Link, Jr., County Manager SUBJECT: Memorandum of Agreement for Drug and Alcohol Testing Services This memorandum outlines the approved agreement between(Cedar Grove Day Care, Cedar Grove Head Start and OPC Mental Health) and Orange County to include the (Cedar Grove Day Care, Cedar Grove Head Start and OPC Mental Health) as a subgroup under Orange County's agreement with Triangle J Council of Governments for drug and alcohol testing services. 1. General The (Cedar Grove Day Care, Cedar Grove Head Start and OPC Mental Health) accepts and will abide by the terms and conditions of Orange County's agreement with Triangle J. 2. Coverage This Agreement covers only(Cedar Grove Day Care, Cedar Grove Head Start or OPC Mental Health) employees subject to drug and alcohol testing under the Federal Department of Transportation's regulations. 3. Period Covered The coverage will extend through Orange County's agreement period with Triangle J until June 19, 1998 unless Orange County should terminate its agreement with Triangle J prior to this date. 4. Costs The current cost for each alcohol test is $25. Positive re-tests for alcohol are $25. Each drug test is $32 (including positive re-tests). The cost for tests required to be administered outside of normal working hours will be at a higher rate. As agreed, Orange County will bill (Cedar Grove Day Care, Cedar Grove Head Start or OPC Mental Health) on a quarterly basis for the number of actual tests performed each quarter. S 4 i 5. Testing_Administration Orange County will provide (Cedar Grove Day Care, Cedar Grove Head Start or OPC Mental Health) with a current listing of approved testing locations for drug and alcohol testing and required Federal Drug Testing Custody and Control forms. Orange County will notify the designated(Cedar Grove Day Care, Cedar Grove Head Start or OPC Mental Health) representative when an employee has been identified for a random drug or alcohol test. (Cedar Grove Day Care, Cedar Grove Head Start and OPC Mental Health)will arrange for the employee to report to an approved testing location within the period specified by Orange County. (Cedar Grove Day Care, Cedar Grove Head Start or OPC Mental Health)will be responsible for identifying when conditions for drug and alcohol testing exist and will arrange for an necessary testing related to reasonable suspicion, pre-employment, post- accident and return-to-duty and follow-up as required by the Federal Department of Transportation. (Cedar Grove Day Care, Cedar Grove Head Start or OPC Mental Health) will provide Orange County Personnel Department with a Drug and Alcohol Testing Consortium Data Change form each time there is a change in status for an employee subject to the federal drug and alcohol testing requirements. (This includes notification of new hires and terminations.) 6. Testing Results Results of drug and alcohol tests will be released only to the designated agency representative upon receipt of the testing results by Orange County. 7. Compliance with Federal Regulations ations (Cedar Grove Day Care, Cedar Grove Head Start and OPC Mental Health) is responsible for assuring compliance with the Federal government's drug and alcohol testing regulations. If the foregoing is acceptable, please sign the original of this letter and return it to me for signature.
