I . Call to Order
Chair Fortmann called meeting to order at 7 : 30 p . m .
II . Additions to the Agenda
There were no changes or additions to the agenda .
III . Approval of Minutes ( August 12 , 2002 )
MOTION : Randall motioned to approve the August 12th minutes . Seconded by
Whisnant .
VOTE : Unanimous .
Fortmann suggested that the CFE receive the staff updates ( Item # VI ) following the
State of the Environment discussion and prior to the committee breakout session .
IV . State of the Environment 2002
Decker reviewed information that he prepared for developing the State of the
Environment ( SOE ) report . He handed out a revised format that he prepared after
meeting with Fortmann and Crisler . An " overview of county " with demographic
data was added to the Introduction . Decker 's information also included a revised
list of environmental indicators . Instead of having large amounts of text for the Air
Quality indicators , the revised format presents the indicators one by one .
The CFE discussed whether to use up/ down arrows or grades to indicate whether
there are positive or negative trends for the indicators reported . Members
discussed the merits of both methods , but favored using arrows whenever
applicable to show the county is or is not making progress toward desirable goals .
Decker reviewed a list of " Potential 2002 SOE Report Objectives " attached to his
handout , which he gleaned from the 2000 SOE Report . He asked members to look

at these during the committee breakout session and provide feedback if any of
those should be included in this year 's report .
Decker presented a chart showing the status data gathered for each indicator and
suggested that each committee review during the breakout session and provide
feedback on the indicators that need more work . Fortmann noted that the
committees should develop long - term and short - term recommendations for the
October meeting , including a couple of things that the BOCC could consider as long -
term goals . Also noted was that the CfE should write the Executive Summary .
Fortmann noted that the SOE Report is due to the BOCC early December so the CfE
needs to finalize the report in November . Decker noted that completing the report
was his primary task while working with ERCD , and that he could complete data
compilation by the next meeting as well as begin writing the introductions . It was
agreed that the CfE would write the Executive Summary and overall state of the
environment after the October meeting .
Fortmann wrapped up with asking Decker to identify indicators for which he needs
committee assistance and send it to committee chairs via email asking for help .
Smith suggested each committee assigning a high , medium , low priority to get a
sense of the relative importance of each indicator . It was agreed that each
committee would confirm its set of indicators during the breakout session .
V . Updates
McIver gave a brief update of the Comprehensive Plan Land Use Committee
meetings thus far . He said there is one more meeting scheduled for September 23 .
Members discussed the importance of the Environmental Impact Ordinance
( EIO ) report that was prepared by Decker . Whisnant suggested an executive
summary be sent to the Planning Department along with Decker 's follow - up memo
identifying gaps in resource protection afforded by the EIO and Flexible
Development review . It was agreed that Decker would write an executive summary
for review by Cotterman and Fortmann . It was suggested that a cover letter be
written that notes the CfE has researched the current EIO and there are areas that
appear to not be covered in the current planning process , and we would like the
CPLUC to consider this information in their discussions .
Wachholz noted that the Planning Department and CPLUC might be the most
efficient way to communicate planning tool summary with cover letter and
executive summary . McIver asked if Shaw and Stancil could also give this to the
Planning Director . Decker noted that the county attorney is currently reviewing the
EIO report for the legal terminology component . Members asked to check with staff
on the attorney 's review status .
MOTION : Whisnant motioned to transmit the EIO Report along with an executive
summary and Decker 's memo and spreadsheet summary ( Evaluation of Planning

Tools ) with cover memo by Fortmann to the CPLUC , the Planning Board and the
Planning Director as soon as possible . Seconded by Wachholz .
VOTE : Unanimous
Shaw reported on the progress of the Natural Areas Element of the Orange
County Comprehensive Plan . He referred members to the draft Goals and
Objectives section of the Element included in that the agenda packet . Shaw noted
that the Biological Resources Committee developed this draft with staff assistance
from Shaw and Decker . These draft goals were modified and expanded from
current goals for natural area protection included in the Land Use Element .
Shaw said the next section of the document will be Action Strategies for
implementing the goals and objectives . Some of those recommended actions might
be changes to the Environmental Impact Ordinance or the Zoning Ordinance . ERCD
staff and Biological Resources Committee will present more sections in October .
Shaw welcomes feedback from the CfE either by email or phone call .
Shaw also reported that on September 17 the BOCC will receive a report from staff
about the proposed March 2003 Environmental Summit and Conservation
Award as requested by the CFE in August .
Shaw reported on Orange County 's 2501 " Anniversary kickoff events held over the
weekend and earlier that day ( September 9 ) at the Old Courthouse in Hillsborough .
Fortmann reported on a request from Bobby Schopler to meet with the CfE in
October to discuss a potential joint venture to establish a wildlife center at a
County nature preserve . The CfE decided not to put this on their October agenda .
CfE members would prefer that Schopler first provide them with a written proposal
that one or two members could read and consider before it goes to the full group .

