Harvey, Current Planning Supervisor Craig Benedict, Planning Director DATE: December 11, 2018 SUBJECT: INFORMATION ITEM - Unified Development Ordinance (UDO) Text Amendments Clarifying Enforcement of Nutrient Standards Orange County's Planning Department has commenced work on a text amendment to the UDO regarding enforcement of nutrient standards within the Cape Fear River Basin, consistent with recent changes in State law. BACKGROUND: Orange County regulates erosion & sedimentation control, as well as stormwater runoff, for non-farm land disturbing activities under the general oversight of the North Carolina Department of Environmental Quality (DEQ). This includes the enforcement of nutrient reduction strategies (i.e. reducing pollution/nutrients entering local water bodies). In 2017 the State chose to delay the implementation/enforcement of these nutrient reduction strategies within the Cape Fear River Basin. The proposed amendment seeks to bring the County's UDO into alignment with State law. The attached map provides detail on the location of the impacted river basin within the County. This amendment only impacts properties within the Cape Fear River Basin. Nutrient reduction strategies shall still be enforced within the Neuse River Basin consistent with State law. TIMELINE: The targeted dates for review are as follows: • Planning Board Ordinance Review Committee (ORC): November 7, 2018 • Development Advisory Committee (DAC): December 6, 2018 • Legal Sufficiency Determination: To be determined 2 • Planning Board Review/Recommendation: January 2, 2018 • BOCC Public Hearing: March of 2019 • BOCC Possible Decision: March of 2019 PUBLIC NOTICE: Public notice will include a legal advertisement, published twice in a newspaper in general circulation in the county, as mandated by State Statutes and detailed in Article 2 of the UDO. Orange County chooses to publish the legal advertisement in two different newspapers and runs the notices for both the Planning Board meeting and the BOCC public hearing. PUBLIC OUTREACH: At this time, additional public outreach is not anticipated. The draft text amendment will be sent to our joint planning partners for their review and comment.
