Summary of Meeting April 10, 2000

I . Call to Order .
Chair Price called the meeting to order at 7 : 35 p . m .
II . Additions or Changes to Agenda
Fortmann requested that a report of the Intensive Livestock Operation
committee meeting be added to the agenda .
Tucker requested that a discussion of the proposed rock quarry expansion by the
American Stone Company be added to the agenda .
Shaw reported that David Stancil was giving a presentation at Chapel Hill Town
Council meeting and would not be in attendance .
Price welcomed and introduced new commission members , Laura Cotterman and
Hervey McIver . Cotterman has worked with the NC Heritage Program and NC
Plant Conservation Program , conducting inventories of natural areas and
developing plans for natural area protection . She is a botanist with a
background in ecology, and is a technical editor for publications involving the
conservation of natural areas .
McIver works with NC Chapter of Nature Conservancy and serves on the board of
the Eno River Association . He is a member of the Shaping Orange County's
Future Task Force and Hillsborough 's Occoneechee Park Committee .
III . Report on Intensive Livestock Operations
Fortmann reported on the recent meeting of the Intensive Livestock Operations
Study Committee , which was formed by the Board of County Commissioners in

February . The committee was charged with examining issues surrounding the
development of intensive livestock operations in Orange County . One of the
main topics of concern will be waste lagoons used by hog farm operations .
The first meeting was held on April 5t" . The committee includes representatives
from the BOCC, CfE, Agricultural Districts Advisory Board , Board of Health ,
Cooperative Extension , Farm Bureau , Animal Control , Environmental Health ,
Natural Resources Conservation Service , Planning Dept, Orange Dairy Heard
Improvement Association , Soil and Water Conservation , and members of the
poultry and livestock farming community .
Fortmann reported that three topics were discussed : 1 ) Defining what should be
considered an " intensive livestock operation " or ILO , 2 ) the potential need for
regulations in Orange County, and 3 ) what rules currently exist at the state and
local level . He explained that existing State rules allow certain numbers of
animals below which there are no requirements for permitting or inspections .
Fortmann said the first meeting was informational and to define what the group
is going to do . According to an Orange County animal agricultural facts and
trends document put together by the Agricultural Extension agents , there are
only three hog farms in the county . One is " free range " farm , one has very small
number of animals , and one is a contract farm where about 4 , 000 hogs are
raised for an outside agent . Only the largest of the three farms uses waste
lagoons . The county had 13 swine producers in 1980 . Poultry operations in the
county include five farms with contracts for egg production . All five have dry
litter waste systems . The dry litter stays in the farmhouse for 11 months
followed by an annual shutdown , cleanup and field fertilizer broadcast . There is
one independent egg laying operation with approximately 60 , 000 birds , which
has a liquid waste system . There are no turkey farms in Orange County .
It was reported that there were 99 dairy farms in 1966 and in 1999 there were
only 21 herds . The average size herd is 105 cows per operation . Dairy
operations use holding pit waste systems , where the waste is collected in the pit
with agitation and distribution as field fertilizer during certain times of the year .
The pits can be earthen or concrete and below ground , and are not operated as
a lagoon .
Fortmann reported that the committee discussed whether there is any need for
regulations . Cooperative Extension and farm representatives said that it would be
unlikely that large operations would be built in Orange County because of the
high cost of land and lack of space outside of existing residential areas . Existing
setback requirements and state siting regulations would preclude new large
operations.. Chatham , Columbus , Halifax, Moore , Randolph and Robeson
counties have all adopted more stringent requirements that those imposed by
the State . In most cases the setbacks have been increased . For example , in

Chatham County the setback for confinement buildings and lagoons is 2 , 500 to
5 , 500 feet from residences .
Fortmann reported on actions resulting from the first meeting : 1 ) the Planning
Department will determine how many locations in the county are suitable for
large livestock operation based on state siting criteria ; and 2 ) Cooperative
Extension will prepare a summary of all the state and county requirements in
terms of permitting and inspections .
The resolution establishing the study committee called for . a final report to the
, BOCC by June 1 , 2000 . Fortmann noted , however, that farming representatives
have asked to extend that timetable since the study is being done during the
busy season . They asked that the next meeting be in October . Fortmann said
he would keep the CfE informed of further developments .
IV. Approval of March 13 , 2000 Minutes .
MOTION : Kohorn made motion to approve the March 13 , 2000 minutes .

