUFFICIENCY
The creation and preservation of infrastructure, policies, programs and funding necessary
for residents to provide shelter, food, clothing and medical care for themselves and their
dependents.
The Orange County Voluntary Agricultural District Program ordinance conserves, protects and
encourages the preservation and improvement of agricultural land within the County boundaries
as a critical component of the County's cultural and rural character and its economy by virtue of
the production of food, fiber and other products. The purpose of this Ordinance is to reduce the
loss of productive and existing farmland by promoting agricultural values and the general
welfare of the County, recognize the existence of important farmlands by seeking to minimize
risks of nuisance suits that arise from the onset of other land uses, encourage participation in
voluntary programs to preserve and protect farmland from non-farm development and increase
identity and awareness of the agricultural community, and its role in the economic and cultural
quality of life for all County residents. (from the Orange County VAD program ordinance)
RECOMMENDATION(S): The Manager recommends that the Board certify the seven (7) farm
properties noted above totaling 588* acres (VAD) and 31 acres* (EVAD), in addition to the 58.42
acres of VAD to EVAD designation change as denoted in the attached documentation, as
qualifying farmland; designate the properties as a Voluntary or Enhanced Voluntary Agricultural
District farm within the Caldwell, Cane Creek/Buckhorn, Schley/Eno, and Cedar Grove
Voluntary Agricultural Districts; and enroll the lands in the Orange County Voluntary Agricultural
District (VAD) and the Enhanced Voluntary Agricultural District (EVAD) programs.
With approval of these additional acres, the Orange County Voluntary Agricultural District
Program will have enrolled 93 farms totaling 10,231 acres* in the VAD and 2,323* acres in the
EVAD, fora total of 12,554 acres (rounded) in the program.

CONSERVATION AGREEMENT DETAIL of VAD and EVAD:
Voluntary Agricultural District (VAD) conservation agreements are for a period of ten
years. The landowner may revoke the agreement through a written request to the Orange
County Agricultural Preservation Board, A Conservation Agreement for land within a
Voluntary Agricultural District shall be automatically renewed for an additional term of ten
years unless either the Agricultural Preservation Board or the landowner(s) gives written
notice to the contrary prior to the termination date of the Conservation Agreement. At the
end of each ten-year term, the Conservation Agreement shall automatically renew for an
additional ten-year term unless notice of termination is given.
Enhanced Voluntary Agricultural District (EVAD) conservation agreements are for a
period of ten years, but cannot be revoked during the term of the agreement. EVAD
enrollment, however, offers landowners additional benefits such as a higher percentage of
cost-share funds under the Agricultural Cost Share Program. A Conservation Agreement for
an Enhanced Voluntary Agricultural District shall be deemed automatically renewed for an
additional term of three years unless either the Agricultural Preservation Board or the
landowner(s) gives written notice to the contrary prior to the termination date of the
Conservation Agreement. At the end of each three-year term the Conservation Agreement
shall automatically renew for an additional three-year term unless notice of termination is
given.

Voluntary Agricultural District (VAD) conservation agreements are for a period of ten
years. The landowner may revoke the agreement through a written request to the Orange
County Agricultural Preservation Board. A Conservation Agreement for land within a
Voluntary Agricultural District shall be automatically renewed for an additional term of ten
years unless either the Agricultural Preservation Board or the landowner(s) gives written
notice to the contrary prior to the termination date of the Conservation Agreement. At the
end of each ten-year term, the Conservation Agreement shall automatically renew for an
additional ten-year term unless notice of termination is given.
Enhanced Voluntary Agricultural District (EVAD) conservation agreements are for a
period of ten years, but cannot be revoked during the term of the agreement. EVAD
enrollment, however, offers landowners additional benefits such as a higher percentage of

CONSERVATION AGREEMENT DETAIL of VAD and EVAD:
Voluntary Agricultural District (VAD) conservation agreements are for a period of ten
years. The landowner may revoke the agreement through a written request to the Orange
County Agricultural Preservation Board. A Conservation Agreement for land within a
Voluntary Agricultural District shall be automatically renewed for an additional term of ten
years unless either the Agricultural Preservation Board or the landowner(s) gives written
notice to the contrary prior to the termination date of the Conservation Agreement. At the
end of each ten-year term, the Conservation Agreement shall automatically renew for an
additional ten-year term unless notice of termination is given.
Enhanced Voluntary Agricultural District (EVAD) conservation agreements are for a
period of ten years, but cannot be revoked during the term of the agreement. EVAD
enrollment, however, offers landowners additional benefits such as a higher percentage of
cost-share funds under the Agricultural Cost Share Program. A Conservation Agreement for
an Enhanced Voluntary Agricultural District shall be deemed automatically renewed for an
additional term of three years unless either the Agricultural Preservation Board or the
landowner(s) gives written notice to the contrary prior to the termination date of the
Conservation Agreement. At the end of each three-year term the Conservation Agreement
shall automatically renew for an additional three-year term unless notice of termination is
given.
