The meeting began at 7:36 p.m., immediately after the Planning Board meeting was adjourned. 22

AGENDA ITEM 2: UNIFIED DEVELOPMENT ORDINANCE (UDO) TEXT AMENDMENTS – REORGANIZATION OF 24 TABLES OF PERMITTED USES - To continue review and discussion on proposed amendments to the UDO that 25
would reorganize the Tables of Permitted Uses in response to the Byrd v. Franklin County judicial decision and 26
modify other sections to ensure consistency within the ordinance. 27 PRESENTER: Michael Harvey, Current Planning Supervisor 28

Michael Harvey noted he had provided a synopsis of the changes this evening as a handout. The changes mostly 30
involve combining categories to simplify the table. He noted the intention is to create a more streamlined table, with 31
similar uses grouped together, and only keeping uses separate that have special requirements (like breweries) or 32
that the county wishes to ban. 33

Michael Harvey anticipates this coming before the Planning Board in August. The county commissioners will be 35
invited to offer comment. 36

A question was asked about a building permit for the recently erected large flag on U.S. 70, with concern that the 38
pole is already leaning. Michael Harvey answered that the county attorney’s office was looking into whether the 39
flagpole required a building permit. 40

Michael Harvey cautioned that the attorney’s office is interpreting the text amendments regarding flagpoles differently 42
from how he interpreted that language. Any board members with concerns should express them to the county 43
attorney’s office. 44
