HomeMy WebLinkAboutAgenda - 09-20-2018 5-a - NCDOT Public Transportation Division-Public Transportation – 5307 Program Grant Applications for FY2018 1 ORANGE COUNTY BOARD OF COMMISSIONERS ACTION AGENDA ITEM ABSTRACT Meeting Date: September 20, 2018 Action Agenda Item No. 5-a SUBJECT: NCDOT Public Transportation Division/Public Transportation — 5307 Program Grant Applications for FY2018 DEPARTMENT: Public Transportation (OCPT) ATTACHMENT(S): INFORMATION CONTACT: 1) Resolution Theo Letman, Transit Director, 919-245- 2) Public Hearing Notices 2007 3) Local Share Certification Teleishia Holloway, Transportation Administrator, 919.245.2007 PURPOSE: To: 1) Conduct a public hearing to receive public comments on the 5307 Program — Operating, Planning, Capital Funding / Durham Chapel Hill Carrboro Urbanized Area allocation (Large Urban) and Burlington Area Small Urbanized Governor's Apportionment (Small Urban) grant applications by Orange County Public Transportation (OPT) for FY 2019; 2) Close the public hearing; 3) Approve the Small and Large Urban 5307 Grant application for FY 2019 in the total amount of $1,069,157 with a local match total of $534,577 to be provided when necessary; 4) Approve and authorize the Chair to sign the 5307 Small and Large Urban Program Resolution and the Local Share Certification for Funding form; and 5) Authorize the Chair and the County Attorney to review and sign the annual Certifications and Assurances documents. BACKGROUND: Each year, the NCDOT Public Transportation Division accepts requests for operations and capital needs for county-operated community transportation programs. OCPT is eligible to make application for both operations and capital funding. The FY 2019 application includes funding allocations from prior year apportionments that had not been applied for. NCDOT is allowing FY 2019 application to include the total funds unapplied for as outlined in the table below: Small Urban: FY's 2015 & 2017 Large Urban: FY's 2016 & 2017 Total $ 674,378 Total $ 394,776 Federal $ 337,189 Federal $ 197,388 Local $ 337,189 Local $ 197,388 Grant funds for administrative purposes will continue to be used to support overall transit systems management and operations and will continue to promote general ridership. 2 The public hearing (see Notices at Attachment 2) provides the opportunity for public comment before the Board takes action on the Local Share Certification (Attachment 3). These grants were accepted / approved previously by the State on June 1, 2017 for #18-SU-056A and June 29, 2017 for#18-LU-056B. FINANCIAL IMPACT: The NCDOT 5307 Program — Operating, Planning, Capital Funding / Durham Chapel Hill Carrboro Urbanized Area allocation (18-LU-056B) and Small Urbanized Governor's Apportionment (18-SU-056A) require a 50% local match (18-SU-056A — $337,189 and 18-LU-056B — $197,388) for operating, planning, and capital expenses. The department will utilize currently available carryover funds from Article 43 Transit Tax proceeds to cover the required local match, and will address this in a future Budget Amendment for consideration by the Board of Commissioners. SOCIAL JUSTICE IMPACT: The following Orange County Social Justice Goals are applicable to this item. • GOAL: FOSTER A COMMUNITY CULTURE THAT REJECTS OPPRESSION AND INEQUITY The fair treatment and meaningful involvement of all people regardless of race or color; religious or philosophical beliefs; sex, gender or sexual orientation; national origin or ethnic background; age; military service; disability; and familial, residential or economic status. • GOAL: ENSURE ECONOMIC SELF-SUFFICIENCY The creation and preservation of infrastructure, policies, programs and funding necessary for residents to provide shelter, food, clothing and medical care for themselves and their dependents. OCPT provides opportunity for access to jobs and services to many individuals. The CTP Administrative and Capital Grant provides Orange County access to funds to support its rural transportation infrastructure that promotes economic self-sufficiency to a wide range of residents and locations. The funds additionally support a system that enhances the access of residents in the non-urbanized areas to health care, shopping, education, employment, public services, and recreation. RECOMMENDATION(S): The Manager recommends that the Board: 1) Conduct a public hearing to receive public comments on the 5307 Program — Operating, Planning, Capital Funding / Durham Chapel Hill Carrboro Urbanized Area allocation (Large Urban) and Burlington Area Small Urbanized Governor's Apportionment (Small Urban) grant applications by Orange County Public Transportation (OPT) for FY 2019; 2) Close the public hearing; 3) Approve the Small and Large Urban 5307 Grant application for FY 2019 in the total amount of $1,069,157 with a local match total of $534,577 to be provided when necessary; 4) Approve and authorize the Chair to sign the 5307 Small and Large Urban Program Resolution and the Local Share Certification for Funding forms; and 5) Authorize the Chair and the County Attorney to review and sign the annual Certifications and Assurances documents. 3 RES-2018-057 Attachment 1 PUBLIC TRANSPORTATION PROGRAM RESOLUTION FY 2018 RESOLUTION Section 5311 (including ADTAP), 5310, 5339, 5307 and applicable State funding, or combination thereof. Applicant seeking permission to apply for Public Transportation Program funding, enter into agreement with the North Carolina Department of Transportation, provide the necessary assurances and the required local match. A motion was made by(Board Member's Name) and seconded by(Board Member's Name or N/A,if not required) for the adoption of the following resolution, and upon being put to a vote was duly adopted. WHEREAS, Article 2B of Chapter 136 of the North Carolina General Statutes and the Governor of North Carolina have designated the North Carolina Department of Transportation (NCDOT) as the agency responsible for administering federal and state public transportation funds; and WHEREAS, the North Carolina Department of Transportation will apply for a grant from the US Department of Transportation, Federal Transit Administration and receives funds from the North Carolina General Assembly to provide assistance for rural public transportation projects; and WHEREAS, the purpose of these transportation funds is to provide grant monies to local agencies for the provision of rural, small urban, and urban public transportation services consistent with the policy requirements of each funding source for planning, community and agency involvement, service design, service alternatives, training and conference participation, reporting and other requirements (drug and alcohol testing policy and program, disadvantaged business enterprise program, and fully allocated costs analysis); and WHEREAS, the funds applied for may be Administrative, Operating, Planning, or Capital funds and will have different percentages of federal, state, and local funds. WHEREAS, non-Community Transportation applicants may apply for funding for"purchase-of-service" projects under the Section 5310 program. WHEREAS, (Legal Name of Applicant) hereby assures and certifies that it will provide the required local matching funds; that its staff has the technical capacity to implement and manage the project(s), prepare required reports, obtain required training, attend meetings and conferences; and agrees to comply with the federal and state statutes, regulations, executive orders, Section 5333 (b)Warranty, and all administrative requirements related to the applications made to and grants received from the Federal Transit Administration, as well as the provisions of Section 1001 of Title 18, U. S. C. This is to inform the public that a public hearing will be held on the proposed Orange County Community Transportation Program Application to be submitted to the North Carolina Department of Transportation no later than November 3, 2018. The public hearing will be held on 20 September 2018 at 7:00 pm before the Orange County Board of County Commissioners at Southern Human Services Center at 2501 Homestead Rd, Chapel Hill, NC 27516. Those interested in attending the public hearing and needing either auxiliary aids or services under the Americans with Disabilities Act (ADA) or a language translator should contact TeLeishia Holloway on or before October 16, 2018, at telephone number 919.245.2002 or via email at thollowav @orangecountync.gov. The NCDOT 5307 Small Urban Program- Operating, Planning, Capital Funding provides assistance to coordinate existing transportation programs operating in Orange County as well as provides transportation options and services for the communities within this service area. These services are currently provided using fixed, demand response, deviated fixed, and subscription routes. Services are rendered by Orange County Public Transportation.
