This Agreement, made and entered into this the of O c t o b e r, 2016 by and between Town
of Chapel Hill (hereinafter referred to as "Town") and Orange County (hereinafter referred to as
"County"), to provide for periodic fire safety inspections of Orange County owned and occupied
facilities within the Town's jurisdiction as mandated by the State of North Carolina pursuant to the
authority contained in Article 18 of Chapter 153A and Article 20 of Chapter 160A of the North
Carolina General Statutes.
WITNESSETH
WHEREAS, it is the desire of the Town and the County to enter into an agreement for the
provision of required fire safety inspections by County employees of Orange County owned
facilities within the jurisdiction of the Town,
NOW THEREFORE, and in consideration of the mutual terms and agreements hereinafter set forth,
the Town and the County do agree as follows:
1. County will carry out, or cause to be carried out,within Town's jurisdiction inspections for
Orange County owned and occupied facilities.
2. Appropriate officials of the County and Town shall work together to produce a schedule
identifying buildings, structures, and premises which are of priority for inspection within
Town's jurisdiction.
3. County Fire Marshal will submit to the Town Fire Marshal, within five working days of
the beginning of each month, a written report of each fire safety inspection performed
within Town's jurisdiction during the previous month.
4. The Town will continue to inspect all County owned facilities or portions of County
owned facilities that are occupied by other businesses or organizations that are not part
of County Government within Town's jurisdiction.
5. The County shall not invoice Town for such inspections.
6. County will conduct routine re-inspections of any facilities that fail to comply fully with
t h e provisions of the North Carolina Fire Prevention Code. However, code
enforcement decisions regarding facilities that fail to comply after repeat inspections,
that may require civil or criminal action, will be Town's responsibility. Town shall not
be responsible for enforcing code violations found to exist in County owned and occupied
buildings located within Town's jurisdiction.
7. Orange County facilities that undergo permitted construction within the Town's
jurisdiction shall be permitted through the Town, and jurisdiction shall apply to the
Town Fire Marshal.
8. In absence of the Town Fire Marshal or in need of assistance, a representative of the
Chapel Hill Fire Department may request for the Orange County Fire Marshal's
Division to provide fire investigation services within the Town's jurisdiction. Also
in the absence of the Town Fire Marshal, the Town Manager may request assistance
from the Orange County Fire Marshal for fire code enforcement within the Town's
jurisdiction.
9. Nothing in this agreement shall prevent appropriate Town agencies or personnel
from assisting in the enforcement of the North Carolina Fire Prevention Code
and in detecting and reporting such violations as they deem necessary.
10. This agreement shall remain in effect until discontinued by either party.
Discontinuance shall occur thirty days after either party provides the other
written notice of its intent to discontinue this agreement.
IN WITNESSEREOF, the undersigned do hereby cause this agreement to be
