HomeMy WebLinkAbout1997 Emergency Svc - Town of Chapel Hill Agreement to Provide Fire Protection AGREEMENT TO PROVIDE COUNTY FIRE PROTECTION NORTH CAROLINA ORANGE COUNTY This agreement, made and entered into the 4h day of December, 1996, by and between the Town of Chapel Hill, a municipal corporation, hereinafter called the Town, and the County of Orange,hereinafter called the County; WITNESSETH: That for, and in consideration of the mutual covenants hereinafter contained, the Town and County, do hereby covenant and ?gree as follows: I, es to furnish and provide ce-.stinuing Pire protection service to I The Town agree all property within the area described in Exhibit A attached hereto and incorporated herein lying outside the boundaries of the Town, by dispatching upon call of any resident or property owner within said fire protection service area, equipment consisting of one pumper of at least 750 gallon per -ininute capacity and additional units c&,Tying at least 1000 gallons of water and adequate personnel to operate the same. 2. The Town will comply with budgeting procedures and other procedures provided fir by state law, and agrees to annually submit to the County budget estimates and a supporting letter of request from the Town Manager. 3. The County agrees to annually levy, collect and make payments to the Town in the amount generated by the annually approved tax rate for the area described in Exhibit A, currently 2.9 ccnt. 4. This contract may be terminated by either party at the end of the fiscal year by giving 180 days written notice of its intent to terminate. In witness whereof,the Town of Chapel Hill has caused these present to be signed in its name by the Mayor and attested by its Clerk, and the County of Orange has caused these present to be signed in its name EST: wn of Chapel Hill CI r ATTEW unty of Orange le'101L,J, C Clerk Chairman-Board of Commissioners Boundary Description, Greater Chapel Hill Fire District Beginning at a point at the intersection of Winter Drive and U.S. 15-501 (Fordham Boulevard) ; thence eastwardly along the Town limits of Chapel Hill and the bounds of the Greater Chapel Hill Fire District, approximately 3061 (three hundred six feet) to a point; thence southerly along the Town limits of Chapel Hill and the bounds of the Greater Chapel Hill Fire District, to a point in the center of Morgan Creek; thence in a northwesterly direction, up Morgan Creek, to-a point; thence northerly along the Town limits of Chapel Hill and the bounds of the Greater Chapel Hill Fire District, to a point in U.S. -I.b-501; thence eastwardly along U.S. 15-501 and the Town limits of Chapel Hill to a point at the intersection of Winter Drive and U.S. 15-501 (Fordham Boulevard) , the point of beginning. The description includes all the properties bordering Winter Drive and Meadow Lane as identified in Chapel Hill Township, Tax Map 126, Block D, Lots 1 through 7, and includes all the land within the described bounds, not in the corporate limits of the Town of Chapel Hill.
