BACKGROUND: Blue Cross/Blue Shield has requested that the County Commissioners approve a pyrotechnics permit for slow-level fireworks display to be held in conjunction with their Family Day on .tune 4, 2005, GS 14-414 indicates that the Board shall consider a fireworks permit far "any and all kinds of fireworks and explosives, which are used for exhibitions or amusement purposes," County policy further requires assurance from the sponsoring agency that adequate public safety measures will be exercised; and that the County will be protected as an additional insured on the insurance policy(ies) covering the event. The display will occur in the Town of Chapel Hill Fire Department's jurisdiction, County approval is a criterion for Town approval. Blue Cross/Blue Shield has fulfilled the County's criteria for a pyrotechnic permit as evidenced by the attached documents, On the day of the display, the Town of Chapel Hill Fire Department will be responsible for ensuring that the site is set up as per the site plan and the inventory of pyrotechnics is commensurate with what is approved. At such point that both the Chapel Hill Fire Department and the Emergency Management Director are satisfied that the criteria for approval have been met, the permit will be signed and officially issued, FINANCIAL IMPACT: None RECOMMENDATION(S): The Manager recommends that the Board approve the pyrotechnics permit for the Blue Crass/Blue Shield Family Day 2005 on June 4, 2005, contingent upon final approval of the set up by the Emergency Management Director or his designee, a PYROTECHNICS PERMIT COUNTY OF ORANGE NORTH CAROLINA ORIGINAL SIGNATURES; COPY 1 Pursuant to G.S. 14-413, Commissioners in North Carolina Counties are empowered to authorize and issue permits for the use of pyrotechnics in connection with ".,.shows of ail descriptions,,,but only after satisfactory evidence is produced to the effect that said pyrotechnics will be used for the aforementioned purposes and none other", On May 17, 2005 Biue Cross/Blue Shield of North Carolina, Chapel Hiii, NC, was approved for a pyrotechnic permit to be used in association with Family Day 2003 to be held at the Biue Cross/Blue Shield campus on 15-501, Chapel Hill on June 4, 2005. The approval is granted based on the following assurances from the requestor: Public Safety personnel will be on site during the event to ensure public safety and to provide adequate traffic control; Proof of Liability insurance which includes the County as a named insured, has been submitted to the Orange County Director of Purchasing and Central Services. Limits of liability are no less than $1,000,000 per occurrence. Show setup will be approved by the Chapel Hili Fire Department and the Emergency Management Director for Orange County or his designee, prior to the beginning of show, Permitted explosives include those identified in the information submitted by requestor and approved by the County as part of the pyrotechnics approval process, Blue Cross/Blue Shield has a curcent fire inspection and is in compliance with the North Carolina Fire Prevention Code, 2000 international Fire Code with North Carolina amendments. Director of Purchasing signs after certification that checklist cdteda has been met, 2. Orange County Manager signs. 3. Fire Official signs, upon approval of the site setup pdor to the event. 4, Emergency Management Director signs after assurance from Fire Official that requirements of the Standard Fire Prevention Code as it respects the use of pyrotechnics has been met. 5, Emergency Management Director provides one copy of permit to show sponsor and returns one copy to the Director of Purchasing for records maintenance. PYROTECHNICS PERMIT CHECKLIST-- Blue Cross/Blue Shield Family Day 2005 North Carolina General Statue 14.413 empowers County Commissioners in the State to issue permits for the use of pyrotechnics in connection with shows of all descriptions after satisfactory evidence is produced to the effect that the pyrotechnics will be used for the aforementioned purposes and no others. The Orange County Commissioners have adopted a policy which cites the completion of the following criteria as prerequisite to the issuance of a pyrotechnics permit. Verification of the receipt of information will be evidenced by the signature of the appropriate official on this form. Only after all criteria listed below have been met will the permit be issued. It should be further noted that all signatures must be written on the face of the permit in order for the permit to be valid. Penalties for use of pyrotechnics without a permit are cited in the North Carolina Building Code, Administration and Enforcement Volume 1A, Chapter 8.1. CRITERIA APPROVED BY DATE i. This event will begin at 4:30 PM and end,just after dark with a short fireworks display. S & W Productions is the company employed to produce the fireworks show. They also produced the identical show for the previous six Family Day events. They have extensive experience producing these type of small scale, low level "shoots", including events at the Durham Bulls ball park, etc. The Chapel hill Fire Department will be providing a lire truck and fire personnel during this event to insure adequate fire protection measures are met. The Chapel 3-fill Fire Marshal, Deputy Chief Mellon, has reviewed this request and will make the final inspection on Saturday prior to issuing the "town of Chapel Hill permit. Two off-duty Chapel l-fill police officers will be employed by BCBSNC to insure adequate public safety during this event. They will be assisted by members of the BCBSNC Corporate Safety Sc Security team as well as nwnerous Allied Security officers, Two off-duty GMTs and an ambulance will be on site during this event. BCBSNC will pay Orange County FMS & Rescue for this service. Copies of the operator's license, site layout, pyrotechnics inventory, and certificate o insurance will be provided by Rick Timberlake of S & W Productions.
