PURPOSE: To consider approval of an agreement for surveying and platting a subdivision of a
parcel currently owned by the Town of Chapel Hill that is proposed as the site of a recycling
center in the Southern Village development.
BACKGROUND: Several years ago, the Landfill Owners Group authorized the Solid Waste
Department staff to negotiate the purchase of land owned by the Town of Chapel Hill in
Southern Village for use as a recycling center. The property is a part of the Town's park site,
adjacent to the park and ride lot, and was purchased with park band money. The bond fund
must be reimbursed for property purchased with band money that is not used for park and
recreation purposes. The proposed site would enhance the availability of drop-off recycling
services in southern Orange County, as the closest recycling center to Southern Village is
located at University Mall.
Following the survey, the Solid Waste Department will prepare a purchase recommendation for
the Board's consideration. The Town of Chapel Hill paid $23,000/acre for the property. If the
Board of County Commissioners approve the purchase of the approximate'/~ acre site, the cost
is expected to be about $13,000 (the amount budgeted for FY 2000-01). The actual cost of the
site will be determined once the property is surveyed. Staff recommends that the site be
constructed within the next two years, with funds for construction of the site to be appropriated
in the next two fiscal years.
FINANCIAL IMPACT: At this time, staff estimates expenditure of approximately $7,000 far the
survey. A separate and subsequent decision on purchase of the property from the Town of
Chapel Hill would be brought back for the Board's subsequent consideration. Adequate funds
for the surveying activity are available in the Solid Waste/Landfill Operations Enterprise Fund
budget far FY 2000-01.
RECOMMENDATION(S): The Manager recommends that the Board approve the attached
agreement and authorize the Chair to sign it, subject to final review by staff and the County
Attorney.

THE COUNTY OF ORANGE
AGREEMENT FOR
SURVEYING SERVICES
This Agreement made and entered into by and between The County of Orange, on behalf of
its Solid Waste Department, herein referred to as "County" and Freehold Land Surveys herein
referred to as "Surveyor" for services as hereinafter described for the preparation of a plat of
subdivision of a parcel currently owned by the Tawn of Chapel Hill.
WTTNESSETH
That for and in consideration of the mutual promises and conditions set forth below, the
Surveyor agrees:
1. Duties of.Surveyor: Surveyor agrees to provide services as described in Exhibit A and
incorporated herein by reference.
2. Duties of the Counter The County shall pay for Surveyor's services as set forth in Exhibit
A and incorporated herein by reference.
3. Billing and,Pavment: Surveyor shall submit regular invoices for work performed and shall
be paid for completion of the work performed during that period under the terms of this
Agreement. The County shall make payment within thirty (30) days of receipt of an
accurate invoice. The value of this contract is not to exceed $3,000 except as agreed by
the parties.
~. Amendment : This agreement may be amended or cancelled by mutual agreement of
the County and the Surveyor. Either the County or the Surveyor may terminate this
Agreement at any time with or without cause upon giving the other party 21 calendar days
prior written notice. County shall within sixty calendar days following termination pay
the Surveyor for all services rendered and all costs incurred up to the date of termination,
in accordance with the compensation provisions of this contract.
Any amendments to the contract are not valid unless signed by the County Manager and
the Finance Director.
This Agreement, unless amended as provided herein, shall be in effect from November 1,
2000 through June 1, 2001.

Proposal: To provide for recordation a plat of subdivision of a parcel currently
owned by the town of Chapel Hill (pin # 9777-94-4255) -the purpose being to
separate from this tract a'rectangle (130' by 175') to be conveyed to Orange
Caunty for use as a recycling center.
Scope: The project will necessitate a field survey -tying the proposed
severance area to the exterior boundary control of the above referenced parcel.
(Nat a full boundary survey, but enough to sufficiently and accurately locate the
new parcel.)
The field data then moves to the office where it is reduced; compared to
documents of record previously retrieved from the Orange County Registry; and
finally, the plat is drawn. At that point we would then submit the plat for a
"courtesy" review to the Town of Chapel Hill Planning Department. We follow
through on the review process making any amendments, additions, or notations
required by the town. Upon completion to that process, we produce a mylar~
signed by myself and presented to the town for their signatures. Details
regarding final delivery to a representative of the county can be worked out then.
Fee: Not to exceed $3000.

review within two weeks of authorization. Final delivery to the county is
dependent on the length of the review process; however, we will be promptly
responsive to their critique.