V . Quarry Expansion Discussion
Tucker reported that a member of a concerned citizens group had contacted her
and requested that the CfE be made aware of the proposed quarry expansion at
Bethel - Hickory Grove Church Road . She asked if members would consider
making a statement prior to an upcoming public meeting (April 12 , 2000 ) .
Tucker explained that the American Stone Company is in negotiations with
OWASA to expand the current quarry operations in Orange County . The quarry
is reaching capacity and the company is looking to expand the quarry onto
adjacent land owned by OWASA . Upon depletion of the original quarry it
became a reservoir, and the same is proposed for the new quarry . Tucker said it
would be good to investigate what analyses have been done to determine the
best alternative for the meeting water needs for the area . Other topics
discussed included the size of the pits , relocating Bethel - Hickory Grove Church
Road , and preserving wetland areas .
Shaw showed a map of the proposed project expansion . Okun described the
area as lying between University Lake and Cane Creek . He explained that
University Lake was built at a size much too small to hold the water from its 30 -
square - mile drainage area . As a result, much of the water is lost to the system .
He noted that drainage area for the much larger Cane Creek Reservoir is also 30
square miles . The abandoned quarry site could provide the additional storage
necessary to meet projected needs .

Okun discussed a recent newspaper report on the effects of blasting on homes in
the quarry area . Other concerns discussed were potential effects on wells , water
supply, and stone needs . a suggestion that American Stone and OWASA might
be required to provide water those people who are affected adversely by the
project, and to compensate property owners for any damages that occur was
discussed . The costs of these types of compensations would be small compared
to the value of the additional water supply .
Other issues discussed were the fact that Orange County contains the
headwaters for many rivers flowing through and outside of the county, earlier
, decisions to limit the provision of water to Chatham County, and the realization
that although water is a limiting factor for growth and development neighboring
counties will buy water from whoever else can supply their needs .
The CfE concluded to reserve making any statement on the proposed quarry
expansion until further study of the issues is completed . Tucker volunteered to
attend the April 12 meeting in a citizen capacity and report back at a later time .
Another idea was to assign investigation of this issue to the future water
committee if the CfE determines to take on this study .
VY . CfE Goals for FY 2000 - 01
The CfE adopted the proposed goals as distributed with the following changes :
Reword the fourth goal under the Air Quality Committee to say, ' Investigate the
potential for the State to establish additional air quality monitoring stations in
Orange County . " And change the completion date to "June 2001 . "
Add "Track transportation issues " as an " ongoing " issue .
Delete the fourth goal listed under Environmental Indicators and Education
Committee .
Adopt the Proposed Water Committee goals with the understanding that there
will be allowed flexibility to modify the goals once the committee is established
and begins working .
MOTION : Jurgelski moved adoption of the goals with changes as noted .
Seconded by Crisler .

V11a Water Resources Committee
The CfE discussed the name of the proposed committee , favoring " Water
Committee " or " Water Quality and Resources Committee " because many
people think of water quantity when they hear " water resources . "

Members also discussed developing a timetable for establishing the
committee relative to completion of the existing WRC project . The Fall of
2000 was targeted as the preferred start- up time . The CfE discussed the
idea of filling the final commission vacancy with a member of the current
Water Resources Committee and inviting other members to participate in
development of a new Water Element of the county 's Comprehensive
Plan . This item was tabled pending further guidance from David Stancil ,
VIII . Update on Lands Legacy Program and Resource Land
Acquisitions
Shaw gave an update of the Lands Legacy Program noting that the BOCC
adopted the new program on April 4t" . He reported that the land
acquisition is underway with ERCD working with other county departments
and land trusts to implement the program . He noted that criteria
developed by the CfE for acquisition of natural areas and wildlife habitat
was adopted with the program , and will be one of the tools used to
identify lands for purchase . The " top 10 " list in the State of the
Environment report will also provide staff with useful guidance for
developing its annual action plan .
Shaw reported that the County completed its first purchase land under the
new program —a 63 - acre parcel from Duke University . The former Duke
Forest property was acquired March 31 , 2000 and will be available for
low - impact recreation uses . Shaw is working on developing suitable
access to the property .
Shaw updated CfE members on the proposed acquisition of land for a
Little River Regional Park and Natural Area . In March the BOCC approved
the terms of Orange County obtaining an option to purchase 135 acres
from the Triangle Community Foundation , Orange County is working with
Durham County, the Eno River Association ( ERA) and the Triangle Land
Conservancy (TLC) to acquire the 391 - acre property, which has over a
mile of frontage on the North Fork of the Little River . Shaw noted that
the two counties received a $ 377 , 000 grant and are eligible to receive
another grant in May . The ERA and TLC will raise funds for acquisition of
this property will hold a media event on April 13th as a " kick off" to a the
fundraising campaign . Discussion followed of park access , stewardship ,
types of recreation , grants , and responsibilities for park maintenance .
Finally, Shaw reviewed recent action by the Board of Commissioners
relative to the Green tract, north of Chapel Hill . Following the completion
of comprehensive surveys of biological and cultural resources on the
property, the BOCC in March decided that a 60 - acre portion of the 169 -
acre tract should be turned over to the county for long -term protection as

