MEMORANDUM OF UNDERSTANDING
Between
ORANGE COUNTY DEPARTMENT OF SOCIAL SERVICES
And
ORANGE COUNTY SCHOOLS
This Memorandum of Understanding (MOU) entered into the 01 day of .5,41,-{, 201(40
between the Orange County Department of Social Services (DSS) and Orange County Schools
(OCS) outlines the responsibilities of both parties to provide services for pregnant and parenting
adolescents within the Orange County School district through the Orange County Adolescent
Parenting Program (APP).
This Memorandum of Understanding is effective beginning July 1, 2011,4, and ending June 30.

A. Orange County Department of Social Services agrees to:
1. Provide a Teen Parent Social Worker to do case management services for pregnant and
parenting teens in the Orange County School district working toward their high school
diploma or equivalency. These services shall include prevention of the adolescents'
second pregnancy, completion of their high school education, and prevention of
abuse/neglect of their children as well as primary pregnancy prevention consultation and
education with individuals and student groups.
2. Supervise directly the Teen Parent Social Worker, a County employee who is
accountable to DSS.
3. Include the OCS liaison on the hiring committee any time a new Teen Parent Social
Worker for Orange County Schools must be hired.
B. Orange County Schools agrees to:
1. Assign a liaison to provide coordination and oversight of the Orange County Adolescent
Parenting Program in the school district.
2. Provide a furnished office and parking space at Orange High School, office equipment,
clerical support, and telephone access at no charge to the Orange County Department of
Social Services.
C. Both the Orange County Department of Social Services and Orange County Schools
agree to:
1. Develop procedures for referrals and the provision of services for pregnant and parenting
students in Orange County Schools.

2. Coordinate efforts regarding work assignments and leave time such as sick, vacation, etc.
for the Teen Parent Social Worker.
3. Use the interviewing and selection process utilized by DSS for the hiring of the Teen
Parent Social Worker in accordance with Orange County policy and procedures.
4. Evaluate the job performance of the Teen Parent Social Worker on an annual basis. If
Orange County Schools determines that the Teen Parent Social Worker's performance or
professional interactions are inadequate or inappropriate, Orange County Schools may
request that DSS initiate appropriate action to correct that employee's deficiencies, or to
terminate that employee's involvement with Orange County Schools, if indicated.
5. Comply with the Orange County Personnel Ordinance and the State Personnel Act and
provide sufficient documentation to support any disciplinary concern regarding the
performance or professional interactions of the Teen Parent Social Worker.
D. Access to OCS Premises
1. All parties acknowledge that N.C. General Statute 14-208.18 prohibits anyone required to
register as a sex offender under Article 27A of Chapter 14 of the General Statues from
knowingly being on the premises of any school or other facility dedicated to the care of
minors. DSS shall conduct criminal record and background checks on the Teen Parent
Social Worker and any other DSS employees or volunteers, who, pursuant to this
Agreement, will work on Orange County Schools' property and/or have direct contact
with Orange County Schools' students. The checks shall include at a minimum checks of
the State Sex Offender and Public Protection Registration Program, the State Sexually
Violent Predator Registration Program, and the National Sex Offender Registry ("the
Registries"), which may be completed at no cost by accessing the North Carolina Sex
Offender Registry website at hqp:// exoffendcl.nebi.v»/. DSS shall provide the names
and identifying information to OCS prior to assigning any employee or volunteer to work
at an OCS school, and DSS personnel shall not begin any services that involve direct
interaction with students until the background checks are completed. DSS shall not
assign any employee or volunteer to a role that may involve direct student contact, at
Orange County Schools' events, or on Orange County Schools property if (1) said
individual has been convicted of a felony; (2) said individual has been convicted of any
crime, whether misdemeanor or felony, involving sex, violence, or drugs; or (3) in the
judgment of OCS, said individual has engaged in any crime or conduct indicating that the
individual may pose a threat to the safety or well-being of student or school personnel.
2. The public schools and school-sponsored events of Orange County shall remain at all
times under the authority of the Board, the Superintendent, and the individual school
principals. DSS shall ensure that the Social Worker and any other DSS agents or
employees comply with any and all rules, regulations, or directives of the Board, the
Superintendent or Superintendent's designee at all times while all on school premises or
at school-sponsored events.

E. Records and Confidentiality of Student Information
I. DSS agrees that any student records obtained in the course of providing services under
this agreement shall be subject to the confidentiality and disclosure provisions of
applicable federal and state statutes and regulations, and OCS policies. The Social
Worker shall comply with all applicable laws, regulations, and OCS policies, including
but not limited to laws, regulations and policies regarding access to confidential student
records. The Social Worker may have access to confidential student records or to any
personally identifiable information of any OCS student only to the extent allowed under
the Family Educational Rights and Privacy Act (FERPA) and applicable OCS policies
and procedures, which require either a legitimate educational interest or written consent
from the parent/adult student before records may be viewed. Nothing in this agreement
provides the Social Worker, DSS or its agents the right of access to any individual
student's records. All student records shall be kept in a secure location preventing access
by unauthorized individuals. The Social Worker shall not forward to any person other
than the parent/adult student or OCS any student record, including, but not limited to, the
student's identity, without the written consent of the parent/adult student and OCS. Upon
termination of this Agreement, the Social Worker shall turn over to OCS all student
records of OCS students to whom the Social Worker has provided services under this
Agreement.
F. In General
1. This MOU shall be reviewed at least annually, prior to June 1 and may be terminated by
either party upon 60 days written notice.
2. The MOU contains the entire understanding of the parties and shall not be altered,
amended or modified, except by an agreement in writing executed by the duly authorized
officials of both parties.
3. Both Orange County Schools and the Orange County Department of Social Services
agree to and understand the conditions outlined in the MOU.
4. By executing this MOU Orange County Schools and Orange County Department of
Social Services affirm that they are and shall remain in compliance with Article 2 of
Chapter 64 of the North Carolina General Statutes and certify that they has not been
identified, and have not utilized the services of any agent or subcontractor, on the list
created by the State Treasurer pursuant to G.S. 147-86.58.
5. This MOU together with any amendments or modifications may be executed
electronically. All electronic signatures affixed hereto evidence the intent of the Parties
to comply with Article 11A and Article 40 of the North Carolina General Statutes
Chapter 66.
