AMENDMENT TO DEVELOPMENT AGREEMENT
NORTH CAROLINA
THIS AMENDMENT, made and entered into this the 28TH day of September, 2018, by and between the County of
Orange, a body politic and corporate of the State of North Carolina, (“County”), and EmPOWERment, Inc.
(“Provider”);
WITNESSETH:
WHEREAS, the County and Provider entered into a Development Agreement on or about September 21, 2018
whereby the County granted the Provider FY 2015-16 HOME funds to relocate and rehabilitate one single-family
residence to be used as rental housing for a veteran whose family income is less than 60% of the HUD area median
income, which residence will be located at 507 Terrell Road, Hillsborough, North Carolina (“Original
Agreement”);
WHEREAS, the County and Provider desire to amend the Original Agreement, while keeping in effect all terms
and conditions of the Original Agreement not inconsistent with the terms and conditions set forth below.
NOW THEREFORE, for and in consideration for the mutual covenants and agreements made herein, the parties
agree to amend the Original Agreement as follows:

Property Description
Containing 0.26 acres and being designated as B-R1 of the Recombination & Division Property Surveyed for
EMPOWERMENT, Inc. according to the plat survey of Steve F. Yuhasz, Registered Land Surveyor, dated, June 1,
2005, and duly recorded in the Orange County Registry in Plat Book 97, Page 160. The conveyance is made
subject to such utility easements, if any, as may traverse the subject property.

Except for the changes made to EXHIBIT A herein, the Original Agreement shall remain in full force and effect to
the extent it is not inconsistent with this Amendment. In the event that there is a conflict between the Original
Agreement and this Amendment, this Amendment shall control.
