HomeMy WebLinkAbout2017-722-E EMS - Orange Alamance PSAP MOU MOU PSAP Agreement This agreement made this 7th day of December, 2016 by and between Orange County Communications, the “PSAP” and “Backup PSAP, and Alamance County Communications, the “Interim Backup PSAP”, and collectively known as the “parties”. WHEREAS, the installation of the Enhanced 9-1-1 telephone system will provide one common number to call to receive public safety assistance and is intended to assure the caller that his/her request for assistance will be answered and that the appropriate emergency response agency will be notified as a result of dialing 9-1-1; and WHEREAS, the parties desire to formalize an arrangement whereby 9-1-1 calls are properly routed; and WHEREAS, it is understood that in the event that 9-1-1 calls are unable to be answered by the PSAP, all calls will be temporarily routed to the Interim Backup PSAP until the PSAP has the Backup PSAP staffed; NOW THEREFORE, the parties agree as follows: ARTICLE I. General Purpose It is the purpose of this Agreement to establish certain procedures for handling 9-1-1 calls between the PSAP and the Interim Backup PSAP in the event that the PSAP is unable to receive or transfer its 9-1-1 calls. ARTICLE II. Definitions (N.C. Gen. Stat. § 143B-1417) A. Public safety answering point (PSAP). -- The public safety agency that receives an incoming 911 call and dispatches appropriate public safety agencies to respond to the call. B. Primary PSAP. -- The first point of reception of a 911 call by a public safety answering point. DocuSign Envelope ID: AEB24751-E250-4139-9D81-9DB4B373BBF5 C. Interim Backup PSAP – Another PSAP, be it Municipal, County or State, designated to take calls on a temporary backup basis and transfer them in accordance with mutually agreed upon call handling procedures. D. Back-up PSAP. -- The capability to operate as part of the 911 System and all other features of its associated primary PSAP. The term includes a back-up PSAP that receives 911 calls only when they are transferred from the primary PSAP or on an alternate routing basis when calls cannot be completed to the primary PSAP. E. Enhanced 911 service. -- Directing a 911 call to an appropriate PSAP by selective routing or other means based on the geographical location from which the call originated and providing information defining the approximate geographic location and the telephone number of a 911 caller, in accordance with the FCC Order. F. ANI/ALI – Automatic Number Identification/Automatic Location Identification ARTICLE III. Conditions A. The services provided as a result of this Agreement are considered services to the general public and this Agreement shall not be construed to create an employer-employee, principal-agent or co-partnership relationship between the parties. B. The cost of operating the PSAP, the Interim Backup PSAP and the Backup PSAP shall remain the responsibilities of the respective parties. C. This Agreement applies to Enhanced 9-1-1 telephone calls that are not answered by the PSAP and therefore routed to the Interim Backup PSAP until the Backup PSAP is staffed. ARTICLE IV. Procedures In the event that it becomes necessary for Orange County 9-1-1 to activate the Orange County Backup Plan, the following steps will be initiated: DocuSign Envelope ID: AEB24751-E250-4139-9D81-9DB4B373BBF5 A. Communication Supervisor notifies the Data Systems Manager, Communications Manager, and Director of Emergency Services Immediately via phone (cell or satellite). B. Communications Supervisor will contact Alamance for permission to do an immediate re-route until the Orange County Backup Facility is operational. C. Communications Manager or designee request the rerouting from Intrado following these steps: x Call the 24 hour Intrado Emergency Call Relay Center and requests rerouting/abandonment (password restricted). D. Backup Facility Activation steps: x Communications Manager and Data Systems Manager will maintain keys to the alternate facility (with backups provided in the primary PSAP) x Power on computer equipment x Ensure connection to CPE and CAD servers x Notify Orange County Asset Management (on-call) and Orange County IT of facility activation. x Assign console positions and ensure staff receive just-in-time refresher training x Relocate staff to alternate facility. x Once the alternate facility is established, call the 24 hour Intrado Emergency Call Relay Center and request to resume normal operations. This will ensure calls begin ringing to the alternate facility. x Orange County Communications Operations Manager will notify Alamance County 9-1-1 Director once normal operations have resumed within the Backup Facility. E. If it is determined at a later date that it is necessary to provide other communications equipment or procedures so as to be able to accomplish the purpose of this Agreement, amendments to this Agreement may be executed identifying the cost obligations of each party for such additional equipment. Relationship Between the Parties In consideration of the mutual services provided herein, both parties agree that nothing contained herein is intended to be or should be construed in any manner as creating or establishing the relationship of co-partners between the parties hereto or as constituting an agency relationship in any manner whatsoever. The individual parties are and shall remain independent entities with respect to all services performed under this Agreement. Each party represents that it has, or will secure all its expense, all personnel required in performing its service obligation under this Agreement and that the acts of its employees performing the service under this Agreement shall be the acts of employees of that entity alone. Each entity agrees that in the performance of this mutual service, its employees shall not require nor be entitled to any compensation, rights or benefits of any kind whatsoever from the other entity to this Agreement, including, but not limited to, tenure rights, medical and hospital care, sick and vacation leave, disability, Worker’s Compensation, Unemployment Compensation or severance pay.
