PURPOSE: To consider applications from ten (10) landowners/farms to certify qualifying
farmland within the Caldwell, Cane Creek/Buckhorn, White Cross, Cedar Grove, and
Schley/Eno Voluntary Agricultural Districts; and enroll and/or update ownership for the lands in
the Orange County Voluntary Agricultural District (VAD, 470 acres); and the Enhanced
Voluntary Agricultural District (EVAD, 91 acres) programs.
BACKGROUND: Orange County's Voluntary Farmland Preservation Program was started in
1992. To date, there are 78 farms totaling 9,320 acres in the Voluntary Agricultural District
(VAD) program, and 2,144 acres in the Enhanced Voluntary Agricultural District (EVAD)
program, for a total of 11,464 acres (rounded) in the program.
The County's Voluntary Farmland Protection Ordinance (VFPO) outlines a procedure for the
Agricultural Preservation Board to review and approve applications for qualifying farmland, and
to make recommendations to the Board of Commissioners concerning the establishment and
modification of agricultural districts. Section VII of the VFPO contains the requirements for
inclusion in a voluntary agricultural district. To be certified as qualifying farmland, a farm must:
a) Be located in the unincorporated area of Orange County;
b) Be engaged in Agriculture as that word is defined in NC GS 106-581.1
c) Be certified by the Natural Resources Conservation Service (NRCS) of the United States
Department of Agriculture as being a farm on which at least two-thirds of the land is
composed of soils that are best suited for providing food, seed, fiber, forage, timber, forestry
products, horticultural crops and oil seed crops;
d) Be managed in accordance with the Natural Resources Conservation Service and NC Soil
and Water Conservation Service defined erosion-control practices that are addressed to

said highly-erodible land; and have a current conservation farm plan and/or forestry
management plan associated with the current usages and owner; and
e) Be the subject of a non-binding conservation agreement, as defined in N.C.G.S. §121-35,
between the County and the owner that prohibits non-farm use or development of such land
for a period of at least ten years, except for the creation of not more than three lots that
meet applicable County zoning and subdivision regulations.
The Agricultural Preservation Board reviewed the findings of the staff assessments for the
attached applications for the Orange County Voluntary Agricultural District program at the March
and May 2017 meetings. All farm applications were reviewed and verified to have met or
exceeded the minimum criteria for certification into the program. The Agricultural Preservation
Board voted unanimously to recommend approval of the certification for the ten (10) farms, and
their inclusion in the Voluntary (470 acres) and/or Enhanced Voluntary Agricultural District (91
acres) program. The certification documentation is on file in the DEAPR/Soil and Water
Conservation District office. The farms are described briefly below:
Brief Farm Descriptions:
1) Owners Allen and Christine Green have submitted an application to enroll one (1) parcel of
land totaling 18.5 acres as qualifying farmland for the Voluntary Agricultural District program
(VAD) in the Cane Creek/Buckhorn Agricultural District. The farm operation includes organic
vegetable crops, pastureland, and managed woodland. This parcel is close to other parcels
owned by the Greens that are currently enrolled into the Enhanced Voluntary Agricultural
Program. The farm has been evaluated against each of the VAD certification requirement
standards and meets or exceeds all of the measures above.
2) Owners Vann Bennett and Bernadette Pelissier have submitted an application to enroll three
(3) parcels of land totaling 90.47 acres as qualifying farmland for the Enhanced Voluntary
Agricultural District program (EVAD) in the Cedar Grove Agricultural District. The farm
operation includes blueberries, blackberries, fruit and vegetable crops, and managed
woodland. The farm has been evaluated against each of the EVAD certification requirement
standards and meets or exceeds all of the measures above.
3) Owners Charles (Gene) and Ruth Williams have submitted an application to enroll two (2)
parcels of land totaling of 72 acres as qualifying farmland for the Voluntary Agricultural
District (VAD) program located in the White Cross Agricultural District. The farm includes
pasture and hay crops for beef cattle, and managed woodland. The farm has been
evaluated against each of the VAD certification requirement standards and meets or
exceeds all of the measures above.
4) Owners and family members Doug and Heidi Brown and Helmut and Karen Poerschke have
submitted an application to enroll two (2) parcel of land totaling 31.82 acres as qualifying
farmland for the Voluntary Agricultural District (VAD) program in the Cedar Grove
Agricultural District. The farm operation includes horses, beef cattle, pastures, hay crops
and managed woodland. The farm has been evaluated against each of the VAD certification
requirement standards and meets or exceeds all of the measures above.

