PURPOSE: To reconfirm BOCC goals for the Land Use Element Update, provide Land Use
Element/Zoning density options, and discuss Public Hearing notification requirements.
BACKGROUND:
1. Reconfirmation of BOCC Goals
At the August 23, 2004 Joint County Commissioner/Planning Board Work Session, the BOCC
requested that the reconfirmation of their goals for the Comprehensive Plan Land Use Element
(LUE) Update be included as an agenda item at a future work session, As a result, at the
October 7, 2004 BOCC Work Session, the Planning Department presented 1981 goals included
in the existing Land Use Element along with other sets of goals that have been compiled since
the 1981 Element was adopted, The BOCC requested that Planning Staff combine all of the
sets of goals that were presented into one comprehensive list for further consideration by the
Board.
It is not intended at this meeting to agree upon every aspect of the goal outline but to
understand the connectivity and primary focus areas,
Attachment 1, "Draft Sustainable Land Use Principles", uses atree-like illustration to show how
the broad goal categories used in the 2002-2003 Comprehensive Plan Land Use Committee
report fits into the new category structure of the current Land Use Element Update,
The following sets of goals are pertinent to the current LUE Update:
1981 Comprehensive Plan (Attachment 2.a.);
1999 BOCC adopted goals (Attachment 2.b.); and
Comprehensive Plan Land Use Committee (CPLUC)(Attachment 2.c.)

Attachment 3, "Format Example -Comprehensive Plan of Orange County, NC Land Use
Element Goals, Objectives, and Policies", is provided to show the overall format of the Goals,
Objectives, and Policies (GOP's) section intended for the current Land Use Element Update.
The eventual GOP's document will be approximately 30+ pages.
2. Land Use Element/Zoning Density Options
Planning Staff have been researching, analyzing, receiving input regarding the Comprehensive
Plan Land Use Element Update for the past four years. Using 2000 US Census information,
previous studies, existing committees and task forces, and discussions with the BOCC and
Planning Bcard, Staff framed a variety of Land Use Element options that to varying degrees
address concerns regarding water and air quality, as well as, other important goals.
Since land use planning scenarios are a compilation of years of guidance, input, outreach, and
feedback during the informal stage, Planning Staff have offered a range of options at this time
because specific endorsement and narrowing of options are not anticipated until the formal
process unfolds.
Following are six options for density, within the County's planning jurisdiction, that range from
the existing plan (Option 1) to increasingly focused plans (Options 2-5 proposals) addressing
water and air quality:
Opticn 1 - Existing Maximum Density Plan
Option 2 - Medium-Low Density Plan
Option 3 - Law Density/Low Vehicle Miles Traveled (VMT) Plan
Option 3.1 -Low Density/Low Impact Design (LID) Plan
Option 4 - Lower Density Plan (Cane Creek/University Lake)
Option 5 - Lowest Density Plan (Upper Neuse Watershed Management Plan and Cape Fear
River Assembly)
Attachment 4, Maps 1-6, show the land use densities provided in each Option.
Attachment 5, shows in tabular form, the percentage of the County that would be resulting from
each density Option.
Options 3 - .5 have high water quality elements achieved in different manners (i.e. same
combination of low density, low impervious, peak flaw management, and/or Low Impact Design
(LID) performance standards.
3. Public Hearing Notification Requirements
Current Procedures:
Orange County does the following (consistent with NC General Statutes) to notify its citizens of
proposed map amendments to the Zoning Atlas and/or Land Use Element of the
Comprehensive Plan.
First-class mailing to affected property owners and property owners within 500 feet of the
affected area no less than 15 days before the public hearing date.
Publishing a notice of public hearing two successive weeks in a newspaper of general
circulation with the first notice appearing not less than 10 nor more than 25 days before
the date of the public hearing.
Posting affected property with a notice (sign) of public hearing that is legible from the
nearest public road.
Alternative Notification Procedures:
NC General Statute 153A-343 provides counties an alternative to first•~class mail notification for
Zoning Atlas amendments when certain conditions apply. NC General Statutes do not require
mail notification for Comprehensive Plan Land Use Map amendments which are not as
prevalent statewide and are different that rezoning changes. The key features of NCGS 153A-
343 are:
• Affected area must contain more than 50 properties, owned by a total of at least 50
different property owners.
• County must publish once a week for at least four successive weeks in a newspaper of
general circulation, an advertisement of the public hearing that shows boundaries of the
affected area and explains nature of proposed change(s).
• Final two advertisements shall comply with and satisfy the provisions of NCGS 153A-323
(first notice appearing not less than 10 nor more than 25 days before the public hearing).
• The amendment shall not be less than one-half of a newspaper page in size.
• Property owners who reside outside of the newspaper circulation area shall be notified by
first class mail.
• County shall post one or more prominent signs on or immediately adjacent to the subject
area to give notice of the public hearing.
Planning Staff would like to query the Board for interest in amending the existing Orange
County notification requirements to include the State Alternative Notification Procedures
summarized above which are intended for large scale and comprehensive changes to land
planning. Comprehensive land use planning and the corresponding zoning implementation
language are important to coordinate together so the understanding of long-range goals is
tangible and specific.
FINANCIAL IMPACT: There is no direct financial impact associated with discussion of these
topics. There are no action items requiring formal Board decisions.
RECOMMENDATION(S): Planning Staff recommends that the Board discuss the topics listed
and provide appropriate direction to Staff.

Policy 1.01,1.3 Adjacent counties shall maintain and make available to
Orange County those impact and analysis studies and
methodologies utilized to determine the impact of
development and redevelopment on the district roadway
network.
Policy 1,01,1.4 Orange County and its municipalities shall consider the
individual and cumulative impacts of Land Use Element
(I.UE) amendments on the existing and planned
transportation facilities within the County and municipalities,
Policy 1.01.1,5 Transportation facilities and services should be developed in
a manner that encourages infill development and promotes
the efficient use of urban services.
Policy 1,01,1,6 To minimize impacts on local transportation facilities,
development which generates high traffic volumes should be
located adjacent to or have safe and adequate access to
principal arterials, expressways or other district transportation
facilities.
Policy 1.01.1,7 Transportation facilities should be planned and located in a
manner that minimizes the potential for adverse impacts on
adjacent land uses.
Policy 1,01.1,8 Multi-Modal transportation facilities and services should be
recognized and encouraged by Orange County and its
municipalities when making land use planning decisions.
Policy 1.01.1.9 In order to protect the public health, safety, and welfare,
Orange County and its municipalities would provide the
means for bicycle and pedestrian access between adjacent
land uses.