a natural area . These 60 acres include mature wooded areas and 500
feet of frontage on an existing railroad corridor .
IX . Agenda Items for Next Meeting ( May 8 )
Price reminded CfE members to forward proposed agenda items to her or
Stancil at least two weeks prior to meeting dates , noting that the agenda
items are mailed out one week prior to meetings .
X . Committee Breakout Sessions
Price adjourned the meeting to committee sessions noting that this is a
good time to begin work on the adopted goals and the next State of the
Environment report, which is scheduled for completion in December .
The CfE discussed committee assignments for new members , McIver and
Cotterman . Both were assigned to Biological Resources Committee .
Jurgelski volunteered to move to the Environmental Indicators and
Education Committee .

CHAPEL HILL — Neighbors of an N. C . 54 stone quarm
ry pleaded with local officials this week to reject plans
for its expansion, as the mining company and OWASA
launched their final push to get the project approved .
Officials from Chapel Hill, Carrboro and Orange
County opened hearings on the proposed expansion
Wednesday and, 31/2 hours later, had listened to a suc-
cession of complaints about the facility.
Homeowner after homeowner complained that blast-
Mg at the quarry site rattles their homes, in some cases
causing damage .
"It's not pleasant," said Anne Parrish, one of the
neighbors . "The thought of living with it 30 more years
is less pleasant . We are not crazy. Our houses shake, our
windows rattle, things fall off our shelves . It's not
ghosts. "
OWASA directors, however, said the expansion
promises southern Orange County a third reservoir, . one
capable of holding up to 3 billion gallons of water, about
the same as Cane Creek Reservoir.
Board of Directors Chairman Peter Gordon brushed
aside complaints that the Orange Water and Sewer
Authority is overestimating future water demands. He
said the project offers insurance against the possibility
that growth might tax the utility's supply capacity.
Without excess capacity, it would risk shortages.
"A water utility has to function all the time," Gordon
said. "When you operate a system all the time, you don't
want to push it right to the edge. "
Wednesday's hearing focused on the American Stone
Co. 's request for a change to Orange County's joint land
use plan, affecting 75 acres, that would allow the expan-
sion.
The additional digging would cross BethebHickory
Grove Church Road and connect American Stone's cur-
rent pit and a smaller one, located to the southeast, that
OWASA already uses to store about. 200 million gallons
of water.
The expansion would produce a 60-acre lake .
OWASA and the mining company have been pushing
the expansion since 1990 . Numerous delays have
dogged the approval process . The utility aborted the
last set of hearings in 1994, when Carrboro aldermen

space around water supplies can put drinking water at risk . More pavement and impervious
surfaces increases run- off water pollution. More than 50 percent of the Significant Natural
Heritage Areas in North Carolina remain unprotected. Scen vi ic stas, wildlife habitat,
biodiversity, and greenspace in urban areas are all being lost to development.
➢ Economic Loss . North Carolina ' s agriculture industry, including food, fiber, and forestry, is
dependent on open spaces , and it contributes more than $ 46 billion dollars to the state ' s
economy and employs 22 percent of the state ' s workforce . Additionally, the 100-year flood
plains of North Carolina ' s rivers are better left undeveloped as illustrated by Hurricane Floyd

