AMENDMENT TO DEVELOPMENT AGREEMENT
NORTH CAROLINA
THIS AMENDMENT, made and entered into this the 29' day of August, 2018, by and between the County of
Orange, a body politic and corporate of the State of North Carolina, ( "County "), and CASA ( "Provider ");
WITNESSETH:
WHEREAS, the County and Provider entered into a Development Agreement on or about August 22, 2018
whereby the County granted the Provider FY 2016 HOME Community Housing Development Organization Set -
Aside funds to rehabilitate twenty -eight (28) rental units within the Club Nova and Johnson Street Apartments
( "Original Agreement "); and
WHEREAS, the County and Provider desire to amend the Original Agreement, while keeping in effect all terms
and conditions of the Original Agreement not inconsistent with the terms and conditions set forth below.
NOW THEREFORE, for and in consideration for the mutual covenants and agreements made herein, the parties
agree to amend the Original Agreement as follows:
WHEREAS, this Agreement does not constitute a commitment of funds or site approval, and the
commitment of funds or approval may occur only upon satisfactory completion of environmental review
and receipt by the County of an approval of the request for release of funds and certification from the U.S.
Department of Housing and Urban Development or the state of North Carolina under 24 CFR Part 58. The
provision of any funds to the project is conditioned on the County's determination to proceed with, modify
or cancel the project based on the results of the environmental review. Pursuant to §92.502(b)(1), a
Responsible Entity must have completed the environmental review requirements under 24 CFR Part 58 and
obtained approval of the release of funds prior to setting up a specific local project in IDIS.
Except for the changes made to the fifth "WHEREAS" clause herein, the Original Agreement shall remain in full
force and effect to the extent it is not inconsistent with this Amendment. In the event that there is a conflict
between the Original Agreement and this Amendment, this Amendment shall control.
IN WITNESS WHEREOF, Orange County and the Consultant have signed this Amendment, effective this
the 29th day of August, 2018.
