MEMORANDUM OF UNDERSTANDING
1, Whereas the grange bounty ~on~nissioners bounty}, the Town of ~arrboro
~Town~ and the chapel :ill-Carrboro Board ofEducation the Boards entered into a separate
agreement to construct at~.etic field 3b at the ~nith Diddle ~chaol site to be primarily set aside
for recreational use by the Town and bounty.
~, since the maing of said agreement, addltlanal costs have been discovered for the construction
of this field because it will be partially located in a drainage way in Garrboro. Town of ~arrbora
ordinances require enhancements to the drainage way. The cost of such e~ancen~ents was not
addressed in the original agreement.
~. recognizing that the Board of Education is constructing at~.etic field 3b for the primary benefit
ofthe Town and ~ounty~ the Town and bounty agree to reimburse the Board for all costs
incurred in complying with the Town of ~arrboro's ordinances pertaining to e~~,ncen~ents of
the drainage way upon written not cation ofthe total amount by the Board of Education, The
costs for this worl~, are estimated to be ~,DU~. The Town shall pay ~o°~o of such costs
~~~l,oo and the bounty shall pay ~o°~'o of such costs ~4~,~~0}, The reimbursement shall
occur not later than the X001-~o~Z fiscal year.
~. This memorandum ofunderstanding hereby amends the development and Joint Jse
Agreement dated January ~, Zoa entered into by the Torn of Carrboro, grange bounty and
the B oard of Education. To the extent that any provision of this agreement conflicts with any
provision of the prior agreement, the provision in this agreement controls.