PURPOSE : To consider the Commission for the Environment' s proposal to hold an
Environmental Summit , in March of alternating years , to bring together members of
environmental organizations and present the State of Environment Report and a proposed new
Orange County Conservation Award .
BACKGROUND : The Orange County Commission for the Environment ( CfE ) , created by the
Board of Commissioners in 1997 , advises the Board on matters related to the County' s natural
environment . The CfE produced the County ' s first State of the Environment report in February.
2000 . The report , to be produced every two years consistent with BOCC goals , examines key
issues and trends that affect the quality of the environment . T he CfE is working on the second
State of the Environment Report (2002 ) for presentation to the Board in December 2002 .
To help publicize the report and create an event organized around environmental issues , the
CfE has developed a proposal to hold an " Environmental Summit" in March 2003 to bring
together the many different groups and organizations involved in environmental protection . The
Summit would also help publicize the findings and recommendations in the bi -annual State of
the Environment report , and generate further discussion of how the County can work with other
entities (jurisdictions , private sector , general public) to monitor and improve the quality of the
environment . A proposed draft agenda for an initial summit in March 2003 is attached . The
proposed summit would be held on a Saturday morning , with March 15 , March 22 and March 29
identified as potential dates .
The CfE also proposes that Orange County recognize individuals that have shown a sustained
and outstanding commitment to resource conservation in Orange County , The CfE
recommends recognizing those individuals with an " Orange County Conservation Award " .
Under the proposal , nominations would be solicited in the fall of alternate years with
recommendations from the CfE , and award confirmation by the Board of Commissioners . The
awards would be announced at the proposed Environmental Summit . A draft nomination form
is attached .
FINANCIAL IMPACT . To help defray costs for the Summit , the Commission for the
Environment proposes to ask local restaurants and markets to contribute breakfast . The
Summit would be held at a public facility , such as the Southern Human Services Center .
The anticipated cost of the summit is less than $ 1 , 000 . Other donations will be solicited to
cover the costs of the event .
. RECOMMENDATION ( S ) : The Manager recommends that the BOCC approve the Commission
for the Environment' s proposal and authorize the CfE and ERCD to plan and organize an
Orange County Environmental Summit for March 2003 , and to solicit nominations for a new
Orange County Conservation Award , The Board may also wish to make recommendations on a
preferred date for March 2003 from among the three dates listed ( March 15 , March 22 and
March 29 ) .

PURPOSE ; To endorse the Memorandum of Understanding ( MOU ) for a Rural Transportation
Planning Organization ( RPO ) for the Research Triangle Rural Planning Area ,
BACKGROUND : The Orange County Board of Commissioners , at its regular meeting on August
20 , 2002 , endorsed establishing a RPO with Chatham , Lee and Moore Counties with Triangle J
Council of Governments (TJCOG ) serving as Lead Planning Agency for the RPO .
The Board reviewed the MOU for the RPO after the quarterly public hearing held August 26 , 2002 ,
and noted several areas of concern . The attached report contains information regarding those

ssues .
Triangle J 4 Council of Governments (TJCOG ) plans to have a chartering ceremony on Friday ,
September 20 , 2002 at 9 : 00 a . m . if North Carolina Secretary ' of Transportation Lyndo Tippett will be
able to attend on that date . The Chairs of the Boards of County Commissioners for Orange ,
Chatham , Lee and Moore Counties will officially sign the MOU to establish the Rural Transportation
Planning Organization at the chartering ceremony .
FINANCIAL IMPACT , If Orange County establishes an RPO with other counties in the Region J
Planning Area , Orange County will have an annual obligation of its share of 20 % of the funding for
the lead planning agency staff and there will be additional Orange County staff time .
RECOMMENDATION (S ) : The Administration recommends that the Board approve the resolution
endorsing the Memorandum of Understanding .