5) Owners Wayne Parmley and Alicia Belcher have submitted an application to enroll one (1)
parcel of land totaling of 42 acres as qualifying farmland for the Voluntary Agricultural District
(VAD) program located in the Cedar Grove Agricultural District. The farm includes seasonal
vegetables, pasture for hogs, goats, and chickens, and managed woodland. The farm has
been evaluated against each of the VAD certification requirement standards and meets or
exceeds all of the measures above.
6) Owners Jeff Berst and Stephanie Bullins have submitted an application to enroll one (1)
parcel of land totaling 52 acres as qualifying farmland for the Voluntary Agricultural District
(VAD) program in the Caldwell Agricultural District. The farm operation includes tobacco and
hay crops, transitioning to vegetables, berries, and fruit trees; in addition to managed
woodland. The farm has been evaluated against each of the VAD certification requirement
standards and meets or exceeds all of the measures above.
7) Owners of the Merry Hill Farm, represented by Lynne Holtkamp (on behalf of multiple family
members), have submitted an application to enroll five (5) parcels of land totaling of 115.25
acres as qualifying farmland for the Voluntary Agricultural District (VAD) program located in
the Cane Creek/Buckhorn Agricultural District. The farm includes beef cattle, pasture, hay
crops and managed woodland. The farm has been evaluated against each of the VAD
certification requirement standards and meets or exceeds all of the measures above.
8) Owner Lee Miller has submitted an application to enroll two (2) parcel of land totaling 50.63
acres as qualifying farmland for the Voluntary Agricultural District (VAD) program in the
Caldwell Agricultural District. The farm operation includes hay crops and managed
woodland. The farm property has been evaluated against each of the VAD certification
requirement standards and meets or exceeds all of the measures above.
9) Owner Ann Bacon Hollowell has submitted an application to update ownership for one (1)
parcel of land totaling 42.22 acres as qualifying farmland for the Voluntary Agricultural
District (VAD) program located in the Schley/Eno Agricultural District. The parcel is part of
the original Bacon Family enrolled in the VAD program in 2002; therefore, these acres will
not increase the overall acreage in the program. The farm includes grain and hay crops, and
transitioning to pastures. The farm has been evaluated against each of the VAD certification
requirement standards and meets or exceeds all of the measures above.
10) Owners Michael and Sherry Miller Scully have submitted an application to update
ownership for one (1) parcel of land totaling 44.2 acres as qualifying farmland for the
Voluntary Agricultural District (VAD) program in the Caldwell Agricultural District. The parcel
is part of the original Miller Family enrolled in the VAD program in 2002; therefore, these
acres will not increase the overall acres in the program. The farm operation includes beef
cattle, pastures, hay crops and managed woodland. The farm property has been evaluated
against each of the VAD certification requirement standards and meets or exceeds all of the
measures above.
FINANCIAL IMPACT: There is no fiscal impact associated with this item. Voluntary Agricultural
Districts are non-monetary and non-binding conservation agreements. Enhanced Voluntary
Agriculture Districts are non-monetary and are binding 10-year conservation agreements.

SOCIAL JUSTICE IMPACT: The following Orange County Social Justice Goal is applicable to
this item:
• GOAL: ENSURE ECONOMIC SELF-SUFFICIENCY
The creation and preservation of infrastructure, policies, programs and funding necessary
for residents to provide shelter, food, clothing and medical care for themselves and their
dependents.
The Orange County Voluntary Agricultural District Program ordinance conserves, protects and
encourages the preservation and improvement of agricultural land within the County boundaries
as a critical component of the County's cultural and rural character and its economy by virtue of
the production of food, fiber and other products. The purpose of this Ordinance is to reduce the
loss of productive and existing farmland by promoting agricultural values and the general
welfare of the County, recognize the existence of important farmlands by seeking to minimize
risks of nuisance suits that arise from the onset of other land uses, encourage participation in
voluntary programs to preserve and protect farmland from non-farm development and increase
identity and awareness of the agricultural community, and its role in the economic and cultural
quality of life for all County residents. (From the Orange County VAD program ordinance)
RECOMMENDATION(S): The Manager recommends that the Board certify the ten (10) farm
properties noted above totaling 470 acres (VAD) and 91 acres (EVAD) (rounded acreage) as
denoted in the attached documentation as qualifying farmland; designate the farms as noted
above as Voluntary or Enhanced Voluntary Agricultural District farm within the Caldwell, Cane
Creek/Buckhorn, Schley/Eno, Cedar Grove, and White Cross Voluntary Agricultural Districts;
and enroll the lands in the Orange County Voluntary Agricultural District (VAD) and the
Enhanced Voluntary Agricultural District (EVAD) programs.
(Note: Two parcels are updating new ownership and therefore approximately 86 acres will not
be an increase in the overall acres of the program.)
With approval of these additional acres, the Orange County Voluntary Agricultural District
Program will have enrolled 86 farms totaling 9,701 acres in the VAD and 2,234 acres in the
EVAD for a total of 11,935 acres (rounded) in the program.

