SolSmart is a national recognition and technical support program to help governments lower the costs for businesses and residents to invest in solar energy. Technical assistance is available to all applicants, but Orange County also applied jointly with the Towns of Chapel Hill and Carrboro for a SolSmart Advisor to provide 6 months of free,full-time technical assistance.The application was successful and the Advisor will be shared among the three jurisdictions.The role of the Advisor will be filled by a team of solar experts from the NC Clean Energy Technology Center at NC State. The Advisor will work with the Sustainability Coordinator and the Planning Department to clarify and simplify processes related to Solar Power development and Solar-ready homes.The Advisor may also be able to help identify and rank order the best Orange County facility rooftops for solar power as well as respond to the BOCC petition on solar-ready construction. The Solar Foundation has reviewed and accepted edits to the attached MOU that were requested by Orange County staff and the County Attorneys.This agreement has also been reviewed and approved by Jeff Thompson, and the County's Risk Manager. Background SolSmart is a national designation program, funded by the U.S. Department of Energy SunShot Initiative, designed to recognize communities that have taken key steps to address local barriers to solar energy and foster the growth of mature local solar markets. The Solar Foundation, serving as the SolSmart Technical Assistance Provider, and its team of national solar and local government experts provides no-cost technical assistance to help communities qualify for SolSmart designation. The SolSmart program primarily seeks to address "solar soft costs," or business process or administrative costs that can increase the time and money it takes to install a solar energy system costs which are then passed on to solar customers. While only certain local government procedures (such as permitting,planning, and zoning) are the source of some soft costs, local governments are in a unique position to reduce soft costs and take action to promote the use of solar locally. The SolSmart designation program will provide high-profile, national recognition for communities that have made it cheaper and easier for solar customers to invest in solar energy. In addition, achieving designation will send a signal to solar companies that a community is "open for solar business," attracting new businesses and helping designees share in the economic development benefits attached to the solar industry. A unique feature of the technical assistance offerings of the SolSmart program are SolSmart Advisors—experienced, temporary staff funded by The Solar Foundation to help communities achieve designation. The primary objective of the SolSmart Advisors program is to provide select communities participating in the SolSmart program with in-depth support for achieving SolSmart designation through engagements lasting up to 26 weeks. Through these engagements, the SolSmart program sees a prime opportunity for Advisors to become part of the next generation of solar market leaders. Under a separate agreement, the North Carolina Clean Energy Technology Center has been chosen to serve in the role of SolSmart Advisor to provide support to Orange County. The roles, responsibilities, and expectations listed below are critical to the attainment of these goals. Provide the SolSmart Advisor with training and educational resources. c. Monitor SolSmart Advisor progress and support other project management activities. d. Provide limited, supplemental technical assistance to the SolSmart Advisor and/or Host Community as needed. e. Connect SolSmart Advisors with existing local networks that can serve as a resource to the SolSmart Advisor. 2. The Host Community will: a. Make every reasonable effort to facilitate and ensure completion of the SolSmart Advisor work plan specified in the Work Plan, composed of "Attachment 1: Orange County Work Plan Calculator" and"Attachment 2: Orange County Work Plan Statement of Project Objectives (SOPO)" attached hereto and incorporated herein, and that the Host Community(or the individual communities on behalf of which the Host Community receives a SolSmart Advisor) will achieve designation under the SolSmart program. The Host Community recognizes that inadequate project progress may result in early termination of the SolSmart Advisor work plan and this MOU. b. Maintain a clear, ongoing commitment to achieving SolSmart designation. c. Assign a project"Sponsor" (e.g., local elected official, local government department head, organization director, etc.) to provide the SolSmart Advisor with reliable access to the staff and decision makers within the community who will select from and ultimately implement the recommendations provided by the SolSmart Advisor. d. Assign a project"Supervisor"to provide regular assistance and guidance to the SolSmart Advisor and to participate in project management and reporting. e. Provide the SolSmart Advisor with adequate work space, equipment, access to Host Community and local government staff and other human resources across all relevant departments and to external stakeholders. f. Allow the work of the SolSmart Advisor, including successes and lessons learned, to be promoted publicly and without restriction by the SolSmart program. 3. The SolSmart Advisor will: a. Assume primary responsibility in qualifying the Host Community for SolSmart designation and maximizing the programmatic impact of the engagement. b. Review and revise as necessary the SolSmart Advisor work plan and ensure steady progress toward work plan objectives, outcomes, and milestones is maintained. Coordinate effectively and work professionally with the Supervisor, Sponsor, and internal and external stakeholders. e. Identify and fully leverage opportunities to promote the work of the Advisors and Host Community. Schedule Host Community will make every reasonable effort to ensure the schedule(s) and milestones are met according to the Work Plan. Failure to maintain the schedule(s) and/or milestones may result in termination of this MOU. If feasible, Host Community will notify TSF in writing within one week of any delays or anticipated delays in performing the Services and explain the reasons for said delays. Term The term of this MOU shall commence on January 30th, 2017 and end no later than July 21, 2017. Termination Either party has the right to terminate this MOU without cause with written notice. Confidentiality Except as necessary