Project: Historic Rogers Road Sewer Expansion Project
Contractor: Moffat Pipe, Inc.
Engineer /Architect: URS Corporation — North Carolina
CONTRACTOR is directed to make the following changes in the Contract Documents.
Description:
Moffat Pipe, Inc. is requesting the following revisions to the substantial completion and final completion
dates of the contract to account for delays in the project considered to be no fault of their own and beyond
their control. Moffat Pipe, Inc. is requesting an additional 18 calendar days. The requested number of
additional contract days are as follows: 17 calendar days for weather delays experienced between March
235 2018 and August 20, 2018, and one (1) calendar day associated with the additional work for items
requested by OWASA on the May 25, 2018 punch list walkthrough. The requested number of delay days
does not account for potential future delays, or delays associated with other concerns not specifically
mentioned herein.
Moffat Pipe, Inc. is also requesting an additional $4,000.00 to compensate them for two items identified
and requested by OWASA on the May 25, 2018 punch list walkthrough, and additional staking due to
homeowners removing surveyors stakes on multiple occasions. A more detailed explanation of each of the
requested revisions to the Contract Price is below.
1) The two items identified on the punch list walkthrough that are not covered under the original
construction contract are the addition of rip rap along the second stream crossing and spring well
located on the Glenbrooke HOA property, and four (4) sewer valve covers for the tracer wire along
the PVC pipe in Outfall R. An additional day for this work has already been included in the itemized
list of delays listed seen in Attachment A.
2) Moffat Pipe was required to call out their subcontractor to re -stake easements approximately three
times in two different locations due to homeowners removing the stakes even though OWASA
communicated the need for the stakes and requested that homeowners not disturb them.
The following lines shall be added to Section 00 4144, Unit Price Contract Bid Form.

0 The following shall be added to Section 0122 00, Unit Prices, Article 1.06:
"BB. Item 37 — Sewer Valve Boxes for Tracer Wire
1. Work Included:
a. Under this Item, the Contractor shall furnish all material, labor, and equipment for the
installation of a sewer valve box to contain the ends of the tracer wire located along the
PVC pipe installed from manhole SSMH -R3 to SSMH -R4, and from SSMH -R4 to SSMH-
R5.
b. Payment for this item will include, but not be limited to:
1) Excavating for valve box, backfilling including material as required, and restoration of
seeding as needed.
2. Basis of Payment:
a. The Contractor will be paid for the number of valve boxes installed and accepted by the
Owner.
3. Payment:
a. The unit price per valve box will be full compensation for providing all labor, materials,
and equipment as may be required for the execution of work of these Items, accepted and
complete."
Item 38 — Rip -Rap for Outfall L Ditch Crossing
1. Work Included:
a. Under this Item, the Contractor shall furnish and install permanent rip rap where new
pipeline crosses existing ditch.
b. Payment for this Item will include:
1) Required clearing, cleanup, and seeding.
2. Basis of Payment:
a. The Contractor will be paid on a lump sum basis, at the applicable Contract price as listed
in the itemized proposal.
3. Payment:
b. The lump sum price will be full compensation for providing all labor, materials, and
equipment as may be required for the execution of work of this Item, accepted and
complete."

1. Work Included:
a. Under this Item, the Contractor shall have their subcontractor re -stake those areas in which
the property owners removed the stakes on multiple occasions.
b. Payment for this Item will include, but not be limited to:
1) All required material, labor, and equipment necessary to perform the work.

c. The Contractor will be paid on a lump sum basis, at the applicable Contract price as listed
in the itemized proposal.

The adjustment in Contract Sum or Price and /or Contract Time or Times stated in this Change Order shall
comprise the total price and /or time adjustment due or owed the CONTRACTOR for the work or changes
defined in this Change Order. By executing the Change Order, the CONTRACTOR acknowledges and
agrees that the stipulated price and /or time adjustments include the costs and delays for all work contained
in the Change Order, including costs and delays associated with the interruption of schedules, extended
overheads, delay, and cumulative impacts or ripple effect on all other non - affected work under this
Contract. Signing of the Change Order constitutes full and mutual accord and satisfaction for the
adjustment in Contract Sum or Price or Contract Time or Times as a result of increases or decreases in costs
and time of performance caused directly and indirectly from the change, subject to the current scope of the
entire work as set forth in the Contract Documents. Acceptance of the waiver constitutes an agreement

between OWNER and CONTRACTOR that the Change Order represents an equitable adjustment to the
Contract, and that CONTRACTOR waives all rights to file a claim on this Change Order after it is properly
executed.