As North Carolina works toward this million acre goal, the state can conserve either a patchwork
of lands or lands that are related to each other in a logical way . A statewide plan cannot be
prescriptive about which objectives should be most important to a community, and thus ,
priorities for open space acquisition need to be set at the local or regional scale . For example,
coastal communities may be most concerned about flood mitigation, piedmont communities may
be most concerned about urban greenspaces , and mountain communities may be most concerned
about scenic beauty. Priorities may also differ between urban and rural communities .
Unlike other trust funds and conservation programs , the farmland preservation program is
relatively undeveloped . Thus , Governor Hunt and the NC Smart Growth Commission have
afforded farmland preservation special attention. A proposal to expand the farmland
preservation infrastructure for North Carolina is currently being jointly developed by DENR, the
Department of Agriculture and Consumer Services , and Cooperative Extension . The Farmland
Preservation Trust Fund should fund the conservation of both farmland and forestland .
State Role
The Million Acre Initiative depends on widespread participation by numerous parties inside and
outside of government to be successful . The State ' s role in the Million Acre Initiative should be
as follows :

The Million Acre Plan identifies a number of recommendations to help North Carolina achieve
open space conservation goals . These recommendations have grown out of a set of principles
developed in collaboration with a broad range of interested parties . As North Carolina needs to
take steps now to enhance its land conservation efforts , some recommendations need to be acted
upon in the near term, including the Short Session of the 2000 General Assembly. Other
recommendations could be implemented over a longer time frame . The major recommendations
identified in the Million Acre Plan are listed below .
Short Term Recommendations
➢ Facilitate Coordination . The Governor should establish a Million Acre Advisory Panel
and direct DNR to coordinate and staff all aspects of the Million Acre Initiative, including
information sharing, data tracking , management of a central website, and education .
➢ Codify Million Acre Goal . The General Assembly should put the Million Acre Goal into
law to provide a source of common inspiration for the citizens of North Carolina and
guidance for future sessions , and the legislature should require annual progress reports
starting September 2000 .
➢ Farmland Preservation . The General Assembly should increase the funding for Farmland
Preservation to at least $ 1 million dollars during the 2000 session . Such funds would provide
farmers an option to keep their land as working farms while protecting their property from
development . This trust fund will need a larger and dedicated funding source in future years
to meet an increasing demand by farmers .
➢ Clean Water Management Trust Fund . The Clean Water Management Trust fund should
be increased from a floor of $ 30 million today to $ 100 million over the next three years . The
General Assembly should not reallocate funds from any of the state trust funds for other uses .
Additionally, the Clean Water Management Trust Fund-should review its policies on buffer
requirements to ensure that conservation of land to protect water quality can be coordinated
with other open space protection objectives .
➢ Dedicated Funding Source . The Governor and the General Assembly should work together
to identify dedicated state . and local revenue sources to fund permanent conservation efforts .
The menu of potential funding sources could include the deed stamp tax, impact fees , transfer
taxes , severance taxes , and others that could complement tax incentives and private
stewardship . Revenues generated should support farmland preservation, increased funding
levels for existing state trust funds , and the Conservation Grant Fund to cover the costs of
transactions for donating lands and educating landowners .

➢ Center for Geographic Information and Analysis (CGIA) . CGIA and DENR should be
supported to create and maintain a GIS database of layered land use maps in North Carolina
which could be used by all parties to identify lands for conservation and track the progress
toward the million acre goal .
Loma Term Recommendations
➢ Financial Opportunity Assessment . DENR and the UNC Environmental Finance Center
should conduct an assessment to shed light on the combination of funding sources that could
enable North Carolina to achieve the million acre goal . The results of this assessment should
be reported to the North Carolina Smart Growth Commission so the report can be used by the
2001 General Assembly.
➢ Retaining Open Spaces through Smart Growth . To complement the Million Acre
Initiative, the NC Smart Growth Commission should explore policies to retain open spaces in
North Carolina in addition to the permanent strategies outlined in the Million Acre Plan. The
Commission should evaluate transfer development rights and Governor Hunt ' s goal of
setting aside 20 % of land for open space in new greenfield developments .
➢ Tracking Progress . The Department of Environment and Natural Resources should provide
an annual report to the Governor and General Assembly on progress towards meeting the
quantitative goal as well as meeting higher environmental, economic, and quality of life
objectives .
➢ Million Acre Bond . Many states have infused large sums of money into open space _
conservation by the issuance of revenue bonds and/or general obligation bonds . These
funding sources should be explored for North Carolina by the 2001 General Assembly.