to carry out the purposes of this MOU, compelled by applicable law or as authorized in advance,neither Party shall use or disclose any information it received from the other under this MOU which previously has been identified as confidential or exempt from mandatory public disclosure. If such information is subpoenaed through legal process,then the subpoenaed Party will immediately advise the Party that provided the confidential information so that it may evaluate whether to invoke legal process to avoid disclosure at its own expense. Solar Statement Communities interested in pursuing SolSmart designation must indicate their commitment to supporting solar development in their community through a Solar Statement that includes: • A commitment to participate in the SolSmart designation program • A statement of solar goals, areas of focus or community priorities (e.g. encouraging solar development on vacant lots or supporting non-profit led initiatives) • Past achievements or programs related to solar and/or renewable energy • Commitment to tracking metrics related to solar and/or provide benchmark of available solar metrics (i.e. number of installed municipal systems or growth in residential installations) • A commitment of staff time and resources to improve the local environment for solar Orange County has completed the Solar Statement requirement. II. Foundational Categories The Foundational Categories include: 1) Permitting and 2) Planning, Zoning, and Development Regulations. • To qualify for SolSmart Bronze,your community must complete the required actions (P-1 & PZD-1) in both of the Foundational Categories and earn at least 20 points in each category. • Your community can use additional points within these two categories to help achieve the required point totals for Silver(at least 100 total points) and Gold (at least 200 total points) designation tiers. On the Intake Form,your community claimed 10 points in Permitting and 30 points in Planning,Zoning, and Development Regulations for a total of 40 points in the Foundational Categories. Permitting Points Upon Criteria Proposed Action Completion Example:P- Example: The Advisor will determine the current fee structure for solar installations, and Example:5 5a review how much information regarding fees is available online. If the fees are variable, the Advisor will conduct several trials to determine costs for different-sized solar systems. The Advisor will speak with the director of the department responsible for collecting fees and determine how the community determined the current rate.Additionally, the Advisor will speak with staff reviewing solar plans to determine the amount of time spent on the review of different-sized systems. The Advisor will draft a memorandum to his/her supervisor outlining the findings of the research and trials, and discuss alignment with best practices. P-1 The Advisor will work with the Orange County Planning Department to identify all Required steps required to permit 1.) a small-scale residential or business rooftop solar installation; 2.) a large-scale ground-mounted solar farm.These steps will be summarized in a checklist and posted online in a location that will be clearly visible to future interested parties. P-7 The Advisor will review national best practices from the Solar ABCs and collect 10 practices from collaborating jurisdictions and bring them to the Orange County Planning Department to discuss their feasibility within the County Context. If Planning Department feels that a single separate standard solar permit form is feasible within current code,the Advisor will work to create the necessary materials and request their adoption. If not,the Advisor can work with the Planning Department to explore any feasible changes to the code that would be necessary, and then proceed with creating and proposing the form as described. 2 DocuSign Envelope ID:AA090EE8-66C2-4C49-8A7F-E6578EE85BD7 P-8 In coordination with efforts for Chapel Hill and Carrboro,the advisor will provide 10 County permitting staff with a training session on best practices for permitting solar PV and solar storage systems. P-9 In coordination with efforts for Chapel Hill and Carrboro,the advisor will provide 10 County fire and safety staff with a training session on best practices for safety related to solar PV. P-10 In coordination with efforts for Chapel Hill and Carrboro,the advisor will contact 10 installers working in the area and survey the installers regarding potential permitting procedural changes.The Advisor will standardize the survey process so that it can be done annually to capture new ideas and solar installers. P-12 In coordination with efforts for Chapel Hill and Carrboro, and as an extension of 20 efforts under P-9,the advisor will help ensure that open source permit data is shared with fire and safety staff and other appropriate parties. The Advisor will prepare a recommendation for a training program for city/county staff that includes an overview of course materials,subject matter, and other appropriate collateral. The Advisor will present the proposed training course to department heads to get approval and make any changes requested. Once approved, the Advisor will oversee the successful execution of the first training session. The Advisor will memorialize the session and create a sustainability plan to ensure regular administration of cross- training. 1-1 Orange County's Permitting and Inspections staff work closely together, and a 20 single training for both of these groups will be provided under P-8. Opportunities for cross-training of Permitting staff and Inspectors will be highlighted in this training. CC-3 As an extension of P-8 and P-9,the advisor will offer design guidelines for PV 20 aligned with NEC and the fire code. CE-5a In coordination with Chapel Hill and Carrboro,the advisor will host one or more 5 solar workshops promoting PV and discussing relevant policies. CE-7 In coordination with Chapel Hill and Carrboro staff, the advisor will provide 10 support for feasibility analysis for candidate sites identified by staff for brownfields, landfills, and other underutilized properties.The final product will be completed and delivered to staff and a summary will be posted on the Solar Projects Page of the Orange County Sustainability website. CE-9 At own initiative,the advisor will engage with regional organizations including but 20 not limited to the Chapel Hill-Carrboro school system and OWASA, on topics including but not limited to unified permitting processes and group procurement opportunities.