PURPOSE : To officially recognize the newly implemented H2Orange Drought Response Program .
BACKGROUND : The H2Orange Drought Response Program held its kick - off with a press briefing
Friday , September 13 , with representatives of Wal- Mart of Durham /Chapel Hill on hand to donate
over 1 , 000 gallons of bottled water to area human services agencies and the Orange County Social
Services Department for their needy clients .
H2Orange is a work group comprised of local water suppliers , municipalities , government
agencies , non- profits , and the agricultural community collaboratively working to empower citizens to
conserve water and develop strategies for the months ahead . The multi -faceted campaign
addresses drought awareness , water conservation strategies , and encouraging consumer use of
water saving devices .
As water restrictions tighten , wells begin to dry up and the demand for water increases , local
communities search for solutions to the five -year drought . H2Orange will work to address these
issues .
H2Orange will have an informational display at this Board of County Commissioners meeting .
FINANCIAL IMPACT : None
RECOMMENDATION ( S ) : The Manager recommends that the Board officially recognize the
important work of H2Orange .

BACKGROUND : In April of this year, the 2002 Farm Bill was signed into law . Included In
the Farm BlII was an appropriation ofv 48 million to the USDA Farmland Protection Program
( FP P ) , to be administered at the state Jovial by th a U DA Natural Resource Conservation
Service ( NRCS ) . The Farmland Protection Programs t nd. s up to a 50 % ranch of the
purchase. of ag riou ltu ral conservation easements ,
On June 27 ' , the Board authorized County staff to submit a grant applioativn for the
acquisition of conservation easements , and staff ( with assistance from the District
onservaborilst and Soil and Water 0istriot staff) submitted a grant applioatien in the amunt
of $ 788 ,900 in Juiy for this purpose .
Staff received confirmation on Friday, September 13 that the aunty ' s grant had been
approved In the amount of $ 784 , 155 ( 99 .4 % of the total requested ) .
USDA is required to encumber the funds for the grant prior to the end of the Federal fiscal
year on September 30 , and . a signed cooperative agreement must be received by the State
Conservationist by September 20 . The County will than have two years from the data of the
agreement to complete . the negotiation of easements .

PURPOSE : To provide a report on various elements associated with the implementation growth
controls in large residential projects .
BACKGROUND : On May 6 , 2002 , the Orange County Planning Board forwarded a letter to the
Board of County Commissioners regarding the need for growth controls ( . . . which might include a
moratorium . . . } in large residential developments . This topic was also broached at a joint Board of
Commissioners / Planning Board meeting on June 6 , 2002 . On June 18 , the Board of County
Commissioners passed a resolution (see - attached ) regarding the actions and issues that needed -to
IN be researched prior to further deliberation . The Planning Board discussed these issues within its
purview on August 7 , 2002 .
The attached report outlines staffs preliminary findings .
Since that August 7 meeting , the County Manager, County Attorney and Planning Director have met
and formulated some recommendations for short-term actions . Long -term actions noted on the
chart include proceeding with the Unified Development Ordinance ( UDO ) and Comprehensive Plan .
A brief discussion was held at the August 29 , 2002 BOCC Work Session regarding this topic , but a
more thorough explanation will be forthcoming at this meeting .
FINANCIAL IMPACT : No financial impact at this time .
RECOMMENDATION : The Manager recommends that the Board discuss the information
presented and provide direction to County Attorney and Planning Director to prepare a Special Use
Process for major subdivisions for the Public Hearing and action this year. Also begin process for
UDO development through a Request for Qualifications ( RFQ ) .

PURPOSE : To update the Board of County Commissioners on progress of the Orange County /
Durham 1 = 85 / US 70 Economic Development District Cooperative Planning Area .
BACKGROUND : Respective Orange County and City of Durham staffs have developed some
preliminary recommendations regarding cooperative planning systems between both jurisdictions :
Discussion , research , and analysis have been in progress since June of 2001 to evaluate topics of
joint interest . Those topics include :

11 . Water and Sewer
III . Annexation
IV . Financing of Utilities of areas near 1 =85/ US70
After this progress report work-session , planning staffs are prepared to present our preliminary
reports to respective managers and then to governing beards in the next few months . The purpose
of these - cooperative planning efforts is to improve land use and transportation decisions , improve
intergovernmental coordination and information sharing , and be able to consistently respond to
inquiries for development in the area , as well as , respond to public health emergencies such as
failed septic systems .
There are six companion studies , plans and agreements that affect this area .