CONSERVATION AGREEMENT DETAIL of VAD and EVAD:
Voluntary Agricultural District (VAD) conservation agreements are for a period of ten
years. The landowner may revoke the agreement through a written request to the Orange
County Agricultural Preservation Board. A Conservation Agreement for land within a
Voluntary Agricultural District shall be automatically renewed for an additional term of ten
years unless either the Agricultural Preservation Board or the landowner(s) gives written
notice to the contrary prior to the termination date of the Conservation Agreement. At the
end of each ten-year term, the Conservation Agreement shall automatically renew for an
additional ten-year term unless notice of termination is given.
Enhanced Voluntary Agricultural District (EVAD) conservation agreements are for a
period of ten years, but cannot be revoked during the term of the agreement. EVAD
enrollment, however, offers landowners additional benefits such as a higher percentage of
cost-share funds under the Agricultural Cost Share Program. A Conservation Agreement for
an Enhanced Voluntary Agricultural District shall be deemed automatically renewed for an
additional term of three years unless either the Agricultural Preservation Board or the
landowner(s) gives written notice to the contrary prior to the termination date of the
Conservation Agreement. At the end of each three-year term the Conservation Agreement
shall automatically renew for an additional three-year term unless notice of termination is

CONSERVATION AGREEMENT DETAIL of VAD and EVAD:
Voluntary Agricultural District (VAD) conservation agreements are for a period of ten
years. The landowner may revoke the agreement through a written request to the Orange
County Agricultural Preservation Board. A Conservation Agreement for land within a
Voluntary Agricultural District shall be automatically renewed for an additional term of ten
years unless either the Agricultural Preservation Board or the landowner(s) gives written
notice to the contrary prior to the termination date of the Conservation Agreement. At the
end of each ten-year term, the Conservation Agreement shall automatically renew for an
additional ten-year term unless notice of termination is given.
Enhanced Voluntary Agricultural District (EVAD) conservation agreements are for a
period of ten years, but cannot be revoked during the term of the agreement. EVAD
enrollment, however, offers landowners additional benefits such as a higher percentage of
cost-share funds under the Agricultural Cost Share Program. A Conservation Agreement for
an Enhanced Voluntary Agricultural District shall be deemed automatically renewed for an
additional term of three years unless either the Agricultural Preservation Board or the

CONSERVATION AGREEMENT DETAIL of VAD and EVAD:
Voluntary Agricultural District (VAD) conservation agreements are for a period of ten
years. The landowner may revoke the agreement through a written request to the Orange
County Agricultural Preservation Board. A Conservation Agreement for land within a
Voluntary Agricultural District shall be automatically renewed for an additional term of ten
years unless either the Agricultural Preservation Board or the landovyner(s) gives written
notice to the contrary prior to the termination date of the Conservation Agreement. At the
end of each ten-year term, the Conservation Agreement shall automatically renew for an
additional ten-year term unless notice of termination is given.
Enhanced Voluntary Agricultural District (EVAD) conservation agreements are for a
period of ten years, but cannot be revoked during the term of the agreement. EVAD
enrollment, however, offers landowners additional benefits such as a higher percentage of
cost-share funds under the Agricultural Cost Share Program. A Conservation Agreement for
an Enhanced Voluntary Agricultural District shall be deemed automatically renewed for an
additional term of three years unless either the Agricultural Preservation Board or the

CONSERVATION AGREEMENT DETAIL of VAD and EVAD:
Voluntary Agricultural District (VAD) conservation agreements are for a period of ten
years. The landowner may revoke the agreement through a written request to the Orange
County Agricultural Preservation Board. A Conservation Agreement for land within a
Voluntary Agricultural District shall be automatically renewed for an additional term of ten
years unless either the Agricultural Preservation Board or the landowner(s) gives written
notice to the contrary prior to the termination date of the Conservation Agreement. At the
end of each ten-year term, the Conservation Agreement shall automatically renew for an
additional ten-year term unless notice of termination is given.
Enhanced Voluntary Agricultural District (EVAD)conservation agreements are for a
period of ten years, but cannot be revoked during the term of the agreement. EVAD
enrollment, however, offers landowners additional benefits such as a higher percentage of
cost-share funds under the Agricultural Cost Share Program. A Conservation Agreement for
an Enhanced Voluntary Agricultural District shall be deemed automatically renewed for an
additional term of three years unless either the Agricultural Preservation Board or the
landowner(s) gives written notice to the contrary prior to the termination date of the
Conservation Agreement. At the end of each three-year term the Conservation Agreement
shall automatically renew for an additional three-year term unless notice of termination is
given.
