Option 3.1
PURPOSE: To receive authorization to submit the Quarterly Public Hearing Legal
Advertisement (Attachment 1) for publication for the May 23, 2005 Quarterly Public Hearing,
with the Planning Department proposing the addition of an approximate %Z page advertisement
which includes a color map (Attachment 2) to compliment the text advertisement of the
proposed Residential Density Zoning Text Amendments.
BACKGROUND: The next regular quarterly public hearing is scheduled for May 23, 2005. A
summary of each item proposed for public hearing is provided. Full text is scheduled to be
forwarded May 13~h. Staff is available to answer questions or research issues prior to the public
hearing.
A. PUBLIC HEARING ITEMS
1. Orange County Flood Damage Prevention Ordinance Amendments
PURPOSE: Orange County proposes amendments to the existing Flood Damage
Prevention Ordinance, The County first joined the FEMA -National Flood Insurance
Program (NFIP) in 1975 and entered the regular phase of the NFIP an March 16, 1981 when
it enacted the Flood Damage Prevention Ordinance. This is also the same effective date of
the Flood Insurance Rate Map (FIRM) flood maps referenced in the ordinance. The BOCC
last revised the ordinance in 1995.
The revisions are proposed because the State of North Carolina Emergency Management
has developed a new model flood damage prevention ordinance for non coastal jurisdictions
like Orange County, Amendments that go beyond the minimum flood damage prevention
standards are required forjurisdictionstyanting to participate in the Community Rating
System (CRS) program, Region IV of FEMA (the Atlanta region, which includes the

Carolinas, Georgia, and Florida) suggests the new model ordinance be adapted and
administrative procedures for the issuance of a floodplain development permit be in place in
order to initiate participation in the CRS program, Improved development permit
procedures, resulting in a better CRS program rating, can reduce flood insurance costs for
homeowners, businesses, and government.
a, Amend the existing Flood Damage Prevention Ordinance according to FEMA Region IV
suggestions and the new State of North Carolina model for non-coastal jurisdictions,
b. Continued participation in the Community Rating System (CRS), and
c, Adopt Administrative Procedures for the issuance of floodplain development permits.
2. Orange County Land Use Element Update Text Amendments
PURPOSE: Research and Public Outreach has been conducted for 5-years to develop
amendments to address sprawl, traffic, and the preservation of air and water resources.
Amendments, in the form of a complete re-write and reformatting, to the Land Use Element
are proposed. The purpose is to provide a complete update to the Land Use Element of the
County s Comprehensive Plan to address the many changes that have occurred in the
County since the Land Use Element was originally adopted in 1981, at that time entitled
"Orange Ccunty Comprehensive Plan",
Draft text amendments, including revised socio-economic and demographic data and goals,
objectives and policies, will be provided prior to the public hearing,
3. Orange County Zoning Text Amendments (See Attachment 3, Summary Table)
a. Residential Density -Amend the following sections of the Zoning Ordinance to reduce
densities from 1 and 2-acres per dwelling unit to 3-acres per dwelling unit in most of the
county with the exception of the Upper Eno Watershed where 5*-acre (*151 5-lots may be
2-acres) density is suggested:
Section 6,23.2; Section 6.23.3; Section 6.23.10; Section 6.24
PURPOSE: The proposed amendments reduce urban sprawl potential by reducing
housing density, They are necessary to address identified growth challenges in the
areas of air and water quality, water resources, environmental protection, open space
preservation, traffic control, and efficient provision of public services,
b, Minimum Lot Size -Amend the following sections of the Zoning Ordinance to raise
Minimum Lot Size from 40,000 sf to 87,120 sf:
Section 5.1,1; Section 5.1.2; Section 6.2,2
PURPOSE: The proposed amendments are necessary to address identified growth
challenges in the areas of sustainability, water and air quality, and groundwater recharge,
Attachment 4 provides an estimate of the number of property owners that may be affected
by lowering residential zoning density. In summary, Attachment 4 shows that historically
the average parcel size created through subdivision has been 2.8 acres, which is very
similar to proposed densities. Furthermore, of the County's 21,773 (12,575 undev, &
9,198 dev,) existing parcels, approximately 58% may be affected by proposed densities.
B. NON-PUBLIC HEARING ITEMS
1. Update on Rural Enterprises Project
PURPOSE: Planning and Economic Development staff will respond to questions and
comments from the February 28, 2005 Joint County Commissioner/Planning Board Work
Session on the Rural Enterprises project and conditional district zoning proposal. The focus
will be on a recommended permitting process, suitability of farm-related businesses in
certain sections of the county, and realistic viability of such businesses in the long-term.
FINANCIAL IMPACT: There is no financial impact associated with this decision,
Advertisement costs are included in the budget for County initiated items,
RECOMMENDATION(S): The Administration recommends APPROVAL of the proposed
May 23, 2005 Quarterly Public Hearing legal advertisement.

NOTICE OF PUBLIC HEARING
ORANGE COUNTY BOARD OF COMMISSIONERS
A public hearing will be held in the Judge F. Gordon Battle Superior Courtroom of the
New Orange County Courthouse, 106 E. Margaret Lane, Hillsborough, North Carolina, on
Monday, May 23, 2005, at 7:30 PM for the purpose of giving all interested citizens an
opportunity to speak for or against the following items:
A. PUBLIC HEARING ITEMS

Section 5.1.1; Section 5.1.2; Section 6.2.2
PURPOSE: The proposed amendments from a minimum of 40,000 sf to 87,120
sf are necessary to address identified growth challenges in the areas of
sustainability, water and air quality, and groundwater recharge including more
area for normal residential activity without disturbing private infrastructure„
B. Non-Public Hearing Items
1. Update on Rural Enterprises Project
Purpose: To respond to questions and request permission to move forward with
preparation of amendments for presentation at an upcoming public hearing,
Planning and Economic Development staff will respond to questions and
comments from the February 28, 2005 Joint County Commissioner/Planning
Board Work Session on the Rural Enterprises project and conditional district
zoning proposal. The focus will be on a recommended permitting process,
suitability of farm-related businesses in certain sections of the County, and
realistic viability of such businesses in the long-term..
Changes may be made in the advertised proposals that reflect debate, objections
and discussion at the hearing.