PURPOSE : To provide the Board of County Commissioners with information on actions
underway to address operational concerns at the Orange County Animal Shelter , propose
entering into an agreement with the consultation arm of a national humane organization to
conduct a comprehensive assessment, and receive feedback and direction from the Board on
particular issues they may wish examined through the evaluation process .
BACKGROUND : Several residents raised concerns at the BOCC meeting on September A31
2002 regarding the operation of the Orange County Animal Shelter and the contract that the
County has with Animal Protection Society of Orange County (APS ) to provide those shelter
services . Specific concerns were raised regarding disease management practices at the
shelter. Concerns were also raised regarding adoption procedures and responsiveness to
public input . The health department staff took immediate steps to procure a preliminary
assessment of disease management practices . The health director consulted with Dr. Kate

Wilder , the Board of Health veterinarian and with Dr. Lee Hunter, the NC Public Health
Veterinarianoto select external veterinarians that could provide -an unbiased assessment of
disease management at the shelter. aDr. Richard Fish , an infectious disease specialist with the
NCSU School of Veterinary Sciences , and Dr. Dwight Bellinger, Director of Animal Research
Laboratories at UNC at Chapel Hill , were contacted and agreed to examine practices at the
shelter. They made a site visit on September 17 , inspected the facilities , and interviewed the
APS Executive Director and the Shelter Manager . Their findings , received on September 24 ,
relate to the physical plant and quarantine and sanitation practices , and are being reviewed with
APS management for actionable items . A copy of their report is attached .

Second , the . health department staff has , gathered information on a comprehensive external
review of shelter operations . There are at least two organizations that conduct these
assessments nationally . One is the Humane Society of the United States ( HSUS ) and the other
is the American Humane Association . Both conduct assessments that address such areas as
shelter operations , adoptions , spay/neuters , field services , community outreach , governance ,
management and leadership , human resources , and. financial information . A description of
each consultation service is attached .
An external assessment would provide an unbiased view of shelter operations and offer
benchmarks with other organizations providing , shelter services nationwide . To the health
department ' s knowledge there has not been an external assessment of operations since the
inception of the contract with the APS for the operation of the shelter. In addition to the usual
areas of operations , management , and leadership ; Staff is proposing that the assessment
address the issues outlined below specifically , and seeks Board feedback or clarification on any
other areas of concerns .
• Program and management improvements
• Public interaction and customer service/satisfaction
• Considerations 'for the design , maintenance , and programming of any new facility
• Continued review and consideration of best disease management practices
• Adoption policies ( ensuring that healthy animals are adopted )
• Provisions for effective , low-cost spay/neuter operations
• Operational policies , procedures , protocols

• Governing structure ;
• Other systems to support the humane treatment of animals and that promote public .

Either agency would require the organization being studied to submit the 'formal request for an
assessment , therefore the APS Board will consider the proposal at their meeting on October 14 .
The Board of County Commissioners would be entered as a coe-requestor and receive the full
report of findings for in depth consideration . The ' entire assessment process beginning after a
contract is established would take from four to six months .

FINANCIAL IMPACT , The cost of the external assessment by either AHA or HSUS ranges
from $ 8 , 000 to $ 20 , 000 and is typically based on size of the shelter, the size of the county , and
the scope . of the assessment , A specific cost will be derived following formal application for
consultation and staff negotiation , and will be reported to the BOCC . It is proposed that the
County pay the full cost from funds within the Board ' s contingency account . The contingency is
currently budgeted at $ 25 , 000 but with the future availability of the additional half-cent sales flax ,
that amount could be supplemented , if the Board desires , for other anticipated projects ( such as
the IOG assessment of schools@collaboration ) by an appropriation from fund balance .
RECOMMENDATION (S ) : The Manager recommends that the Board receive the report on
action steps underway , provide further feedback and clarification on issues it wants particularly
addressed within the comprehensive external evaluation of the Orange County Animal Shelter ,
and authorize entering into an agreement with either Athe American Humane Society or the
Humane Society of the United States for said evaluation in an amount estimated between
$ 8 , 000 and $ 20,10000
